Tuesday, October 21, 1980 Time: 6:35 p.m. Minutes of a Regular Council meeting held in the Council Chamber on Tuesday, October 21st, 1980, at 6:35 p.m. All the members were present with Aldermen Watkins, Buckley and Jacobs taking their seats as indicated in the minutes. Alderman McKitka's seat remains vacant. Also present were the Municipal Manager and the Deputy Clerk. A. REPORTS OF VARIOUS COMMITTEES: 1. PLANNING COMMITTEE ey (a) Seconded by Alderman Bose That the minutes of the Planning Committee meeting of October 14th, 1980, be received. RES. NO. C-65 (b) The recommendations of these minutes were considered and dealt with as follows: 1. The Planning Committee had dealt with a delegation by the Chairman of the Panorama Ridge/Sullivan Local Area Planning Committee concerning a 104 lot subdivision south of #10 Highway and a subdivision application by Genstar north of the #10 Highway east of Scott Road. In connection with the 104 lot subdivision south of #10 Highway, Mr. Pickstone indicated that the Local Area Planning Committee was not recommending approval of this application as the impact of the development was too great. The Committee was suggesting that Late Comer Agreements be considered so that the economic pressure may be taken from the first developer in a particular area. In relation to the Genstar development on the north side of #10 Highway east of Scott Road, Mr. Pickstone indicated that this development was reviewed in light of the Urban Development Area and existing schools in the area and the Committee felt that there was no reason to approve this project out of context. The Planning Committee's recommendation was dealt with as follows:

This mot i on was Defeated on a tie vote with Aldermen Schrenk, Fomich and the Mayor against. Alderman Watkins entered the meeting before the vote was taken on this motion. 2. The Planning Committee had dealt with application 80-RZ-232 which is an application for a townhouse development at th Avenue. The Planning Department reported that 32 townhouse units would be developed on a 2.5 acre site between 108th Avenue and 109th Avenue at 143A Street. The designations on the Official Regional and Community Plans are Urban and the Whalley Official Community Plan calls for Low Density Residential in accordance with the R-F zone. The Planning department also reported that the present proposal has been designed in accordance with the specific requirements and constraints of the site. Three clusters of townhouse units are proposed, with each cluster sited at the edge of the ravine. The flat western portion of the site is available for parking and circulation space. The ravine is incorporated into the design of the project while still being preserved as a natural open space. The application was recommended by the Planning Department. The Committee's recommendation was dealt with as follows: Moved by Alderman Bose That application 80-RZ-232 be approved to proceed under Section 716 of the Municipal Act for rezoning from "Family Residential Zone (R-F)" to "Multiple Residential Zone (RM-2)" subject to: declaration of the site as a Mandatory Development Permit Area; dedication of a 33 foot x 33 foot road allowance at the north west corner of the site; provision of a right-of-way for public access and drainage course preservation along the eastern portion of the site; submission of a tree survey, site plan, building plans and landscaping plan to the approval of Council; 2.

Such approval to be valid for six months from this date. with Aldermen Schrenk, Jacobs andich against. Alderman Jacobs entered the meeting before the above motion was voted on. The Planning Committee had dealt with application 80-RZ-183 which is an application to permit a half-acre gross density project on a 110 acre site between 59th and 62nd Avenue and between 120th Street and 124th Street. The Planning Department had reported that 215 lots would be developed. The site is designated as Urban-2 on the Official Regional Plan and Urban on the Official Community Plan. The 1979 Concept Plan for Newton designates the area for one acre residential development. The Planning Department also reported that the soils have very poor sub-surface drainage and septic tank operation is impossible. The Planning Department had advised that the site plan turns its back on surrounding development by providing a landscape buffer on the north, east and west sides of the development with rear yards backing on the buffer. This application was not recommended by the Planning Department. The Planning Committee's recommendation was dealt with as follows: Seconded by Alderman Bose That application 80-RZ-183 not be considered for rezoning at this time. with Alderman Fomich against. The Planning Committee had dealt with application 80-RZ-222 which is an application for a high density residential and commercial development at th Avenue. The Planning Department reported that the proposed site is located within the town centre corridor defined in the Whalley/Guildford Concept Plan for high density mixed use projects. The area is designated Urban on the Official Regional and Community Plans and the Whalley Official Community Plan calls for low density residential development. The site is also within a Mandatory Development Permit Area. The proposal consists of a mixture of residential, commercial and recreational uses. Two levels of retail and offices are proposed along 104th Avenue in addition to a racquet court facility at the rear of the building. A twenty storey high rise structure housing 153 units is proposed above the commercial and recreational spaces. The application was recommended by the Planning Department. The Committee's recommendation was dealt with as follows: 3.

4 Seconded by Alderman Bose That application number 80-RZ-222 be approved to proceed under Section 716 of the Municipal Act for rezoning from "Family Residential Zone (R-F)" to "Core Commercial Zone (C-C)" subject to: m (a) (b) approval of the Ministry of Highways; amendment of the Whalley Official Community Plan; (c) approval of B.C. Hydro for use of the right-of-way for recreation and parking; and (d) the parking structure being redesigned to allow for better public access to the B.C. Hydro right-of-way. RES. NO. C-69 Such approval to be valid for six months from this date. with Alderman Fomich against. A motion by Alderman Campbell that this application be tabled until Council has considered the Whalley/Guildford Plan received no seconder. 5. The Planning Committee had dealt with application 77-RZ-l07(H) which is an application for a Development Agreement for an apartment project at 1851 Southmere Crescent East. The Planning Department reported that the applicants have requested a Development Agreement to allow the construction of 165 apartments on a 2.2 hectare (5.47 U acre) site in the Genstar project in South Surrey. The site is the subject of Land Use Contract Number 371 which allows a density of 30 units per acre. This property ha5 frontage on Southmere Crescent East and backs onto the central park. The approval of the Development Agreement was not recommended by the Planning Department. The Planning Committee's recommendation was dealt with as f 011 ows : Moved by A1 derman Schren k That this application for a Development Agreement be approved to proceed. RES.NO.C-70 This motion was Defeated with Aldermen Bose, Campbell, Jacobs and Fomich against. RES.NO.C-71 then Moved by Alderman Fomich Seconded by Alderman Jacobs That this application for a Development Agreement under Land Use Contract Number 371 be referred back to the Planning Committee for further input. 4.

5 RES.NO.C-72 RES.NO.C The Planning Committee had reported on the Agricultural Land Reserve application of Mr. S.K. Fung concerning the acre site at th Avenue. Mr. Fung was requesting permission to subdivide the property into two parcels so that he could decrease the size of his farming operation and either lease the new parcel or sell it for the development of a new farm. The Planning Department reported that the parcel presently has an irregular configuration. Subdivision would further complicate the situation and may decrease the agricultural viability of the land. The Planning Committee's recommendation was dealt with as follows: 7. That the application made by Mr. Fung under Section ll(4) of the Agricultural Land Commission Act for permission to subdivide land in the Agricultural Land Reserve not be given Council support. The Planning Committee had dealt with a request for a niehgbourhood pub application at nd Avenue. The Planning Department reported that the lot is presently vacant and is zoned C-2 which permits the establishment of neighbourhood pubs. The proposed conversion to Highway Commercial (C-H) would also permit a pub. Although the site is within one mile of the Newton Inn, with its lounge and tavern, it seems to be an acceptable site for a neighbourhood pub. It is also within a commercial node, with a small plaza to the east. This proposal meets Council's guidelines for neighbourhood pubs and the Planning Department was recommending that this application be given approval in principle. The Planning Committee's recommendation was dealt with as follows: for a neighbourhood approval in princip That the application by Mr. D. Varelis pub at nd Avenue be given e. A motion by Alderman Bose to table this item until the applicant produces sufficient design details received no seconder. 8. The Planning Committee had dealt with a request for a neighbourhood pub at 91st Avenue and the King George Highway. The Planning Department indicated that a request was received to locate a neighbourhood pub in a building that had been formally used as a mexican restaurant on the King George Highway at approximately 91st Avenue. This site is approximately one mile from the Surrey Inn and approximately 1 1/4 miles from the Newton Inn. The Planning Committee's recommendation was dealt with as fol 1 ows : 5.

6 RES.NO.C-74 Seconded by Alderman Fomich That the Planning Department submit the - usual report in relation to this neighbourhood pub appl i cati on. 9. The Planning Committee had dealt with application 80-RZ-214 which is an application for a commercial development at th Street. The Planning Department reported that the applicants were requesting rezoning of a 9,000 square foot site in South Surrey to permit a commercial development. The site is designated Urban on both the Official Regional and Community Plans. The Semiahmoo Plan indicates a local commercial node in the affected area. The applicants are proposing a 3,000 square foot one storey building. The application was recommended by the Planning Department. The Committee ' s recommendation was dealt with as follows: RES.NO.C-75 RES. NO. C approved. Seconded by A1 derman Bose That application 80-RZ-214 not be The Planning Committee had dealt with application 80-RZ which is an application for a two lot subdivision at th Avenue. The Planning Department reported the applicant is requesting the rezoning of a.816 acre site in the Crescent Heights area of South Surrey to permit the two lot subdivision. The site is designated Urban on both the Official Regional and Community Plans. The Semiahmoo Peninsula Plan land use designation is Half-Acre Residential. The lot is currently 35,544 square feet or 4,456 square feet short of the necessary area to permit a two lot subdivision in accordance with the R-1 zoning. The applicant had been advised that she could acquire the additional property from an adjacent lot. The application was not recommended by the Planning Department. The Committee's recommendation was dealt with as follows: approved. That application 80-RZ-217 not be Carr i ed The Planning Committee had dealt with application numbers 80-RZ-181 and 80-RZ-182 which are applications for an apartment project on two properties at 152nd Street between 18th and 19th Avenues. The Planning Department reported that the two sites are designated Urban on both the Official Regional and Community Plans and are shown as single family on the proposed Semiahmoo Peninsula Plan. 7 RES.NO.C-77 RES.NO.C The site is within the Urban Development Area and part of the site is within the Mandatory Development Permit Area. The design of the development takes full advantage of the amenity provided by Bakerview Park and provides a transition from the highway commercial area fronting 152nd Street and the residential area to the east. The proposal is to provide 181 two bedroom apartments in 4 three storey buildings. 161 underground parking spaces and 216 surface parking spaces will be provided. The application was recommended by the Planning Department. The Planning Committee's recommendation was dealt with as follows: Seconded by Alderman Campbell That applications 80-RZ-181 and 80-RZ-182 remain tabled until the next Planning Committee meeting and that a plan for multi-family developments around the South Surrey town core be developed. The Planning Committee dealt with application 80-RZ-124 which is an application for a 23 lot single family subdivision at th Avenue. The Planning Department reported that the property is designated Urban on both the Official Regional and Community Plans. The site is within the Urban Development Area and is shown as Low Density Residential on Control Plan 61 and the proposed Newton Plan. The subdivision layout has been designed to provide access from the rear for the proposed lots fronting onto the arterial roads (128th Street and 64th Avenue). An open space walkway from 64th Avenue will provide access to the proposed neighbourhood park to be located north of 64A Avenue. The Planning Committee's recommendation was dealt with as follows: Seconded by Alderman Campbell That application 80-RZ-124 be tabled and referred to the next Planning Committee meeting for further consideration. The Planning Committee dealt with application 80-RZ-204 which is an application for a 19 unit apartment building at th Street. The Planning Department reported that the site is designated Urban on the Official Regional and Community Plans and is shown on the proposed Newton Plan for multiple residential development. The applicant is proposing a three storey building containing 19 units consisting of 16 two bedroom units and 3 one bedroom units. The Planning Department reported that there is a 66 foot x 200 foot residential lot between two apartment projects. Council considered this project on September 8th, 1980, and tabled it until a more comprehensive project involving this 66 foot x 200 foot lot is submitted. The 7.

8 applicant was asked to relocate his proposed building to the north side of the site and to demonstrate that it is possible to design a building on the lot to the south which - will meet the RM-2 zoning criteria. The application was recommended by the Planning Department. The Planning Committee's recommendation was dealt with as follows: That application 80-RZ-204 be approved to proceed under Section 716 of the Municipal Act for rezoning from "Family Residential Zone (R-F)" to "Multiple Residential Zone Two (RM-2)" subject to: (a) (b) approval of the Ministry of Highways; and approval of a Development Permit. RES.NO.C-79 Such approval to be valid for six months from this date. 14. The Planning Commitee had considered designated truck routes in the Municipality. The Planning Comnittee had recommended that the matter of designated truck routes be referred to the Public Works Committee. Alderman Schrenk indicated that the Public Works Committee had made a recommendation on this matter. RES.NO.C The Planning Committee had considered the West Newton Study. The Planning Committee had been advised by the Director of Planning that the Planning Department had prepared a study on the West Newton area which had been precipitated by the application being made by the Genstar Development Corporation. The Director of Planning indicated that the report contrasted and presented three development options; (1) one-acre subdivision, (2) half-acre either regular or gross density, and (3) industrial developments. The Director of Planning had indicated that the industrial development proposal was discussed because this site was held by one owner and was heavily treed around the perimeter which would screen it from the surrounding residential area. The one acre proposal may postpone the actual decision to be made but would maintain the options for future land use. The half-acre development would provide lots that were presently in demand. The Planning Committee's recommendation was dealt with as follows: Seconded by Alderman Fomich That the West Newton report be considered as a back-up to the Genstar development application and that the West Newton report be made public. m m 8.

9 n RES.NO.C The Crescent Beach Marina proposal had been included on the Planning Committee agenda but was not discussed. Moved by Alderman Campbell Seconded by Alderman Schrenk That the Crescent Beach Marina proposal be deleted from the Planning Committee agenda. 17. The Planning Committee had considered a letter from the Surrey School Board regarding development applications in the area of 80th Avenue and Scott Road. The letter indicated that portions of this area were required for a school site and the School Board was in a position to acquire this land. The Planning Committee's recommendation was dealt with as follows: RES.NO.C Seconded by Alderman Bose That the letter from the School Board be referred to the Planning Department to red flag the properties for possible school sites and that a copy of the letter be placed on the files of the rezoning application. The Planning Committee discussed the recent Council moratorium on rezoning and development proposals in the Newton core area as well as the formation of a Local Area P 1 ann i ng Comm i t tee. The P 1 ann i ng Comm i t tee I s recommendation was dealt with as follows: RES.NO.C-83 Moved by A1 derman Schrenk Seconded by Alderman Bose That Council appoint a Local Area Planning Committee for the Newton core area and that the Planning Department come forward to Council with a recommendation for members of that Planning Committee. 19. The Planning Committee had been advised by the Planning Department that Community Builders Ltd. were proposing a subdivision that contained all duplexes. This property had originally been planned as a townhouse project and had been turned down at a Public Hearing. Community Builders Ltd. had provided architectural design and the design was presented to the Planning Committee for their information. The Planning Department indicated that it was a good example of this form of development and the matter would now go forward to the Design Panel for consideration. Lrr 20. The Planning Committee had discussed the overpass to the Internorth Development to the west of the Surrey Place Shopping Centre. The Planning Department had indicated that a number of suggestions had been made to the Developer and the Developer would now go forward to the Design Panel to deal with the actual design of the overpass. 9.

10 (c) The following motion dealing with applications 80-RZ-181 and 80-RZ-182 dealing with development at 19th Avenue and 152nd Street remained tabled pending a report from the Planning Committee: Moved by A1 derman Buck ley Seconded by Alderman Schrenk That a right-of-way be required along the north boundary for a road (d) The following resolution had been tabled pending a report from the Planning Committee. The Mayor indicated that it was now in order to consider this resolution. RES.NO.C-84 Moved by Alderman Campbell That this site be zoned P-R under By-law 5942 and as the applicant has made an application that was received and dealt with by the Planning Committee, zoning to P-R would make the marina conforming and would not preclude a new revised application. The motion was then put and (e) The following motion had been tabled pending a report from the Planning Committee. Moved by Alderman Watkins Seconded by Alderman Campbell That application 80-RZ-217 for rezoning from R-1 to R-F(R) be not approved. m This motion was withdrawn by the mover and seconder as application 80-RZ-217 had been considered under Item Number 10 of the Planning Committee minutes. (f) An application by Mr. Eikmans to have property removed from the Agricultural Land Reserve at th Avenue was tabled to this meeting pending the submission of information by Mr. T. Pearce. The Planning Committee had recommended that the application under Section ll(4) of the Agricultural Land Commission Act not be given Council's support. RES.NO.C-85 Seconded by Alderman Bose That the application made by Mr. Eikmans under Section 11 (4) of the Agricultural Land Commission Act for permission to use a portion of the 26 acre site at th Avenue for a non-farm use not be given Council's support. (9) The following motion had been tabled pending the submission of further information. The Manager stated that the Hazelmere Golf & Country Club application for rezoning to Tourist Commercial Zone Two was dealt with under Item 575 of his report. 10.

11 The Manager's Report Item Number 575 dealt with a letter received from Mr. Archer, President of the Hazelmere Golf & Tennis Club Ltd. The letter indicated that the application for rezoning is for the purpose of constructing tourist type accommodation - not permanent housing. The letter also indicated that at the time of final approval, the Hazelmere Golf 8, Tennis Club Ltd. will submit a copy of the Strata Corporation's By-laws which will regulate the maximum time per annum a condominimum owner may occupy his or her unit. The letter concluded that it is the intention of Hazelmere Golf & Tennis Club Ltd. to have a recreational resort so as to attract tourists from other parts of the country, United States and overseas. RES. NO. C-88 (a) Moved by A1 derman Fomich Seconded by Alderman Schrenk That the minutes of the meeting of October 6th, 1980, be received. B. REPORTS OF VARIOUS BOARDS: 1. 12 RES.NO.C-89 Moved by Alderman Fomich Seconded by A1 derman Buck ley That the minutes of the Housing - Committee of September 5th, 1980, the minutes of the Park Committee of September loth, 1980, and the report from the Chairman of the G.V.R.D. Planning Committee regarding progress of the Official Regional Plan Update be received. 2. ADVISORY DESIGN PANEL RES. NO. C-90 RES. NO. C-91 Moved by Alderman Bose Seconded by A1 derman Jacobs That the minutes of the meeting of September 24th, 1980, be received. Alderman Schrenk then indicated that the Advisory Design Panel had commented on a letter that had been received from Artex Fabricators Ltd. concerning a new building constructed for Gunn Industries Ltd. on Enterprise Way. Seconded by Alderman Campbell That a copy of the Design Panel minutes and a copy of the Design Panel letter to Gunn Industries Ltd. be forwarded to Artex Fabricators Ltd. Alderman Fomich left the meeting. RES. NO. C FRASER RIVER HARBOUR COMMISSION C. MAYOR'S REPORT: (a) That the Deep Sea Shipping Report of August, 1980, be received. 1. The Mayor stated that Council had passed a motion directing the publication of the following motion made at the Special Council meeting of October 20th public. "That the Municipal Council is not prepared to allow Sunday horseracing at this time". 2. The Mayor then advised the Council members that the Adjourned Public Hearing on Part 2 of By-law No would be held in the Council Chamber on October 22nd, at 7:30 p.m. The Mayor then asked the Council members to indicate whether or not they would be available to attend this Public Hearing. 12.

BY-LAWS: In connection with "Part 1 of Surrey Zoning By-law, 1979, No. 5942, Amendment By-law, 1980, No. 6366", third reading was not considered as this application was referred to the next meeting of the Planning Committee. In connection with "Part 1 of Surrey Zoning By-law, 1979, No. 5942, Amendment And No. 40 Development Permit Area Designation By-law, 1980, No. 6367", third reading was not in order as no action was taken on By-law No U 3. RES.NO.C RES. NO. C RES. NO. C-95 Alderman Fomich returned to the meeting. "Part 1 of Surrey Zoning By-law, 1979, No. 5942, Amendment By-law, 1980, No. 6394" had been to Public Hearing earlier this evening and was now read for the third time. 1979, No. 5942, read i ng. The Manager ind cated that he would check this development to make sure that there were no drainage problems associated with the subdivision of this property. Moved by Alderman Jacobs Seconded by Alderman Campbell That application 80-RZ-184 be referred back to the Planning Committee to look at possible traffic congestion, access and exits from the site and the scale of development. 13.

14 In regard to "Part 1 of Surrey Zoning By-law, 1979, No. 5942, Amendment By-law, 1980, No. 6397" the Deputy Clerk stated that this By-law was not in order for third reading as the Fleetwood Levy has not been paid. In regard to "Part 1 of Surrey Zoning By-law, 1979, No. 5942, Amendment By-law, 1980, No. 6398" the Deputy Clerk stated that this By-law was not in order for third reading as the Fleetwood Levy has not been paid and the tree survey and tree preservation plans have not been submitted. In regard to "Part 1 of Surrey Zoning By-law, 1979, No. 5942, Amendment By-law, 1980, No. 6405" which had been to Public Hearing earlier this evening, the Deputy Clerk stated that the legal description would have to be amended. The Manager's Report under date of October 20th was considered and dealt with as follows: Item 546: The Manager submitted a letter from Thompson & McConnell, Barristers & Solicitors, dealing with the Crescent Beach comfort station. The letter enclosed copies of letters sent to Mr. John Medland, the Solicitor for the Crescent Beach Property Owners Association, Mr. S. Birchfield, Acting Registrar of Title for the New Westminster Land Title Office, and Mr. Chester, along with a copy of the Notice of Hearing. The letter indicated the Court should be asked to modify the restrictive convenants on Lots 39 and 40 by inserting the words, "as shown in the architectural sketches prepared by Ib Hansen and approved by J.A. Gillis, President of the Crescent Beach Property Owners Association". The letter indicated that if a majority of the people are in favour of the question posed in the Notice, then copies of the minutes of the Hearing, the recorded vote, and a resolution by Council to proceed with the Court Hearing to modify the restrictive covenants should be forwarded to the Solicitor. 26.

27 RES. NO. C-158 Item 565: Seconded by Alderman Campbell That the information be received. The Manager submitted a report from the Municipal Engineer dealing with Mr. Keddie's letter on the Wooden's Pit Haul Road. RES.NO.C-159 The report indicated that the Engineering Department had not ignored Mr. Keddie's input in the past, but in fact had met with him on several occasions. The report also indicated that the Haul Road was washed out last September by a 10 year severity storm and the road has not washed out since. The Municipal Gradall has been cleaning ditches in the pit area and constructed a new drainage ditch. The report concluded that the over-burden was being hauled onto Mr. Keddie's property at his request as this was the closest dump site. Seconded by A1 derman Campbell That the Engineer's report be received and that a copy of the report be forwarded to Mr. Keddie. Item 566: Y The Manager submitted a report by the Municipal Engineer dealing with the delegation to Council by Mr. Petijevick concerning drainage problems at nd Street. The report indicated that on May 12th, 1980, Council authorized the construction of drop structures and sloped stabilization work on the watercourse flowing through Mr. Petijevick's property. Rather than grant the necessary working right-of-ways for the work, Mr. Petijevick indicated the watercourse should be enclosed to eliminate the erosion problems. The report added that B.C. Hydro was contacted for permission to redivert the existing temporary ditch back to its original course and they indicated they had no objection to the work subject to a written request. The report indicated that the ditch on the west side of 132nd Street is budgeted under the 1980 Program and is scheduled to be constructed in December of this year. The report added that further to Mr. Petijevick's request to install a culvert for a distance of 30 feet onto his property, the Engineering Department estimated that it would cost approximately $5, to carry out the work. The report noted that the Corporation does not have any responsibility for what amounts to enclosing a watercourse on private property. Mr. Petijevick had also requested that a flow regulator be installed on the upstream end of the culvert to restrict the flow in the watercourse. The report indicated that the Corporation should not be party to restricting flow in any watercourse, unless it is prepared to provide a community storage pond and apply the storage factor consistently throughout the Municipality. The report concluded that any improvement work on private property, other than which Council has approved, should be the responsibility of the owner. 27.
