4 CIVIL ENGINEERING PLANNING SURVEYING Town of Lisbon Plan Commission Meeting November 3, 2016 Engineering and Planning Comments Old Business: Item No. 3 - Discussion and necessary action on minutes of the Plan Commission Meeting of October 6, 2016 Recommend approval of Meeting minutes as submitted. New Business: Item No. 4A - Discussion and necessary action on the Site Plan and Plan of Operation for Darin Marquardt, d/b/a Performance Off-Road, a vehicle accessories shop, located at N69W25055 Indian Grass Lane, Suite N, Sussex, WI 53089, LSBT The proposed business is located in a multi-tenant building located at the southwest corner of Indian Grass Lane and STH 164. Site is Zoned M-2 General Industrial District. 2. The following comments relating to the Plan of Operation are offered for consideration: Provide response to line item 32. Provide response to line item 33 providing general list of materials to be sold. 3. Will operation generate normal automobile fluids? If so will they be recycled? 4. Line Item No. 15, is applicant sure there will be no weekend hours? Now is the time to designate these hours. 5. Recommend approval based on submitted Plan of Operation. Item No. 4B - Discussion and necessary action on the Conditional Use request for Sandra G. Knutsen, W278N9252 Sweetbriar Lane, Hartland, WI 53029, LSBT , to operate a Limited Family Business in a detached garage crafting dental appliances 1. This item was subject to a Public Hearing relative to a request for a Conditional Use permit prior to tonight s Plan Commission meeting. 2. The property is Zoned R-1 Residential. The R-1 District requires a lot area of 1.0 acres and 150 feet of average width. The parcel in question exceeds these regulations. 3. This property was subject to a Public Hearing held tonight to discuss the issuance of a Conditional Use permit for the operation of Limited Family Business. 4. The requirements for the operation of a Limited Family Business are found on Page 100 of the Zoning Code and are enumerated below. Application requirements. In all cases, the following requirements shall be met in order to grant a conditional use. An applicant may apply for a LFB/SOB if all of the following are true: i. The property is located in the A-10, A-5, A-3, R-1 or R-2 zoning district. ii. The main portion of the business is run by members of the family residing on the premises, who is also the owner of the business. iii. The business does not employ more than one (1) person who is not a resident on such lot, whether they are family members or not. Line item 35 how is hazardous chemicals addressed, do they require special disposal? Item No. 4C - Discussion on the Conceptual Review for James Schumacher, N47W27143 Greenhill Drive, Pewaukee, WI 53072, to operate a landscaping business, Landscape Master, LLC at N79W24681 Plainview Road, Lisbon, WI 53089, LSBT Property in question is Zoned A-5 Mini-Farm. Presently the property is occupied by a barn and evergreens. 2. Per page 100 of the Zoning Code Limited Family Businesses are allowed in the A-5 District. 3. The following incomplete line items need a response: Item 11, specify types of vehicles to be stored outside. Line item 17 needs a response. 4. This party participated in a Pre-consultation meeting with Town Clerk/Administrator and Town Planning Consultant. Issues derived from that meeting were; number of equipment that would be stored outside, number of employees on site, if this were to be considered as Limited Family Business, there is no primary residence on the site at this time. Applicant indicated a residence would be constructed but had no firm timeline. 5. Neighboring lots/parcels are all single family residential uses. 6. Operation does not meet the criteria for a Limited Family Business per Zoning Code pages

6 3 P age Town of Lisbon November 3, 2016 Item No. 4D - Discussion and necessary action on the Sign request for Jeff Fillinger, for Mary s Custom Storage, W275N6725 Lake Five Road, Hartland, WI 53089, LSBT Mary s Custom Storage is located west of Lake Five Road, South of CTH VV and North of CTH MD. 2. Property is presently Zoned B-2 Local Business. Presently a storage facility is being erected on the site. 3. Proposed sign is 32 square feet of sign face area. Per the Town s Sign Code Regulations, a sign face of 60 square feet is allowed. Therefore, the sign meets the area restrictions. 4. Signs may not be closer than 10 feet to a right-of-way line. Exhibit submitted with sign indicates compliance with this requirement. 5. Per Page 14, Standards of the Sign Code, the sign base area shall be landscaped for a minimum of 5 feet in all directions. 6. If the sign is to be illuminated, an electrical permit will be required. 7. Recommend approval subject to above comments and Plan Commission comments. Item No. 4E - Discussion and necessary action on the Conditional Use request for John Greilinger, N91W25390 Tomahawk Drive, Sussex, WI 53089, LSBT , to operate a Limited Family Business in a garage designing plastic injection molds and grinding core pins 1. The property was subject of a Public Hearing relative to the issuance of a Conditional Use Permit for a Limited Family Business on this property. 2. Consider comments presented at tonight s Public Hearing. 3. The property is presently Zoned R-1 Single Family Residential District. Said district requires one acre lot at 150 feet minimum average width. The parcel is approximately 2.6 acres in size. 4. A review of the Waukesha County GIS Mapping shows that there is mature evergreens along the east and west property lines to a point at the rear of the applicants accessory structure. 5. The following requirements for affirming a Limited Family Business are found on page 100 of the Zoning Code. The applicant should meet all of the requirements stated herein: Application requirements. The following comments are offered relative to the Plan of Operation. Line item 9, what level is machining taking place? Line item 16, please provide approximate driveway dimensions to accessory structure. Line item 17, outdoor lighting is this a typical lighting for a residential neighborhood? Please explain line item 36. How is this material disposed of? Is this material flammable? Does this operation cause any problems with normal household computers or televisions? 8 TOWN OF LISBON PLAN COMMISSION MEETING OCTOBER 6, 2016 Chairman Osterman called to order the Plan Commission meeting at 6:32 P.M. Members Present: Also Present: Chairman Joseph Osterman, Chad Samanske, Jane Stadler, Mark Meyer, Ed Nelson, Bryan Oelhafen. Planning Consultant John Stigler, Supervisor Ryan Lippert, Clerk/Administrator Matt Janecke and Deputy Clerk Gina Gresch. COMMENTS FROM CITIZENS PRESENT None. APPROVAL OF MINUTES Motion by Nelson, seconded by Samanske, to approve the minutes of the Plan Commission Meeting and Public Hearing of August 10, 2016 and Town Board & Plan Commission Meeting of September 1, NEW BUSINESS Discussion and necessary action on the Certified Survey Map for Nicki Saxon, for the Skodras property at N88W22418 North Lisbon Road. The petitioners, Mr. & Mrs. Saxon were present. Planning Consultant/Engineer John Stigler read his comments into the record: 1. The property is presently vacant except for possible horse fencing. 2. The property is presently Zoned AD-10 based on the parent parcel size at the time the Town s Zoning Code was developed. 3. The lands are designated as Rural Density Residential with a 5 acre density factor, with lots allowed as small as one (1) acre and 150 feet. 4. The Town s Adopted Land Use Plan designates this area as future RD-5 (Rural Density Agricultural and Other Open Lands). This District requires an overall density of 1 unit per 5 acres and lots at a minimum of 150 feet of average lot width and one acre in area. The proposed CSM (Certified Survey Map) meets this requirement. 5. Per Section 7.06 Lots, of the Town of Lisbon Development Ordinance, Lots are in general not to exceed a 2.5 (depth) to 1.0 (width) ratio. The lot proposed on this CSM is at a ratio of 3.61 to 1 and therefore does not meet this guideline. 6. The following technical items need to be addressed: a. The bearing stated along the east property line on the face of the CSM does not agree with the bearing used in the legal description. b. In the Legend, the symbol for the section corner monuments is missing from the map face. 7. The applicant will need to go through a rezoning to the RD-5 District per the Town s Adopted Land Use Map prior to grant of final CSM approval. 8. Recommend preliminary approval subject to rezoning. Planning Consultant/Engineer Stigler stated he would like to trim the ratio back. Mrs. Saxon stated she doesn t want to do that because of the existing fencing; she doesn t want to move it so her parents can use it as a horse pasture. Also, the survey was drawn up this way so that their house is even with the neighbor s house to the east so it is more aesthetically pleasing. Commission Stadler stated she is concerned about the Fire Department s ability to turn around equipment in the event of an emergency, especially since the trucks are about 35 feet long. Plan Commission members discussed the driveway length and point of access which would be off of Lisbon Road. Planning Consultant/Engineer Stigler stated a condition of approval can be added to the motion to require a circular drive to address fire equipment concern.

9 Plan Commission Minutes October 6, Page 2 Plan Commission members discussed the lot ratio, reducing it and how that would affect the soil borings and septic field. Mr. Saxon stated the property would probably utilize a mound system. Plan Commission members did not have any issues with the lot ratio. Planning Consultant/Engineer Stigler stated the property is currently zoned AD-10 which this proposal doesn t meet the requirements for and therefore requires a rezone to RD-5, which needs to be approved by the Town and Waukesha County. Motion by Nelson, seconded by Oelhafen to preliminarily approve the Certified Survey Map for Nicki Saxon, for the Skodras property at N88W22418 North Lisbon Road, subject to all eight of the Engineer/Planner s comments, paying particular attention to items 4a, 5, 6, and 7, also subject to adding a circular driveway for fire access and receiving rezoning approvals from Waukesha County and the Town of Lisbon. Motion carried. Discussion and necessary action on a Plan of Operation for J&C Real Estate, at N70W25156 Indian Grass Lane, Unit C for temporary storage. Mr. Tomasini was present. Planning Consultant/Engineer Stigler stated this was added to the agenda yesterday. The petitioner is requesting approval to use the space as a temporary storage facility. The only outdoor use would be for the two 31 foot long trailers which would be stored at the east end of the property next to other existing trucks and materials. Plan Commission members asked questions about missing information from the Plan of Operation form which included outside usage and hours of operation. Mr. Tomasini stated this is strictly a storage operation so there are no actual hours because he isn t sure when he will be coming and going. He would only be there limited times when he is adding or removing items in the unit. He is using the space as a way to consolidate the several storage areas he has. He owns several businesses and has accumulated equipment he doesn t want to dispose of yet. Items include restaurant items, equipment, appliances, backup materials for offices like carpeting, ceiling tiles, light figures, etc. He and his wife are also moving from larger to smaller home so instead of getting rid of things before they know what will fit in new home, they want to store those items as well. Commissioner Stadler asked for more information about the two trailers. Mr. Tomasini stated those are his son s trailers which will be stored at the east end of the property next to those items which are already present. There will not be any combustible items being stored. Commissioner Stadler stated there is a two week application deadline so that the Plan Commission members have enough time to review the information. She doesn t have an issue with approving this application but isn t happy having to make a decision with short notice. Chairman Osterman stated the application timing was an error on the Town s part and he apologized to everyone for getting the information to them so late. Plan Commission members discussed the term temporary as it relates to how long he will be needing storage for. The lease is for one year but if he needs more time that is between him and the property owner if he needs another lease. Planning Consultant/Engineer Stigler stated there is no need to put a time limit on the approval. Motion by Nelson, seconded by Samanske to approve the Plan of Operation for J&C Real Estate, at N70W25156 Indian Grass Lane, Unit C for temporary storage, subject to completing the missing information from the Plan of Operation. Motion carried. Discussion and necessary action on Building and Site Plan, Plan of Operation, Lighting Plan, Landscape Plan and signage for Growth Werks LLC, on Parcel # 2 of Quarry Corners Business Park, LSBT The petitioners were present. Names and addresses? Planning Consultant/Engineer John Stigler read his comments into the record: A. Building Comments 1. Applicant should provide turning template for Town Firefighting equipment for all turning movements.

10 Plan Commission Minutes October 6, Page 3 2. On the climate controlled building site plan does not indicate the location of the air conditioning units. If on the roof, screening is required. 3. Applicant should provide building material sample. 4. As discussed with the applicant at the pre-consultation some visual breakup of the west elevation would be beneficial, such as dormers or roof ridge line items. 5. On Sheet C-2, C-4 the building offset to the north property line is missing from the plan. A side yard of 25 feet is required. Also the front yard setback is missing from C Storm water management elements are missing from the application. Water quality must be addressed. B. Plan of Operation 1. The applicant did not submit a Town of Lisbon Plan of Operation. Applicant did file a general narrative of the operation on his letterhead. A completed Plan of Operation is required. C. Lighting Plan 1. Lighting Plan Sheet ES 1.0 indicates that there should be no light spillage beyond the property lines. The Town prohibits light poles over 18 feet in height. D. Landscape Plan 1. See Sheet L-101, Plant sizes are not listed on the Landscape Plan. Hardwoods are required to be 2 BHD at time of installation. Evergreens are required to be minimum of 6 feet in height at time of planting. E. Signage 1. Sign is proposed to be constructed with a stone base approximately 24 high with overall height of 6 feet 4 in height. 2. The sign is classified as a freestanding monument sign. 3. Per the Town Sign Code, sign area is limited to 60 square feet. Proposed sign is calculated at 50.6 square feet, therefore meets the area restriction. 4. Sign must be a minimum of 10 feet from the right-of-way line. Proposed location meets this criteria. 5. Sign base must be landscaped for 5 feet on all sides. 6. Lighted signs require an electric permit from the Building Inspector. 7. Applicant must pay sign permit feet. The petitioner reviewed the site plan with the Plan Commission which is to build an office building and storage facility on the southwest corner of the property. There will be a six foot tall metal fence along Quarry Corners Parkway for security reasons. There is one driveway for a single point of access which will be gated and will require a code to enter and leave. If anyone forgets their code there is a kiosk on site linked to a 24 hour call center with access to a person who will confirm they are the intended user and will give them the code. Cameras will be installed and will be able to read license plates. Plan Commission members discussed the driveway width which the applicant replied there is software they will use to determine that and will check with the Fire Chief too. There is enough room with the internal driveway for snowplowing purposes. The snow will be pushed into the swales which follow the natural flow pattern. The Fire Department will use a Knox Box if they ever need to enter the premise. They also discussed landscaping and confirmed a landscape architect will be used to draw up those plans. Plan Commission members also discussed storm water management. The DNR changed some of these regulations so a comparison needs to be done to see if there are any gaps in requirements to be filled. There is a storm water easement on the east side of the property which is a grass filter strip. The west side as a grass culvert which will filter the sediment. Plan Commission members would like Strand and Associates to review the storm water plans. Plan Commission members discussed the possibility of someone using the storage facility for something they aren t supposed to, such as storing illegal items or living in it. The petitioner stated there will be onsite staff that will monitor all activity but aren t sure how you could screen what it is people are storing.

11 Plan Commission Minutes October 6, Page 4 The petitioner reviewed the exterior building materials which will be a green, vertical hardy plank siding with stone at the base, a stone sill and hardy plank trim. They chose stone because they had to adhere to the Village of Sussex s regulations. The hardy plank siding has a 25 year warranty. The air conditioning unit will be on the side of the building. They could put it on the rooftop and would screen it, but the units are back far enough that they cannot be seen from the street. Planning Consultant/Engineer Stigler asked if a holding tank or mound system would be utilized and that the town prefers a mound system. The petitioner hasn t reviewed that yet but also prefers a mound system. The office elevation looks good and includes windows to break up the garage doors. Architectural features were added around the entire building and the garage doors are a pre-finished white/off-white. A monument sign is also proposed. Planning Consultant/Engineer Stigler stated the two biggest issues to follow up on are the storm water plans and final landscaping plans. The petitioner stated the project is proposed to be completed in two phases. Phase two will start once phase one reached 70% leasing capacity so it is difficult to give an exact timeline. Plan Commission members discussed the area where phase two will be and if it will be greenspace or graveled until it is developed. Plan Commission members are concerned about outdoor storage occurring if the area is graveled and would prefer it to be left as greenspace. The petitioner agreed with the Plan Commission and confirmed there is no outdoor storage allowed. The Plan Commission would prefer the petitioner come back to the town three months prior to starting phase two. Motion by Nelson, seconded by Samanske to approve the Building and Site Plan, Plan of Operation, Lighting Plan, Landscape Plan and signage for Growth Werks LLC, on Parcel # 2 of Quarry Corners Business Park, LSBT , subject to all of Stigler s comments listed above, paying particular attention to item A6, relating to storm water management. Motion carried. Discussion and necessary action on Building and Site Plan and amended Plan of Operation for an addition to the existing office/sales building for The Rock Stone and Landscape Supply at W249N6916 ST 164. Planning Consultant/Engineer John Stigler read his comments into the record: 1. Building and Site Plan review comments. 2. Proposed building addition will be located in the southeast area of the present office/showroom. 3. The proposed building addition meets all required setbacks and offsets. 4. The property is presently Zoned M-2 General Industrial and the requested Use is an Allowed Use. Per the Towns Adopted Land Use Plan the property is designated as Industrial. 5. Proposed building height is approximately 25 to 30 feet. Per the M-2 District building height of 50 feet is allowed. Therefore height regulation is compliant. 6. Building materials are to be of similar color and texture as the present building. Please provide detail of building materials. 7. Recommend approval of building addition. 8. Revised Plan of Operations. 9. Please provide answer to Question No. 29a. 10. Provide response to 2 nd question of No. 33. List of Materials requested. 11. No. 39, Fire Dept. should inspect the property when building addition is completed. 12. Recommend approval of building addition and amended Plan of Operation with corrections and additions noted. David Wirtz, The Rock owner was present and stated he used the prior Plan of Operation form to complete this one and whatever information is missing from this application was missing on the old one too. He will work with Planning Consultant/Engineer Stigler on completing that information. Those items include a list of items sold which will be stone and landscape supplies.

12 Plan Commission Minutes October 6, Page 5 Mr. Wirtz stated the addition will be attached to the back of the existing building, will have similar exterior building materials on the north and south side, compared to the existing building. The roof will be copper in color. The expansion is to give the existing employees more room; no additional employees are proposed. Commissioner Nelson stated the current usage is a vast improvement from what was there before. Building Inspector Oelhafen suggested the petitioner speak with the Fire Department about the Uniform Dwelling Code standards as they might needs state approved plans. The petitioner stated those plans for fire suppression equipment is already in the works and will be reviewed by the Fire Chief. Motion by Samanske, seconded by Nelson to approve the Building and Site Plan and amended Plan of Operation for an addition to the existing office/sales building for The Rock Stone and Landscape Supply at W249N6916 ST RD 164, subject to all of Stigler s comments listed above.
