These plats are in the review process and are pending the submittal of corrections by the applicants to bring the plats into compliance with City requirements. It is the recommendation of staff that these plats be disapproved without prejudice pending the submittal and review of the corrected plats. A public hearing may be recessed and continued any time after the hearing has commenced. Section C of the UDC states if a postponement or continuance of a public hearing is to a specific date and time no later than 60 days from the first or most recent hearing, the announcement of the postponement of continuance at the public hearing in which the application has been postponed or continued by the Planning and Zoning Commission shall be sufficient notice and no additional notice is required. 4 Planning and Zoning Commission Meeting Agenda January 6, 2014 Public Hearings Members of the public may address the Commission on items listed on the agenda under Public Hearing Items. Persons wishing to address the Commission must first complete a request to speak card. A person may also use the request to speak card to indicate his or her support or opposition to a case without speaking. Cards may be picked up at the desk by the entrance to the City Council Chambers and may be deposited at the desk or given to a staff member. Speaking time is generally limited to five minutes per speaker. Per the by-laws of the Planning and Zoning Commission, the applicant and those favoring the request shall have a maximum of 30 minutes, including rebuttal, to present their arguments for the request. Those in opposition to a request shall have a maximum of 30 minutes to present their arguments against the request. When a large group is present, it is encouraged that representatives be appointed to speak for the group so that redundant testimony is minimized. Commissioners may have questions of those speaking at the public hearing. The time used to answer the Commission's questions will not be deducted from the allotted 30 minutes. Local Government Code Section requires that the body with approval authority over plats take action within 30 days of the plats being filed with the City, otherwise the plats are deemed approved. Staff recommends that the following listed plats be disapproved without prejudice pending completion of the City's review process and submittal of corrections by the applicants. This is necessary in order to avoid having the following plats considered approved even though they are not in compliance with all City requirements. AGENDA PUBLIC HEARING ITEM: #4 S130503A - Site Plan Amendment - Greenhouse (City Council District 1). Chief City Planner Jim Hinderaker presented the case report and a Power Point presentation to the Commission for approval of a Site Plan Amendment to allow for reduced parking. The subject property is located east of N. Highway 360 and south of Avenue J East and is zoned Planned Development 329A (PD-329A) District. The agent is John Wheeler and the applicant is Reed Shandoff, American Addiction Centers. Mr. Hinderaker stated the Greenhouse is a for-pay inpatient drug and alcohol treatment facility primarily engaged in providing diagnostic, medical treatment, and monitoring services for individuals who suffer from substance abuse disorders. The Greenhouse is a closed campus facility. Patients, once signed-in, are not permitted to come and go. As a matter of policy, residents are not allowed to bring vehicles to the facility. Mr. Hinderaker stated the Development Review Committee has no objections to the Site Plan amendment to reduce the required parking from 145 parking spaces to 114 parking spaces. Chairman Garrett noted there were no questions for staff, opened the public hearing, and asked for speakers. Reed Shandoff and Lincoln Davis with America Addition Center, th Street, Grand Prairie, TX, and John Wheeler, 6455 Stichter Avenue, Dallas, TX, were present representing the case and to respond to questions from the Commission. 11 PLANNING AND ZONING COMMISSION MINUTES, DECEMBER 2, 2013 AGENDA PUBLIC HEARING ITEM: #5 TA Text Amendment - Article 4 Permissible Uses; Appendices F, I, L, O, P, R, S, T and U. Chief City Planner Jim Hinderaker presented the case report and a Power Point presentation to the Commission for approval of a Text Amendment to Article 4 Permissible Uses ; Appendix F Corridor Overlay District Standards ; Appendix I I-30 Overlay District; Appendix L SH 360 Overlay District ; Appendix O Hospital District ; Appendix P Beltline Corridor Overlay District ; Appendix R Central Business District ; Appendix S I-20 Overlay District ; Appendix T SH 161 Overlay District ; and Appendix U Lakeridge Parkway Overly District of the Unified Development Code to remove Pawn Shop as a permissible use by right from the General Retail (GR), Commercial (C), Commercial One (C-1), Central Area (CA), Heavy Commercial (HC), and Heavy Industrial (HI) Zone Districts and all overlay districts, the HO District, and all CBD Districts, thus limited Pawn Shop as a permissible use by right in only the Light Industrial (LI) Zone District. The owner/applicant is the Planning Division, City of Grand Prairie. Mr. Hinderaker stated staff was asked to review current Texas State Law, Grand Prairie Code of Ordinances, and the Unified Development Code (UDC) regulations relating to pawn shops and to propose an amendment that would limit the proliferation of pawn shops within the City. Mr. Hinderaker stated Article 4 of the UDC currently permits Pawn Shops as a use by right (requires no approval from P & Z or City Council) in the following seven (7) zoning districts: GR- General Retail, C-Commercial, C-1-Commercial, CA-Central Area, HC-Heavy Commercial, LI-Light Industrial, and HI-Heavy Industrial; as well as a number of Planned Development zone districts. However, as stated above, the LGC permits cities to limit pawn shops to a single zoning district. Mr. Hinderaker stated there are a total of 4,117 non-residential, non-public parcels in Grand Prairie. The UDC currently permits Pawn Shop uses on 2,922 parcels and 43 Planned Developments permit Pawn Shop uses. Reducing the number of zoning districts where pawn shops are permissible will create a number of non-conforming land uses. However, in accordance with Article 19: Non-Conforming Development, non-conforming uses, structures, or buildings may be continued under the regulations of the Unified Development Code. Mr. Hinderaker stated the Development Review Committee (DRC) and the City Council Development Committee recommends approval of the proposed amendments to Article 4 Permissible Uses ; Appendix I IH-30 Overlay District ; Appendix L SH-360 Overlay District ; Appendix O Hospital District ; Appendix P Beltline Corridor Overlay District ; Appendix R Central Business District ; Appendix S IH-20 Overlay District ; Appendix T SH-161 Overlay District ; and Appendix U Lakeridge Parkway Overlay District, all of the Unified Development Code as shown in the draft ordinance. 3

AGENDA PUBLIC HEARING ITEM: #6 TA Text Amendment - Article 6 "Density and Dimensional Requirement and Article 16 Site Plan Approval. Chief City Planner Jim Hinderaker presented the case report and a Power Point presentation to the Commission for approval of the Unified Development Code to establish a unified development process allowing a lot to be used together with 1 or more contiguous lots for a single use or unified development regardless of lot ownership. The owner/applicant is the Planning Division, City of Grand Prairie. Mr. Hinderaker stated a proposed amendment to the Unified Development Code to the establish a unified multi-family development process to enable property owners of adjacent and contiguous platted lots to develop a multi-family complex that crosses internal property lines of platted lots that may or may not be under different ownership. This text amendment creates a new development tool that may be utilized by a developer, to develop a tract of land with multiple lots under different ownership that for financing reasons cannot be joined. The new tool will essential treat multiple platted lots, under different ownership, as a single tract of land for determining and applying the dimensional standards of the UDC. Mr. Hinderaker stated the Development Review Committee (DRC) and City Council Development Committee recommends approval of the proposed text amendment to Article 6, Density and Dimensional Requirements and Article 16 Site Plan Approval of the Unified Development Code as shown in the draft ordinance. PURPOSE OF REQUEST: As required by Ordinance for Specific Use Permit 906 the City Council shall conduct a public hearing one (1) year after City Council adoption of this Ordinance to confirm compliance with all applicable codes which shall include, but not be limited to, the requirements of this SUP Ordinance, the Unified Development Code, the City of Grand Prairie Code of Ordinances, City adopted building codes, city adopted fire codes and other applicable regulatory requirements and/or enforced by the state and federal government. STATUS: As required staff requested inspections of the property and operations by the Code Enforcement Division and the Environmental Services Department. The inspections conducted indicated that all operations on the site appear to be in conformance with the conditions of the Specific Use Permit as approved by City Council. RECOMMENDATION: Staff is recommending renewal of the Specific Use Permit and that no further monitoring be required by the Planning & Zoning Commission and the City Council unless recommended by staff. WHEREAS, the owners of the property described herein below filed application with the City of Grand Prairie, Texas, petitioning an amendment to the Zoning Ordinance and map of said city so as to amend the zoning designation of said site for a Specific Use Permit for Auto Body Shop and Paint Booth Uses, with Outside Storage in a Light Industrial (LI) District; and; WHEREAS, the Planning and Zoning Commission of Grand Prairie, Texas, held a public hearing on said application on November 5, 2012, after written notice of such public hearing before the Planning and Zoning Commission on the proposed Specific Use Permit had been sent to owners of real property lying within 300 feet of the property on which the creation of a Specific Use Permit for Auto Body Shop and Paint Booth Uses, with Outside Storage in a Light Industrial (LI) District; is proposed, said notice having been given not less than ten (10) days before the date set for hearing to all such owners who rendered their said property for City taxes as the ownership appears on the last approved City Tax Roll, and such Notice being served by depositing the same, properly addressed and postage paid, in the City Post Office; and WHEREAS, after consideration of said application, the Planning and Zoning Commission of the City of Grand Prairie, Texas voted 9 to 0 to recommend to the City Council of Grand Prairie, Texas, that said Zoning Ordinance and Map be amended to allow a Specific Use Permit for Auto Body Shop and Paint Booth Uses, with Outside Storage in a Light Industrial (LI) District; and WHEREAS, notice was given of a further public hearing to be held by the City Council of the City of Grand Prairie, Texas, in the City Council Chambers, Grand Prairie City Hall, located at 317 W. College Street at 6:30 o'clock P.M. on November 20, 2012 to consider the advisability of amending the Zoning Ordinance and Map as recommended by the Planning and Zoning Commission, and all citizens and parties at interest were notified that they would have an opportunity to be heard, such Notice of the time and place of such hearing having been given at least fifteen (15) days prior to such hearing by publication in the, Fort Worth Star Telegram, Fort Worth, Texas, a newspaper of general circulation in such municipality; and WHEREAS, The City Council of the City of Grand Prairie voted 8 to 0 to recommend approval of the Specific Use Permit on November 20, 2012 by the adoption of Ordinance WHEREAS, as required by Ordinance , Section 3.1 a review by City Council is required one year after approval. 18 File #: , Version: 1 LIGHT INDUSTRIAL (LI) DISTRICT; Definitions of Permitted Uses: Auto Body & Paint Shop: Means an auto repair facility that does repairs of the frame and body by the process of pulling, beating, part replacement, application of body putty, sanding, and wet sanding to prepare a vehicle for painting. Then paints the vehicles in an approved paint booth, buffs, and polishes to provide a like new auto paint finish. General Auto Repair: Means maintenance, repair, or replacement of the alternator, generator, starter, water pump, battery, brakes or other minor part thereof; minor tune up (which consists of distributor cap, rotor and spark plug replacement); change of oil and filter, fan belt, or hoses; lamp replacement; repair of flat tires; muffler replacement/repair; lubrication. Repair in this case may also include service of air conditioning, cooling system, or similar component system. This may also include state vehicle inspections and the minor repairs necessary to pass state requirements Outside Storage: The placement of articles, including merchandise, inventory, equipment, machine and other material, which are not currently in use, in an uncovered area. All outside storage is required to be screened with a solid fence in accordance with Article 8 of this Code. Conditions: 1. All operations must be done in compliance with the approved site plan and operational plan as approved by City Council. 2. All development and use of the SUP Area will be required to meet minimum performance standards relating to noise, glare, smoke or particulate matter, odorous matter and vibration as specified in the Unified Development Code. 3. Future expansion of the facility must be done by submitting a revised site plan for review and approval to the Planning Department. 4. Dumpster screening elevations and details must be shown on the approved site plan and location must be approved by city solid waste contractor. 5. All operations shall be performed in compliance with City Ordinance # 7408 Automotive Related Business regulations. 6. Operation of an auto body shop with paint booth shall be conducted in accordance with the requirements of the 2003 International Fire Code (IFC) and the adopted amendments. 7. The storage and use of flammable and combustible liquids in repair garages shall comply with Chapter 34, IFC. Paint and thinner storage shall not exceed 30 gallons. 8. Welding, cutting, open torches and other hot work operations and equipment shall comply with Chapter 26, IFC. 9. Operations which involve the application of flammable finishes shall comply with Chapter 15, IFC. 10. Cross connection devices may be required under the provisions of City Code Chapter 13 Article X depending on how water willbe used in the facility. Any cross connection devices that are required must be shown on all plan submittals to building inspections. It is required that you provide the make model and location of the backflow preventer to be installed. This information is required during the first submission of building permits. Testing fees for backflow prevention devices must be paid prior to issuance of building permits. 11. The Environmental Services Department requires a sample point be installed on the sanitary sewer line. The location and a sample point detail must be shown on the building plans submitted for review with the application for a building permit. All property owners or facility owners shall contact the City s solid waste contractor for information regarding dumpster location and access. Mechanical garbage and trash compactors shall conform to city code sections and The general contractor shall be held responsible for ensuring compliance with these city codes. 13. No operations or activities may result in creation of a nuisance as defined in city code 29-68(12) to (29). Specifically, no building, road or construction activity may cause water to stand and result in mosquito harborage. 14. All noise created during the construction and subsequent operational activities conducted on the subject property must comply with City Code Chapter 13, Article XIII, Section s to Construction must be limited the daytime hours between six o clock a.m. and ten o clock p.m. when constructing a building with 300 feet of a residence. 15. The facility must maintain manifests detailing the types and amounts of chemicals stored within the building area and maintain manifest of their disposition to a state or federally approved disposal site. 21. No parking or storing of vehicles will be permitted on an unpaved surface. 22. No salvaging of any type shall be done inside the SUP area. 23. All damaged vehicles awaiting repair must be screened from public right-of-way in conformance with the standards of screening and setbacks. 24. A pipe fence shall be installed at the property line in front of the building to limit parking in landscape area adjacent to public right-of-way. 25. Recycled asphalt does not meet the landscaping requirement for ground cover, it must be removed and replaced with grass or other approved ground cover. All landscaping must be irrigated to current city standards. 26. Move the existing fence and gate a minimum of 18 feet from public right-of-way to allow stacking in drive prior to gate being opened. 27. Must maintain compliance with all federal, state and local environmental regulations. 28. Must practice all best management practices listed in its storm water pollution prevention plan. 29. SECTION The Specific Use Permit (SUP) shall automatically terminate in accordance with Section of the Unified Development Code if no building permit is issued for Auto Body Shop and Paint Booth within one (1) year after City Council adoption of this Ordinance, or upon cessation of the use for a period of six (6) months or more. a. If a building permit is not required for Auto Body Shop and Paint Booth, the Specific Use Permit shall automatically terminate if no certificate of occupancy is issued for Auto Body Shop and Paint Booth within six (6) months after City Council adoption of this Ordinance. 2. Furthermore, by this SUP Ordinance, the Specific Use Permit shall automatically terminate if no certificate of occupancy is issued for Auto Body Shop and Paint Booth within six (6) months after the issuance of a building permit. 3. REQUESTED APPEALS BY OWNER/APPLICANT: Masonry The UDC (Section ) requires buildings in the Light Industrial (LI) District, and adjacent to a designated arterial thoroughfare, to be 100% masonry or glass and providing that 15% of the front façade include an accent masonry material, texture, or color.
