Commissioners Sloan, Jackson, Freye, Jones and Wallin and staff assembled at 1:00 p.m. in the Public Meeting Room, Chesterfield County Administration Building, Iron Bridge Road Chesterfield, VA for a work session. CALL TO ORDER. I. REQUESTS TO POSTPONE ACTION, EMERGENCY ADDITIONS, CHANGES IN THE ORDER OF PRESENTATION. Mr. Sloan requested to add item I. A. to suspend the Planning Commission by-laws to add the block vote at the 6:00 p.m. session. On motion of Mr. Jones seconded by Dr. Wallin, the Commission agreed to add item I. A. to the 6:00 p.m. agenda and to suspend their by-laws to add block voting for deferral and consent cases. II. REVIEW UPCOMING AGENDAS. Ms. Jane Peterson apprised the Commission of the caseload agendas, for April 18 has 28 cases, May 16 has 15 cases, June 20 has no new cases and July 18 has no new cases. III. REVIEW DAY S AGENDA. Mr. Greg Allen stated there was one 4:00 p.m. case today, Case 16TS0261 Keck Investments and the Bermuda District Planning Commissioner has requested a sixty (60) day deferral. Mr. Turner stated the Commission will hold a public hearing on a pending Ordinance amendment for Commercial and Industrial Uses. Ms. Heather Barrar provided a brief overview of the two (2) historic designation cases which are being presented today at the public hearing for the Historic Preservation Committee and the Planning Commission. Ms. Jane Peterson provided an overview on the 6:00 p.m. agenda, which has twenty-nine (29) cases for today s agenda. 3 IV. WORK PROGRAM - REVIEW AND UPDATE. Mr. Turner stated the Planning Commission recently sent two (2) Code Amendments up to the Board with recommendations for adoption. One: Code Amendment Relative to Uses by Special Exception was approved. Mr. Turner thanked the Commission for their work regarding that special exception. Two: Code Amendment Relative to Mailed Written Notice. This lead to conversation at the Board concerning the level of notification that we provide. They deferred action on the Code Amendment and asked that staff come back and present details to them with a formal presentation. Mr. Gib Sloan and Dr. Wallin will make themselves available to the Board for any questions. In the explanation provided, Dr. Wallin wants to start off with what is done to notify citizens about these cases, then it is in context about why the Planning Commission recommended approval. V. PLANNING COMMISSION FOLLOW-UP ITEMS LIST. There were no questions relative to the Follow-Up Items list. VI. PRESENTATION BY EMERGENCY COMMUNICATIONS CENTER. Mr. Rich Troshak, director for Emergency Communications presented an overview to the Commission relative to the emergency communication system and radio inoperability between county police, fire, and EMS systems. Mr. Peppy Jones stated the Commission deferred voting on the towers for sixty (60) days to allow Mr. Troshak time to look at County owned property for site development. In response to a question from Mr. Sloan relative to tower failure, Mr. John White from Motorola explained why the County needs taller towers than what was originally stated. There was general discussion between the Planning Commissioners, Mr. Troshak and Mr. White relative to location of towers, height of the towers and concentration of signals after the new towers are installed. 4 Mr. Steve Haasch gave a process update to the Commission regarding the Comprehensive Plan. He thanked the Communications and Media Department for their assistance in using a variety of means to get the word out about the Comp Plan update. Ms. Chelsea Hartman presented an overview on Chapter 6: Housing, stating that this chapter received a major revision and reorganization which included changing the name to Neighborhoods & Housing. Mr. Carl Schlaudt presented an overview on Chapter 7, Revitalization which has been reorganized and completely revised. Staff has gone out into the community and met with Revitalize Our Communities Committee (ROCC), the Jefferson Davis Association (JDA), many Home Owners Associations (HOA), civic groups and individuals within the community. The questions heard most frequently from these groups related to strategy, which is action, and the tool kit, which implements action. Staff have looked at other counties that have successfully tackled Revitalization to see what practices they used, and the lessons learned. On motion of Mr. Jackson, seconded by Ms. Freye, the Commission adjourned the 1:00 p.m. Work Session at 4:25 p.m. 4:00 P.M. PUBLIC MEETING - PUBLIC MEETING ROOM. I. CALL TO ORDER. Mr. Sloan, Chairman, called the 4:00 p.m. Public Meeting to order at 4:26 p.m., in the Public Meeting Room, Iron Bridge Road, Chesterfield, VA. II. REQUESTS TO POSTPONE ACTION, EMERGENCY ADDITIONS, CHANGES IN THE ORDER OF PRESENTATION. There were no requests to postpone action, emergency additions, and changes in the order of presentation. III. REVIEW MEETING PROCEDURES. Mr. Turner dispensed with the reading of the meeting procedures. IV. APPROVAL OF PLANNING COMMISSION MINUTES. PUBLIC MEETING, CONSIDERATION OF THE FOLLOWING PROPOSAL: A. 16TS0261*: In Bermuda Magisterial District, Keck Investment Properties, LLC requests approval for a preliminary plat for 38 single family subdivision lots known as MISWOOD ACRES on a site totaling approximately Acres located at Happy Hill Road. Tax ID The applicant s representative, Mr. Jack Wilson, while not present, did accept deferral of Case 16TS0261 for sixty (60) days to the May 16, 2017 Planning Commission Public Hearing. On motion of Mr. Sloan, seconded by Dr. Wallin, the Commission resolved to defer Case 16TS0261 to the May 16, 2017 Public Hearing. VI. PUBLIC HEARING, CONSIDERATION OF THE FOLLOWING PROPOSAL: 17PJ0119 CODE AMENDMENT RELATIVE TO COMMERCIAL & INDUSTRIAL USES. Ordinance to amend Code of the County of Chesterfield, 1997, as amended, by amending and reenacting Secs , , , , and of the Zoning Ordinance relating to commercial and industrial uses and the zoning districts in which permitted by right, with restrictions, or by conditional use. This ordinance would, among other things, eliminate conditional use standards for construction, demolition, and debris landfills, borrow pits, junkyards, mining, and quarrying and allow site specific standards to be addressed through the conditional use process; allow craft breweries, distilleries, and wineries with restrictions in O-2, C-2 through I-1; allow farm breweries, distilleries and wineries in A; allow breweries, distilleries and wine manufacturing in I-2 and I-3; allow outside dining as accessory to a permitted or restricted use in C-2 through I-3 and address parking requirements for such uses; allow nightclub as an accessory use to craft brewery or brewery manufacturing in I-1 through I-3; allow conference centers with restrictions in O-2 and conditional use in I-1 and prohibit the uses in C-5; allow crematoriums with restrictions in O-2, C-2 through C-4 and by right in C-5 through I-3; allow data centers with conditional use in A, as restricted uses in C-3, C-4 and I-1 and by right in C-5, I-2 and I-3 Districts; allow data services with conditional use in A, permitted by right in O-2 and C-2 through I-3; allow dye and soap manufacturing as a conditional use in A and permitted by right in I-2 and I-3; prohibit floor manufacturing in C-4 through I-1; clarify that furniture, fixture and mattress assembly from finished products is permitted with restrictions in C-4 and by right in I-1 through I-3; prohibit wholesale greenhouses and plant nurseries in I-1; allow mass transportation terminals in C-4; allow mini-storage facilities in I-2 and I-3 with a conditional use; allow nuclear medicine, railroad car and tire manufacturing with conditional use in A and by right in I-3; allow perfume and printing ink manufacturing with conditional use in A and by right in I-2 and I-3; allow carry out and fast food restaurants with restrictions in I-1 through I-3; clarify that retail sale of goods manufactured or assembled as accessory to permitted uses is permitted with restrictions in I-1 though I-3; and define farm brewery, farm distillery, farm winery, crematorium, data center, data services office, and construction demolition debris landfill; and address parking CPC & Preservation Committee Minutes FINAL 5 P a g e

6 requirements for manufacturing area associated with craft, brewery, distillery or winery. Action may include allowing the specified uses in other districts either with conditional use, with restrictions, or by right, or to modify restrictions, and to define other uses specified herein. Mr. Ray Cash presented a brief overview of the Code Amendment and stated this item has been discussed at previous Work Sessions. This amendment came about because of the Comprehensive Plan direction which asked staff to evaluate Industrial Uses and Districts in which permitted by right restrictions and conditional uses are allowed. The goal is to determine what uses should be changed to different Zoning category s based upon current technology, additional uses based upon evolving industries and target industries necessary for a strong and diverse economy. Planning has collaborated with Economic Development, benchmarked with other localities, and posted amendment to the web for public comment. While there were no comments from the public, Economic Development had some concerns that addressed outdoor dining in relationship to craft breweries, distillery and winery industries and the need for nightclub use. There is one (1) addendum to the item today; addressing outside dining, parking requirements based upon outside dining square footage that exceeds 20 percent of the area of the principal use as a credit which is an incentive for the provision of outside dining and helps other existing restaurants to provide the use. Staff recommends following the Public Hearing, the Commission forward a recommendation of approval to the Board of Supervisors. Mr. Andy Scherzer stated he had questions relative to changes to the uses of boat sales, service, repair, and rental and wholesale greenhouses. Dr. Wallin, Mr. Sloan and Ms. Freye asked additional questions related to those uses. Mr. Cash responded that boat sales, service, repair, and rental is a restricted use in a C-5 District and that I-2 and I-3 Districts typically do not provide for repair uses, instead reserving for manufacturing uses, the amendment would require conditional use by the Board in I-2 and I-3 Districts. Commercial greenhouses require outdoor growing space which is not typically permitted in I-1 Districts and staff recommended such use no longer be permitted as a restricted use. Mr. Cash stated that the Commission could decide not to recommend approval of changes to these uses. No one else came forward to speak in favor of, or in opposition to, the request. There being no one else to speak, Mr. Sloan closed the Public Hearing. On motion of Dr. Wallin, seconded by Mr. Jackson, the Commission, deferred action on Code Amendment Relative to Commercial & Industrial Uses (17PJ0119) to the April 18, 2017 Planning Commission meeting. C. CHAPTER 10: THE LAND USE PLAN- CONTINUED. Mr. Haasch revisited Chapter 10: The Land Use Plan, explaining this chapter had some new information added relative to a sense of place. Staff want to encourage many different types of homes as not one size fits all. 7 encourage employment. Staff are still looking for changes toward conservation easements and have captured an area called Institutional, as in the Matoaca District with VSU. Mr. Sloan asked Mr. Haasch to review change # 16, the Meadowville Landing area and Mr. Jackson requested a review of change # 5, Jessup Road, and Rt. 10. There was general discussion among the Commission relative to land use throughout the county and Mr. Haasch reviewed the next steps. Mr. Sloan stated there are three (3) items still outstanding from the 1:00 p.m. Work Session today: Item VIII. Discussion of Zoning Caseload Improvements will be deferred to the April 18, 2017 Work Session. Item IX. Discussion of Code Amendment Relative to EMC Signs (17PJ0118) will move to the April 18, 2017 Work Session for discussion and the Public Hearing will move to the May 16, 2017 Planning Commission meeting. Item X. Discussion of Planning Commission Annual Report (17PJ0120) will be moved to the April 18, 2017 Work Session. On motion of Mr. Jones, seconded by Dr. Wallin, the Commission resolved to move 17PJ0118 Code Amendment Relative to EMC Signs for a discussion item at the April 18, 2017 Work Session and to move the Public Hearing for 17PJ0118 to the May 16, 2017 Planning Commission meeting. VII. RECESS. The Commission recessed at 5:13 p.m. for dinner. 5:00 P.M. DINNER - EXECUTIVE MEETING ROOM. During dinner, there was general discussion on topics related to the Planning Commission. 6:00 P.M. JOINT PUBLIC HEARING OF PRESERVATION COMMITTEE AND PLANNING COMMISSION. I. CALL TO ORDER PLANNING COMMISSION. Mr. Sloan called the meeting to order. II. CALL TO ORDER PRESERVATION COMMITTEE. Ms. Mary Ellen Howe called the Preservation Committee to order and introduced Mr. Andy Scherzer and Ms. Julie Crowe as new members. III. INVOCATION. 8 IV. PLEDGE OF ALLEGIANCE TO THE FLAG OF UNITED STATES OF AMERICA. The Commission led in the Pledge of Allegiance to the Flag. V. REVIEW UPCOMING AGENDAS. Mr. Kirk Turner stated for April there are 28 cases scheduled, for May there are 15 cases scheduled, for June there are 0 cases scheduled and for July there are 2 cases scheduled. VI. REQUESTS TO POSTPONE ACTION, EMERGENCY ADDITIONS OR CHANGES IN THE ORDER OF PRESENTATION. There were no requests to postpone action, emergency additions or changes in the order of presentation. VII. REVIEW JOINT PRESERVTION COMMITTEE / PLANNING COMMISSION MEETING PROCEDURES. Mr. Kirk Turner commented on the thirty (30) years of service of the Preservation Committee, stating that since 1987, the Committee has provided guidance to the protection of 48 structures and sites in Chesterfield County helping preserve the fabric of our community. Our landmark sites include public parks like Falling Creek Iron Works and they have provided unique structures for private homes and county businesses. The Planning Department looks forward to continuing the relationship between the Planning Commission and the Preservation Committee. Mr. Kirk Turner reviewed the meeting procedures. By County Code the Planning Commission and Historic Preservation Committee must hold a joint public hearing on applications for historic designation and for applications to modify historic designations. Each body tonight will decide to recommend approval, deny, or defer the case. Once their decision is made, they will forward their decision to the Board for approval. VIII. JOINT PRESERVATION COMMITTEE / PLANNING COMMISSION PUBLIC HEARING, CONSIDERATION OF THE FOLLOWING PROPOSAL. A. 17HP0123: In Matoaca Magisterial District, Chesterfield County Parks, and Recreation Department requests historic landmark designation for the Pleasant View School and privy (the designation would extend a distance of 20 feet from both structures on each side of the structures) in an Agricultural (A) District on 2 acres known as River Road. The Comprehensive Plan suggests the property is appropriate for Rural Residential/Agricultural use (single family dwelling on a minimum of 5 acres fronting 250 to 300 feet along existing public road). Tax ID Ms. Heather Barrar presented an overview of the case and noted that Pleasant View School is the last African-American school from the segregation era in the County. 9 Mr. Bernard Anderson, Mr. Claude Baker, and Mr. Herbert Townes are in favor of the historic designation and the preservation of the property. No one else came forward to speak in favor of, or in opposition to, the request. There being no one else to speak, Mr. Sloan closed the Public Hearing. Mr. Sloan asked the Preservation Committee and Ms. Mary Ellen Howe for a recommendation. Ms. Mary Ellen Howe asked for a motion. On motion of Mr. Cogbill, seconded by Mr. Morris, The Preservation Committee resolved to recommend approval of Case 17HP0123. Howe, Daniels, Cogbill, Crowe, Dutton, Morris, and Scherzer. Mr. Sloan asked if there was any further discussion on the case. On motion of Dr. Wallin, seconded by Ms. Freye, the Planning Commission resolved to recommend approval of Case 17HP0123. B. 17HP0124: In Matoaca Magisterial District, New Dawn Properties, LLC requests the adjustment of previous historic landmark designation for the parcel of Adventure Hill (retaining the designation for the house structure and a minimum of 3 acres, but removing the designation from all outbuildings and other property) in an Agricultural (A) District on 68.9 acres known as Winterpock Road. The Comprehensive Plan suggests the property is appropriate for Rural Residential/Agricultural use (single family dwelling on a minimum of 5 acres fronting 250 to 300 feet along existing public road). Tax ID Ms. Heather Barrar presented an overview of the case and staff s recommendation for approval as the building is of high architectural quality and historic interest, the designation will not cause significant adverse impact on future development and is in keeping with recent case trend to designate the least amount of land to reduce future adverse impacts and it complies with the Comprehensive Plan. Mr. Matt Henderson, the applicant, requested the Preservation Committee and the Planning Commission approve his request. Mr. George Haas does not want the designation removed because it would open the possibility to develop the entire acreage. No one else came forward to speak in favor of, or in opposition to, the request. 10 Mr. Sloan asked the Preservation Committee and Ms. Mary Ellen Howe for a recommendation. Ms. Mary Ellen Howe said this home was built by one of her distant relatives and the development will be tastefully done with large parcels. On motion of Mr. Daniels, seconded by Mr. Morris The Preservation Committee resolved to recommend approval of Case 17HP0124, subject to the conditions in the staff report. Howe, Daniels, Cogbill, Crowe, Dutton, Morris and Scherzer. Mr. Sloan asked if there was any further discussion on the case. On motion of Dr. Wallin, seconded by Ms. Freye, the Planning Commission resolved to recommend approval of Case 17HP0124, subject to the condition in the staff report. CONDITION This designation shall not apply to any property needed for any improvements to Winterpock Rd per the Thoroughfare Plan. IX. ADJOURNMENT OF THE PRESERVATION COMMITTEE AND RECESS OF THE PLANNING COMMISSION. Mr. Sloan turned the meeting over to Ms. Mary Ellen Howe. Ms. Howe asked for a motion to adjourn. On motion of Mr. Cogbill, seconded by Mr. Dutton, the Preservation Committee agreed to adjourn. Howe, Daniels, Cogbill, Crowe, Dutton, Morris and Scherzer. 11 There were no citizens comments on unscheduled matters. XIII. PUBLIC HEARING, CONSIDERATION OF THE FOLLOWING PROPOSALS IN THIS ORDER. DEFERRAL REQUEST BY INDIVIDUAL PLANNING COMMISSIONER CONDITIONAL USE, CONDITIONAL USE PLANNED DEVELOPMENTS AND REZONINGS. DUE TO THE LARGE NUMBER OF CASES TO BE HEARD THIS EVENING, THE COMMISSION HAS INITIATED A BLOCK VOTE SYSTEM FOR DEFERRAL AND CONSENT CASES ONLY. A. 13SN0529*: (AMENDED) In Clover Hill Magisterial District, Douglas and Susan Sowers request amendment of conditional use planned development (Case 03SN0288) relative to transportation improvements and phasing, to amend cash proffers and amendment of zoning district map in a C-3 District on 113 acres fronting in two (2) places for a total of 1,770 feet on the south line of Old Hundred Road, east of Otterdale Road, also fronting in two (2) places for a total of 740 feet on the east line of Otterdale Road, south of Old Hundred Road. Density will be controlled by zoning conditions or Ordinance standards. The Comprehensive Plan suggests the property is appropriate for Suburban Residential I (maximum of 2.0 dwellings per acre) and Community Mixed Use uses. Tax ID Ms. Penny Giles, the applicants representative, accepted deferral of Case 13SN0529 by the District Planning Commissioner to the April 18, 2017 Planning Commission Public Hearing. On motion of Dr. Wallin, seconded by Ms. Freye, the Commission, resolved to defer Case 13SN0529, by Ms. Freye with the applicant s consent, to the April 18, 2016 Planning Commission Public Hearing. D. 17SN0522*: (AMENDED) In Matoaca Magisterial District, Douglas and Susan Sowers request amendment of conditional use planned development (Case 00SN0174) to amend cash proffers and amendment of zoning district map in a Residential (R-12) District on acres located within the Collington Subdivision located along Ashmill Drive, Ashmill Court, Greywell Terrace, Bayford Drive, Cravensford Loop, Cravensford Terrace, Hockliffe Loop, Paddock Wood Court, and West Hensley Road. Density will be controlled by zoning conditions or ordinance standards. The Comprehensive Plan suggests the property is appropriate for Suburban Residential II use (2.0 to 4.0 dwellings per acre).
