10 BOARD OF TRUSTEES BUTLER COUNTY,OHIO PROCLAMATION WHEREAS, the Liberty Township Board of Trustees wish to express our appreciation to Captain Jim Limerick and honor him for his distinguished 25-year career with Liberty Township and dedicated service to the community; and WHEREAS, Jim began his career with the Liberty Township Fire Department on February 21, 1993 as a volunteer firefighter and was promoted to a Career Firefighter/Paramedic in September of 2001; and WHEREAS, Jim focused his career on helping not only the residents of the community, but he invested himself wholly into the members of this department. He was instrumental in shaping the department s EMS program and leading it to be one of the premier organizations in the region. Through Jim s dedication and perseverance, he was promoted to the rank of Captain in 2007; WHEREAS, these years of service have been marked by exemplary dedication in the best interests of the community, and for the betterment of the Liberty Township Fire Department, which contributes to the health, safety and comfort of this community; NOW, THEREFORE BE IT RESOLVED, that the Liberty Township Board of Trustees wish to express our sincere appreciation to Captain Jim Limerick for his loyalty to Liberty Township and wish him success, happiness, prosperity, and good health in his future endeavors. Since time of Preliminary PUD Plan approval, the applicant worked with Duke Energy regarding the extension of 30 utility easement from the Cedarbrook subdivision to the north, for the extension of an existing gas main, which would route along the west boundary of the proposed Fieldstone Farms development. It was determined by Duke Energy that the easement area through the Fieldstone Farms development needs to be 50 in width, and that no trees or other deep-rooted plantings are permitted in the easement area. Duke Energy stated that ornamental grasses and shrubs which do not grow over 4.0 in height are permissible in the easement area. Based upon this, the applicant is proposing a setback between the proposed multi-family buildings and the western boundary line of the PUD, which will be within a defined Duke Energy Utility Easement, with a 0 3 tall mound, 172 shrubs (which includes a combination of Snow Queen Oakleaf Hydrangas, Alleghany Vibumums, Sea Green Junipers, and Rotstrahlbusch Switch Grass ) and 8 trees provided. The applicant shall provide Liberty Township a copy of the recorded utility easement, which shall include language regarding the landscape requirements. This buffer, and the buffer along the northern boundary of proposed Section Two and Section Three shall be installed prior to construction of any structure within these sections to ensure maximum buffering between the proposed multi-family uses and adjacent single-family uses to the west. The applicant may work with adjacent property owners to the west regarding a potential landscape easement which would allow the applicant to install the required 1 tree per 20 lineal feet (minimum of 50% evergreens) in order to satisfy the minimum planting requirements of the typical Buffer C.

82 3. The applicant indicated a Buffer C on the interior of the site between the proposed multi-family residential and the proposed single-family residential (north of Section Two and Section Three). This buffer shall incorporate 4 mounding mound, which is the requirement of the Buffer C outlined in the Liberty Township Zoning Resolution. 4. Access for Lots 5 7 shall be restricted to Caitlyn Rose Lane. At no time shall these lots have direct access to Millikin Road. 5. If any entry feature fence or landscaping that is to be installed along the south property line of Lots 5 7 (along the Millikin Road frontage), that is outside of the public right of way, it shall be within a recorded landscape easement. All entry features, including the proposed Main Entrance Monument shall obtain a Zoning Certificate prior to installation. 6. Where the proposed 8 Asphalt Trail meanders into designated open space, and outside of the public right-of-way, a Public Use Access Easement shall be recorded and/or indicated on the Plat. 7.
