5 AMENDMENTS TO THE 2001 ZONING CODE /26/09 ZCA-09-02/ An Ordinance to Amend Sections , SA , and of the Municipal Code, to allow underutilized parcels within the designated infill area to use the Infill Development Process /04/09 ZCA An Ordinance Approving Both Initial Zoning of UAC-6 for the Las Cruces Center Annexation and an Amendment to Chapter 38, Section UAC University Avenue Corridor Plan Overlay Zone District to Establish the Zoning District of UAC /24/08 ZCA An Ordinance Amending Chapter 38 Article V, Section of the Municipal Code changing the existing Central Business District (CBD) zoning district boundary to include the southwestern intersection of Alameda Boulevard and Lohman Avenue /23/08 ZCA An Ordinance Amending Chapter 38 of the 2001 Las Cruces Municipal Code by Enacting Section Airport Overlay District (AOD) /25/08 ZCA Amended Chapter 38, Section of the Municipal Code, University Avenue Corridor Overlay District. Added language regarding UAC Area 3 to specifically allow religious institutional uses at 1317 and 1345 Mesa Ave. Allow development of a campus ministry building on the property /25/08 ZCA Amending Chapter 38, Section of the Municipal Code, University Avenue Corridor Overlay District to allow fitness related uses, eliminate front building setback requirements, and allow commercial parking lots/garages, provided that commercial parking facilities do not front on a public roadway unless building design incorporates storefronts along the roadway /22/07 ZCA Repealing and replacing Chapter 38 of the Las Cruces Municipal Code (2001 Zoning Code, As Amended). The purpose of the new ordinance is to ensure consistency with previous amendments and to eliminate any ambiguities that may exist. Page 1 of 5
6 AMENDMENTS TO THE 2001 ZONING CODE (Continued) /24/06 ZCA Repealed Section G.6 and enacted a new section G.6; and amended Section E by adding a new Section 9 to include Bicycle Parking Design Requirements /27/06 ZCA Amended various sections of Chapter 38 dealing with non-residential zoning and parking requirements. Repealed and replaced Section (Administration); Amended the definition of building height in Section 38-21; repealed and replaced Section (Office, Commercial, and Industrial Zoning Districts); repealed and replaced Section (Parking and Land Use Tables); repealed and replaced Section (West Mesa Industrial Park Overlay Zone District); repealed and replaced Section (Flexible Development Standards); repeals and Replaces Section (Off-street Parking); and Repeals and Replaces Section (Non-conforming Uses). Eliminated reference to the C-4 Zoning District and updated district listings to reflect the new MT District and modification of the M-1 and M-2 Districts throughout Chapter 38 of the Municipal Code /27/06 ZCA The amendment removed variance authority from the Board of Adjustment, and redirected authority to the Planning and Zoning Commission /24/05 ZCA New Sec NMO North Mesquite Neighborhood Overlay Zone District ZCA New Sec SMO South Mesquite Neighborhood Overlay Zone District /28/05 ZCA The amendments specifically seek to change various provisions related to residential development standards such as allowable types of structures, density, height, minimum acreage, setbacks and roadway access. A provision related to nonconforming residential uses is also included. In most instances, the amendments only impact specific residential zoning districts. Section 38-21, Section 38-31, Section 38-33, Section 38-53, Section 38-54, Section 38-57, Section 38-70, and Section Page 2 of 5
7 AMENDMENTS TO THE 2001 ZONING CODE (Continued) /16/04 ZCA Sections 38-10B2c & 38-74A. Extending the grace period for nonconforming zoning districts to September 3, /1/04 ZCA Section 38-10D4. Notice of Planning and Zoning Commission public hearings regarding zone change-related cases will be sent by regular mail /18/03 ZCA Section The definition of the number of mobile homes that constitutes a mobile home park was amended to be consistent with state law /18/03 ZCA The following four sections containing references to the clear sight triangle were amended to be consistent with the revised definition of the clear sight triangle found in Section : Section 38-21, Section 38-57, Section 38-58, and Section /4/03 ZCA Section Creation of two open space zoning districts, OS-R Open Space Recreation Zoning District and OS-NC Open Space Natural/Conservation Zoning District, and amending other sections as necessary /19/03 ZCA-03-01, Section 38-73A. Extending the grace period for nonconforming zoning districts to September 3, Section 38-10B2, Expediting the review of City-initiated zone changes by not requiring Planning and Zoning Commission review. ZCA Section 38-73B3. Extending the compliance times for mobile home parks. Section 38-73B4h. Maintaining nonconforming status when involuntary property damage occurs. ZCA Section 38-32D. Reducing maximum building heights to 60 feet and requiring a special use permit for any building height above the maximum height listed for each zoning district. Page 3 of 5

Section Correction of definition of Child Care Center or Preschool. Sections 38-31D & Clarification of minimum 15 foot front yard setback for a dwelling and minimum 25 foot front yard setback for garage/carport in R-1a, R-1aM, R-1b, and R-1bM zoning districts. Section 38-32D. Correction of C-2/C-3 gap between minimum and maximum square footage requirements and other refinements. Section 38-33D. Parking requirement clarification for child care uses. Section Correction of discrepancy in side yard setback requirements for a mobile home park. Section & Amendments to flexible development standards and to the regulations for antennas, towers, communication structures, and other vertical structures to encourage co-location and to provide for flexibility in the application of standards. Section 38-62, Refinements to improve the exceptions and modifications section. Sections & 38-62, Repeal of ineffective graphics. Section Correction of language in the delineation of the Avenida de Mesilla gateway Overlay Zone District. Section Inclusion of missing drawing in the Central business District (CBD) section. Section 38-49C. Clarification of language regarding where a PUD may be located. Section 38-73B. Simplification of provisions for the continuation of legal nonconforming land uses, structures, lots/parcels/tracts of land, and site design features. Section Clarification of wall/fence height regulations defined by residential land uses and nonresidential land uses, not zoning district. Page 4 of 5

A new paragraph 5 regarding replacing a nonconforming mobile home was added to the nonconforming provisions section /19/02 ZCA Section West Mesa Industrial Park Overlay Zone District as completely revised /17/ Section University Avenue Corridor Citizen s Design Review Committee requirements were transferred from Section to Section through Section /04/2001 Adopted 2001 Zoning Code (Chapter 38).
