MORTON COUNTY COMMISSION REGULAR MEETING February, The Morton County Commission Regular Meeting was called to order on February, at 5: PM by Chairman Strinden at the Morton County Courthouse, 210 Second Avenue NW, Mandan, North Dakota. Others present were Commissioners Boehm, Zachmeier, Leingang, Schulz and Auditor Rhone. Boehm moved and Schulz seconded to approve the agenda with an addition. All voting aye, motion carried. Schulz moved and Leingang seconded to approve the minutes of the February 10, meeting. All voting aye, motion carried. Boehm moved and Leingang seconded to approve payment of the bills as submitted. Other than the First Response agency groups (which the Emergency Management Office registered) there are only citizen registrations for the City of Mandan. In order to get the word out, a flyer has been developed for insert to the City of Mandan Water Billing mailing (see flyer attached). City Watch registration links now begin on Morton County s home page. It was also become an issue in dispatch with many city alarm systems not being registered. Not having the alarm registered gets to be a situation in dispatch when the contact/key holder contact information for the alarm is not known (see flyer attached). The City of Mandan sends out approximately 6,650 water bills and this is accomplished through three mailings. Three printers submitted quotes and the lowest was for $ Pre-Sort Plus who performs the mailing, charges one cent per insert. The next mailing is on March 11 th. This is an allowable expenditure of 911 Funds under Operations and Public Educational Materials. Funds from the 911 account cannot be used to influence or sway public opinion. There is currently a balance of: $5,0 in the 911 Fund. 13 Morton County Commission Meeting Commission Packet Communications Center, Communications Center Operations Improvement (Public Safety) MEETING DATE: /10/ PREPARATION DATE: // SUBMITTING DEPARTMENT: Morton/Mandan Combined Communications Center DEPARTMENT DIRECTOR: Tom Doering PRESENTER: Tom Doering SUBJECT: Allocation of Funding STATEMENT/PURPOSE: Request for approval to use Budget Line (Capital Outlay Equipment) for operational improvements in the Morton Communications Center BACKGROUND: The budgeted Capital Outlay for ($5,400) was originally earmarked for purchasing Bulberry Insight s Automatic Vehicle Locator (AVL). It has been determined that the next Computer Aided Dispatch (CAD) system (scheduled for use in to months) would include an AVL. And it wouldn t be fiscally prudent to purchase AVL now. With the advent of Computer Aided Dispatch (CAD) and dispatchers changing over to using headsets, it is necessary to reduce as many distractions as possible and alert dispatchers in the communications center when other dispatchers are communicating. Electronic Communications and NRG (NDACo) are preparing quotes for establishing a Corrections Console at the front window in the Morton County Communications Center. Equipment purchased would be transferrable for establishing a fourth console to be established when the jail facilities are no longer needed and the communications center moves to a larger location. The cabinet will need to either come out and the center section like our dispatchers use now would be installed and an additional chair will be needed. Maintenance will do the cabinet removal. Four Monitors we have six extra in the Emergency Management Office and they could be used for: 1. LEC Camera Monitoring 2. Courthouse Camera Monitoring (not being used to its full capability) 3. Door Control Screen 4. Cop Desk Screen A shoehorn for door intercom and the console should be able to access dispatch s printer, copier and fax. We have extra towers but may need an upgrade or a new hard drive in one?

14 County Commissioners Agenda Packet Documentation Meeting Date: February 10, Subject: Allocation of Funding to Purchase Console Gateway Equipment Page 2 of 2 Install a jail phone hookup and the hand held jail radio would be moved from the city console to the jailer console. A light above each console interfaced to communications equipment that activates when the dispatcher is communicating (three total). In speaking to Sheriff Shipman, the position could be staffed for corrections personnel on light duty and sequentially throughout the day (during heavy traffic times). Additional staffing periods would occur when additional staff is employed. We do not have an actual cost or quotes yet but the limit would be the amount allocated for Capital Improvement ($5,400.00) PRESENTED MOTION: Approve using budgeted Capital Equipment funds for improving operations in the Morton County Communications Center at a cost not to exceed $5,400

15 Emergency Notification System Morton County Emergency Notification System When a crisis occurs, local public safety officials have three methods to alert the public: 1. Media press releases written by local government and delivered to local radio, television, newspapers and the Morton County web-site. 2. The Emergency Alert System (EAS). This system sends messages to your all-hazards alert radios and broadcast on radio and television stations. 3. The City Watch Notification System. This system is a series of remote computers and telephone lines to relay a recorded message to the public with information and instructions during an emergency or non-emergency event. While no system can ever be guaranteed disaster proof, by using these three methods, local officials make every effort to keep the public informed. 17 P&Z SUMMARY FOR MARCH 10, COMMISSIO N MEETI NG This summary is intended to prepare Morton County Commissioners for the planning and zoning portion of the upcoming commission meeting, and brief Commissioners on issues addressed during the February 27, Planning and Zoning Commission meeting. 1. Request by Sunflower Wind Project, LLC for approval of a Special Use Permit for construction of the Sunflower Wind Project in parts of Sections 16,, -23, and 26- of Township 9 North, Range 90 West, and Section 5 of Township 8 North, Range 90 West. The project is proposed to include up to 55 wind turbines, generating a total of up to 110 MW of renewable energy, as well as a project substation, underground power lines, and access roads to the sites. a. P&Z Action: Recommended approval of the Special Use Permit with the following conditions: i. Up to 55 wind turbines may be constructed, along with an underground collection line system, a substation and interconnection facility to the existing transmission line, access roads, underground communications cables, meteorological towers, and one operations and maintenance building ii. All wind turbines shall be placed within the Feasible Turbine Placement Area, as defined on the Sunflower Wind Project map, which is attached to this permit iii. Additionally, all wind turbines shall be set back from all section lines a distance not less than one hundred (100) feet. iv. The substation and interconnection facility shall be constructed in the general location indicated on the Sunflower Wind Project Map. v. The Operations and Maintenance Building may be constructed in any location within the project boundary, subject to area regulations of Article 5, Section 5 of the Morton County Zoning Regulations. vi. Land that is disturbed during construction of each turbine and associated facilities will be substantially returned to its original state by ripping compacted soil, returning native topsoil, and / or reseeding within six months of the completion of that particular turbine and associated facilities. vii. Sunflower Wind Project shall enter into a road maintenance agreement with the Morton County Highway Department to ensure that all county and township roads will be repaired or restored to a condition at least equal to the condition prior to construction of the Sunflower Wind Project. viii. Special rescue equipment and training necessary to accommodate high-angle rescues shall be provided to Morton County emergency responder s servant area. Additionally, Sunflower Wind Project shall coordinate with the Morton County Emergency Manager for addressing and identification methods for the project. ix. After decommissioning, all wind turbine nacelles, blades, towers, foundations, cables, Morton County Department of Planning and Zoning th St. NW, Mandan, ND Page 1 of 2

18 roads substation, and other facilities shall be removed to a depth of 48 inches. x. Sunflower Wind Project shall apply for all necessary approach permits, moving permits, and building permits necessary to complete construction of the project. xi. The remainder of the special use permit fee shall be paid in full before issuance of a building permit. xii. All terms and conditions of the Morton County Zoning Regulations, as well as all applicable state and federal regulations, shall be met during the construction, operation, and decommissioning of the Sunflower Wind Project. b. P&Z Action: Recommended denial of a request by the applicant to adjust the special use permit for the Sunflower Wind Project. The recommended approval includes a condition that requires payment in full of the fee, which is 1/10 of 1% of total project costs. c. Public Hearing: No members of the public addressed the Planning and Zoning Commission during the public hearing. Jon Cohen, a representative of the applicant, addressed the planning and zoning commission and offered to answer questions. 2. Request by Morton County for adoption of an official zoning map and zoning text amendments to replace Schedule A of the Morton County Zoning Regulations. A public hearing was also held on January 23, to review a draft map. a. P&Z Action: Recommended approval of the Morton County Zoning Map and text amendments to the Morton County Zoning Regulations. b. Public Hearing: No members of the public addressed the Planning and Zoning Commission during the public hearing. OVERVIEW AND BACKGROUND The Sunflower Wind Project, LLC proposes to build, own, and operate the Sunflower Wind Project in Morton County and Stark County. The proposed facility includes up to 55 wind turbines in Morton County and has a nameplate capacity of up to 110MW, which meets the definition for Wind Energy Facility in the Morton County Zoning Regulations. The project is subject to a Special Use Permit in the Agricultural (A) Zone and the standards in Appendix I of the zoning regulations. The application submitted by Sunflower Wind Project, LLC is attached to this report, as well as maps of the project area and proposed locations for turbines, access roads, and collector lines. The precise locations of turbines are tentative, depending on the model selected, final results of wind studies, and other factors. The applicant has asked for permission to build within a defined feasible turbine placement area. The scope of Morton County review extends to the siting locations for turbines and accessory improvements, as well as any impacts the project may have on public services and infrastructure. In a limited sense, the county regulations also pertain to design of the turbines, such as lighting and color. The purpose of this report is to evaluate the proposed project in terms of these standards, and those of the comprehensive plan, to assist the Planning and Zoning Commission in their recommendation. The applicant must also receive approval from Stark County, the North Dakota Public Services Commission, and complete federal environmental review requirements. All of these approvals are currently pending. FINDINGS OF FACT In addition to the information presented in the attached application, these findings may be taken into account: All property owners in the project area have recorded easements to participate in the Sunflower Wind Project. One property owner has agreed to participate with one tract of land, but has not signed an easement with another tract of land in the project area. There are four occupied residences within the project area, all occupied by project participants that have recorded easements: o 39 County Road 90 Phyllis and Roger Leutz o 7675 County Road 90 Dale Heinle o th Ave David and Claudia Meberg o 3995 County Road 89 Lyle Hoerauf Page 2 of 5

21 There are two occupied residences within a half mile of the project area, one of which is a landowner participating in the project: o 45 County Road 90 Duane and Rita Opp o rd St David Opp Several microwave paths cross through the proposed project area, most of which roughly follow the path of the existing transmission line. Prairie Public Broadcasting owns a tower in the project area that transmits microwave communications. The applicant has organized and held several information sessions with residents in the surrounding area about the project prior to submitting an application. The Planning and Zoning Department has not been contacted with any public comment regarding this proposal, as of 2/21/. STAFF ANALYSIS The applicant has demonstrated that all of the requirements of the zoning regulations are met by the Sunflower Wind Project or will be met during the course of operations. All required setbacks are incorporated into the Feasible Turbine Placement Areas shown on the site map, and the applicant has committed to meeting requirements related to design of turbines and buildings, restoration of transportation infrastructure, and restoration of the property. The special use permit would be conditional upon the ongoing adherence to these regulations. The Planning and Zoning Commission also has the responsibility, during review of special uses, of evaluating the general effects on the public health, safety and wellbeing and conformity to the county comprehensive plan. Development of Energy Resources Morton County Comprehensive Plan objective 5.a states that the county will maintain cooperation with and enhancement of the energy industries. The Sunflower Wind Project would further this economic development objective of the Comprehensive Plan by increasing the total wind energy profile of the county by roughly forty percent. Quality of Life for Rural Residents Potential negative impacts to the quality of life for surrounding residents are largely avoided or mitigated through site design and operational commitments made by the applicant. Any wind turbine may be considered a nuisance to surrounding properties, in terms of noise, shadow flicker (the result of sun going behind a rotating blade), or aesthetics. Although there are no documented direct public health consequence of these effects, residents very near similar projects have expressed annoyance. Setbacks of ¼ mile from all occupied residences should be sufficient to protect any existing residents from these effects. There are no commercial or public uses in the project area. Mitigation of Potential Hazards Page 3 of 5

22 There are potential hazards associated with any wind turbine, and these hazards are sufficiently mitigated by the project conditions. In cold climates, ice may attach to turbine blades and be thrown to the ground. Studies have shown that most ice is thrown directly below the turbine and rarely more than 0 feet from the turbine. The setbacks from existing roadways and residences should protect these areas from this possibility. Furthermore, Sunflower Wind Project will be committed to providing equipment and training to emergency responders necessary to respond to any emergencies uniquely attributed to the project. The Federal Aviation Administration has already determined that the proposed sites for turbines will not create a hazard for air navigation. Impact on Environment and Cultural Resources Because the project will be connecting into a federally-owned transmission line, the project must comply with the National Environmental Policy Act and an environmental review is in process. This involves evaluation of bird migratory patterns, archeological resources in the area, and other impacts to natural and cultural resources. Although these issues are outside of the scope of review of this permit, they will be considered through other means. Coordination with Existing Infrastructure Wind turbines may interfere with microwave paths by physically blocking the line-of-sight between two microwave towers. This could potentially result in interference for television or radio broadcasting. There is one microwave tower, owned by Prairie Public Broadcasting, Inc. in the project area, and a number of microwave paths that cross the project area in the general area of the existing transmission line. The applicant is aware of this possibility, and Comsearch was retained in 20 to identify any microwave paths and conduct an interference analysis. The consultant identified several paths of obstruction that should remain open to avoid microwave interference. The applicant proposes setbacks of approximately 0 ft. from each of the microwave paths, and this has been incorporated into the Feasible Turbine Placement Areas. Prairie Public Broadcasting, the owner of the microwave tower in the project area, has reviewed the results of the study and confirmed that the setbacks are adequate to avoid interference. The hauling of concrete and turbine materials for construction of facilities is expected to damage gravel roads in the area. This is an unavoidable impact, but Sunflower Wind Project has agreed to work with Morton County to repair any damage caused during the construction phase. Nevertheless, there will be impacts to the users of the transportation system during the course of construction. Compatibility with Agricultural Use of Land Agriculture is an important industry for Morton County, and the protection of land for farming and ranching is an objective of the Comprehensive Plan. Because the footprint of the wind facility will likely be between 2-5%, most of the land in the area can continue in agricultural use throughout the life of the project. During construction there will likely be additional impacts to the land to dig trenches and transport materials, but Sunflower Wind Project will be committed to restore the land within six months after construction is completed. 23 STAFF RECOMMENDATION Given all of the factors considered in the above analysis, staff recommends approval of the special use permit for the Sunflower Wind Project subject to the following conditions: 1. Up to 55 wind turbines may be constructed, along with an underground collection line system, a substation and interconnection facility to the existing transmission line, access roads, underground communications cables, meteorological towers, and one operations and maintenance building. 2. All wind turbines shall be placed within the Feasible Turbine Placement Area, as defined on the Sunflower Wind Project map, which is attached to this permit. 3. Additionally, all wind turbines shall be set back from all section lines a distance not less than one hundred (100) feet. 4. The substation and interconnection facility shall be constructed in the general location indicated on the Sunflower Wind Project Map. 5. The Operations and Maintenance Building may be constructed in any location within the project boundary, subject to area regulations of Article 5, Section 5 of the Morton County Zoning Regulations. 6. Land that is disturbed during construction of each turbine and associated facilities will be substantially returned to its original state by ripping compacted soil, returning native topsoil, and/or reseeding within six months of the completion of that particular turbine and associated facilities. 7. Sunflower Wind Project shall enter into a road maintenance agreement with the Morton County Highway Department to ensure that all county and township roads will be repaired or restored to a condition at least equal to the condition prior to construction of the Sunflower Wind Project. 8. Special rescue equipment and training necessary to accommodate high-angle rescues shall be provided to Morton County emergency responders serving the area. Additionally, Sunflower Wind Project shall coordinate with the Morton County Emergency Manager for addressing and identification methods for the project. 9. After decommissioning, all wind turbine nacelles, blades, towers, foundations, cables, roads, substation, and other facilities shall be removed to a depth of 48 inches. 10. Sunflower Wind Project shall apply for all necessary approach permits, moving permits, and building permits necessary to complete construction of the project. 11. The remainder of the special use permit fee shall be paid in full before issuance of a building permit.. All terms and conditions of the Morton County Zoning Regulations, as well as all applicable state and federal regulations, shall be met during the construction, operation, and decommissioning of the Sunflower Wind Project. 26 Morton County, North Dakota January STATEMENT OF INTENT Sunflower Wind Project, LLC ( SWP ) proposes to build, own, and operate the Sunflower Wind Project ( Sunflower ) in Morton and Stark Counties, North Dakota. The Project area is located approximately 4 miles to the south of Hebron and 8 miles to the west of Glen Ullin. The total nameplate capacity of the Project will be up to 110 megawatts (MW). The enclosed maps that are submitted with this application reflect the proposed Project layout. Of the total number of turbines, up to 55 wind turbines would be constructed in Morton County and up to wind turbines would be constructed in Stark County. Please note that the estimate of the number of turbines is preliminary and is subject to increases or decreases due to the final turbine selection, geotechnical studies, micrositing, and final engineering. Infinity is targeting to commence construction at the beginning of to support a commercial operation date by the end of. The wind turbines would be connected together by a.5 kilovolt (kv) underground collection line system that would connect into a Project substation. The voltage would then be stepped up at the Project substation to 2 kv and connected to a new switchyard facility on the Western Area Power Authority s (WAPA) existing Dickinson - Mandan 2 kv transmission line. Other ancillary facilities that would be developed in conjunction with the Project include one permanent meteorological tower, new access roads, and an operations and maintenance building. In total, the project area encompasses approximately 11,000 acres of land of which only 2-5% would be disturbed due to the development of the Project. Basin Electric (Basin), a rural electric provider that operates within various parts of North Dakota and other areas of the Midwest, recently signed a power purchase agreement (PPA) to buy the power generated from the Sunflower Project starting at the end of. The PPA will allow the power generated by the Project to be sold at a predetermined price for the life of the wind farm. Sunflower Wind Project, LLC respectfully requests the following from Morton County: 1. Authorization of this application for a Special Use Permit for the Sunflower Wind Project as described in the Application, enclosed site plans, and this Supplemental Information Submittal, including the project substation and other associated infrastructure. 2. 27 Morton County, North Dakota January PROJECT SUMMARY The Sunflower Wind Project is a planned wind energy generation project located on the border of Morton and Stark Counties and will have a nameplate capacity of up to 110 MW. The Project area is located to the south of Highway 94 approximately 4 miles to the south of Hebron and 8 miles to the west of Glen Ullin. The project will consist of wind turbines, an underground electrical system, a project substation, an overhead transmission line, access roads, one or more meteorological towers, communication cables, and an operations and maintenance building. A wind turbine model has not been definitively selected for the site, but preliminary studies have assumed that approximately 53 Vestas V-110 wind turbines will be utilized. The energy produced by the turbines will be delivered to the electric grid at a new switchyard that would be constructed on Western Area Power Authority s existing Dickinson to Mandan 2 kv transmission line. 28 Morton County, North Dakota January COMPANY OVERVIEW Sunflower Wind Project, LLC ( SWP ) is managed by Infinity Wind Power ( Infinity ). Headquartered in California with regional offices in Colorado and Minnesota, Infinity is a privately held company focused on quality wind energy development. Infinity s active development portfolio represents over 4,000 MW of wind energy projects across 10 states. Infinity originates, develops, and delivers top quality wind projects for asset sales, turnkey transactions, or power purchase arrangements. Infinity utilizes a landowner advocacy approach to project development, working actively to bring the many benefits of wind energy generation to the communities where our projects are located. Maintaining close relationships with landowners, community members, and elected officials is paramount to the success of our projects. In early 20, Infinity developed and sold the 500 MW Ironwood Wind Project near Spearville, Kansas to Westar Energy. The first phase of the Ironwood project achieved commercial operation in August, 22 and is co-owned by Duke Energy Renewable Systems and Sumitomo. 29 Morton County, North Dakota January DEVELOPMENT DESCRIPTION Project Location The proposed 110 MW Sunflower Wind Project site is located on rolling hills that are primarily used in agricultural operations to the south of Highway 94. The site was selected because of its excellent wind resource and proximity to existing transmission facilities. Additionally, the local community is both knowledgeable and enthusiastic about wind energy development. The land use in the project area is primarily agricultural and compatible with the operation of a wind project. General Land Description of Sunflower Wind Project Once the proposed project is operational, Sunflower will generate up to 110 MW of renewable energy. Site Design When completed, the Sunflower Wind Project will consist of wind turbines, an underground electrical system, a centralized project substation, and a new switch station at the interconnection location, access roads, one or more meteorological towers, communication cables, and an operations and maintenance building. As the site design is finalized, care will be taken to ensure that these proposed land uses have minimal impacts on the existing farms, pastures, and residences within the project area. Prior to construction of any facilities, SWP will meet with each of the participating landowners to discuss concerns they may have about the locations of proposed improvements and will take their concerns into consideration in the final site layout. Wind Turbines Wind turbines are ideally sited in areas with compatible land uses and on well-exposed terrain features that maximize energy production. The final turbine layout will be optimized to take into account meteorological phenomena, existing land uses, landowner concerns, accessibility, environmental constraints, and construction costs. Because of the predominant north-south winds at the project site, turbines will be placed in multiple rows that are oriented in a generally east-west direction. 30 Morton County, North Dakota January In order to select a wind turbine that will generate electricity at the lowest overall price to customers, analysis of the equipment and installation costs versus the energy production must be completed for various turbine models. The selection of the wind turbine model that will be used at Sunflower has not been finalized but preliminary siting studies have assumed a Vestas V-110 wind turbine will be used. With this turbine, as many as fifty-three (53) 2.0 MW units would be deployed, each with a 110 meter (1 feet) rotor diameter and standing 80 meters (262 feet) at the hub and 5 meters (442 feet) at the blade tip in its highest position ( tip height ). Other possible turbines to be used at the site range from 1.7 MW to 3.0 MW in nameplate capacity. The hub heights of these alternate turbines would likely be 80 meters (262 feet) and rotor diameters would range from 90 meters (295 feet) to 108 meters (4 feet). A list of some of the most commonly used wind turbine models in the United States is provided in Table 2. SWP requests the right to utilize any turbine model at Sunflower, including turbines not listed in this table. Wind Turbine Models Associated Infrastructure In addition to the wind turbines, other infrastructure is required to allow for daily operation and maintenance of the wind project. A.5 kilovolt (kv) electrical collection system will be installed to bring energy from each of the turbines to a central project substation. To the extent feasible, all collection system cables will be installed underground. At the project substation, the voltage of the electricity from the wind turbines will be stepped up from.5 kv to 2 kv. The project s energy will then be delivered to the electric transmission grid at a new switchyard that would be built on WAPA s existing Dickinson to Mandan 2 kv transmission line that crosses the Project area. In order to access the turbine locations, new or improved field entrances from existing county roads will be constructed. Impacts to existing county roads due to the transportation of components and equipment, construction activities, or operations and maintenance of the wind project will be minimized. SWP will enter into a road maintenance agreement with Morton County to ensure the development and operation of Sunflower does not result in any long-term negative impacts to county roads. 31 Morton County, North Dakota January Additionally, one or more meteorological towers will be installed to ensure optimal performance of the wind turbines. Underground communications cabling will allow the turbines to send and receive information from operators. Employees of the project will be based at an operations and maintenance building within the project footprint. Land Use It is estimated that the total area affected by the project will be approximately 2% of the total area of the Project Properties. This estimate includes the turbines as well as the access roads, turbine foundations, and the associated pad mounted transformers. Because of the minimal surface footprint of a wind project, agricultural activities on any of the Project Properties can continue within close proximity to the base of each turbine tower. Land that is disturbed during construction of the project will be substantially returned to its original state by ripping compacted soil, returning native topsoil, and/or re-seeding. As a result, Sunflower is expected to be compatible with the continued agricultural use of the land, in accordance with Morton County s desire to preserve agricultural land. Appendix A includes a policy consistency analysis as it pertains to the development policies included in the Morton County Zoning Ordinance related to Wind Energy Development. Setbacks To provide a margin of safety and minimize impact on the local community, the turbines will be placed at minimum distances from certain features that are within or adjacent to the Project properties. The setbacks noted in Table 3 below are based on recommendations from the North Dakota Public Services Commission and from County Zoning Standards. Where there are two standards that have different setback distances, the more conservative distance was used in the Project layout. The Feasible Turbine Placement Areas reflected in the maps that are enclosed with this application reflect all of the development standards reflected in Table 3. In addition, there are additional setback constraints that have been incorporated into the Project design. (e.g. setbacks from microwave beam paths, wetlands, and other environmental constraints). 33 COMMUNITY SUPPORT AND LOCAL BENEFITS Morton County, North Dakota January Community Support and Outreach SWP and Infinity Wind Power ( Infinity ), have worked diligently with the landowners, community, and regional officials to develop a positive rapport as well as collect input from all stakeholders about the Sunflower Wind Project. The community is very supportive of this project, realizing the additional income to local farmers and the creation of new jobs would be beneficial to the local economy. The project has already brought benefits to the area with payments to landowners and teams of developers and consultants working in the project area. SWP has hosted a number of landowner and open house meetings to update the community on the Sunflower development progress in order to provide project participants, neighbors, and other interested parties with more detailed information about the project and to collect feedback from the community. SWP believes in maintaining an open and transparent relationship with the community. The development, construction, and operation of Sunflower will be carried out in a manner to maintain community support throughout the many years of project operation. SWP will maintain the highest standards for quality construction techniques and tight management practices during construction and over the long-term operation of energy projects. 34 REGULATORY AND ENVIRONMENTAL COMPLIANCE Morton County, North Dakota January Coordination with applicable federal, state, and local entities has been underway for several years in order to identify areas of concern and to assess a planning and design approach which can be utilized to minimize the impacts of the Sunflower Wind Project. Tetra Tech EC, Inc. completed an environmental assessment of the project area, including discussions with State and Federal agencies. Western Ecosystems Technology, Inc. (WEST) has supported SWP in conducting baseline biological surveys consistent with the United States Fish and Wildlife Service s Wind Energy Guidelines. Finally, Beaver Creek Archaeology has completed historic and cultural resource evaluations within the Project area on behalf of SWP. The summary of the findings from the surveys completed by the consulting firms noted above is summarized below. Aviation Safety Preliminary turbine coordinates were submitted to the Federal Aviation Administration (FAA) for review and the FAA issued Determinations of No Hazard to Air Navigation for each of the proposed locations. Aviation lighting on some of the wind turbines will be required in order to make the turbines more visible to passing aircraft. The specific lighting requirements will be determined by the FAA once the project layout has been finalized and SWP will comply with these lighting requirements. Additionally, electric collection system lines within the project site will be buried underground when feasible. Cultural and Archaeological Resources Section 1 of the National Historic Preservation Act of 96 directs Federal agencies to evaluate the effect of a proposed action on any district, site, building, structure, or object eligible for, or included on, the National Register of Historic Places. As noted earlier, the Project is interconnecting on to an existing WAPA line. As WAPA is a federal agency, the agency must comply with the National Environmental Policy Act (NEPA). Compliance with NEPA requires that WAPA also complete Section 1 consultations related to historic or cultural resource impacts. Beaver Creek Archaeology, Inc. completed a Class III archaeological resource survey in conjunction with the Project layout to investigate for the presence of subsurface archaeological resources and also evaluated existing historic structures within the Project area. The purpose of this survey was 1) to support WAPA s Section 1 obligations, and 2) to determine the likelihood of encountering cultural resources during construction of Sunflower. This review found very limited archaeological sites within the Project area, all of which can be avoided associated with the construction and operation of the Project. Before construction, SWP will conduct additional cultural resources investigations in order to avoid impacting previously undiscovered resources to the greatest extent possible. Biological Constraints Infinity hired HDR to perform desktop environmental reviews of the Project site, pursuant to Tier II of the USFWS Wind Energy Guidelines. As a part of these reviews, wildlife agencies were contacted regarding potential impacts to the current land use at the project site, including the US Fish and Sunflower Wind Project Supplemental Information Submittal 11

35 Morton County, North Dakota January Wildlife Service ( USFWS ) and North Dakota Game and Fish Department ( NDGFD ). NDGFD primarily expressed concern with disturbing native prairie and wetlands. SWP intends to avoid building infrastructure in these land features to the greatest extent possible. USFWS did not express specific concerns about this site, but did recommend due diligence surveys for protected species. HDR reviewed the site for ecological sensitivity and prepared a Critical Issues Analysis report to summarize the potential ecological sensitivity of the site. At this time, there are five federally endangered species (whooping crane, interior least tern, pallid sturgeon, black-footed ferret, gray wolf), one threatened (piping plover), and one candidate species (Sprague s pipit) listed for Morton and Stark Counties by USFWS. There are also several species in these counties considered by NDGFD to be in need of conservation. Because the vast majority of the site has been converted to agricultural cropland or is grazed by livestock, fragmented landscapes have been created making it unlikely that significant areas of suitable habitat for these species of concern exist. In addition to these protected species, the fauna most sensitive to the construction of a wind project tend to be avian and bat species. Although some species of birds will live on the site and others may migrate through it, HDR does not expect the site to contain areas where large concentrations of birds would congregate. To further minimize the risk of impacts to avian species, the placement of facilities within native grasslands, wetlands, or undisturbed habitats will be avoided to the greatest extent possible. Electric collector lines will be placed underground. Turbine towers will also be constructed using tubular towers and without perches so that avian predators will not be attracted to the project area. It is planned that any flora unique habitat located within the project site can be accommodated with modifications to the project design, since the project utilizes minimal land area. WEST has been hired to conduct biological surveys of Sunflower throughout 23 based on the Tier 3 guidance outlined in the USFWS Wind Energy Guidelines. WEST has completed spring, summer, fall and winter avian point count surveys, raptor nest surveys, a habitat characterization study, a whooping crane stopover evaluation and acoustic monitoring for bats. Based on feedback from WEST based on the data collected to date, no fatal flaws pertaining to sensitive species have been identified. Aesthetics In order to minimize the visual impacts of the wind turbines, turbines will have tubular towers and the structures will be painted in a single neutral color (white or gray). Logos or advertisements will not be located on the wind turbines, unless approved in advance by the Board of County Commissioners. Communication The construction and operation of Sunflower will comply with all applicable Federal Communications Commission (FCC) regulations. A search for FCC licensed point-to-point microwave and fixed station radio frequency facilities within the project boundary was performed by Comsearch. The layout reflected in the maps that were submitted with this application reflect Sunflower Wind Project Supplemental Information Submittal

36 Morton County, North Dakota January the avoidance areas near existing microwave beam paths that cross the Project area to ensure a conflict does not occur. Emergency Response To facilitate emergency responses, should one be necessary, each final wind turbine location will be assigned a 911 address. Turbine identification numbers will be clearly visible at a normal sight level. Additionally, SWP will provide any additional special rescue equipment and training for the Stark County Fire and EMS Department to accommodate high angle rescues. Permitting The Sunflower Wind Project must obtain a Certificate of Site Compatibility ( CSC ), which is granted by the North Dakota Public Service Commission. A CSC is required to build a wind project greater than 0.5 MW in size in North Dakota. Infinity expects to apply for this permit in the first quarter of. In addition to the Special Use or Conditional Use Permits required by both Counties, Road Crossing/Encroachment Permits, and Building Permits will also be required from both Morton and Stark Counties prior to construction of the project. 37 Morton County, North Dakota January DECOMMISSIONING The Easement Agreements that SWP has with the landowners provide for a decommissioning of the Project. Decommissioning activities include the removal of wind turbine nacelles, blades, towers, foundations, cables, roads and other facilities to a depth of 48 inches below grade. Also included is returning the land to the same grade and filling the land with topsoil comparable to the top soil that existed, both as to the quality and depth, as it was at the time construction began. In addition to Sunflower s regulatory obligations for infrastructure removal related to decommissioning, Sunflower s easements require the creation of a restoration fund. At the 11th year of operation, Sunflower is required to create a restoration fund through a federally chartered bank for each turbine associated with the Project and continue to make annual contributions through the life of the Project. The restoration fund is intended to secure Sunflower s obligations under its easements related to the decommissioning and removal of the project components. If Sunflower were to go bankrupt, the landowner would then have access to the restoration fund in order to pay for the removal costs associated with Project infrastructure. 38 Morton County, North Dakota January APPENDIX A Morton County Policy Consistency Review Appendix I of the Morton County Zoning Regulations addresses the development of wind energy projects that have a nameplate capacity of 100 kilowatts or greater. As the proposed Sunflower Wind Project would have a nameplate capacity that exceeds this threshold, the regulations outlined in Appendix I are applicable to the Project. The following is a discussion of the consistent of the Project with the Section 3, General Requirements. a. Wind turbines and related towers shall be painted a non-reflective, non-obtrusive color. Response: Pursuant to FAA requirements, all wind turbines will be painted a single neutral color (white and grey). b. Wind turbines and related towers shall not be used for displaying any advertising except for reasonable identification of the manufacturer or operator of the wind energy facility. Response: No advertising is proposed to be included on the wind turbines associated with the Sunflower Wind Project. c. Each wind tower shall be marked with a visible identification number to assist with provision of emergency services, and the permitee shall file with the local emergency manager, a wind energy facility map identifying wind turbine location and numbers. Response: SWP will coordinate with County fire and emergency management services on requested identification maps or other identification methods for the Project. d. Wind turbines shall not be artificially lighted, except to the extent required by FAA or other applicable authority. Response: The only proposed lighting that would be included for the wind turbines would be FAA approved lights that are required to be affixed on the nacelle of specific turbines within the Project. The turbines that will be required to have lighting will be determined in consultations with FAA requirements based on the final layout. The project substation and operations and maintenance building will likely have minimal lighting intended for nighttime security. e. The design of buildings and related structure at wind energy facility sites shall, to the extent reasonably possible, use materials colors, textures and location that will blend the wind energy facility to the natural setting and existing environment. Response: The design of the operations and maintenance facility will utilize material colors, textures blend in the natural setting of the Project area and minimize visual impacts to the degree possible. At wind energy facility sites, the location and construction of access roads and other infrastructure shall, to the extent reasonably possible, minimize disruption to farmland, the landscape and agricultural operations with Morton County. Response: The Project will utilize existing county roads and farm roads to the maximum extent practicable. However, new roads will be required on the privately owned land where the Project is proposed in order to access the turbine locations. New proposed routes will be designed to minimize the total road length to the degree possible in order to minimize the disruption on existing farmland operations. g. The permitee shall promptly replace or repair all fences or gates removed or damaged during all phases of the wind energy facility s life, unless otherwise negotiated with the affected landowner. When the permitee installs a gate where electric fences are present, the permitee shall provide for continuity in the electric fence circuit. Response: Pursuant to the County s requirement and consistent with SWP s obligations in easements signed with the landowner, all fences or gates removed or damaged during the construction and operation of the Project will be replaced or repaired. h. The permitee shall ensure that, following completion of construction of a wind energy facility, all County roads will be repaired or restored to a condition at least equal to the condition prior to construction of such facility, as inspected and approved by Morton County Superintendent of Highways. Response: SWP will enter into a road maintenance agreement with Morton County to ensure the development and operation of Sunflower does not result in any long-term negative impacts to county roads. i. The permitee shall place electrical line, known a collectors, and communication cable underground when located on private property. (Collectors and cables shall place electrical line, known as collectors, and communication cables underground when located on private property. Collectors and cable shall also be placed within or adjacent to the land necessary or wind turbine access roads unless otherwise negotiated with the affected landowner. (Does not apply to feed lines) Overhead collection facilities may be permitted where necessary. Response: As noted earlier, the Sunflower Wind Project does not require any new overhead transmission lines to be constructed to support the project. Energy generated at each of the individual wind turbine locations will be collected through new underground.5 kv transmission lines, which will in turn be connected to a new project substation. The new project substation is proposed adjacent to the point of interconnect on WAPA s existing Dickinson to Mandan 2 kv transmission line that crosses the Project area. 40 Morton County, North Dakota January APPENDIX B Request for Special Use Permit Fee Reduction Morton County has adopted a Special Use Permit application fee of.0 x Total Project Cost with up to $1,000 due at the time of the SUP filing and the balance due before the building permits are issued. Based on the County s current fee schedule, the total application fee is almost $100,000 for the Sunflower Wind Project. We have been informed that the application fee was established to cover costs related to the following. 1. To cover additional roadway maintenance expenses incurred by the Morton County Highway Department. Although operators are generally responsible for roadway improvements in the project area, the County had experienced additional costs in the past and wanted to be prepared for this. 2. To insure against the possibility of having to remove the structures if the facility were to be abandoned by the operator and after bankruptcy. 3. To cover administrative costs. With regard to the second item, SWP believes this cost is redundant to expenditures that we have already committed to funding for the Project. Specifically, all of the landowners that are participating in the Sunflower Wind Project have a provision in their agreement that creates a decommissioning and removal fund at the end of the Project s life. At the 11th year of operation, Sunflower is required to create a restoration fund through a federally chartered bank for each turbine associated with the Project and continue to make annual contributions through the life of the Project. The restoration fund is intended to secure Sunflower s obligations under its easements related to the decommissioning and removal of the project components. If Sunflower were to go bankrupt, the landowner would then have access to the restoration fund in order to pay for the removal costs associated with Project infrastructure. Based on this, we believe that application fees that are intended to cover the costs of decommissioning and infrastructure removal are unwarranted for this Project. Subsequently, SWP respectfully requested that the total application fee for the Project be capped at $,000. 42 MEMO TO: Morton County Planning and Zoning Commission FROM: Daniel Nairn, Director of Planning and Zoning DATE: January 15, SUBJECT: Morton County Zoning Map The Planning and Zoning department proposes the adoption of an official zoning map for Morton County. Attached to this memo are: a zoning text amendment to incorporate a zoning map into the Morton County Zoning Regulations a draft zoning map, in a mapbook format. a record of zoning map amendments since 72 that are included on the map BACKGROUND Morton County adopted their first zoning map on February 1, 72, a few years after the adoption of the first zoning ordinance. The zoning districts were determined by this map until 85, when it was replaced by a text description of the zoning districts in Appendix A, Schedule A of the Morton County Zoning Regulations. Presumably, this was done to make updating easier, avoiding the need to recreate a map with each new amendment. Schedule A refers to districts with cadastral descriptions (section-townshiprange) or sometimes with reference to a subdivision. Although for a number of years an unofficial zoning map has been used for administrative purposes, the text description is the official description of districts currently in place. ZONING MAP PROPOSAL The intent of the attached zoning map is to maintain the existing zoning designations, accurately reflecting the original zoning map and all amendments to it. The adoption of this zoning map should not change the zoning for any properties, with a few small exceptions addressed below. That being said, mistakes could have occurred while translating the record of zone changes to this map. Ideally, any mistakes could be identified during the public hearing process and before adoption. Zoning districts to match parcels It is good practice for zoning districts to match property lines. When single parcels fall into multiple zoning districts, landowners and administrators may not know which regulations to follow. Fortunately, Morton County zoning is already aligned very well with parcels, with the exception of zoning around the I-94 interchanges. The original zoning map designated boxes of commercial zoning around interchanges and they have been given cadastral boundary descriptions. In many cases, these zones included only small portion of larger agricultural tracts, which leaves some property owners with split zoning designations. Page 1 of 3

43 The Tax Equalization Department is working to create new tax parcels out of the portions of these tracts that are commercially zoned. This does not alleviate confusion entirely, but it does help administration and mapping to not have split parcels. In a few instances, staff proposes changing the commercial zoning around interchanges to match existing property boundaries. In these cases, the zoning district comes close to matching a property boundary, and changing the boundary of the district is simpler than creating a new parcel out of a small and abnormal shape. Zoning District Abbreviations There have been some discrepancies in the abbreviations used for the zoning districts, because some are not entirely intuitive. Technically, any printed maps or pdfs would be a copy of the official map, essentially snapshot at any given time. The purpose of a digital zoning map is to facilitate amendments, allowing the map to be updated immediately after a rezoning is recorded. It also makes the zoning map directly available to the public online through a mapping service without need for disclaimers about its legitimacy. Removal of Floodplain District The draft map does not show the F Floodplain District. When Morton County enrolled in the National Flood Insurance Program in the 80 s, a new Model D Floodplain Ordinance was adopted. This ordinance applies to the Special Flood Hazard Areas, as set by FEMA, rather than the floodplain districts established on the original map. Although the older floodplain districts have not been used in recent years and are not shown on the unofficial maps, to my knowledge they have not been legally repealed. Their non-inclusion on the Morton County Zoning Map would effectively nullify the original F Floodplain District in Article of the Zoning Regulations. Rules for Interpretation The zoning text amendment also contains a few rules for interpreting the map that are standardly applied. Because the map cannot function with a survey-level of accuracy, these rules help resolve any disputes about the exact boundaries of a zoning district. Page 2 of 3

The Morton County Zoning Map is contained within the geographical information system (GIS) files on the Morton County computer server, and is made publically available through the office of the Morton County Department of Planning and Zoning. Said digital map file will be regulatory for the purposes of enforcement of these regulations. Section 3. Where uncertainties exist with respect to the boundaries of the various districts as shown on the zoning map, the following shall apply:

46 (1) The district boundaries shall be interpreted as following the centerlines of public roadways, waterways, or railroad rights-of-way, or property lines. (2) In the case that a boundary does not clearly follow any of the above features, it shall be interpreted as following the quarter-quarter section boundaries of the United States Public Land Survey System. (3) Where the exact location of a zoning district boundary remains uncertain, the boundary location shall be determined by the Zoning Administrator. (4) Whenever any street, alley or public way is vacated by official action of the Board of County Commissioners, the zoning districts adjoining each side of such street, alley, or public way will be automatically extended to the center of such vacation and all area included in the vacation will be subject to all regulations of the extended district. Section 4. Unincorporated areas of Morton County that are within a duly-enacted extraterritorial zoning area of any incorporated city, pursuant of of the North Dakota Century Code or any agreement between Morton County and another government, are not assigned a zoning district on the Morton County Zoning Map. Areas that are designated for joint jurisdiction between Morton County and an incorporated city are assigned a zoning district on the Morton County Zoning Map, and all procedures of said section of North Dakota Century Code shall be followed in the administration of these regulations within areas of joint jurisdiction. ARTICLE BOUNDARIES OF DISTRICTS Section 1. Rules Where Uncertainties May Arise: Where uncertainties exist with respect to the boundaries of the various districts as legally described in Appendix A which is made a part of these regulations, the following shall apply; a.
