S ob zi rom na kon ti nu i ra ni negativni trend, jasno je da je po trebno pristupiti reformama investicionih politika, kako na nacionalnom, regionalnom, bilateralnom, multilateralnom, tako i na internacionalnom ni vou, kako bi se obezbedio ekonom ski raz voj. Ključni elemen ti u reformama jesu: obez bedi ti in stru mente za ublažavanje rizika, kre irati mehanizme odgovornog investiranja, poboljšati strukturnu koherentnost i promovisati regionalno investiranje. Osvrtom na sa da šnje sek tor sko sta nje u in ve sti ci ja ma (u iz ve šta ju UN CTAD-a iz go di ne) uoča va se da je sek tor uslu ga za be le žio dvo stru ko ve ći rast u od no su na in ve sti ci je u pro iz vod nom sek to ru u go di ni. Ta ko đe, ako se uzme u raz ma tra nje či nje ni ca da in ve stiranje u IT sektor pod razumeva tri vida investi ranja: transak ciono (mini miziranje tro ško va), stra te ško (ino va ci o ne teh no lo gi je, po sti za nje kon ku rent no sti) i in for ma ci o no (po bolj šanje pristu pa informacijama i komunikacijama), tada se može pretpostaviti da re forme u in vesticionoj politici treba da su u direktnoj korela ci ji sa investici jama u informacionim tehnologijama. Uzro ci su mno go broj ni, ali se mo gu ge ne ra li zo va ti u dve ka te go ri je. Pr va de ter mi nan ta je ste sve do mi nantniji ekonomski jaz razvijenih i ne razvijenih eko no mi ja, što po ka zu ju i po slednji podaci iz Svet skog izve štaja o in ve sticija ma od stra ne UN CTAD-a iz go di ne, ko ji uka zu ju na no vi dra sti čan pad di rekt nih stra nih in ve sti ci ja za 16% u odnosu na go dinu. Sa dru ge strane, za be le že no je i re kord no uče šće pri liva direktnih stranih investi cija u zemljama u raz vo ju sa 55%. 1 Kretanje in ve sticija je ve oma različito u zavisnosti od regiona, ali i vr ste i struk ture ulaganja. Tako je Azija postala najveći investi ci oni region u sve tu, dok su ze mlje u raz vo ju ima le po vo ljan trend grin fild in ve sti ci ja, kao i po gra nič nih mer džera i akvi zicija. Posmatrajući sektorska ulaganja, sve značajni ja je ulo ga sek to ra usluga u ukup nom investiranju, sa posebnim nagla skom na M&A sek to ru, gde je u od no su na go di nu za be le žen rast od re kordnih 28%. 2 Dru ga deter minanta, sa kojom se suočava svetska eko nomija je su sve veći eko nomski i geopolitič ki rizici. Ekonomski rizici ukazuju na sve veći ri zik in ve sti to ra usled netransparentnosti infor maci ja, sukoba inte resa subjeka ta korpo ra ci ja, ali i loših ko munikacionih veza, što vr lo često do vodi do nerelevant nih in for ma ci ja ko je uspo ra va ju pro ces od lu či va nja, špe ku la tiv nih ak tiv no sti, itd. Ge o po li tič ki ri zi ci ra stu, sa po ra stom bro ja po li tič ki ne sta bil nih pod ruč ja, pa čak i sve većeg broja teritorija pod sukobima. Sve prethodno iz lože no govori u prilog nužnog menjanja i reforme investicio ne po li ti ke na različitim nivo ima ekonomske aktivnosti, od nacionalne do global ne eko nomije. Suština ovih reformi treba da je bazira na na stvaranju mehani za ma ko ji će ublažiti ili eliminisa ti rizike, kreirati instrumente za spro vođe nje istih i po boljšati struktur nu kohe rentnost i proces investi ranja. Analizom determi nan ti okruženja i cilja ka ko jem treba usme riti nove okvire investicionih politi ka, do la zi se do za ključ ka da po ten ci jal tre ba da je usme ren na sek tor uslu ga, sa po seb nim na gla skom na in for ma ci o ne teh no lo gi je. Svetska investi ci ona po litika trenutno stanje Na osnovu izveštaja UNCTAD-a, 2015, osnovni investicioni trendovi u go dini se mogu definisa ti na sledeći način: 4 Čak 80% investicionih poli tika je definisano u pravcu libe ralizacije i poboljšanja opštih uslova, Samo 8% mera ima lo je specifične cilje ve u pravcu ja čanja uloge privatnog sek to ra u iz grad nji odr ži vog raz vo ja kao što je in fra struk tu ra, zdrav stvo, obrazovanje itd. 31 novi međunarodni investicio ni sporazum je zaključen, sa nagla skom na održivi razvoj, Najmanje 50 zemalja je pod vrgnulo re viziji i kontro li postojeće investicio ne ugovore 228 zemalja ima određene uslove u nacio nal nom tretmanu prilikom zaključena akvizicija ili investiranja, 42 nova investi ci ona spora su otvorena (oko 7%) na re laciji država investitor, ukup no 608, od to ga bro ja 36% je do bi la dr ža va, a 27% in ve sti tor. Prethodni poda ci govo re da do la zi do velikih pomeranja u pogledu vo đenja in ve sticione po litike i navode na zaklju čak o nužnosti re for mi. Glo bal ni tren do vi, ipak, mo ra ju da se uslov no raz ma tra ju zbog po sto ja nja od stupanja u regio nal nim i strukturnim tren dovi ma, na ro či to između razvi jenih i zemalja u tranziciji. Upravo, na taj način posma trano, na globalnom ni vou SDI be le že pad od 16%, uče šće ze ma lja u raz vo ju iz no si isto rij skih 55%u ukupnim investi cija ma. Investicije prema razvijenim zemljama opale su za 28%, a u Evro pi be le že pad od čak 11%. (sli ka br. 1) Prilivi u ze mlje u tranziciji opali su za 52%, kao posledica regionalnih sukoba, kon flika ta i sankcija. Takođe, većina eko nomija, regio nal no posmatranih, bele ži pad u in ve sti ra nju, a kao uzrok se vi de glo bal na kre ta nja i ge o po li tič ki fak to ri. Mo gućnost poboljšanja ovih kretanja se vidi u smanjenu transakcionih troškova i po ve ća nju tr ži šta kroz od re đe ne vi do ve eko nom skog re gi o nal nog gru pi sa nja. 4 262 Tatjana Dragičević Radičević, Ljiljana Stanojević investiranja može tražiti i u regionalnom po vezivanju kroz ja čanje lan ca vrednosti, tj. ulaganjem u tehnološki raz voj. 5 Posle silaznog trenda u prethodnom periodu M&A u prekograničnoj saradnji u go di ni su po ra sli za 28% u od no su na go di nu. Ve o ma zna ča jan po da tak je da je taj trend uočen u svim eko no mi ja ma, sa na po me nom da su raz vije ne ze mlje za be le ži le rast od 16%, a ze mlje u tran zi ci ji rast od čak 66%.Ve o ma je zna čajna njiho va uloga u sek to ru usluga (rast od 36%), posebno te lekomunikacija ma, i to na ro či to na evrop skom tlu. In te re san tan je po da tak da je čak 50% M&A u ze mljama u razvoju bila ku po vina imovine od strane razvije nih ekono mija. 6 Ka da je sek tor sko po sma tra nje u pi ta nju, po sled nji do stup ni po da ci su da su uslu ge u pe ri o du od po ra sle za 63% ka da su u pi ta nju SDI. Kao re zul tat ta kvih kreta nja navo di se povećana libe rali zacija, naročito u sektoru finansija i teleko mu ni kacija. U sektoru usluga je zabeležen rast prekograničnih M&A za 37%. 7 Slika 1. Trendo vi uka zuje na determinisane probleme u međunarodnom investiranju, ali i otkriva ju pravce bu dućih kretanja, kao i moguće instrumente u funkciji sma nje nja de fi ni sa nih ri zi ka. 3. Reforme investicionih politika Ana li zi ra no sta nje u in ve sti ci ja ma na glo bal nom ni vou nu žno uka zu je na po tre bu spro vo đe nja in ve sti ci o nih re for mi. Na gla še nost ri zi ka ula ga nja ugroža va sprovođenje investicionih politika na svim nivoima i sve subjekte učesnike, a po sebno po veri oce. Prema izveštajima i zaključcima UNCTAD-a reforme investici o ne politike treba da su fokusirane na četiri nivoa i da obuhvataju pet područja. 8 Četiri nivoa obuhvataju: 9 Nacionalni, Bilateralni, Regionalni, Multilateralni nivo. Pet pod ručja, koja zahteva ju re forme u investicionim politikama su sledeća: 10 Sačuvati pravo regulacije javnog interesa, Reforma investicionih sporova, Jača nje promocije i olakšica za strana ulaganja, Obezbeđivanje od go vornosti investitora, Unapređenje sistemske koherentnosti. Kreiranje novih mehanizama u pravcu reforme investicionih politika na nacionalnom nivou je ste pr vi ko rak. U tom smi slu po treb no je stvo ri ti stra te ški pristup u definisanju kriteriju ma i okvira područja neophodnih investicionih reformi i us postavljanje novog okvira sa ciljem smanjenja nestabilnosti i rizika, povećanja efi kasnosti investiranja, institucionalnog jačanja i infrastrukturne izgradnje. Na bilateralnom nivou potrebno je in strumen te reforme usme riti na za jednič ku ak tiv nost u po gle du bo ljeg raz u me va nja, sa rad nje, pre go vo ra ugo vor nih stra na, a u pravcu po sti za nja konsenzusa. Po pi ta nju pod ruč ja u ko ji ma je nu žno spro ve sti in ve sti ci o ne re for me, pr vo se od no si na oču va nje pra va re gu la ci je jav nog in te re sa, što pod ra zu me va proce nu tro škova i koristi u potpisa nim IIA ugovorima. Do sa dašnji pristup stva ranja po volj ne klime, delimič no je stvarao ograni če nja po pitanju održavanja prava regula ci je shodno nacio nalnoj politi ci. Država mora zadržavati pravo regulacije u zaštiti jav nog in teresa ili ciljeva održivog razvoja. Ovakav pristup podrazumeva i reviziju po stojećih aranžma na i zaključivanje novih IIA pod nazivom Nova generacija. U ovim aktivnostima, UN CTAD naglašava i značajnu ulogu civilnog društva. Postojeći model rešavanja investicionih sporova naglašava neravnopravan po ložaj zemlje domaćina i investitora, u pogledu ve ćeg rizika kojem je izložena ze mlja do ma ćin, ne rav no prav ni po lo žaj do ma ćih i stra nih in ve sti to ra, ne dovolj ne tran spa rent no sti i ne za vi sne ar bi tra že. U no vom mo de lu tre ba iz gra di ti me ha ni zme ko ji će eli mi ni sa ti pret hod no na bro ja na ogra ni če nja, a funk ci ji obezbe đi vanja pravničnih postupaka. Promocije i olak šice u investiranju moraju bi ti u direktnoj po vezanosti sa ci lje vima nacionalne po litike, au funkciji odr živog razvoja. Ovo područje uključu je interaktivnu saradnju su bjekata na nacionalnom nivou sa drugim nivoima u defini sanju međunarod ne in ve sticione politike, kako u glo balu, tako i u pojedinačnim slučajevima. Odgovornost investitora je u postojećem mo delu IIA bila minimizira na, čak u određe nim nacionalnim zakono davstvima i zaštićena. U reformi investicionih po li tika, kao jedan od ključnih za da ta ka postavljen je cilj izgrad nje odgovornosti u pravcu maksimizacije koristi i doprinosa i mini mi ziranja negativ nih posledi ca. Sistemska koherentnost do sa da ni je po ka za la svo ju sna gu, pa je re for ma usmerena i u tom pravcu. Veliki broj ne re šenosti i nedoslednosti određenih pitanja i ne po sto ja nje me đu na rod nih prav nih in stru me na ta za nji ho vo re ša va nje, na met nuli su potrebu i iznalaže nje rešenja u no vom modelu investicionih politi ka. Neophod no je defi nisati instru mente koje će dovesti do tražene koherentnosti na nacionalnom i međunarodnom nivou. Sa gle da va ju ći sve de fi ni sa ne ne do stat ke po sto je ćeg mo de la in ve sti ra nja, ali i prav ce i okvi re u kojima se sprovodi reforma, kao i predložen okvir ni model reformi, po trebno je iz naći odgo va rajuće in strumente realizacije definisanih aktivno sti, ali i in ve sticionu po li tiku usmeriti strukturno u prav cu gde će ona pružiti naje fikasnije re zultate. Kao jedan od prava ca može bi ti investi ranje u informacione tehnologije, ko je pružaju dugoročno održivi razvoj, ali i u velikoj meri do prino se reali zaciji zacrta nih ciljeva u reformi in ve sticionih politika na međuna rod nom nivou. 7 Re forma investicione politike sa posebnim osvrtom na investicije Investicije u informacionim tehnologijama U ana li zi me đu na rod nih kre ta nja in ve sti ci ja, kao i bu du ćih re for mi u tom do menu, jasno se uočava potreba kom panija da smanje troškove i rizik, ali i uloga ko ju u tom domenu imaju IT tehnologije. Ulaga nja u informacio ne tehnolo gije i njiho va mogućnost da istovreme no dovedu do porasta prihoda, uz istovremeno smanje nje t ro š ko v a, pred me t su m no g i h i s t r a ž i v a nja i po lem ik a (K au ff ma n a nd Wa lden 2001; Ku la ti la ka and Ven ka tra man 2001; Sam ba murthy et al. 2003). Takođe, sprovedena istra živanja ukazuju i na to da IT investi cije imaju dugoročnu ispla ti vost, a ne samo kratkoroč nu, merenu trenut nim po ra stom produktiv no sti 24. Pr vo bit no ula ga nje u IT sek tor, bi lo je usme re no na tro škov nu ana li zu i za do voljstvo kupaca u funkci ji isporuke. 25 Bri nol fso ni Hit su još go di ne u svom is tra ži va nju po ka za li da in ve sti ci je u IT sektor su isplativije u odnosu na dru ge in ve sti ci je, i da ih je po treb no ana li zirati iz tri ugla pro duktivnosti, profita bil nost i po tro šač ki vi šak. 26 Na osnovu njihovih za ključaka i trendova u investicio nim kretanjima, mo že se za ključiti da ulaganje u IT tehnologiju ima trojako dejstvo: Transakciono Strateško Informaciono Transakcioni efekat investi cija u IT jeste sma njenje troškova, pa samim tim i sma nje nje ri zi ka, ko ji je da nas iz u zet no na gla šen zbog ne stal no sti i ne sta bilno sti u ekonomi jama svih drža va, pa i na regionalnom i glo balnom nivou. Ovaj transakcio ni efekat investicija u IT u skladu je sa defi nisanim reformama u investicijama. Strateški efekata se ogleda u dugoročnom efektu IT investicija, i stvaranju si ste ma ko ji je pri la go dljiv br zim tr ži šnim pro me na ma, po ja ča va la nac vredno sti, a samim tim i sofisticiranu potre bu kupaca/potrošača. Da kle, ovaj efekat je direktno u funk ciji izgradnje konkurentnosti, koja je neo phodni pred uslov u funkciji održivog razvoja. Informacioni efekat je onaj ko ji se naj če šće ve zu je za in ve sti ci je u IT, a to je pobolj šanje tokova informa cija i komunika cije, što je tako đe prepo znato kao nu žan preduslov u stvara nju boljih okvira in ve stiranja. Sva tri efek ta investicija u IT, u velikoj meri odgovaraju zacrtanim nivoima i pod ručjima delovanja nužnih reformi u pravcu poboljšanja investicionih politika. 23 Lucas, H. Osnov ni cilj ove re for me je ste usme ren u pet pra va ca, a to je: oču va nje pra va re gu la ci je jav nog in te re sa, bo lja regu la ti va u re ša va nju investicio nih sporova, pro mocija i olakšice u in ve sti ra nju, ve ća od go vor nost in ve sti to ra i iz grad nja si stem ske ko he rent nosti. U iz na la že nju no vih mo de la in vesti ranja, koji mogu odgovori ti na postavljenje zah te ve i ci lje ve, ula ga nja u in fo r ma ci o ne teh no lo gi je mo gu bi ti jed no od efi ka snih in stru me na ta, jer efek ti njihovog ula ganja su trodimenzionalni (transak ci o ni, stra te ški i in for ma ci o ni) i predsta vljanju u značajnom smislu doprinos iz grad nji efi ka snog si ste ma in ve sti ranja sa dugo ročnim, strateški održivim razvo jem. The main ca u ses are in cre a sed econo mic in sta bi lity and ge o po li ti cal risks. Gi ven the con ti nued ne ga ti ve trend, it is cle ar that it is necessary to reform the investment policies at the na tional, regional, bi lateral, mul ti la te ral and in ter na ti o nal le vel, to en su re su sta i na ble eco no mic de ve lop ment. Key ele ments of the re forms are: to provide instruments to reduce risks, create mechanisms of re spon si ble investment, improve the structu ral coherence and pro mote regional in vestments. Re fer to the cur rent da tes of the sec tors in vest ments (ac cor ding to the re port of UN CTAD from 2015th) shows that the ser vi ces sec tor re cor ded do u ble growth com pa red to the in vest ment in the ma nu fac tu ring sec tor in Al so, if we ta ke in to con si de ration the fact that in vest ment in IT sec tor in vest ment in vol ves three aspects: tran sac ti o- nal (minimizing costs), strategic (innova tion technologies, achieving competitiveness) and in forma tion (improving access to in formation and communications), it may be assumed that the re forms in the investment policies sho uld be di rectly correlated with in vestments in information technology.
