Approve/Amend July 24, 2018 Planning & Zoning Meeting Minutes Motion by Alders to approve; 2 nd by Pearo; Motion Carried. 1. FLOOR ITEMS Ames said that Harvey Greenberg passed away several weeks ago, and he was the 1 st PZ member, served on ER School board. Did many things for Burns Township. Jorgensen said that for many years Harvey cut the grass and paid for that to be done. Ames called for a moment of silence in memory of Harvey Greenberg. 2. PUBLIC HEARING A PRELIMINARY PLAT by Mark and Michelle Poce for property owned at Burns Parkway NW, to plat 44.8 acres into four (4) residential lots. (PID# , , ). Planner Stockman presented the preliminary plat of Wood Duck Ponds Subdivision with 3 new lots along Burns Parkway, and the back acreage to be added to the Poce parcel. There a few changes from the original idea to incorporate recommendations by Planner and Engineer. Discussed Park & Trail plan/opportunity, ROW width Engineer recommended not needing the extra 20 ft.; Poce is dedicating 75 ft. from center of road for road and trail ROW. Need to document that City does or does not want the trail at this time TPC recommends approval subject to the Engineer s review and the Findings of Fact. Applicant had no comments. Mailings and postings completed. No public Comments. PZ Comments Wagner asked about driveway adjustments/lot lines & 300 ft. at building setback line. County has not responded with driveway placement yet; Poce will be submitting final plat before a permit application can be submitted, and it will show proper lot width. PUBLIC HEARING CLOSED PZ Decision: Stockman advised PZ to make sure motion includes plan for Park & Trail dedication.

3 City of Nowthen Planning & Zoning Commission August 28, 2018 Page 2 Alders made a motion to approve subdivision per the revised Planner s layout that meets the minimum lot size, Engineers recommendations, Findings of Fact, with 75 ft. ROW that could be used for further trail development. Pearo 2 nd. All in favor. Motion carried. 3. PUBLIC HEARING A REQUEST by DeKok Management LLC for approval of an Interim Use Permit to allow a 10,875 square foot outdoor storage area on the Sparkle Pool property. The property is located at Iguana Street NW (PID# ). Planner Stockman presented Background for the IUP and discussed the following: Fence partially in drainage easement & will need encroachment agreement; need indoor space for storage of products/next year s stock items; need outside storage for equipment items listed in Findings. Willing to add slats to fence for privacy, hoping for approval for every other slat section. Findings of Fact - 60X140 storage area surfaced with Class 5 gravel, w/limited items stored as listed. Asking for PZ approval of screening, landscaping, etc. Applicant not present for Comments. Postings & mailings completed. No Public Comments. PZ Discussion: Drainage pond accessible for City maintenance; Easement agreement drafted Engineer has approved fence location & encroachment agreement Any additional screening/landscaping needed? Alders thinks the front should be fully screened to provide a clean appearance for vehicles passing, including the gate and the two 10 sections which are visible from the front. Better from a security standpoint as well. Additional trees have never been required in the past. Gravel area is smaller than total fenced area. Changing wording in Findings to be less specific about vehicle description & items stored, and allow him room to grow. Limit to items used for the business, no private vehicles or semi-tractor/trailers. Include PU or box trucks. PUBLIC HEARING CLOSED PZ Decision: PZ agreed on Business equipment limitation for storage; full slats on gate & two 10 sides; Planner will incorporate all items discussed in revised Findings. Pearo made the motion to approve IUP subject to the limitations PZ discussed and Findings of Fact; Jorgensen 2 nd. All in favor. Motion carried. 4. PUBLIC HEARING A REQUEST by J. Helgeson LLC, building owner, for approval of an Interim Use Permit to allow outdoor storage of materials and equipment for the three current tenants located at th Avenue NW: Jackelyn & Sandor Pratt, North Forty Design LLC; Marlin Hager, Creative Earthscapes; and Daine Randall, MN Heartwood LLC (PID# ). Planner Stockman presented the background and recommendations for IUP. Discussed:

4 City of Nowthen Planning & Zoning Commission August 28, 2018 Page 3 Three tenants and their businesses Kiln drying of wood Wood working operations Landscape contractor 2 driveways onto 199 th Ave. Typically don t use the driveway closest to City Offices. Truly only approving IUP for MN Heartwood LLC & Creative Earthscapes for outdoor storage. North Forty Design has no need for outdoor storage. Applicant had no comments. Publications and mailings posted. No Public Comments PZ Discussion: 1 permit issued to landowners, joint application with individual conditions. Applicant is proposing fabric along fence line all the way around for screening. Noise factor with saw mill. Industrial zone is acceptable place for this noise. Fabric screening cost prohibitive for slats along entire fence; fabric screening has 85% visibility blockage versus 65% for slats, perforated for wind. Logs are only stored along a fraction of the fence area (about 1/5 of the fence along the east side. Applicant desires screen for privacy factor. South side of building facing the Nowthen Memorial Park, is actually visibly appealing as it stands; less industrial and more park-like. Add stub fence to hide log storage area and parking area for vehicles/trailers. Slats are required around the semi-enclosed log storage area, north to the entrance gate and west along 199 th Ave to the property corner. All other screening is optional. Applicant offers scraps for residents to burn; commended applicant for reuse choices. No public comments PZ Decision & Discussion of Findings of Fact: Deciduous trees on north side exist; East side of building quiet during off season months; MN Heartwood operates all year long. Limit scrap wood to one dump truck load; add stub fences on sides of log storage area with slats in chain link around log storage; 3 portable saw mills; slats on north side facing 199 th Ave; Parking limited to paved or gravel areas; Alders made the motion to accept the IUP with the Findings of Fact changes discussed above. Jorgensen 2 nd ; All in favor; Motion carried. 5. CONCEPTUAL SUBDIVISION PLAN A REQUEST by Gary Leistico on behalf of the Orval and Joanne Leistico Estate to resubdivide the property for distribution to family members and for sale of certain portions of the property outside of the family (PID# , , , , , , , , , , , , ). Planner Stockman presented the background and recommendations for subdivision concept. Split off old farmstead; Engineer recommends platting a new road providing access to future lots; splitting 65 acres somewhat evenly between Dennis and Gene, on east

5 City of Nowthen Planning & Zoning Commission August 28, 2018 Page 4 side of Nowthen Blvd. Only subdivision under discussion is on east side of Nowthen Blvd. Applicant is willing to plat to achieve the 2.5 acre lot size for the farmstead lot; large parcels could be re-platted later. Proposed shared driveway would be the site of the proposed road for any future subdivision. Applicant is asking for one additional home site near pond. No flag lot needed; plenty of frontages along road and proposed platted road. PZ members said it all seemed reasonable. Pearo asked to hear from landowners. They understand the platting process. Just wanted to make sure it is reasonable. Leistico commended Planner Stockman for her excellent work. They have plans to get started with surveying and delineation yet before winter. Jorgensen made a motion to move this forward to the City Council. Ames 2 nd. All in favor. Motion carried. 6. CONCEPTUAL SUBDIVISION & DEVELOPMENT PLAN A REQUEST by Josh Peterson and Michael and Lani Hollenbeck for property owned at 8335 Viking Boulevard to split 4.4 acres from the acre Hollenbeck property (PID# ) and combine it with the 1.6 acre Anoka County parcel at 8359 Viking Blvd (PID# ) for industrial development of a storage facility. Planner Stockman presented the background and subdivision concept plan. Wetlands issues; Screening requirement along residential land to west; Todd, from Bogart Peterson, brought pictures and visuals to depict natural barriers, and explained them to the Commission, and Josh Peterson explained the sketch of the buildings layout and Ordinance concerns. Stockman said it would be beneficial for Peterson to purchase the Anoka County piece to eliminate the flag lot situation, and allow other options for future small uses. Todd said this is one of those situations where the national wetlands maps differ significantly from what is actually out there. Planning to remove the culvert and obstruction from existing driveway not in use on Anoka County property. Peterson is asking if PZ think it is reasonable to pursue this concept. Land purchase is under contract, so Peterson controls it. Just wanting input to determine if it is worth investing more into development. City Engineer and County do not want street access onto Viking in this location; new road would be farther west; driveway access exists.. In support of the concept: 5-0. Unanimous.
