2 1.0 Rules and Regulations The Board of Directors of Pelican Bay Cooperative Association has adopted the following rules pertaining to the use of the facilities within the Resort. The prime consideration in the adoption of these rules has been to enable the Members and their Guests to obtain the maximum enjoyment from the use of the facilities, while at the same time, considering the health, safety and general well being of the Members, Guests, Management and Staff. These rules are subject to change by the Board of Directors pursuant to the by-laws of Pelican Bay. The Resort Managers are empowered by the Board of Directors to ensure the application of the Rules and Regulations and, as well, to recommend suspensions and/or revocation of membership privileges. Members must make every effort to follow the intent of the Rules and Regulations and ensure their families and Guests do the same. A clear and firm set of rules serves us all well and ensures a consistently well run Resort. 1.1 Alcohol Under no circumstances are minors to be served or are allowed to consume alcohol in or on Pelican Bay property No person shall be in any public area while intoxicated Alcohol may be consumed only on individual camping sites or at specific Resort areas or at sponsored events where alcohol is specifically permitted Should any problems occur and the Managers cannot get any cooperation from the person or persons involved, the Police will be called immediately. 1.2 Beach/Swimming Area/Playground The swimming area is roped off for the safety of the swimmers. Do not swim outside the roped area for your own safety There is no Life Guard on duty for the swimming area. Swimming is at your own risk. Young children must be supervised by an adult at all times Glassware is not allowed in the beach or playground areas Garbage containers are located in the Beach and Playground areas for your convenience. Do your part to help keep these areas clean The Playground area is for the enjoyment of the children (young Updated June 26, 2013 Ver 4.0 Page 2 of 10
3 and old). Young children should be supervised by an adult to prevent any injury. Any abuse of the playground equipment will not be tolerated Absolutely no motorized vehicles are allowed on the Beach at any time, with the exception of Resort maintenance equipment or Management designated equipment. 1.3 Boat/Power Water Craft (PWC) All government Rules and Regulations are to be adhered to by all Boat and PWC owners All Boats and PWCs are to stay away a minimum of 250 feet from the swimming area The Association assumes no liability in the event of damage or theft for any Boat, Water Craft, accessories or trailers on the Pelican Bay property The requirements by law to have insurance and plates to travel in the public areas, applies to the park. 1.4 Boat Launch/Pier The boat launch is for the use of members and their Guests only Tow vehicles and trailers must be removed from the boat launch as soon as the boat is launched. Trailers and tow vehicles must be parked in designated parking areas only (Respect the members lots in the boat launch area). Should the parking areas be full please park in the other designated parking areas, or return your vehicle and trailer to your lot All garbage must be put in the garbage cans provided or returned back to your site. Do your part in keeping this area clean. 1.5 Bulletin Board/Notices The Bulletin Board is provided for general notices, Resort business and particular announcements. Nothing shall be posted on the bulletin board except by the Manager Members wanting to post a notice or message will require approval by the Manager. 1.6 Children and Guest Supervision Parents will be held responsible for the conduct of their guests and their children and it will be their responsibility to see that their guests and children observe the rules and regulations of the Resort. 4 purpose of this regulation, a child is defined as anyone below the age of 18. Parents who are members will be responsible for the conduct of their adult children who may be using the park facilities as family members. 1.7 Conduct Physical abuse, profanity, loud or abusive language, and other objectionable conduct are prohibited. 1.8 Damage The Resort will not be responsible for the loss of or damage to any property of the Members or Guests. It is recommended that each Member attain their own insurance to cover their personal property Any Member or Member Guest who willingly or negligently defaces, injures, destroys or removes Resort property or equipment shall be held liable for the full replacement cost. Legal action may also be taken as well as immediate and permanent expulsion from Pelican Bay Resort on the first offence. 1.9 Employees Employees of the Resort shall not be subject to the individual direction or control by Members. The specific direction and control of employees is vested in the Resort Managers. Resort Managers are directed by the Board. If Members have issues with the Resort staff or Resort Managers, they are requested to submit a letter to the board outlining their concerns Firearms and Fireworks Firearms and/or weapons are not allowed on Resort property and are strictly forbidden Fireworks are not permitted in the Park. An exception to this is Fireworks organized by the Board or a Board approved committee. In this case the Board will grant approval if it is satisfied that the Fireworks are carried out with a permit under the control and supervision of a qualified person Fires Fires are allowed only in designated fireplaces Fire pits must be located at a safe distance from anything combustible. All fire pits are to be constructed and used in accordance with the St. Paul Fire Department Guidelines as outlined in Version 1.1 of the Development Regulations. 5 The Management may prohibit the building of fires at any time when such fires may present a fire hazard Fires are to be totally extinguished when not personally attended No parking in fire lanes Garbage All garbage must be properly wrapped in plastic bags, tied and deposited in garbage containers Any larger items that would typically not be placed in a regular garbage bag including for example mattresses, barbeques, building materials and large appliances etc. are to be taken out of the Resort and disposed of by the member at the expense of the member The cleanliness of the Resort is the responsibility of all members. Do your part to keep the Resort clean Guests Members must inform Management of Guests staying in the absence of the Member. Members are responsible for their Guests actions All Members bringing Guests with an R.V. to Pelican Bay must notify the Management prior to the Guests arrival Member s Guests must park their R.V. within the Member s site. Guest s R.V s. are not permitted to park on roadways or common property or to obstruct adjacent sites If required, Members can reserve a vacant site for their Guests for a daily fee to a maximum stay of 7 days. Check with Management for the rate per night Members are responsible to escort their Guests in and out of the gate Members sub-leasing their lot and / or RV must inform the Board and the Manager in writing, including the name, address, phone number and address of the lessee. The member continues to be responsible for the lot and the conduct of the lessee. Lessees are bound by all Park rules and regulations and are required to meet with a representative of the Board to ensure they are familiar with Park rules and regulations. Development Permits will be issued only to members, not to lessees. Updated June 26, 2013 Ver 4.0 Page 5 of 10
6 Leases are subject to approval of the Board or a committee appointed by the Board Littering Littering is not allowed or tolerated. Receptacles are provided in convenient locations throughout the Resort for all trash and garbage. Please Use Them at all times Maintenance Fees Members who are not current on their annual Maintenance Fees will be prohibited from accessing Pelican Bay unless specific arrangements have been made with the Board Fees are to be paid by April 30 th and Oct. 31 st each year. A 10% late charge will be applied for late payment and for NSF cheques Main Gate/Access Main Gate Access is permitted to Members only by use of a Swipe Card Swipe Cards will be issued and registered to Members only. A maximum of two cards per site will be issued to members e.g. at time of sale, and additional cards will be available for purchase at a fee set by the Board. A fee will be charged for replacement of any lost cards Members are responsible to ensure that they have a Swipe Card if they wish to enter the Resort Gate. Swipe Cards are nontransferable. Failure to comply with these Rules and Regulations will result in disciplinary action and/or suspension of privileges Motorized Vehicles (Includes automobiles, trucks, ATV s, Golf Carts, Side by sides, Motorcycles etc.) The speed limit on all roads within Pelican Bay is 15 km/h in order to maintain a safe environment for all members. Please adhere to this speed limit at all times. Motorized traffic must yield to non-motorized traffic and be operated in a courteous and respectful manner Motorized vehicles are allowed to use the Resort roads as a direct access out of the Resort. They are not allowed for pleasure use within the Resort. Travel from point A to point B only is allowed. Motorized vehicles must be operated only on designated roads The requirements by law to have insurance and provincial license plates to travel in the public areas, applies to the park. All ATV s, golf Updated June 26, 2013 Ver 4.0 Page 6 of 10
7 carts and side by sides must also be registered with the Manager and display a Pelican Bay plate No one under the age of 14 is permitted to operate an ATV, golf cart or side by side unless accompanied by an adult. No ATV, golf cart or side by side can be operated with more riders than the vehicle is designed for. That means two seat vehicles are restricted to two riders. Helmet use is recommended particularly for children Operation of all motorized vehicles must in every way be in compliance with the laws and regulation of the Province of Alberta. This includes the need to have working mufflers and spark arresters. Excessively noisy vehicles are not permitted Noise Quiet hours are from 11:00 pm to 9:00 am, unless it is a Resort organized function. Late night campfire socializing is allowed if it does not negatively affect other members enjoyment of the park Stereos, televisions, electric tools, etc. shall be restricted in their use and time for the mutual comfort and enjoyment of the Resort by all Members. Use of power equipment is allowed between 10:00 AM and 9:00 PM Noisy late night gathering in the park after 11:00 PM is not permitted Parking Parking is allowed only on Member sites and shall not block roadways or adjacent sites. Areas are available for Guest parking. Parking on common areas is permitted only on a temporary short term basis e.g. week-ends. This includes any RV s (not set up for use), boat trailers and motorized vehicles Pets Household pets are allowed at Pelican Bay. It is the responsibility of the Member to assure that the pet is well behaved and does not become a nuisance to the Members of the Resort. i.e.: Excessive barking, howling of pets, roaming of pets Pets must be kept on a leash throughout the Resort. Pets are allowed on the Members site without a leash as long as the pet stays on the site Owners are responsible to clean up their pet s droppings immediately, and to dispose of them properly. 8 Pets are not allowed on the Beach and Playground areas at any time Management reserves the right to request members to remove unruly, loud, vicious, aggressive or misbehaved pets from the Resort area. Management may restrict the number of pets allowed Private Business Operation of a private business, soliciting or the advertisement of such within Pelican Bay is not allowed without written permission from the Management under the direction of the Board of Directors Soliciting, ticket selling or fund raising is not allowed without written permission from management Advertising, displays or notices of any type are not to be located on any site without prior approval from the Management Notices by the Member are allowed on the Resort billboard with Management approval Propane/Gasoline Storage Propane bottles must be properly stored and secured to prevent any accidental fire or explosion Gasoline must be stored in Government approved containers, and kept a safe distance from any ignition source. i.e.: fire pits, trailer furnace, etc Bulk storage of gasoline on Member sites is prohibited Sewage/Grey Water All sites that are in use must have a means of disposing ALL wastewater. Members MUST use one of the following methods to dispose of their wastewater: Install an approved in-ground concrete or plastic sewage holding tank on the site and have it emptied at least once per year. Pits or culverts in the ground or non-concrete or not-plastic in-ground tanks are prohibited for any type of water disposal on Pelican Bay property. Sites not serviced with an in-ground concrete sewage holding tank will be responsible for the proper disposal of their wastewater at the sewage disposal tank located at the main gate of the Resort. Park Managers will be maintaining a log to ensure members without in- Updated June 26, 2013 Ver 4.0 Page 8 of 10
9 ground holding tanks are using this sewage disposal tank at the main gate. Under certain circumstances, through specific Board notification, the Board may approve a member to be exempt from the above 2 options. This would only be approved if the requesting member s lot does not generate any wastewater while at Pelican Bay Resort A fee will be charged for the use of the Resort sewage disposal tank (regardless of size) as set by the Board of Directors The disposal of any wastewater in any of the outhouses and/or shower facilities is prohibited. The disposal of any wastewater on the ground is prohibited. Non-compliance of the above will result in serious disciplinary action by the Management as directed by the Board of Directors Storage Compound A designated storage area will be setup for the storage of the member s only recreational equipment. It is recommended that the storage of this equipment be kept on your site whenever possible Pelican Bay is not responsible and shall not be held liable for any damage or theft to any equipment left on Pelican Bay Property Site Improvements/Maintenance Regular maintenance of the members site is the responsibility of the member. Sites must be kept reasonably clean and safe. Any lot development must be done in accordance with the current Development regulations. No structures or development other than approved driveways is permitted on common areas Not Covered in Rules and Regulations Any areas or circumstances currently not covered under the Rules and Regulations of Pelican Bay Cooperative Association will be judged at the discretion of the Resort Manager and the Board of Directors. The Board will have final say in any matter regarding the Rules and Regulations. Updated June 26, 2013 Ver 4.0 Page 9 of 10
10 2.0 Failure to Comply Any Member or Guest who refuses to abide by the Rules and Regulations of the Resort will be subject to a warning, fine, suspension of privileges and/or loss of Membership. Any Member, Family of Member, Member Guest or Lessee failing to comply will result in the Member Receiving: FIRST OFFENCE: A written warning will be issued. Dependent on the severity of the offence, it is to the discretion of the Board to determine any further course of action. SECOND OFFENCE: The whole family would receive suspension for a period of 14 days, with the offending family member suspended for 28 days. THIRD OFFENCE: Family would receive a 28-day suspension and offending family member suspended for 56 days. Upon completion of the 56 days, if the suspended family wishes to return to the Resort, they must arrange for a hearing with the Board of Directors and Management at the convenience of the Board. Reinstatement will be conditional and judged on the family s willingness to reimburse for damages, if any, and their attitude toward Resort members, management and staff. The Board and Management reserve the right to a final decision for the best interest of the membership as a whole. In accordance with the by-laws, the Board is authorized to expel a member or lessee from the Park on third offence. Expiration of Offences: Once a 2-year period has elapsed from the recognition date of an offence, the offence will be removed from the offender s record. Updated June 26, 2013 Ver 4.0 Page 10 of 10
