2 WELCOME TO PINECREST Welcome neighbor! We hope you will enjoy living in our community as much as we do. Enclosed are several informative documents we think you will find helpful and useful for your residence here. PLEASE TAKE A FEW MINUTES TO READ THEM OVER If you have any questions or concerns, please feel free to contact Realtime Property Management of South Florida, LLC at any time. 3 Rules and regulations 1. Unit owners should be aware that no rental is permitted for a period of less than three (3) consecutive months and that a unit cannot be rented more than three (3) times in one year. In addition, no more than four (4) persons are permitted, by law, to reside in a two-bedroom unit. Lessees are not permitted to sub-lease their rental units. 2. Sidewalks, stairways and landings, which are part of common/ limited common elements, shall not be obstructed in any way. No strollers, bicycles, toys, trash, chairs, or other articles will be permitted to stand in said areas nor shall anyone be permitted to play or loiter on sidewalks, stairways or landings. 3. All personal property shall be stored within owner s units. 4. No dirt or other substances shall be swept onto stairways or over balconies. No clothing or towels shall be hung outside of units or inside windows. 5. All trash/ refuse shall be deposited into trash/ garbage dumpster in designated areas. Boxes must be broken down before discarding/ recycling. 6. No employee of the Condominium Association or Condominium Manager shall be requested or required to perform any personal activity. 7. All parking and traffic regulations of the condominium association must be obeyed. No trucks, trailers, campers, boats, golf carts or un-drivable vehicles shall be parked or stored on condominium property without prior written approval of the Pinecrest Condominium Association. Please observe the 15 mph speed limit in our community. 8. No disturbing noises, either within the unit or on common elements which would interfere with the rights, comforts or convenience of other unit owners, shall be permitted. 9. No sign, advertisement or other lettering shall be displayed, painted or affixed on any part of the Condominium Unit that is visible from outside the unit or condominium property without prior written approval of the Pinecrest Condominium Association. 10. No awnings, enclosures, canopy, shutter, hurricane shutters, porch windows or like item, shall be attached to or placed upon the porch within any unit, outside walls or roof of the building except as provided in the Declaration. 11. The association shall retain a duplicate key to all units. No unit owner or occupant shall alter any lock or install a new lock without the written consent of the board. Where such consent is given, the unit owner shall provide the association with an additional key for use by the association pursuant to its right of access to the unit.

4 12. No cooking shall be permitted on or in the common elements nor shall any goods or beverages be consumed outside of the unit except on areas designated for that purpose by the Board. 13. No flammable, combustible or explosive fluid, or substance shall be kept in any unit or enclosed area except those required for normal household or medical uses (I.e. portable oxygen) No barbequing is permitted on lanai s. 14. Any unit owner who plans to be absent from their unit during the hurricane season must prepare their unit by removing all furniture and other objects from their porch prior to his departure and designate a responsible individual or firm to care for their unit during their absence. 15. Only one walking pet is permitted. No pet over forty (40) pounds will be permitted. Pets must be kept on a leash when outside the unit. Pet owner are responsible for the retrieval and disposal of their pet s excrement. Not pet shall be maintained or harbored within a unit that would create a nuisance for any other unit owner. 16. No unit may be used for any commercial or business purpose. 17. No electrical machinery or device of any sort, including citizen s band apparatus shall be used within the unit or porch that causes interference with television or radio reception. 18. Each unit owner or his tenant shall park his automobile in his assigned space. Guests or temporary parking for delivery vehicles may use any parking spaces not assigned. (Unmarked spaces) 19. No repair or any type of motorized equipment such as cars, boats, motorcycles, motor homes, or trucks shall be performed upon any portion of the common elements. 20. No unit owner shall grow/ plant any type of plant, shrub, flower, etc. outside of his unit without prior written consent of the Board. 21. Complaints regarding the management of the condominium property, or regarding actions of other unit owners shall be made in writing to the Pinecrest Condominium Association, and/or its manager. 22. Each unit owner shall be held accountable for violations of any of the Rules and Regulations by their family members, guests, tenants, agents, or employees. The Pine Crest Condominium Association Rules and Regulations herewith have been condensed from the Rules and Regulations and Bylaws of the original Indian Creek Book of Documents given to each owner at the time of purchase.

5 Clubhouse & Pool Area Rules To reserve the Clubhouse please contact Realtime Property Management For private Parties and Clubhouse Rentals* 1. NO SMOKING in the clubhouse or covered patio area. You may smoke at the far end of the pool. (Designated Smoking Area); make sure you use an ashtray. 2. Wet bathing suits and/or towels are not permitted in the clubhouse. 3. Children must be continually supervised while in the pool and the pool area as well as in the clubhouse. Please be mindful of noise in the pool area to ensure enjoyment by all. 4. No glass of any kind is permitted in the pool area. 5. You may eat and/ or drink at the tables around the pool. Beverage containers must be in plastic. 6. Items provided for use in the pool must be returned to the container they are stored in. 7. Please adhere to the posted Pool Rules. 8. The clubhouse must be left clean. 9. Empty all trash receptacles including the one under the sink. 10.Pool gates are to be locked at all times We hope you enjoy the use of the clubhouse facilities *The association does not permit non-residential rentals for private parties.

6 Frequently asked questions and answer sheet Q: What are my voting rights in the condominium association? A: The owners of each unit are entitled to case one vote for each unit owned. (Article 8.7 Declaration of Condominium). Q: What restrictions exist in the condominium documents on my right to use my unit? A: Units restricted to single family residents. (Article 9.1 Declaration of Condominium); no material notification to unit without prior written content of Association and/or Sponsor. (Article 9.4 Declaration of Condominium); no nuisance (Article 9.5, Declaration of Condominium); only 1 walking animal with a weight of not more than 40 pounds shall be kept in a unit. (Article 12 (p) of the Association Bylaws. Q: What restrictions exist in the condominium documents on the leasing of my unit? A: No lease may be made for less than 90-day period; no owner may lease his unit more than three times per calendar year, a unit owner intending to lease his unit shall furnish to Association with a copy of said lease (Article 9.7 Declaration of Condominium). Q: How much are my assessments to the condominium association for my unit type and when are they due? A: The quarterly fee as of 9/1/16 $900. When due: 01/01, 04/01, 07/01, 10/01. Statements are mailed as courtesy. The due date remains the same whether or not you receive the statement.

7 Q: Do I have to be a member in any other association? If so what is the Name of the Association and what are my voting rights in this association? Also how much are my assessments? A: Each owner is subject to the terms of the Articles of Incorporation and Bylaws of Indian Creek Community Association. These assessments are collected by the Condominium Association and is currently $930 quarterly for 2018, which amount is paid by the Association. Each owner is also subject to the Declaration of Covenants, Conditions & Restrictions of the Indian Creek Swim & Tennis club. Membership in the Indian Creek Swim & Tennis club is optional with each owner. Q: Am I required to pay rent or land use fees for recreational or other commonly used facilities. If so, how much am I obligated to pay annually? A: No. Q: Is the condominium association or other mandatory membership association involved in any court cases in which it may face liability excess of $100,000? If so, identify each such case. A: No.

8 Recreational Facilities Rules and Regulations (A) Unit owners, their guests, tenants and their guests, using the facilities of the Pinecrest swimming pool, do so at their own risk. NO LIFEGUARD ON DUTY. (B) The association has furnished all unit owners with 2 pool keys. If keys are lost or stolen, this must be reported to the Association. $25.00 will be required to replace each key. (C) The association has the authority to refuse anyone the use of the swimming pool, clubhouse or other facilities around the pool area due to misconduct, intoxication or any disregard of the rules and regulations. Rules 1. All persons are encouraged to shower before entering the swimming pool. Rinsing off tanning oils will prevent filter damage and reduce the amount of oil residue left on the pool tile and pool furniture. 2. Children under the age of twelve (12) must be accompanied by an adult (18 years or older) at all times within the pool area. Parents are responsible for the conduct and safety of their own children. 3. Residents and guests in bathing suits are required to stay within the pool area. Persons using the tennis courts must wear proper tennis attire (bathing suits are not permitted). Cover-ups are required outside the pool area. 4. NO GLASS CONTAINERS or glass ashtrays are permitted within the pool area. Trash must be put into trash cans, which are provided for such use. No food or drink is permitted beyond the drainage tile area around the pool. 5. Golf shoes may not be worn in the pool areas. 6. NO PETS are allowed on or in the pool and/or clubhouse area. 7. Use of flotation devices such as rafts are permitted as long as they do not cause a nuisance to other bathers. 8. NO DIVING is allowed, as the deepest part of the pool is six (6) feet. Pool depth is designated in feet.

9 9. Pool deck furniture may not be removed from the area. If an umbrella is raised, please lower it when leaving to prevent wind damage. When leaving, please return the lounge chair back to the upright position. There are no attendants to replace items left askew. Pool gates are to be locked at all times. (Insurance regulations) 10. Every member using the picnic area is responsible for leaving the area in a clean and presentable manner. 11. The pool and pool areas shall be opened from 8:00 AM to dusk. Children under eighteen (18) years of age or their guests are not permitted in pool area after 5:30 PM without adult supervision. 12. No one is to use the pool when it is officially designated as closed. 13. Fecal contaminations are a serious health hazard. Therefore, children who are not toilet trained, are not wearing the proper protective swimming attire are not permitted to be in the pool. 14. The clubhouse may be used at any time upon request to Association committed reservations. Those who use the clubhouse must leave it properly locked, cleaned and tidy. To reserve clubhouse, contact Realtime Property Management at vstewart@realtimepm.com. There is a refundable security deposit of $200 for any clubhouse rental based on post inspection. 15. There will be no running, roller- skating., ball playing bikes or skateboarding permitted in any of the recreational facilities. 16. SMOKING IS PERMITTED ONLY IN THE DESIGNATED SMOKING AREA LOCATED AT THE WEST END OF THE POOL AREA. 17. A propane grill (self-cleaning) is provided for use outside the clubhouse. Grill must be cleaned after each use. In order to ensure enjoyment by all residents the Board of Directors has adopted these rules and regulations, presented by the Pool Committee, pursuant to its authority under the Declaration of Condominium. We trust that all persons using the Association s facilities will abide by the Rules and Regulations, which will insure an enjoyable pool and tennis facility for all residents.

12 Recycling Use Newspaper Bin for: 1. Newspapers 2. Magazines & Catalogs, phone books, unwanted mail 3. Brown paper grocery bags 4. Cardboard boxes (broken down to 3 X 3 maximum) Use Glass, Aluminum & Plastic Bin for: 1. Clean brown, green and clear glass containers (no lids) 2. Plastic containers with the # s 1 through 7 stamped on the bottom. (Number is located inside a triangle) (No lids, Styrofoam peanuts, plastic wrap or bags) 3. Aluminum cans, pie plates and foil (new) 4. Steel cans 5. Milk, juice cartons and drink boxes (No straws) All other items may be deposited into the dumpsters Occasionally you may have bulk items (such as old TVs, small pieces of furniture, etc. you wish to dispose of, please call Solid Waste Authority to come pick up Construction or renovation debris must be removed by contractor must be removed by contractor. Large items such as sofas that will not fit safely into the dumpster must be disposed of by the individual via private removal services.

13 Rules Reminder Notice As it often comes to pass, people who purchase a home in a deed restricted community need to be reminded that a deed restricted is exactly what it implies. You purchase a home in a community which is regulated by its Declaration, Bylaws and Articles of Incorporation. These documents are an extension of your deed; they are legal documents. Purchasers are legally bound to acknowledge receipt of and agree to abide by those documents before their transaction is closed and they become owners and members of that association. In addition to the Condo Documents, a condo association is regulated by Florida Statutes, Chapter 718, and The Condominium Act and Chapter 617 C Corporation Not for Profit. The Board of Directors has a legal responsibility to comply with all three. The board of Directors, to the best of its ability, must enforce the Condo Documents. Owners also have a legal responsibility as members of an association in a deed restricted community. Owners should have a good understanding of their Bylaws and Rules and Regulations promulgated by the Board of Directors as well as procedures to be followed which have been set in place for the good of the whole community. In Pinecrest, for example, Article 12 of the Bylaws specifically outlines Use Restrictions and from that Article the Board of Directors has derived various Rules and Regulations. Guidelines and procedures covering various items in an association from filing a complaint to making a material change to your unit are in place. All complaints and requests for material changes to a unit must be submitted to the management company. They are community liaison for the board. Listed below are some of the Rules, Regulations, and Procedures which most often seem to get over looked and/or ignored. ACC REQUEST FORMS: The Board reviews all applications for major changed in the condo i.e. flooring for 2 nd floor units, new windows, new air- conditioning units and any major structural changes. All applications must be submitted through Realtime Property Management and the process can take up to two weeks. Application forms are available through Realtime Property Management. For example, but not limiting to. installation of hurricane shutters, installation of any new air conditioning unit, window installation, floor covering changes for any second floor

14 unit, any new construction work regarding a structural change, any new door instillation i.e. front door or sliding glass door, any and all plantings outside your unit. BIKE REGISTRATION: There is a bike rack, with limited space, located on the North side of the clubhouse. If you plan to park your bike there, it must be registered. Registration stickers are available by contacting Felicia Steiner, Unit 902-F, GRILL: There is a barbeque grill located in the pool area. The grill was purchased by the association for use by residents with the provision that each party using the grill will be responsible for cleaning the grill. This is a self- cleaning grill and the instructions, which are posted, are very simple to follow. HOWEVER, there are a few residents who use the grill regularly and DO NOT CLEAN IT. If this continues, the board will limit the use of the grill by keeping it locked or requiring prior permission to use it. Due to directive from the Palm Beach County Fire Marshall s Office, propane gas tanks, are NOT permitted at Pinecrest Condominium other than at the Clubhouse. This eliminates ALL private grills using propane gas for cooking purposes. Violators will be held accountable by the Palm Beach County Fire Department where fines may be levied for violations. The only Private grills legally permitted are electric grills such as a George Foreman type grill ; these must be used so as not to cause smoke or discomfort to neighboring unit owners. GUEST REGESTRATION FORMS: This form is available through Realtime Property Management. If a family member or friend is going to be staying in your condo when you are not in residence, this form should be submitted. If you don t use the form, a short letter can be sent in. For security purposes, it is important that we know who is authorized to be on the property or who is using your vacant condo. PARKING: Each unit has one assigned parking space and it must be utilized by the unit owner. All other spaces are considered open spaces are available for 2 nd car and/or guests. When you are leaving Pinecrest for an extended period of time and you are leaving your car here, it must be parked either in your assigned space or in the overflow parking lot at the front of the complex. PETS: The Bylaws state that the owners are allowed one pet and in the case of a dog, there is a weight restriction (40lbs.) In addition, owners are required to clean up after their dogs and dispose of pet waste. Dogs are to be leashed. RENTALS AND/ OR SALES: There is paperwork required in accordance with the Bylaws. The association must be notified in writing of any impending sale or lease of your unit. This is done

15 through the APPLICATION PROCESS. Applications are required for both sales and rentals. There is a $ Application Fee. In addition, a personal interview is conducted with each purchaser or tenant. All Paperwork and interviews must be completed before a sale closes or a tenant moves in. Application Process can take up to two (2) weeks. Forms and additional information are available through Realtime Property Management. TRUCKS: Pickup trucks and commercial vehicles, trailers, and campers are not permitted on the property over night without PRIOR WRITTEN CONSENT from the board. Temporary parking passes are available through Realtime Property Management. HURRICANES: Hurricane Season is June 1 through November 30. A Hurricane Watch means a hurricane may threaten an area. It is very important to listen to the news and the hurricane warnings and do as advised. If you are told to evacuate, please do so as soon as you can. Life is more important than property. Please be aware that if for some reason you decide to stay, you do so at your own risk and with the full knowledge that emergency assistance may not be available to your during and most likely, for several days after the hurricane has passed. If you are not a year-round resident, you should have a caretaker who will be responsible for making sure that your home is secured. With the approach of a hurricane it is the property managers and the maintenance team s responsibility to protect the common elements. It is your responsibility to protect your own home and personal belongings. When a warning is issued: Remove all objects from your walkway, porches, and patio area. Close and firmly lock all sliding glass doors and windows. Close all blinds to avoid shattering glass. Place towels at the bottom of all sliding glass doors and window sills to limit any water intrusion. Make sure you turn off all A/C and electrical items so as to protect them from a power surge. Fill your bathtub with water for drinking in case the domestic water supply is interrupted or becomes contaminated. This water can also be used to flush toilets. Stock up on daily necessities such as bottled water, first aid kit, can opener, batteries, blankets, baby food, non-perishable foods etc. Fill your cars with gasoline once a watch has been issued. Visit for more information. During a hurricane: Continue to listen to the radio and follow instructions.

16 Stay indoors. In case of electrical outages, use battery powered lights instead of candles or lanterns. Use telephone only in emergency. Conserve refrigeration, open door to refrigeration as little as possible. Do NOT crack any windows or doors. After a hurricane: Walk or drive cautiously Beware of outdoor hazards such as downed power lines, washed out roads, etc. Conserve refrigeration. Do not use water until authorities have declared it is safe to do so. Take extra precautions against fire. Notify your insurance company in the event of a loss. FIRE: In case of a fire call 911, Pull handle down on Red Fire Box located outside between kitchen windows, Leave the building if your fire alarm goes off (high pitch noise), * If alarm goes off (no fire) false alarm: Call Realtime Property Management * The overriding principle in the whole condominium concept is the promotion of the health, happiness and peace of mind of the majority of unit owners. In accomplishing this goal, there will be some compromise of individual rights. It is the association and the Board of Directors which continually face the responsibility of maintaining the delicate balance between individual rights of unit owners. Please remember that YOU are the ASSOCIATION and you share equally in assisting your Board of Directors in this endeavor. IF YOU ARE AN OWNER WHO LEASES YOUR UNIT, PLEASE MAKE SURE YOUR TENANT RECEIVES THIS INFORMATION AS IT APPLIES TO THEM ALSO.
