Originating Department SUBJECT: Department Head Presenter Adoption Re: Ordinance to rezone an approximately 9.73 acre parcel of property located at 2260 Ringing Boulevard, commonly referred to as the Ringling Shopping Center, from the Commercial Shopping Center Neighborhood (CSC-N) and the Residential Single Family - 3 (RSF-3) zone districts to the Downtown Edge (DTE) and Downtown Neighborhood Edge (DTNE) zone districts. COMMISSION PRIORITIES: Business Requirement EXPLANATION: (see next page for additional explanation) The subject property is located at 2260 Ringling Boulevard, at its intersection with Lime Avenue. The property currently contains a 97,779 square foot building which previously housed a Publix-anchored Shopping Center and is now predominantly vacant. The property totals approximately 9.73 acres. The majority of the property is zoned Commercial Shopping Center Neighborhood (CSC-N), with all development located on this portion of the Site. The remainder of the site, located adjacent to the neighborhood to the east is designated as Residential Single Family 3 (RSF-3). This residentially-zoned property has been part of the larger site since development of the existing shopping center but was specifically retained as residential to provide a greenway buffer between the development and neighborhood. 2 ADDITIONAL EXPLANATION: AGENDA REQUEST In February 2015 the City received a formal written Notice of Claim pursuant to the Bert J. Harris, Jr. Private Property Rights Protection Act from the owners of the Ringling Shopping Center. The claim is based on the City Commission's denial of Site Plan 12-SP-12 to develop a free standing 98,000 sq. ft. Wal-Mart store on the property in February of This action resulted in the Mediated Settlement Agreement (Case 2013 CA NC) as signed in October, Under this agreement, three options were made available to the property owner: - Alternative 1: Remodeling Existing Structures or Limited Redevelopment under Existing CSC-N Zoning - Alternative 2: Redevelopment Pursuant to Existing CSC-N Zoning - Alternative 3: Continued Use or Redevelopment after Amending Comprehensive Plan and Zoning Pursuant to City s Settlement Offer The property owner was required to provide notice of which option they had selected within 12 months of the agreement. On June 8, 2016, the City was notified that the owner wished to pursue Alternative 3 for Comprehensive Plan Amendment and Rezone of the property. Staff is processing all requests on behalf of the property owner (Doyle Family Trust and Padick Partners), as provided under the Agreement. The property is currently zoned Commercial Shopping Center Neighborhood (CSC-N) and Residential Single-Family 3 (RSF-3). Rezone is requested to bring the property under the Downtown Edge (DTE) and Downtown Neighborhood Edge (DTNE) zone districts. Specifically, the DTNE district would be requested for both the portion of the site currently zoned RSF-3 and a 100-foot depth section along the southern property line. The remainder of the site would be rezoned to DTE. Concurrent request has also been made to bring the entire property into the Urban Edge Future Land Use Classification. Concurrent with this request, two segments of Ringling Boulevard adjacent to the subject property would be designated as primary streets (with the 100-foot break used to allow a central access drive). This Primary Street Designation is also proposed for update within the Zoning Code under concurrent request. There is no site plan or specific development program or timeline tied to the project, however the Agreement limits the development of the property to a combination of 175,000 square feet of retail/non-residential use and 222 residential units, or the equivalent to total trip generation to that mix of development. The required Community Workshop was held August 3, The required Traffic Concurrency Analysis found the change de minimus based on the provided development program. A revised analysis would be required if this development program changes at time of final development approval. Subsequent to the Planning Board Public Hearing, the agent for the property owner has met with staff to develop further proffers to address items raised through the review process and Public Hearings, namely future pedestrian access through the site, access and future configuration of Lime Avenue, and the planned sidewalk widths along Ringling Boulevard. We anticipate that these will be presented by the agent for the property owner at the City Commission Public Hearing. In a Public Hearing held October 12, 2016, the Planning Board recommended approval of the rezone subject to conditions limiting development to the density and intensity outlined within the Settlement Agreement (as noted above). This motion passed by a 3-1 vote with PB Member Halflants voting no. 2

5 WHEREAS, the Planning Board, acting in its capacity as the Local Planning Agency considered the written staff analysis and the testimony at the public hearing and specifically found that Rezone Application No. 16-REN-0 I satisfied the standards for review set forth in Section IV-II 06, Zoning Code (2002 edition) and was consistent with the Sarasota City Plan (2030) and recommended approval to the City Commission; and WHEREAS, the City Commission held a duly noticed public hearing pertaining to Rezone Application No. 16-REN-Ol on November 21, 2016; and WHEREAS, the City Conunission is adopting this rezoning so as to facilitate the Mediated Settlement Agreement and provide for future redevelopment of the subject property in conformance with the Sarasota City Plall (2030). NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SARASOTA, FLORIDA: Section 1. The following described real property located in the corporate limits ofthe City ofsarasota, Sarasota County: See the sketch of the DTE parcel depicted on Page I of 4 and the legal description ofthe DTE parcel depicted on Page 2 of4 ofexhibit A, a copy ofwhich is attached hereto and incorporated by reference herein. The abovedescribed real property is included within the parent tract referred to by the Property Appraiser's Office as ParcellD No located at 2260 Ringling Boulevard. Section 3. This rezoning is granted pursuant to Article IV, Division II of the Zoning Code (2002 edition) pertaining to rezoning and shall be subject to all of the terms, requirements and limitations thereof. Section 4. The approval granted by this Ordinance with regard to Rezone Application No. l6-ren-01 is subject to the following conditions: A. Pursuant to the Mediated Settlement Agreement arising out of Sarasota Circuit Civil Case No CA NC, and for purposes of transportation concurrency analysis, the property described in Sections 1 and 2 above is vested for 580 p.m. peak hour trips. For pul]joses of the analysis, a concurrency determination was based on 222 dwelling units of Mid-Rise Apartments and 175,000 square feet of Specialty Retail Center. An updated concurrency analysis shall be required at the time of Administrative Site Plan or Building Permit submittal based upon final proposed uses, with recognition of the 580 vested p.m. peak hour trips. Circulation review will also be required at the time of Administrative Site Plan or Building Permit submittal, consistent with the applicable policies ofthe Zoning Code and Engineering Design Criteria Manual. B. Development of the property described in Sections 1 and 2 above shall be limited to a combination of 175,000 square feet of retail/non-residential use and 222 residential units, or the equivalent to total trip generation to that mix ofdevelopmcnt. 3 3 of 11

As it relates to development of the propelty described in Sections I and 2 above, with any site plan that abuts Ringling Boulevard, the owner or applicant shall provide the fojlowing improvements to the lands abutting the said property: I. Sidewalks of twelve (12) feet in width with an eight (8) foot clearance at ajl points, excepting the entranceway; 2. Canopy trees on thirty (30) foot centers in the improved areas; and 3. These improvements shall be located south ofthe existing paved street. To the extent that installation of the improvements requires additional land, the owner or applicant shall either dedicate such land to the City or provide a non-exclusive easement for public non-vehicular access to the sidewalk area. In the event such a dedication or easement is made, the frontage line for the calculation of setbacks shall be taken from the easement, rather than the current right ofway. D. With respect to development ofthe property described in Sections I and 2 above, at the time of site plan approval for a site plan abutting the residential portion of South Lime Avenue, the owner or applicant shall provide the following improvements within the existing right ofway: I. A sidewalk five (5) feet 111 width from the south property line along Lime Avenue to the traffic circle; 2. Gutters as required by current code; and 3. Canopy trees on forty (40) foot centers in the improved area. E. With respect to development ofthe property described in Sections 1 and 2 above, in order to ensure that the residential portion of South Lime Avenue is not connected to the current commercial portion of South Lime Avenue south of its 4 4 of 11

8 intersection with Ringling Boulevard, prior to or concurrent with any application for site plan approval for any portion of the subject property, the applicant will file with the City a request to vacate that portion of the platted but unpaved area of South Lime Avenue lying north of the existing cui de sac, with public access and utility easements over the vacated portion. F. As it relates to development of the property described in Sections I and 2 above, with respect to any site plans filed for the subject property, future vehicular access from the subject property to the residential portion of South Lime Avenue will be limited to: I. Emergency access, improved to the requirements of the City of Sarasota Engineering Department and the City'S Fire Marshall, which shall include a Knox Box ifthe access is gated; or 2. Access for any residential units developed that have frontage directly on that poltion oflime Avenue. G. The property described in Sections I and 2 above shall be developed to provide and include (I) a non-exclusive non-vehicular access way from the residential portion of South Lime Avenue to a point across /i'om the existing four (4) foot sidewalk on the portion of Shopping Lane that lies west of the railroad right of way; (2) a nonexclusive non-vehicular access easement across the existing four (4) foot sidewalk area on the north side of Shopping Lane between the railroad right of way and School Avenuc; and (3) if available and legally reasonable, shall provide non-exclusive nonvehicular access across the railroad right ofway, subject to the terms and duration of any license agreement providing such access. These non-vehicular accesses shall be provided 5 5 of 11

9 and shown on any site plans for the propelty described in Sections 1 and 2 above that adjoin the relative poltions ofsouth Lime Avenue and the railroad rightofway. H. Pursuant to Section , Florida Statutes, the issuance of a development permit by the City ofsarasota does not in any way create any right on the part of an applicant to obtain a permit from any state or federal agency and does not create any liability on the part ofthe City ofsarasota for issuance of the permit if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in violations ofstate or federal law. The development approvals granted herein are subject to the condition that all other applicable state and federal permits be obtained before commencement of the development. Section 5. This Ordinance shall take effect immediately upon second reading.
