Report 01-50) (Cont'd) That the owner agrees in writing to satisfy all requirements, financial and otherwise, of Norfolk County concerning upgrading, provision and dedication of roads, installation of roads, sidewalks, the installation of municipal water, sanitary sewer services, utilities and storm water drainage, installation of street lighting and payment of capital charges. That the Road Allowances included in the Draft Plan be constructed and dedicated as Public Highways on the final Plan of Subdivision ; and that all dead end streets and open sides of Road Allowances be terminated in 0. metre reserves to be conveyed to and held in trust by the municipality. That the streets contained within the Draft Plan be named to the satisfaction of Norfolk County. That such easements as may be required for utility, drainage and access shall be granted to the appropriate authority in the form approved by the appropriate authority. That the subdivision contain phasing arrangements to the satisfaction of Norfolk County. That the owner acknowledge that the water and sanitary sewage capacity allocated to this project may expire years from the date of this draft plan approval. The allocation shall not expire without previous notice to the owner, and the subsequent opportunity for the owner to make application to the municipality for extension of the allocations. In the event that the owner is able to demonstrate to the municipality that the project is proceeding, the allocations will be extended in increments of two years. The project shall be deemed to be proceeding if vacant fully serviced residential lots or blocks exist on the real estate market (for sale) within a registered plan of subdivision. 8. That the owner convey Blocks A and C and part of Block D to the municipality for park purposes and a Tree Preservation Area.

That the owner agrees to prepare and implement a landscape No. 6 : (Cont'd) plan, prepared by a Registered OALA, including berming, planting and fencing to the satisfaction of Norfolk County (Community Services Dept.) for lands within that portion of the former LE & N Railway right-of-way abutting the subject lands within Block D and E in order to provide buffering between this subdivision and existing properties fronting on Elm Street. 10. That the owner agrees to provide one tree per lot to the satisfaction of Norfolk County. 11. That the proposed lots be certified by an Ontario Land Surveyor to ensure conformity with the provisions and requirements to Zoning By-Law , as amended, or its successor prior to final approval. 12. That lot grading and drainage plans, sediment and erosion control plans and stormwater management plans be prepared to the satisfaction of the Long Point Region Conservation Authority and Norfolk County and that required fencing shall be in accordance with an agreed upon landscape plan as per condition No That adequate fire protection measures be installed to the satisfaction of the Fire Chief for Norfolk County. 14. That the owner agrees that the turning circle(s) contained in the Draft Plan have a minimum radius of 20 metres.

That a 0. m (1 ft) reserve be placed along the east side of Blocks G and 0 and the north side of Blocks E, F, J and K and the south side of Block B and that the reserves be conveyed to Norfolk County. 18. That Block B be conveyed to Norfolk County for a future road allowance. 19. That Parker Drive be constructed to connect with the existing west end of Parker Drive to the satisfaction of Norfolk County. 20. That Block S be conveyed to Norfolk County and that the owner agrees to provide fencing, sidewalks and bollards within the walkway area to the satisfaction of Norfolk County.

That the owner agrees to satisfy the concerns of Union Gas No. 6 : (Cont'd) Ltd. regarding construction over and access to their existing easement through the registration of a restrictive covenant on title which would include among other things restrictions on the type of fence and the requirement for all owners to contact Union Gas for line locations prior to any excavation as well as ensuring that Union Gas will have the right to enter affected lots in order to carry out any necessary inspections, repairs and/or usual maintenance. AMENDMENT 22. That prior to final approval, the approval authority is to be advised in writing by the owner how condition 1 through 21 have been satisfied." Moved by Peter Black Seconded by Charlie Luke THAT Condition 19 be deleted and replaced with the following : "THAT Parker Drive be constructed for emergency use only (including knock down bollards) to connect with the existing west end of Parker Drive to the satisfaction of the General Manager of Public Works and Environmental Services." The original resolution was then put forth and Carried as Amended.
