Minutes of a Regular Council meeting held in the Council Chamber on Monday, May 3rd, 1982, at 7:04 p.m. All the members of Council were present with Alderman Schrenk entering the meeting as indicated in the minutes. Also present were the Municipal Manager and the Municipal Clerk. A. ADOPTION OF MINUTES: 1. Seconded by Alderman Bose That the minutes of the Regular Council meeting of April 26th, 1982, be adopted. RFS.NO.K (a) Moved by Alderman Bose Seconded by Alderman Fomich That the minutes of the Council-in-Committee meeting of April 26th, 1982, be received. FW3.NO.K-357 RES. NO. K-358 (b) Moved by Alderman Bose Seconded by Alderman Whittaker That the recommendations of these minutes be adopted, except the recommendation dealing with budget amendments, as this recommendation was dealt with at the Regular Council meeting held on April 26th, B. DELEGATIONS : 1. Mr. D.R. Stewart of 1313 South Ogden Drive, Los Angeles, California, was to be present regarding a Section 936 Order on a dilapidated building located at th Street.

2 Mr. Stewart was not present at this meeting. RES. NO. K-359 Moved by Alderman Whittaker Seconded by Alderman Fomich That the Council of The Corporation of the District of Surrey hereby declares that the dilapidated building located on Remainder of Lot Eighteen (18) of the East Fifteen (15) Chains of Section Twenty-Four (24), Block Five (5) North, Range Two (2) West, Plan Nine Thousand Fourteen (9014), New Westminster District, being th Street, Surrey, B.C., is in so dilapidated and uncleanly a condition as to be offensive to the community. It is hereby ordered that the said building be demolished, foundation removed or filled in with clean granular material, if necessary, and all debris be removed from the site by the owner or agent of the owner within thirty (30) days of service of this order upon them. It is further ordered that, should the owner or agent of the owner fail to comply with the aforesaid order within the said period of thirty (30) days, the Permits & Licenses Department, by our own workmen or contractors, may be instructed to enter on the land and demolish the dilapidated building and remove the debris from the site at the expense of the owner, and the charges for so doing, if unpaid by the owner on the 31st day of December of any year, shall be added to and form part of the taxes payable in respect of that land as taxes in arrears. 2. Watson Construction Ltd. of th Avenue, Maple Ridge, B.C. was to be present regarding a Section 936 Order on an excavation located at th Street. V Mrs. Watson of 2210 Glenwood Drive, Maple Ridge, B.C. was present concerning the excavation located at th Street. Mrs. Watson indicated that a home was going to be built on the site and proper drainage had been installed, to prevent water from ponding. Mrs. Watson indicated that the site had also been inspected by the Municipality. RESeN0.K-360 Seconded by Alderman Bose That consideration of this 936 Order be tabled, pending a further report from the Manager. 3. Mrs. J. Eddington and Mr. Drudl were present on behalf of the West Newton Local Area Planning Committee to present the West Newton Plan. Mr. Drudl indicated that the Local Area Planning Committee did accept the very short time limit from Council and did the very best they could to come up with an acceptable plan within the time allotted. Mr. Drudl added that the Local Area Planning Committee had had its final meeting with the Planning Committee, Council, the School Planner, the Engineers, the Parks Administration and the Director of Planning. Mr. Drudl pointed out that any II 2.

3 constructive criticism and suggestions from these meetings had been discussed at a final meeting of the Committee and, where warranted, the changes had been implemented into the policies and map being presented to Council for consideration. Mrs. J. Eddington then outlined the following changes, which are excerpts from the West Newton Community Plan: Page 3: 2) Distribution of a questionnaire on which residents and absentee property owners could give their opinions on possible types of development and the quality of services on the west side of Newton. About 6,200 questionnaires were mailed out. Due to confusion and errors in the mail, many people did not receive the questionnaire. Although about 213 usable (of 228) responses were received, the reliability of the data was uncertain because of the problems with distribution through the mail. However, the Committee did examine the responses to the questionnaires and used the information as the basis of this plan. Y U 5) Public presentations of the draft plan were made to the Newton Ratepayers Association and West Newton residents. At the latter meeting, lively detailed discussion took place in small groups. The draft plan was well received, with only a few minor changes. Page 4: - C. Page 6: 3) To raise the average density, the townhouses would not only be placed around the commercial areas, but along Scott Road, and scattered through the individual neighbourhoods. Mr. Drudl indicated that the Local Area Planning Committee recommended that the proposed increase in housing density west of 128th Street would be in proportion to existing family neighbourhoods east of 128th Street. noted that the overall density is only 9 to 10 units per acre in the proposed plan. Page 8: (10) Three areas are proposed for mobile homes. Each of these areas would have 50% mobile homes and 50% compact housing. They are: the west side of 124th Street, between 72nd Avenue and 75th Avenue; south side of 64th Avenue, east of 122 Street; and the northeast corner of 68th Avenue and 123rd Street. Page 11: (4) A new north-south collector road is proposed to run between 60th Avenue and 76th Avenue along 122/123/124 Streets. Should Delta not permit connections to the Annacis Crossing along 64th, 72nd and 80th Avenues, there will be more north-south traffic and 124th Street, north of 75th Avenue, would have to be upgraded to a major collector road. 4.

5 Page 12: 7) Because arterial roads will eventually carry 4 lanes of traffic, the noise and disruption to the residents along them will be great. To minimize the disruption, the Committee recommends that there be landscaped mounds along arterials. Houses would have their accesses from a local road. Detailed design should guarantee noise reduction and attractive landscaping, at the least cost. Page 14: 2) The open space required under the townhouse and compact housing zones would be combined to create green areas between the neighbourhoods, for pathways and recreation. These linear open spaces would be developed to form a network of bicycle trails. 5) When sites are cleared for development, the landscaping plans should include reforestation. 6) The Committee acknowledges that when the Surrey Administration does detailed planning, the green spaces will vary in width. Our plan is conceptual only to give an impression of how we would like to see open spaces created between neighbourhoods. The green spaces on Scott Road were reduced in width because the Committee felt that only a pathway was required because Scott Road could become a major commercial centre in Delta. Future development in West Newton could change the location and width of the open spaces shown on our plan. Page 16 : J. Servicing programs could permit development to commence at either the north or the south ends of the study area. Should any of the major developments (shopping centre at Scott Road/64th Avenue, tourist village, Kwantlen College campus, or the business park) not occur for any reason, then the designated uses on the plan should be replaced by additional neighbourhoods containing townhouses and compact housing. Alderman Schrenk entered the meeting. Mrs. Eddington indicated that this was the Local Area Planning Committee's amended Plan and, since the Committee had input from every avenue available (ratepayer and planning groups, public meetings, resource people, Administration and Council) the Committee asked Council to consider implementing this Plan into the Official Community Plan. 5.

6 Mrs. Eddington indicated that, in the Local Area Planning Committee minutes of April lst, the Committee asked for Council's approval to permit copies of the finalized concept Plan for distribution to the public and to members of the West Newton Property Owners Association at a suggested price of $1.50 for the map and $1.00 for the brief; also, complimentary copies to be distributed to all of the resource people and the community groups that were involved in the preparation of the Plan. Mrs. Eddington stated that the Committee was asking for Council's approval of this recommendation this evening. U Mr. Drudl then commented on a letter received from the Newton Community Ratepayers Association, dated April 19th, regarding two policies mentioned in the West Newton Plan. In connection with the minutes, Alderman Schrenk stated that the Committee had indicated that the monies set aside for the Bothwell Farm could be utilized to turn the farm into a heritage park, Alderman Schrenk also added that the Committee would be advised that a tree preservation by-law was not feasible nor possible at this time. The Mayor read the following proclamation regarding "Posture Week" : 7.

8 WHEREAS WHEREAS PROCLAMATION FOR POSTURE WEEK the British Columbia Chiropractic Association is sponsoring Posture Week from May 1 to 7, endeavouring to educate the public on the value of correct posture and to develop a consciousness on this important health problem; and correct posture, especially when developed in young people, is one of the greatest contributing factors to better health, physical endurance, working efficiency and attractive appearance. w NOW, THEREFORE, I Don A. Ross, Mayor of the Municipality of Surrey welcome the opportunity to call upon all civic organizations, schools, and youth organizations to co-operate with the chiropractic profession of British Columbia in an educational program to make people aware of the value of correct posture and of its benefits to our public health standards. I hope every boy and girl will learn the habits of correct posture which can do so much to keep us all alert and healthy people. Elks and their auxiliary, the Order of the Royal Purple, established at the 1967 convention a program to be known as the Elks Purple Cross Deaf Detection and Development Program; and WHEREAS WHEREAS such program was established to bring about the earliest identification of the hard of hearing child by continuing to search out ways to assist in the development and rehabilitation of the hard of hearing child; and such detection and development in infancy is vitally important, if appropriate assistance in developing language and speech are to be provided; and U 8.

9 WHEREAS assistance is needed in co-ordinating and upgrading all programs in Canada in their continual campaign to search and find this hidden handicap in Canadian children through continued co-ordination and consultation with qualified audiologists, speech pathologists, educators of the deaf, medical and professional agencies and educational programs. Item 2786 ( ) South Surrey The Manager submitted a report from the Municipal Engineer regarding the public image of Surrey adjacent to White Rock. In connection with the post office, the report indicated that businesses such as the Bank of Commerce in the Ocean Park Shopping Centre and residents of South Surrey, typically give their return address as being in White Rock. This is because mail reaches them more speedily via the White Rock Post Office than through other Surrey Post Offices. The report noted that the White Rock Post Office is located on 24th Avenue in Surrey and it was regrettable that the Post Office did not change the name of the Sub Station when the new Post Office was built on 24th Avenue. Ir In connection with schools, the report indicated that many children who live in South Surrey attend the school located in Surrey, known as the "White Rock Junior Secondary School". 17

18 In connection with cable television, the report indicated that South Surrey receives "White Rock Cablevision Limited" and this station carries White Rock news and relatively little Surrey news. I In connection with newspapers, the report indicated that the "White Rock/Surrey Sun" and the "Peace Arch News" typically carry more substantial coverage of events in White Rock than in Surrey. The report noted that some people in South Surrey are more comfortable with the identity or image of White Rock than with that of Surrey. The report added that Council might wish to pursue the development of a South Surrey entity and the words "South Surrey" could be added to the names of public facilities in the area. In regard to "Welcome To Surrey" signs, the report indicated that such signs should not go on roads leading from the balance of Surrey into South Surrey; and neither should they go on roads leading out of White Rock into South Surrey. The Manager pointed out that Council could consider calling South Surrey - "Semiahmoo". RE3.NO.K-406 Moved by Alderman Schrenk Seconded by Alderman Fomich That the information be received. Item 2787 ( ) South Surrey/White Rock Pool Alderman Watkins returned to the meeting. The Manager submitted a report from the Parks & Recreation Administrator dealing with the South Surrey/White Rock Indoor Swimming Pool. The report indicated that the Parks & Recreation Department had just resumed full operation, after the annual maintenance shutdown which took place during the month of March. As a result, the pool has lost two weeks' revenue, being approximately $8, to $10,000. At the same time, the Parks & Recreation Administrator indicated that 80 percent of the yearly budget is spent during this period. Therefore, the cost figures provided would grossly exaggerate the operation, because of this fact. The Parks & Recreation Administrator indicated that the revenue and expenditures are in line with the budget and the Department is continuing to make changes to adapt to new situations as they arise. The report concluded that the Department: has rearranged staff schedules, which will clearly identify a labour savings at the end of the year; staffing is at a minimum and it will continue to be kept at this level

K-408 Item 2788 ( ) Access to Scott Road The Manager submitted a letter from the Municipal Engineer dealing with a request for vehicular access to Scott Road, north of Old Yale Road. The report indicated that Mr. Zeeman has not forwarded any background information concerning this matter. The report stated that the Ministry of Transportation and Highways has restricted access to Mr. Zeeman's property on Scott Road, north of Old Yale Road, to right turn ingress and egress. The report noted that it is the Ministry's position that any new development proposals in this area should be permitted only restricted access to Scott Road. The report added that there are two unconstructed Municipal rights-of-way, Fir Road and Span Road, connecting Mr. Zeernan's property directly to Old Yale Road. Seconded by Alderman Jacobs That the information be received and a copy of this report be forwarded to Mr. Zeeman. U Item 2789 ( ) Sanitary Landfill Operation The Manager submitted a report from the Municipal Engineer dealing with the Port Mann Sanitary Landfill Operations. The report indicated that Alderman Schrenk expressed the following concerns regarding the operation of the landfill: (1) That we are receiving more sand fill from Wooden's Pit than is required and that our contract with the hauler would not allow us to stop delivery without payment. (2) That hog fuel is being dumped, at times, during the night by persons with a key to the landfill gate. The report indicated that, in the matter of the sand fill, the Municipality is not receiving more than is required. The report pointed out that, on several occasions in the past, the Municipality has stopped the contractor from hauling at no cost to the Municipality, to avoid over-deposits, and the Municipality will continue to control delivery in this manner. The report added that the contract price is far below what it would cost the Municipality to do the work and the Municipality occasionally has 19.

20 the contractor haul clay fill for slope stabilization and base for the future industrial road in that area. The report noted that hog fuel is required to build temporary access roads over the sand fill within the landfill site, as vehicles cannot move over open garbage or sand. The report indicated that McKenzie Mills provides hog fuel material at a cost of $7.50 per unit and they operate on a 24-hour day basis Monday through Friday and, in order to get sufficient quantities for the Saturday operation, the Engineering Department allows them to deposit the hog fuel at night. The report noted that this is particularly important on Friday nights, because the landfill operates on Saturdays, but McKenzie Mills does not. The report concluded that the Municipality's agreement with McKenzie Mills provides the Municipality with hog fuel at considerably less cost than quoted by other suppliers and the Municipality has dealt with them for a number of years. Item 2790 ( ) Frostrup Development - Driveway Access The Manager submitted a report from the Manager, Administrative Services - Planning dealing with an application for Soil Removal under By-law No The report indicated that, on April 19, 1982, By-law No was introduced, first and second readings were given, and May 10, 1982, was the date set for the Public Hearing. This By-law was to designate a portion of Lot 6 of the South Half of the North West Quarter of Section 34, Township 7, Plan 5097, New Westminster District, as a soil removal area. The report noted that the Municipality has now received detailed plans of the proposed operation, and it seems evident that it will be contrary to Section 275 of the Mining Regulation Act and Section 2 of the Surrey Soil Removal and Depositing Regulation By-law, 1979, No The Manager pointed out that access to 192nd Street is available during the soil removal. After the soil removal is completed, Frostrup may construct an access as planned, without Council approval, to provide access to the remainder of the Parcel. In addition, the Manager indicated that this approval granted on the soil removal should be deferred and the Public Hearing postponed, pending further study and an additional report. 21 Item 2791 ( ) Zoning at Beecher Street The Manager submitted a report concerning the delegation to Council by Mr. Brookes concerning the rezoning of property at Beecher Street. The Manager was recommending that this property be rezoned to R-F. RES. NO. K Moved by Alderman Easton Seconded by Alderman Campbell That Application be approved to proceed for rezoning from C-L Local Commercial Zone to R-F(R) Restricted Single Family Residential Zone, pursuant to the provisions of Section 716 of the Municipal Act. Such approval to be valid for six months from this date. with Alderman Schrenk against. Item 2792 ( ) Strata Title Duplex 12168/70-102nd Avenue The Manager submitted a report from the Chief Inspector dealing with an application for Strata Title at 12168/70-102nd Avenue. The report indicated that the strata conversion has now been processed by the Permits & Licenses Department and was submitted for Council's approval, subject to the recommendation that the Engineering Department collect an additional $ water connection fee. The Manager was recommending that the Strata Title at 12168/70-102nd Avenue be approved, subject to the Engineering Department collecting an additional $ water connection fee. Seconded by Alderman Bose That the Strata Title not be approved. RES.NO.K-412 This motion was Defeated with Aldermen Bose and Fomich in favour. RES. NO. K-4 13 then approved. Item 2793 ( ) Surrey Gymnastic Society The Manager submitted a letter from the Deputy Secretary Treasurer of School District 36 dealing with the Surrey Gymnastic Society - Gymnastic Centre at Frank Hurt Secondary School. 21.

22 The letter indicated that the School District had now found a way to overcome the earlier hurdles which required the Municipality to play the role of a vehicle through which the School District could arrive at an arrangement with the Gymastic Society. The letter added that the School District was now finalizing a direct agreement between the School District and the Society. The letter was suggesting that the agreement between the Municipality and the School District, pertaining to the Surrey Gymnastic Society, be cancelled. e The Manager was recommending that Resolution No. G-997 authorizing the agreement between the Municipality and the School District be rescinded. RES.NO.K-414 approved. Moved by Alderman Foniich Seconded by Alderman Whittaker That the recommendation of the Manager be Item 2794 ( ) Agreement - W.E. Kinvig School and Park The Manager submitted a report from the Parks & Recreation Administrator dealing with a Joint Use Agreement for the W.E. Kinvig School/Newton Park. - The report indicated that on January 29, 1982, the Parks & Recreation Administrator submitted a Joint Use Agreement which was endorsed by the Parks IS Recreation Commission at their meeting of January 28, 1982, and was subsequently recommended for Council's consideration. The report stated that the Agreement had been reviewed by the Municipal Solicitor and the School District, and the necessary recommended changes have now been incorporated. The report noted that this Agreement is a result of negotiations which have gone on with both the School District and the Department of Education, relative to the Department's decision to limit the actual size of this elementary school sire, because of the availability of the abutting Newton Park. The report noted that the Municipality strongly opposed this decision with the result that the Department of Education agreed to contribute $100, towards the development of an approximate one-acre site at the extreme north end of the Park, as identified in the Agreement. The School District will have the use of this area during normal school hours, after which time it will revert to much needed community use. The report concluded that the Commission was recommending that the term of the Agreement be ten years only. The Manager was recommending that the Agreement be approved, that the Mayor and Clerk be authorized to sign the documents, and that Surrey Council advise the School Board that in future the area of the school site must be independent of the adjacent park. Moved by Seconded That the Alderman Easton by Alderman Whittaker recommendation of the Manager be Item 2795 ( ) Slope Stability Assessment - Bayview Street Area The Manager submitted a report from the Municipal Engineer dealing with the slope stability assessment in the Bayview Street area undertaken by Cook, Pickering and Doyle. The report indicated that the following geotechnical concerns were studied : (1) The slope between Crescent Drive and Bayview Street is basically stable, providing that surface runoff is controlled in a manner to avoid saturation of the slope. (2) Remedial measures within some of the drainage paths down the slope or within existing ravines need to be undertaken to reduce or eliminate further downcutting and erosion. Ir (3) Storm drains should be installed along Crescent Drive to pick up all runoff from above Crescent Drive, thereby minimizing the runoff over the slope to that which results from the individual properties directly adjacent to the slope. (4) Due to the impervious nature of the surface deposits of Newton Stoney Clay, septic fields would not be expected to perform well and, therefore, installation of sanitary sewers in the areas presently not serviced should be considered. (5) Removal of vegetative cover on the slopes should be discouraged. The proposed grading for a property to be developed, above or below an extensive slope, should possibly be reviewed by the District of Surrey, before providing a building permit. This should involve consideration of the cuts and fills and retaining walls. In addition, the handling of runoff from upslope properties should be reviewed. Alternatively, the District of Surrey could identify properties which are "sensitive" to development and require approval of the development procedures by an Engineer retained by the Developer. The report briefly outlined a number of pertinent items that had been extracted from the prepared report. u The Municipal Engineer was recommending that the Municipality undertake an erosion control program within the existing ravines and install storm sewers along Crescent Drive, in order to intercept overland flow and thereby minimize runoff over the 23.

24 slope; install sanitary sewers in the areas presently not serviced; and identify the areas sensitive to development and ensure that all works are properly engineered by a qualified professional. rrr The Manager was recommending that the recommendations of the Engineer be adopted and carried out, as funds permit, and that the Crescent Beach Property Owners' Association receive a copy of the report. K Moved by Alderman Campbell Seconded by Alderman Schrenk That the recomnendation of the Manager be approved and that a copy of the report also be forwarded to the property owner on Bayview Street who sustained a loss because of a slide, Item 2796 ( ) Sprinkling Regulations The Manager submitted a report from the Municipal Engineer regarding sprinkling regulations within the Municipality. The report noted that, for over a decade, the Municipality has instituted sprinkling restrictions in order to halve the sprinkling demand by distributing it to the odd numbered addresses on one day and the even numbered addresses on the next. The report noted that, during the last few years, the Engineering Department has attempted to strengthen the water supply system, The Engineer indicated that he was hopeful that the Municipality would not have to impose restrictions this year, provided that the utility customers took it upon themselves to moderate the water usage during peak periods. The Engineer concluded that he did not wish to impose the sprinkling restrictions, but rather test the distribution system to the sensible usage by the utility customers. - RES. NO. K-4 17 Moved by Alderman Easton Seconded by Alderman Fomich That the information be received. The Manager was then asked to investigate a public relations type of advertising concerning this matter. In connection with street lighting project 1 (176th Street from 16th Avenue to 40th Avenue) 82 property owners objected to the installation, as they felt that the benefit to their property was marginal. However, only 54 objections were counted as valid and 28 objections were not counted as both property owners had not signed the petition. The report indicated 25.

26 that this street lighting extension was originally requested by the Traffic Department in order to improve traffic safety on this section of 176th Street. The Traffic Department has now advised that the installation could be cost-shared with the Province. The Manager was recommending that street lighting extensions be approved, except for areas 1, 10 & 12, and that the Municipality investigate the possibility of cost-sharing with the Province the installation of street lighting on 176th Street from 16th Avenue to 40th Avenue. Alderman Fomich pointed out that Project No. 9 was not approved by a majority of the property owners. The Municipal Clerk indicated that if the majority of the property owners were not in favour of the work proceeding, the street lights still could be installed by Council, but charges Would not be levied against the adjacent properties. The report indicated that the Natural Drainage Policy requires that a Restrictive Covenant for storm water detention be placed on the townhouse development at 65th Avenue and King George Highway. The report noted that the development was creating 36 units on the site. In order to reduce the impact on the Department of Highway's storm sewer system and the flooding of Hyland Creek, a detention facility was required. The Manager was recommending that the Restrictive Covenant be approved and that the Mayor and Clerk be authorized to sign the documents. RE23.NO.K-420 approved. On February 15th, 1982, Council agreed to cancel the Development Agreement No On March 18th, 1982, Engineered Homes Ltd. wrote to the Municipal Manager to indicate that they did not intend to cancel the project, but only wished to delay the construction time, as it was their intention to possibly build this project in The report noted that Engineered Homes Ltd. had indicated that their intention was to apply for a six month extension.
