1 Mr. Seemann called the regular scheduled Bristol Township Trustee meeting to order on Tuesday, September 5, 2017, at 7:00 PM in the administration building with the following Trustees present and answering roll call: Mr. Seemann, present Mr. French, absent Mr. Webb, present Mr. Webb moved to approve the minutes of August 22, Mr. Seemann seconded the motion. # Mr. Webb, yes Guests James Williams, Charles Wargo, Elaine Mastromatteo, Steve Craiger, Matt Lynn, Chuck McMonagle, Carolyn Marino, Ron Mahan, Julie Sloan, Steve Papalas all observing. Art Groves was inquiring about the zoning ordinances concerning living in a camper on his property due to a recent house fire. Trustees gave him the name of a certified license electrician, and the name of the head of building at the Trumbull County Engineers Office. Mr. Webb moved to hold a workshop with zoning to address Mr. Groves concerns, on September 19, 2017, at 6:00 PM, one hour before the next scheduled Township Trustee Meeting, in the administration building. Mr. Seemann seconded the motion. # Mr. Webb, yes Ken Weeks Zoning Commission Chair announced a Public Hearing to discuss side yard clearance, to be held on Wednesday, at 6:45 with the regular meeting at 7:00 PM on September 13, 2017, in the administration building. Ellen Gordon Zoning Inspector reported the Southeast section of Bristol will be canvassed next week and 8 zoning certificates were issued in August. Fire Chief Tom Dempsey reports: ï M17-1 needs PM work done ï M17-1 needs rear tires, costing approximately $ ï ï Old Business Work has been completed on the Geo-Thermal pump at the Fire Station by Best Furnace. 400 Alarms to date Trustee Webb reported that he will continue to pursue the INFRA grant for roads. The back of the Chapel at Evergreen Cemetery was sprayed for the removal of the green

2 coloring due to being in an area of not much sun. Mr. Webb also reported that Gary Shaffer from the Engineers office believes the Berming on Fenton Road will be done around the first week of October. Trustee Seemann reported that an update has been supplied for the Pontem software that the cemetery deeds, and plots are recorded with, at no cost to the Township. New Business Trustee Webb gave an update concerning the new ambulance. A quote for an AEV Ambulance was provided by Ron Mahan that was about $9, cheaper than the Braun Ambulance that had been approved at the last meeting. Trustee Webb contacted the AEV dealer in Toledo via through their website and received no response on whether a vehicle was available for viewing or if the quote aligned with the Braun unit. Some contact from AEV had been made with Chief Dempsey but AEV did not provide Trustee Webb with any information to consider an AEV unit. Penn Care was also asked to provide Trustee Webb with a viewing and they brought the ambulance out the next day. Trustee Webb reported that he reviewed the unit and took a test drive in the back. Having some EMT experience he felt the ride quality was excellent and saw no reason to change course on the motion to purchase. He further explained that he valued the relationship with Penn Care and felt any issues would be better addressed by a current local vendor than a vendor that was only present during a vehicle sale. Mr. Webb moved to continue the paperwork to finance with Middlefield Bank a New Demo E450 Braun Chief XL type 3 Ambulance at 2.87% interest for a period of (5) five years per ORC Mr. Seemann seconded the motion. # Mr. Webb, yes Mr. Webb moved to pay all outstanding invoices and approve all warrants issued. Webb, Trustee ATTEST: Ida Dolly Mansfield, Fiscal Officer From: Mark Webb Date: Sat, Aug 26, 2017 at 8:20 PM Subject: Bristol Township Ambulance Purchase To: John, one of our residents, Ron Mahan, has provided me with specifications that he says are an apples to apples comparison of AEV ambulance and a demo ambulance from Braun that we have approved for purchase. As your bid is a shade cheaper we may still have time to change direction if we are comfortable that your unit would be a better option. One of the main questions I have is whether the quote provided is for a built unit or one that would need to be constructed and what the mileage is. If this is a built unit we would really value a viewing. Either we I may need to get you in touch with our fire chief to discuss the comparison of the units. Please let me know if this is a vehicle that is currently available to be seen and any other information that may help us understand whether we should consider an AEV purchase. -- Thanks, Mark Webb, Bristol Township Trustee Fiscal Officer Mansfield, It was a pleasure speaking to you yesterday afternoon relative to the captioned matter. As I indicated during our telephone conversation, it is my preference that Bristol Township s ambulance loan with Middlefield Bank be secured by a promissory note that is similar to the promissory note that I previously prepared for Bristol Township s prior vehicle loan. Of course, if Middlefield

4 Bank insists on using its own promissory note, I am available to review the same if the Board of Trustees and you would like me to do so. Further, I trust that Bristol Township will adopt an appropriate note resolution, obtain the required certification from the Trumbull County Auditor, and complete all other necessary paperwork, as it did with respect to its prior vehicle loan, before executing a promissory note in favor of Middlefield Bank. As you indicated that Bristol Township is seeking a seven (7) year loan with Middlefield Bank to purchase an ambulance, after our discussion yesterday afternoon, I again reviewed R.C (A) which authorizes townships to secure loans for the purpose of purchasing equipment, including motor vehicles. R.C (A) provides, in pertinent part, that the maximum maturity of loans secured under R.C is subject to the limitations in section of the Revised Code. R.C (B)(7)(b) provides that a loan for the purchase of [f]ire department apparatus and equipment may not exceed ten (10) years. However, R.C (B)(8) provides that a loan for the purchase of [n]ew motor vehicles other than those described in any other division of this section and those for which provision is made in other provisions of the Revised Code may not exceed five (5) years. Although neither R.C nor any other section of Chapter 133 of the Ohio Revised Code defines fire department apparatus and equipment, or otherwise answers whether an ambulance may be included within the same, R.C (I), which pertains to tax levies for fire and ems purposes, distinguishes an ambulance and related equipment from fire department apparatus and equipment. Accordingly, based on the foregoing, it is my opinion that Bristol Township s ambulance loan cannot exceed a maturity of five (5) years, since neither R.C nor any other section of the Ohio Revised Code provides otherwise.
