1 Downtown FWB Organization Farmers Market Guidelines I. DEFINITIONS a. Farmers Market Director: Jennifer Bundrick a. b. FARMER: Anyone including the backyard gardener, who offers produce that was grown and or raised by them, including, but not limited to, fruits, vegetables, cut greenery, live plants, herbs, flowers, meat, poultry and dairy products. c. FOOD VENDOR: Any Vendor selling, packaged, prepared, baked or canned goods. d. HOME GROWN: Produce actually grown by the Farmer. e. HOMEMADE: Food that was made from scratch and not purchased for resale. f. LOCALLY GROWN: Produce that is grown within a 100 mile radius of the Downtown Fort Walton Beach Farmers Market may be labeled as locally grown and sold on the Market. g. FARMERS MARKET DAY: 2 nd (second) Saturday 8am 1pm, March 2015 October h. MARKET FEE SCHEDULE: There is a $15.00 non refundable vendor space fee or advance fee of $105 for entire year. i. NON REFUNDABLE: not subject to refunding or being refunded. j. SPACE: A space (10ft X 10ft) is issued to a person or entity granting the right to use and occupy the market a. Space identified in the application. k. VENDOR: Any person or entity who assigned a space to offer items for sale or to perform services on the Market, whether on a weekly basis or for some other period of time. l. PRODUCE: A vegetable, herb, fruit, cut greenery, live plants, herbs, and flowers or other such produce that is locally grown and available, a Farmer may offer for sale on the Market only such grown produce. m. PREPARED FOOD: Homemade baked goods, candy, honey, jams, jellies, drinks from natural products grown and owned by the seller, and highly acidic canned goods (with an inspection report from the Florida Department of Agriculture). n. FLORIDA COTTAGE FOOD ACT: This Act now allows the home preparation and sale of Cottage Products. Cottage food product means food that is not a potentially hazardous food as defined by Florida s food safety regulations. These vendors no longer have to find commercial kitchens in order to prepare their products. However, cottage food operations are not exempt from any state or federal tax law, rule, regulation, or certificate that applies to all cottage food operations. II. FARM, FOOD & PLANT ITEMS THAT MAY BE SOLD ON THE MARKET

2 1. PRODUCE: Locally Grown and Home Grown. NO RESALE PERMITTED. 2. PREPARED FOOD: Home Made. NO RESALE PERMITTED. 3. The Farmer s Market Director shall have the authority to approve or to disapprove any item offered for sale on the Market under this section. III. FARMERS MARKET SEASON HOURS OF OPERATION 1. The Downtown FWB Farmers Market will be open the 2 nd (second) Saturday from 8:00 A.M. until 1:00 P.M. rain or shine, from March 2015 through October The Farmers Market Director, with the consent of the Downtown FWB Organization, may curtail and/or modify such days and/or hours of operation for reasons such as lack of activity during inclement weather. 2. ALL Vendors are expected to arrive for setup at 7:00am to ensure the market is ready for patrons by 8:00am. Failure to comply will result in possibly being unwelcomed to future markets. 3. Should an emergency arise and the Vendor may be arriving later than the 7am set up time, the Vendor shall notify the Farmers Market Director, Jennifer Bundrick by phone at (850) or at downtownfwbartwalk@gmail.com, as far in advance of opening as is possible. IV. REQUIREMENTS FOR VENDORS 1. Every Vendor at the Downtown FWB Farmers Market must comply with applicable federal, state, and local laws, ordinances, and regulations. 2. Collection and filing of any applicable taxes and payment to the appropriate taxing authority is the sole responsibility of the Vendor. 3. Vendors shall be open and ready to sell when the Market opens, and remain open until the Market closes. Failure by Vendor to be open to sell by 8:00 A.M. or to notify the Market Director of the need for a later opening time may result in the release of Vendor s space to another entity for that day and future markets dates. 4. Vendors selling prepared foods (breads, cakes, homemade beverages, etc.) must secure a food permit or be in compliance with the Florida Cottage Laws. Contact the Florida Department of Agriculture ( ) for more information. 5. All Vendors must unload their vehicles and then park in the parking spots FURTHEST from the market leaving plenty of room for patrons. 6. Cleanup: Vendors are required to clean up after themselves. Vendor space must be maintained in a clean, safe and sanitary manner. No Vendor is permitted to dispose of produce waste, overripe/leftover produce or boxes in any onsite garbage receptacles. 7. Vendors are required to bring a 10x10 tent 8. Vendors are required to have a presentable booth space failure to comply will result in being unwelcome at future markets.

3 V. FARMERS MARKET SPACE AGREEMENTS 1. Vendors must notify Jennifer Bundrick with the Downtown FWB Organization by calling (850) or e mail, downtownfwbartwalk@gmail.com, by 5:00pm the Wednesday before that Market day if such Vendor will not occupy their paid space(s) for that Saturday. Failure to do so will result in the loss of the paid fee for that day and may possibly be unwelcomed to future markets. 2. The Farmers Market Fee is $15.00 per market or Vendors can pay $105 in advance for the season. All fees are nonrefundable. 3. Spaces are assigned upon the approval of the application. The approved applicants may only use assigned market spaces. Allowing the assigned space to be used by any other person, including a family member, in the absence of the person to whom the space is issued, must be approved by the Farmers Market Director. 4. No Vendor shall be allowed to sell from any space in the Farmers Market without an approved application and space assignment being on file. 5. When assigning vendor spaces the variety of product is significant. Applications are processed, in the order that they are received, and spots are assigned, taking into account the item(s) that will be sold and space availability. VI. VENDOR PLACEMENT: 1. The Farmers Market Director, will be at the Market no later than 7:00 a.m. Saturday for vendor check in. Vendors must notify the Farmers Market Director by calling (850) or e mail, downtownfwbartwalk@gmail.com, by 5:00pm the Wednesday before that Market day if such Vendor will not occupy their paid space(s) for that Saturday. Failure to do so will result in the loss of the paid fee for that day. In order to secure your assigned spot all fees must be paid by 5:00pm the Wednesday before that Market day. 2. Vendor set up is between 7am. If a Vendor has a specific space(s), then that Vendor must occupy such space(s) by 7:15am at the latest. If a Vendor has not occupied his/her space by the above time the space may be assigned to another Vendor. Prior arrangements may be made, with the Farmers Market Director, if a vendor will arrive later than 7:15am. 3. Space allowing, the Farmers Market Director may allow Vendors to relocate to unoccupied spaces within their respective area (i.e. farmers, artisans, or antiques) after all Vendors have been placed. 4. After all Vendors have been placed and at the discretion of the Farmer Market Director, Vendors may spread to an approved adjacent space(s). Farmers will have the option to spread first. Space permitting, Vendors may spread to a maximum of two additional spaces provided they have the product for sell to fill the expanded area.

4 5. Vendor relocation shall be at the discretion of the Farmers Market Director and shall be based on reasons regarding feasible and practical distribution of Vendors and/or products. 6. The Downtown FWB Organization reserves the right to refuse to offer or renew a space to any Vendor, or to relocate or revoke any space without cause for a Farmers Market space previously issued, when it is considered to be in the best interests of the Market. The Downtown FWB Organization further reserves the right to revoke at any time or not renew any license or space without cause. If the Vendor s space is revoked, or not renewed, the Vendor is entitled to receive an notice of such action at least 5 business days prior to the effective date of such action unless such termination or non renewal is for cause or for an emergency. The following shall be grounds for immediate cancellation of any license or space, for cause, without prior notification: (a) failure to meet the terms of the agreement; (b) failure to comply with the guidelines. 7. Vendors shall be responsible for the actions of employees, agents, or other persons working for, or with, the Vendor. 8. Spaces are entity or person specific. If a family is applying for a space, all members of the family who expect to sell at the Farmers Market must sign the application and release. If the space is being obtained by a business, an officer or a general partner must sign the application. VI. VENDOR SPACE 1. Vendors MUST use a 10x Vendors must provide their own equipment and any additional materials for display of items. 3. Vendors may not use set up materials that permanently damage the space. Power to vendors may be available on a limited basis. Water service is not provided. Vendors must indicate if a power source is needed and it must be approved prior to the day of the Farmers Market. 4. The Market Manager must approve any sign that a Vendor wishes to use in his or her space. The Market Manager has the sole discretion to disapprove any sign or signage considered by the Farmers Market Director to be inappropriate. VII. PARKING 1. AFTER UNLOADING, BEFORE SETTING UP, VENDORS MUST MOVE THEIR VEHICLES TO THE PARKING SPOTS FURTHEST FROM THE FARMERS MARKET. 2. A Vendor may request permission from the Farmers Market Director to exceed the restrictions on parking contained herein only for special occasions or to accommodate large amounts of heavy produce.

5 VIII. HEALTH, SANITATION, AND SAFETY 1. The Downtown FWB Organization will provide and empty, all public, litter containers at the Farmers Market. 2. Vendors are responsible for the collection and proper disposal of all refuse, grease, and trash generated from their spaces. 3. Vendors are responsible to see that their areas are left clean and orderly when they leave the Market for the day. Failure to comply with this section may result in the imposition of the actual cost of any cleanup, to be collected by the Farmers Market Director. 4. The Downtown FWB Organization is not responsible for damage to or loss of any personal or other items in any of the assigned spaces. 5. Children less than 14 years of age brought to the Farmers Market by Vendors must be kept within the Vendor s space and be under the supervision of a designated adult. 6. Vendors and their representatives agree to protect and hold the Downtown FWB Organization, their employees, agents, and representatives harmless and to protect such entities from any and all claims, demands, suits, actions, judgments, and recoveries, for or on account of any damage, theft, or injury (including death) to property or person occurring as a result of Vendor s use of Downtown FWB Farmers Market space for which Vendor has been approved, including loss or injury resulting to Vendor from any cause whatsoever, including but not limited to electrical or equipment failure. IX. GENERAL INFORMATION 1. The Downtown FWB Farmers Market promotes a family atmosphere. Vendors shall conduct themselves at all times in a courteous and professional manner. Proper dress is required of all Vendors. Rude, abusive, or other disruptive or offensive conduct is not permitted. Profanity or otherwise offensive language, including gestures, is prohibited. 2. No person shall make a public outcry, engage in hawking, or play any musical instrument (except for Vendors who are demonstrating a musical item that they have crafted or who have been approved in advance by the DIB for such musical performance), or give other entertainment while selling on the Farmers Market, whether for personal pleasure or for public enjoyment unless previously approved by the Farmers Market Director. 3. Vendors who violate any of the regulations contained in this Farmers Market Handbook will be given a verbal warning. A second violation for the same, or for a different violation, will result in a written warning. A third violation will result in the termination of the vendor s space. 4. Jennifer Bundrick, Farmers Market Director, and the Downtown FWB Organization manage the Downtown FWB Farmers Market. For additional
