3 COMMISSION ON COMMON OWNERSHIP COMMUNITIES Created Purpose - Membership - Financial Disclosure - Terms - Meetings - Montgomery County Code, Section 10B-3. Amended by Bill 42-09, effective 7/12/10, modifying membership. Amended by Bill 50-15, effective 7/13/16, making mandatory attempted dispute resolution by informal negotiation; requiring training of Commission members, transferring assigned duties from the Office of Consumer Protection (OCP) to the Dept. of Housing and Community Affairs (DHCA), and eliminating the OCP ex officio position. To advise the County Executive and the County Council on ways to handle common ownership of property in communities; promote public awareness of the rights and obligations of living in common ownership communities to maintain property values and quality of life; conducts administrative hearings on disputes not resolved through the Office of Consumer Protection. Fifteen voting members consisting of eight unit or lot owners or residents of self- and professionally managed condominiums, cooperative housing corporations and homeowners' associations; and may include members or former members of governing boards; and seven professionals associated with common ownership communities (such as persons involved in housing development and real estate sales and attorneys who represent community associations, developers, housing management or tenants), and including at least one person who is a professional community association manager. There are five ex-officio non-voting members from the following agencies: County Council, Planning Board, Department of Environmental Protection, Departrrient of Permitting Services, Department of Transportation and the Department of Housing and Community Affairs. Annual public disclosure is required. Three-year terms; no compensation. First Wednesday ofeach month. There are also monthly committee meetings. Applicants for vacant professional positions who submitted applications in response to recent vacancy notices need not reapply; applications are pending and will be considered. The Commission currently has 15 voting members consisting of unit or lot owners or residents and professionals associated with self- and professionally managed common ownership communities. The Commission advises the County Executive and County Council regarding public policy issues that impact common ownership communities, provides education and resource information, and promotes public awareness of the rights and obligations necessary to maintain property values and quality oflife in common ownership communities. The commission offers dispute resolution through mediation and conducts administrative hearings if mediation is not successful. Members serve three-year terms without compensation, but are eligible for reimbursement for travel and dependent care for meetings attended. Meetings are held the first Wednesday evening of each month. There are also monthly committee meetings and hearings. Members are required to file a public financial disclosure statement within 15 days of Council confirmation and each annual period thereafter. Applicants of diverse backgrounds, professions, gender, geography, disability and ethnicity are encouraged to apply. Members of County boards, committees and commissions may not serve on more than one such group at a time. Members must complete training on the Maryland Open Meetings Act and basic parliamentary procedure. Leggett's appointments are subject to confirmation by the County Council.
