Public Present: CALL TO ORDER Mayor Henry Braun called the Public Hearing to order at 7:00 p.m. and outlined the procedures to be followed. 2. BYLAWS 2.1 Bylaw No , "Land Use Contract No. 156, Discharge Bylaw, 2018" ( (PRJ Address: Applicants: Owners: Purpose: 3785 Sandy Hill Road R. and K. Fengler R. and K. Fengler If Bylaw No is adopted, Land Use Contract No. 156 (District of Matsqui would be discharged from the Certificate of Title of the subject land. The current underlying Urban Residential Zone (RS3 would then control development and would permit a Secondary Suite on the property. There were no comments or questions. 2.2 Bylaw No , "Land Use Contract No. 42, Discharge Bylaw, 2018" ( (PRJ Address: Applicants: Owners: Purpose: Oakridge Crescent J. Ofenbock and J. Ofenboeck J. Ofenbock and J. Ofenboeck If Bylaw No is adopted, Land Use Contract No. 42 (District of Matsqui would be discharged from the Certificate of Title of the subject land. The new Urban Residential Hybrid Zone (RSH would then control development and would permit a second storey addition to the existing mobile home. Attachment: Public Hearing, June 25, 2018 (PH Minutes - June 25, 2018 Correspondence received June 25, 2018, from T. Woywitka, 2215 Crystal Court; is opposed to the application. Notes that the Land Use Contract will be expiring in 2024, and does not believe it is necessary to rush discharge of the Land Use Contract for the profit of land speculators and investors, speaking to concerns of larger homes being built, diminished views and privacy, and possible illegal suites. Peachey, 2044 Oakridge Crescent; remarked that it is a unique neighbourhood with mobile homes; is opposed to the application as it stands; is not against additions, but is opposed specifically to the discharge of the Land Use Contract; could support the application if Council could find a way to proceed without requiring the Land Use Contract to be discharged; noted 71% of area residents preferred the Land Use Contract to remain in place until its ultimate expiration in 2024; referred to the percentage of owners who wish to retain the Land Use Contract as a super majority and does not believe the neighbourhood s overwhelming majority should be dismissed for the sake of this one application; referenced how no one on Council obtained more than 51% of votes to be elected and Council should respect the percentage of those who wish to keep the Land Use Contract; if the Land Use Contract is discharged it would permit the owner of the property to undertake any permitted use in the underlying zoning; and recommended that the application be referred to staff for a variance if possible to accommodate owners wishes, and if that was not possible then Council should deny the request. There were no further comments or questions. 2.3 Bylaw No , Abbotsford Zoning Bylaw, 2014, Amendment Bylaw No. 180 ( (PRJ Address: Applicant: Owner: Rezones: Purpose: 2108 Ridgeway Street Central Valley Engineering Ltd. Y.S. Harry from Urban Residential Zone (RS3 to Compact Lot Residential Zone (RS6 and Comprehensive Development Seventy Nine Zone (N79 If Bylaw No is adopted, a new Comprehensive Development Seventy Nine Zone (N79 would be created and the subject land would be rezoned to RS6 and N79. The applicant proposes to develop a two lot subdivision consisting of one single-family dwelling and one duplex lot. Correspondence received June 21, 2018, from L. and R. Ross; have discussed the proposal with most of the residents on Kendale Place, and have concerns regarding parking. Ridgeway Street is a very busy street with vehicles parked on both sides, while Kendale Place is a narrow street with only seven homes that do not want parking problems. There were no comments or questions. Delves from Urban Estate Residential Zone (RS1 to Residential Zone (RS5-A If Bylaw No is adopted, the applicant proposes to develop a five lot bareland strata subdivision with no secondary suites. Correspondence received May 23, 2018, from C. and S. Dunton, Christina Place; share a property line with the proposed development and are in support of it. Package Pg. 14

McClendon and B. Heidinger, Christina Place, are opposed to the development; feel that five more homes would be too much for the area; the area is already overcrowded; parking is already very congested; concerned about the trees at the back of their property; and the disruption and noise during construction. Correspondence received May 25, 2018, from C. Leslie, Community Manager, on behalf of the owners of Strata Plan LMS221, as this property is below the proposed development and are concerns about storm drainage, and the sewer system; have concerns regarding the arborist report relating to the large trees. Correspondence receive May 23, 2018, from C. Stanchfield and C. Wong, are opposed to the development; experience traffic and parking issues daily; and feel that it will have a negative effect on their property value. Correspondence received May 28, 2018, from J. Wittrup, Christina Place, is opposed to the development; traffic has increased especially when school is in; parking is an incredible challenge; and there are a lot of children that play in the cul-de-sac and are very concerned for their safety. Correspondence received May 28, 2018, from H. Mittman Old Clayburn Road, does not want the trees removed as it will affect her privacy. Correspondence received June 19, 2018, from G. and M. Smith, are opposed to the development with the addition of five more homes it will increase traffic and that is already an extreme issue. Correspondence received June 18, 2018, from S. Campbell, Christina Place, is opposed to the development has concerns about child safety and the increased parking issues. Correspondence received June 22, 2018, from E. Enns, Christina Place, is opposed to the development feels that five homes on the lot will be too many, parking is a major problem especially when school is in, concerned about the width of the lane, and wonders how emergency equipment could access the always busy street. Correspondence received June 18, 2018, from S. Meerstra, Christina Place; remarked parking is already limited on the street; noted increased congestion in the cul-de-sac during school drop off and pick up times for Abbotsford Christian School; and believes the construction vehicles and machinery required for the development would pose a danger to the children who live and play in the cul-de-sac. Correspondence received June 22, 2018, from J. Morris, Christina Place; expressed concerns regarding the rezoning and proposed development noting the one acre lot is irregular in shape and slope, and will require a tremendous amount of backfill for five houses; remarked that parking is currently insufficient for current residents who own more than one vehicle, and addressed safety concerns for children on the street. Dennie, Christina Place; have spoken with approximately 75% of the residents of Christina Place regarding the potential for more traffic and parking on an already crowded street; noted many parents regularly use Christina Place as a parking/drop off area for Abbotsford Christian School, with homeowners facing damage by drivers turning around on lawns, and blocking driveways; if Council approves the development, noted the parking concerns of the current residents must be addressed. Gahir, Christina Place; concerned about the impact building five additional units on Christina would have on the parking situation that already exists. Correspondence received June 25, 2018, from K. Grosses, Christina Place; concerned about the proposed development, as parking on Christina Place is already ridiculous and has safety concerns for children playing on the street; and is opposed to the proposal. E. Pope, Christina Place; submitted additional letters on behalf of area residents; spoke to problems with volume of traffic during the school year; feels it is unfair to add five units to the congestion that already exists on the street; could not find in the plans how large the homes will be; there are days the garbage collection truck does not go down their street as it cannot maneuver through the cars; concerns for emergency vehicles being able to get through; moved from another part of town to avoid these types of issues; does not believe it is fair that a developer can come in and ask the Planning Department to change the zoning; does not agree with five houses and suggests two would be OK; and begs Council not to change the zoning on his street. R. Jackson, Christina Place; spoke to her submission and the photos she provided; noted potentially 13 more cars will be coming up and down the street with the development; showed picture of a car illegally parked in front of a fire lane; does not like the feel of this development, and has concerns regarding safety; if the development goes ahead would like to see restrictions in place that construction vehicles cannot park on the street; and that dump trucks and delivery trucks cannot enter the street during school drop off and pick up times. M. Enns, Christina Place, spoke to his , noting he lives right beside the laneway; estimated an additional 13 vehicles will be driving by his home and said that five extra homes would be an inconvenience to the homes already in the area; questioned the width of the laneway, remarking you cannot get two vehicles down the laneway, and has seen, and assisted, previous owners stuck in the snow; and a variety of factors of this development will impact his home personally. A. Stover, Christina Place; Christina Place is a lovely street, but noticed right away the number of vehicles parked on the street, which makes it difficult to find parking on the street when you have visitors; also spoke to safety issues, noting that emergency vehicles would be required to make a five or six point turn to get out of the cul-de-sac; addressed privacy impacts for the properties located in the area, and concerns regarding precedence moving forward. B. Geerlinks, Christina Place; not opposed to development; however, is concerned with this development and the number of homes being proposed; suggests perhaps two homes is OK but five is excessive; parking in the area is horrendous and kids play in the cul-de-sac; remarked there are several panhandle lots in the area, but with fewer lots off them, and significantly wider laneways. Enns, Christina Place; spoke to her written submission; echoes the concerns of the neighbours; noted kids play in the cul-de-sac; and raised concerns regarding loss of privacy due to the proposed development saying this is a very large concern. B. Beatty, Hartnell Place; questioned what effect the proposed development would have upon Cedar Springs Trail from the Bateman area to Old Clayburn Road; asked how close the 2.5m retaining wall would be to the trail concerned about pedestrian safety on the trail while trees are being removed during construction; and questioned what the stability of the soil would be Package Pg. 16

A. Enns, Christina Place; has lived on the street her entire life and played on the cul-desac, and in the forest; when it is gone, the kids who live on the street will be robbed of that; spoke of safety concerns for children, and impact on the active wildlife in the area. A. Jackson, Christina Place; spoke to parking concerns on Christina Place, and how they always exist, not only during school pick up and drop off times; estimated that the average number of vehicles per home on Christina Place is 4-5, compounded with visitors, making a constant abundance of cars parked on the street causing congestion at all times of the day or night and safety issues for children playing on the street. A. Gill, Christina Place; spoke to safety factors with children playing in street; noted she could support a one or two house development, but not five.
