THE BANKRUPTCY COURT SHALL HAVE EXCLUSIVE JURISDICTION OVER ALL DISPUTES AND OTHER MATTERS RELATING TO THE AUCTION AND/OR THE ASSETS TO BE SOLD, AND BUYER EXPRESSLY CONSENTS TO AND AGREES NOT TO CONTEST SUCH EXCLUSIVE JURISDICTION. 2. The seller reserves the right to sell or remove any or all assets before the auction date. Please contact the auctioneer to be placed on the info distribution list. 3. All purchased property must be removed no later than July 31, Check-out will start on Thursday July 12, All announcements made the day of the auction, take precedence over previous announcements, advertisements, and distributed information. 5. In the event of a dispute among bidders, the Auctioneer shall make the sole and final decision to either accept the final bid or re-offer the item(s) in dispute. 6. A 25% deposit is required upon successful bid award. Full payment is due with-in 24 hours following the date of the purchase. Only cash, cashier s check, traveler s check made payable to BL Enterprises will be accepted.company checks will be accepted with a bank letter of guarantee. 7 Applicable sales tax (8%) will be added to the price. Dealers purchasing equipment for resale must file their resale permit number to avoid sales tax being added to their purchases. 8. All equipment is sold As-Is, Where-Is with no warranties whatsoever. While descriptions are believed to be accurate, the auctioneer and seller make no warranties or guarantees as to authenticity, merchantability, correctness of description, fitness or condition of the items being auctioned and will not be held responsible for any advertising discrepancies or inaccuracies. 9. All bidders are advised to carefully inspect each item prior to purchasing. The bidder is responsible for knowing which items he or she is bidding on. When they become a successful bidder they have created a binding contract and will be expected to comply with the terms and conditions of the sale. In the event, the bidder does not comply with any of the terms and conditions of the sale, in addition to other remedies available to the seller and auctioneer, including without limitation, the right to hold the purchaser liable for the bid price, the auctioneer at his option may (1) resell the property publicly or privately, with the purchaser being liable for the deficiency plus all costs incurred, or (2) cancel the sale, retain and/or recover the deposit specified as liquidated damages. 10. All purchases must be paid in full prior to removal. Checkout times will be announced at the time of sale. The removal and shipment of the items is the buyer s responsibility. Failure to remove the items with-in the specified removal period will result in the item(s) being deemed abandoned. The auctioneer at their sole discretion may resell per (8) above, or remove and store the lot at purchaser s sole risk and expense. Purchaser shall be liable for any rent incurred or damages suffered by auctioneer because of purchaser s failure to remove any lot. 11. It is the buyer s responsibility to safely secure the purchased items to meet all applicable government safety standards in using, selling and transporting items purchased. Certain pieces of this equipment may contain residual chemicals. The purchasers hereby indemnify and hold harmless the auctioneers and seller from any and all damages or liabilities from any injuries to persons or property of any type whatsoever caused during the sale, or during the removal of the items purchased. 12.
