11 PUBLIC COMMENT Ms. Kimberly Buchheit made comments regarding hesitating to submit continuing education courses under laws and rules unless it is related to statutes or rules. Mr. Lamar Evers said that he thought it was a fine line and he has always looked at the laws and rules as what governs his practice in Florida. He said that we need to watch this issue in the future. Mr. Jeff Lucas said that he has been studying and teaching the law and that court decisions are how the law has become homogenized sometimes crossing boundaries into other states. He said that he would suggest that the courses be submitted as general. Mr. Jeff Carlan said that he was a consultant to the Board in the past and it was the Board s intent that surveyors become familiar with the statutes, rules, and laws. Ms. Harper said that it specifically states in F.A.C. 5J-17 that when courses are submitted to the Board for review, that if proposed laws and rules continuing education courses do not specifically cover Chapters 177 and 472, F.S., or Chapter 5J-17, then the continuing education provider must provide the Board with a detailed written explanation as to how the proposed laws and rules continuing education course rationally relates to your practice. Mr. Petzold said that it is a possibility to split courses that are determined to contain some general and some laws. Mr. Fusco said that he didn t think that courses submitted to the Board should not be split up. He also said that Lucas and Company, LLC s Land Boundary Master Class should not be split up.
