RECOMMENDATION: By motion, Open the public hearing, receive public testimony; close the public hearing; and, By motion, adopt a resolution forwarding the proposed project to the City Council with a favorable recommendation subject to the conditions of approval (Attachment 1 ). While the proposed facility is located on the westerly edge of the Coast Bible Church property, it is situated on a

2 Planning Commission Agenda Report March 11, 2014 Page 2 of 6 portion of the property that is located within a General Plan and Zoning designation of Planned Community (PC) and is regulated by Comprehensive Development Plan (COP) 90-02, Mammoth Offices. The Rezone application requests approval to amend the COP to allow "wireless telecommunication facilities" uses by Conditional Use Permit. The rezone is limited to a text change and does not affect the COP map boundary. The tree will be located on the west section of the property within an unimproved area. The wireless facility would accommodate one (1) wireless service carrier (AT&T). The project includes an enclosure for the equipment cabinets. The landscape plan provides for planting three 24" box, Eucalyptus polyanthemos (Silver Dollar Gum) trees to be planted along the perimeter of the facility and within existing Eucalyptus trees to screen the new faux tree. The plan also includes thirteen 5 gallon Rhaphiolepis indica 'Springtime' (Indian Hawthorne) shrubs to screen the perimeter walls of the enclosure. BACKGROUND: General Location: The proposed project is located at Via Escolar, approximately 250 feet east of Rancho Viejo Road. Assessor's Parcel Number: Environmental Determination: Related Cases: General Plan Land Use and Zoning Map Designation: The City's Environmental Administrator has determined that the project is categorically exempt (Section 15303; Class 3 "New Construction or Conversion of Small Structures" from further review. A Notice of Exemption (NOE) will be posted should the project receive final approval. N/A The facility is proposed on a portion of the property that is located within a General Plan designation of LU 5.0 P&l (Public & Institutional) and has a Zoning designation of Planned Community (PC) and is regulated by Comprehensive Development Plan (COP) 90-02, Mammoth Offices (Attachment 3). The Rezone application requests approval to amend the COP to allow "Wireless Telecommunication Facilities" uses by Conditional Use Permit.

The Rezone application would amend the COP to allow "wireless telecommunication facilities" uses by Conditional Use Permit. The rezone is limited to a text change and does not affect the COP map boundary. Municipal Code, Title 9, Land Use Code (LUC) Section identifies cellular antennas as a compatible use for all districts, subject to development and design standards, as well as approval of a CUP as specified by LUC Section Thus, the proposed COP amendment would be consistent with the City's regulatory policy which relies on development standards to determine whether a specific "wireless telecommunication facilities" would be acceptable and approvable. The proposed facilities will be situated no closer than about 590 feet from the nearest residential neighborhood. While COP does not provide development standards (i.e., floor area ratio (FAR), setbacks, building height, etc.), the location of the faux Eucalyptus tree with wireless facilities maintains similar setbacks to those established for the Public & Institutional Zone District in which the bulk of the Church property is located; Public & Institutional District. The proposed facility will provide a 600-foot rear yard setback which is greater than the required minimum of 5-foot. In addition to the Table 3-19, Development Standards established by Section of the Title 9, Land Use Code, Section (b)(3)(A) establishes the following specific design standards for which staff has evaluated the project for compliance as follows: (A) Design Standards. All antennas, excluding amateur radio antennas, including guy wires, supporting structures, and accessory equipment, shall be located and designed to minimize their visual impact as viewed from surrounding properties and public streets. The following minimum design standards shall apply: (i) Material used. All antennas and supporting structures or components shall be of non-reflective, glare-reducing materials. Colors and materials for antennas and their components shall be chosen to minimize visibility and to match or blend with the primary background. (ii) Screening: All telecommunications antennas and facilities, including cellular, pes, and other wireless communications antennas, shall be designed to blend with the surrounding environment and to be as unobtrusive as possible. Screening shall be provided in the form of fencing, landscaping, structures, or parapets integral to the building, as shown in Figure 3-2. Such screening and maintenance shall be provided to the satisfaction of the Planning Director. (iii) Multiple-use facilities. Antennas may be integrated into existing or newly developed facilities and structures that are functional for other purposes, such as ball field lights, flag poles, and clock towers. All multiple-use facilities shall be designed to camouflage the antennas, as shown in Figure 3-1. The proposed project is in compliance with these standards because the wireless facilities are screened within a faux Eucalyptus tree and the project includes the planting of three Eucalyptus trees to provide further screening of the wireless facilities. The cabinets, cables and associated equipment are proposed to be located within an enclosure. Furthermore, the applicant has submitted a planting plan that provides

5 Planning Commission Agenda Report March 11, 2014 Page 5 of 6 thirteen 5 gallon Rhaphiolepis indica 'Springtime' (Indian Hawthorne) shrubs to screen the perimeter walls of the enclosure. Section of the Title 9, Land Use Code, specifically establishes five findings for Conditional Use Permit approval related to General Plan consistency, Land Use Code compliance, and design standards. Staff has reviewed the project and concludes that the project as designed meets the findings provided on the attached resolution (Attachment 1 ). ENVIRONMENTAL IMPACT: This project has been reviewed in accordance with the California Environmental Quality Act. The City's Environmental Administrator has determined that the project is categorically exempt (Section 15303; Class 3 "New Construction or Conversion of Small Structures" from further review. A Notice of Exemption (NOE) will be posted should the project receive final approval. Because the project includes a Rezone application to amend the Comprehensive Development Plan (COP) and the City considers COPs to be comparable to Specific Plans, the City has taken steps to comply with Senate Bill (SB) 18 which requires local governments to consult with local Native American tribes on certain planning applications and provide notice to such tribes at certain key points in the planning process. These consultation and notice requirements apply to adoption and amendment of both general plans (defined in Government Code et seq.) and specific plans (defined in Government Code et seq.). The City has mailed consultation invitations to the four local Native American tribal contacts that were provided to the City by the Native American Heritage Commission. PRIOR REVIEW: On September 23, 2008, the Planning Commission approved Resolution # for Royal Street Communications for an unmanned wireless facility located within a freestanding ancillary structure on the subject property. COMMISSION/COMMITIEE/BOARD REVIEW AND RECOMMENDATIONS: Not Applicable. NOTIFICATION: Pursuant to Title 9, Land Use Code, Section (f), Notification Procedures, a public hearing notice has been mailed to all property owners within 1,0000 feet as listed on the Orange County Real Property Tax Assessment rolls); has been published in the Capistrano Valley News at least ten (10) days prior to the hearing; has been posted at three public locations (Attachment 2) ; and a "Notice of Proposal" sign has been posted

7 PC RESOLUTION NO XX REZONE (RZ) , CONDITIONAL USE PERMIT (CUP) A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA RECOMMENDING CITY COUNCIL APPROVAL OF A REZONE AMENDING COMPREHENSIVE DEVELOPMENT PLAN (COP) 90-02, MAMMOTH OFFICES AND A CONDITIONAL USE PERMIT (CUP) FOR A PROPOSED UNMANNED WIRELESS TELECOMMUNICATIONS FACILITY USING VIA A THIRTY FIVE (35) FOOT TALL FAUX EUCALYPTUS TREE LOCATED AT VIA ESCOLAR (ASSESSOR PARCEL NUMBER: )(ROSS MILETICH, CORE DEVELOPMENT SERVICES) Whereas, Ross Miletich, Core Development Services, 2749 Saturn Street, Brea, CA 92821, on behalf of AT&T has requested approval of a rezone and conditional use permit to allow an unmanned wireless telecommunications facility located at Via Escolar, which is General Plan-designated LU 5.0 P&l (Public & Institutional) and has a Zoning designation of Planned Community (PC) on the Official Zoning Map and is regulated by Comprehensive Development Plan (COP) 90-02, Mammoth Offices. The Rezone application requests approval to amend the COP to allow "Wireless Telecommunication Facilities" uses by Conditional Use Permit; and, Whereas, the proposed project has been processed pursuant to Section , Development Review of the Land Use Code; and, Whereas, the Environmental Administrator has reviewed the project pursuant to Section of the California Environmental Quality Act (CEQA) and determined that the project qualifies for a Class 3 (Section 15303) categorical exemption, and will cause the Notice of Exemption to be posted pursuant to Section (d) of the CEQA Guidelines which provides that "the notice shall not be filed with OPR or the county clerk until the project has been approved;" and, Whereas, the Planning Commission has considered the Environmental Administrator's determination pursuant to Section of the California Environmental Quality Act (CEQA); and, Whereas, the Planning Commission conducted duly-noticed public hearing on March 11, 2014, pursuant to Title 9, Land Use Code, Section and City Council Resolution to consider public testimony on the proposed project and has considered all relevant public comments. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby make the following findings for the proposed Zone Change as established by Section of Title 9, Land Use Code of the City of San Juan Capistrano: ATTACHMENT 1

8 PC Resolution XX 2 March 11, The proposed zone change is consistent with the General Plan Element including applicable goals and policies because the project consists of a proposed COP amendment to allow "wireless telecommunication facilities" uses by Conditional Use Permit and the City has previously established a policy of allowing such facilities within any area of the City subject to compliance with the City's development standards for such facilities. Furthermore, the Conditional Use Permit is a substantially consistent with General Plan Land Use Element and Community Design Element because the policies established by the General Plan or implemented through the development standards for "wireless telecommunication facilities" established by the Title 9, Land Use Code and the proposed project, subject to compliance with the recommended condition of approval, will meet those standards. 2. The proposed zone change is consistent with the Land Use Code, including Title 9, Chapter 2, Article 1, "General Plan and Zoning Consistency" and more specifically, Table 2-1, "Zoning Consistency Matrix" because the proposed COP amendment would allow "wireless telecommunication facilities" uses by Conditional Use Permit and require compliance with the provisions and development standards of Section (b)(2) of Title 9, Land Use Code. 3. The site of the proposed zone change is suitable for the land use to be permitted by Conditional Use Permit within the zone district because the COP amendment provides for the specific regulation and compliance of "wireless telecommunication facilities" with the land use and development standards established by Title 9, Land Use Code. 4. The proposed "wireless telecommunication facilities" use to be allowed by the proposed zone change will be compatible with existing and planned uses on surrounding properties and the community in general because the City has previously authorized "wireless telecommunication facilities" on the Coast Bible Church property based on a finding of use compatibility and the proposed rezone will require compliance with development standards to assure such compatibility. 5. The proposed zone change is reasonable and beneficial at this time because it would establish "wireless telecommunication facilities" as a conditionally permitted use thereby allowing the development of "wireless telecommunication facilities" within the City which are necessary for convenience of residents and the support of businesses within the City. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby make the following findings for the proposed Conditional Use Permit as established by Section of Title 9, Land Use Code of the City of San Juan Capistrano: 1. The proposed use and design are consistent with the maps and policies of the General Plan, specifically the Community Design Element because that element implements the City's design objectives through the adopted Architectural Design

Furthermore, the proposed location of the antennas will be consistent with the City's Architectural Design Guidelines, and specifically: Section 2(a) which states that, "facilities should not be discernible from public right-of-ways or open space areas;" and, Section 2(c) which states that, "cellular and wireless facilities should be screened by structures and or landscaping;" and, Section 2(d) which states that, "Clustering and co-location of wireless and cellular facilities is encouraged;" and, Section 3(a) which states that the, "wireless communication antennas should be integrated within the overall building and/ or landscape design". The proposed design is consistent with the Architectural Design Guidelines, consistent with the previously approved use of faux Eucalyptus trees for "wireless telecommunication facilities," is in conformance with the required setbacks. 2. The proposed use and design are consistent with the purpose, intent, and standards of the Title 9, Land Use Code and any applicable specific plan or comprehensive development plan, because the proposed project has been subject to review and approval of a Conditional Use Permit and recommended conditions of approval will substantially reduce the potentially adverse aesthetic effects of cellular antennae and the proposed project has been designed to meet all required setbacks and other applicable development standards, and the proposed antenna structure will be located over 300'-0" from the nearest residential neighborhood. 3. The site for the proposed use is adequate in size and shape to accommodate all yards, open spaces, setbacks, walls and fences, parking and loading areas, fire and building code considerations, trash and recycling enclosures, and other features pertaining to the application because the proposed "wireless telecommunication facilities" will be located at the edge of the project site which does not impact vehicular, pedestrian, or other forms of traffic, nor parking and loading areas, and will meet all applicable setbacks. 4. The proposed use and its on-going operation will be compatible with abutting properties and the permitted uses thereof, and will not generate excessive light, noise, vibration, odors, visual blight, traffic, or other disturbances, nuisances, or hazards, because the proposed "wireless telecommunication facilities" has been designed to comply with the Title 9, Land Use Code development standards for "wireless telecommunication facilities," will be consistent with the Architectural Design Guideline's provisions for such facilities, and generates minimal traffic necessary for periodic maintenance work. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano hereby approves the project subject to

10 PC Resolution XX 4 March 11, 2014 those conditions of approval established by Exhibit A, attached hereto and incorporated herein. PROTEST OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS: Pursuant to Government Code Section 66020, the applicant may protest the imposition of fees, dedications, reservations or other exactions imposed on this development project by taking the necessary steps and following the procedures established by Sections through of the California Government Code. General Conditions: 1. Rezone and Conditional Use Permit , approval to amend Comprehensive Development Plan (COP) 90-02, Mammoth Offices to allow Wireless Telecommunication Facilities" uses by Conditional Use Permit and to construct an unmanned wireless telecommunications facility on one (1) thirty-five (35) foot tall faux eucalyptus tree located at Via Escolar (Assessor Parcel Number(s) ). This approval is granted based on the application materials submitted by Ross Miletich, Core Development Services on November 1, 2013, including site plan, elevations, and photo simulations. These plans and the proposed use of the site are approved as submitted and conditioned herein, and shall not be further altered unless reviewed and approved by the affected city departments. Minor modifications to this approval which are determined by the Development Services Director to be in substantial conformance with the approved site plan, and which do not intensify or change the use or require any deviations from adopted standards, may be approved by the Development Services Director upon submittal of an application and the required fee. 2. All exterior cables shall be non-reflective, textured and painted to match the existing building or surface to which it is attached. 3. Approval of this application does not relieve the applicant from complying with other applicable Federal, State, County or City regulations or requirements. 4. All plans, specifications, studies, reports, calculations, maps, notes, legal documents, and designs shall be prepared, signed, and stamped (when required) only by those individuals legally authorized to do so.

12 PC Resolution RZ & CUP AT&T Coast Bible Church 2 of4 Final Conditions of Approval March The applicant shall defend, indemnify, and hold harmless the City of San Juan Capistrano and its officers, employees, and agents from and against any claim, action, or proceeding against the City of San Juan Capistrano, its officers, employees, or agents to attack, set aside, void, or annul any approval or condition of approval of the City of San Juan Capistrano concerning this project, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Planner. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officers, employees, and agents in the defense of the matter. 6. The applicant shall be responsible for informing all subcontractors, consultants, engineers, or other business entities providing services related to the project of their responsibilities to comply with these conditions of approval and all pertinent requirements in the San Juan Capistrano Municipal Code, including the requirement that a business license be obtained by all entities doing business in the City. 7. In the event that exhibits and written conditions are inconsistent, the written conditions shall prevail. If there are any disparities between these conditions and the plans or final revised plans that are approved for any subsequent phase, the conditions and/or plans as stipulated in the later approval shall prevail. 8. The use shall meet the standards and shall be developed within the limits established by the Municipal Code as related to emissions of noise, odor, dust, vibration, wastes, fumes, or any public nuisances arising or occurring incidental to the establishment or operation. 9. The applicant shall pay all fees at the time fees are determined payable and comply with all requirements of the applicable federal, state, and local agencies. The duty of inquiry as to such requirements shall be upon the applicant. 10. All applicable approvals and clearance from other departments and agencies shall be on file with the Building and Safety Department prior to issuance of any permits, final inspections, utility releases and/or release of securities, as specified in these conditions. (B&S) 11. Future Technologies. In the event that future wireless technologies are made available and are feasible, the applicant shall modify or remove the facility at the applicant's expense. Said technologies may require the removal of the facility or a reduction in the quantity of panels. The Planning Commission reserves the right to review and modify the subject use in the future. (PLN) 12. Co-location. The addition of a new carrier at this site shall be co-located on the existing equipment if feasible. The following conditions shall be completed prior to or in conjunction with the issuance of building permits:

Prior to issuance of building permits, plans for this project shall be submitted to the Building and Safety Department for review and approval, and shall comply with the latest City-adopted edition of the applicable building codes. (B&S) 14. Building Construction Plans. Prior to issuance of building permits, the applicant shall submit final construction plans, building elevations and floor plans to the Planning Department for final review and approval. Such plans shall be fully dimensioned and in substantial conformance with those plans approved by the Planning Commission, Design Review Committee, and/or Development Services Director (as applicable). (PLN) 15. OCFA Review of Hazardous Materials (Service Code 2.50). Prior to the issuance of a building permit, the applicant shall submit to the Fire Chief a plan for review and approval of the battery system. The plans shall be in accordance with the California Fire Article 64. Please contact the OCFA at (714) for a copy of the Guidelines and Informational Bulletins. (OCFA) The following conditions and requirements shall be met during construction, from the beginning of the first ground-disturbing activity until the use has been released for occupancy. 16. Waste Disposal and Sanitation. At all times during construction, the applicant shall maintain adequate sanitary disposal facilities and solid waste disposal containers on site. The accumulation of refuse and debris constituting a public nuisance is not permitted. (PW) 17. Construction hours. Construction hours shall be limited to 7:00a.m. to 6:00p.m., Monday through Friday and between 8:30 a.m. and 4:30 p.m. on Saturday. Construction activity shall not be permitted on Sundays or any Federal holiday.(pln) 18. Archaeological Monitoring. Prior to issuance of a grading permit, the applicant shall submit to the Development Services Department documentation that a qualified archaeologist (defined as an archaeologist on the List of Certified Archaeologists for Orange County) has been retained, including a Native American observed sub-consultant, to monitor site clearing, grading, and excavation activities, stating the name, qualifications, and contact information for the archaeologist. (PLN) The following conditions shall be met prior to acceptance of improvements and release of bonds and/or surety, final utility clearances, or granting permission to use or occupy the project site, as specified below: 19. Consistency with Approved Plans and Elevations. The project shall be constructed in accordance with all the approved plans and conditions of approval, including but not limited to site plans, grading plans, wall plans, landscape/irrigation plans, lighting plans, and elevations. If all improvements cannot be installed prior to occupancy, the City may approve a Deferred Improvement Agreement to defer the completion of the improvements provided

14 PC Resolution RZ & CUP AT&T Coast Bible Church 4 of4 Final Conditions of Approval March that a bond, cash deposit, or other surety in a form and substance approved by the City Attorney, is submitted to the City in lieu of installation of the improvements, that application and required fees are submitted, and that the incomplete improvements will not create an unsafe condition on the site. The term of the deferral shall be as determined by the City Planner. (PLN) 20. Final Planning Inspection. A minimum of one week prior to final inspection by the Building and Safety Department, the applicant shall schedule a final inspection by the Planning Division, and shall pay any outstanding balance in the Developer Deposit Account assigned to this application. (PLN) 21. Lessees or Other Users. Coast Bible Church shall ensure that any lessee or other user(s) shall comply with the terms and conditions of this permit, and shall be responsible for the future of any lessee or other user(s) under this permit. 15 PLANNING COMMISSION PUBLIC HEARING NOTICE city of san juan capistrano A PUBLIC HEARING WILL BE HELD BY THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO ON TUESDAY, THE 11TH DAY OF MARCH, 2014 AT 6:30 P.M. IN THE CITY COUNCIL CHAMBERS AT PASEO ADELANTO, SAN JUAN CAPISTRANO TO CONSIDER THE FOLLOWING PROJECT: Rezone CRZl and Conditional Use Permit (CUP) , Coast Bible Church: Ross Miletich, Core Development. Services has requested approval of a proposed unmanned telecommunications wireless facility on the Coast Bible Church property. The facility is proposed on a portion of the property that is located within a General Plan and Zoning designation of Planned Community (PC) and is regulated by Comprehensive Development Plan (CDP) 90-02, Mammoth Offices. The Rezone application requests approval to amend the CDP to allow "Wireless Telecommunication Facilities" uses by Conditional Use Permit The rezone is limited to a text change and does not affect the CDP map boundary. The project site is located at Via Escolar, San Juan Capistrano, CA 92692; also referred to as Assessor Parcel Number (APN) Information on this project is available for review at the Development Services Department, Paseo Adelanto, San Juan Capistrano; (949) This project has been reviewed in accordance with the California Environmental Quality Act The City's Environmental Administrator has determined that the project is categorically exempt from further review. A Notice of Exemption (NOE) will be posted should the project receive final approval.
