1 Sooke Core Sewer Specified Area Proposed Boundary Adjustment for Brailsford Place RECOMMENDATION: THAT Council receive the Petition for Local Area Service for the property located at Brailsford Place (legally described as Lot, Section, Sooke District, Plan EPP); and THAT Council give First, Second, and Third reading to Bylaw No. Sooke Core Sewer Specified Area Amendment Bylaw (-). Report Summary: On December,, District of Sooke Council adopted Bylaw No., Sooke Core Sewer Specified Area Amendment Bylaw (-) which removed Melrick Place from the Sooke Core Sewer Specified Area (SSA). The removal of this property from the SSA was at the request of the owner of the property. Since that time, road dedication and subsequent subdivision have allowed for the southern portion of the former Melrick Place property to be sold to the owners of the adjacent View Point Estates property at Maple Park Terrace. The new owners have now applied to the District to amend the zoning on both properties from CD9 and RU to R, as well as for inclusion of Brailsford (formerly part of Melrick) into the SSA. Report: The District has received an application to amend the zoning on this property from RU to R. In order for the property to be considered for the R Zone, the property must also be included in the SSA. The applicants propose to include this property in the overall design of View Point Estates which is located immediately to the west of this property, as depicted on the attached location map. Council may recall that the original development plan for Maple Park Terrace (then called Spiritwood) had also included the property at Melrick (now Brailsford and Melrick) in the overall development plan. Since the new owners have taken over the project, Council has amended the zoning of Melrick to R and re-included it in the SSA. The developers are now requesting Council consider the same for Brailsford. Staff have not requested an additional sanitary serviceability review for the inclusion of this land as it is proposed to be developed in conjunction with View Point Estates and the reduced density that the new developer is now planning with the proposed R zone. When the Spiritwood project was originally modelled by Stantec, the engineers Development Services Regular Council - April, - RPT -- File No. - PLN

2 looked at adding new units to the system (a combination of lots and multi-family units). Should Council approve an R zone for the property, after park dedication, the developer could obtain approximately new lots. It should be noted that as part of the original development plan, the previous Spiritwood developer also paid for the installation of sewer infrastructure leading from the development, along Winfield Drive and Grant Road to West Coast Road. The property is surrounded by the current SSA and is located within the Community Growth Area (CGA) as identified in the Sooke Official Community Plan and its longterm goal to provide sanitary sewer service to all properties in the CGA. Policy., Sooke Core Area Local Service Area Boundary Policy, permits Council to consider applications from individual property owners for inclusion into the SSA. Should Council proceed with the bylaw process, the requirements of Policy., as well as Bylaw No., Sooke Core Sewer Specified Area Mandatory Connection Bylaw,, and Bylaw No., Sooke Core Sewer Specified Area Cost Recovery Bylaw,, will also be addressed. Budget/Financial Impacts: Development Cost Charges will be collected at the time of development as per bylaw requirements. The property will be added to the Sooke Core Sewer Specified Area Assessment roll as per the requirements of Bylaw No., and applicable parcel tax and sewer generation charges will be collected as required. Strategic Relevance: Council s Strategic Plan item: Enhancing Community Livability the District will work toward making Sooke a vibrant and accessible community take steps to protect Sooke s natural beauty will be met by connecting properties to the District s wastewater collection and treatment system which assists in the long-term protection of the environment. The core area of the District of Sooke shown on the map attached to this Policy was designated under the Local Government Act as a specified area for the provision of sewage collection and treatment services, by Bylaw No., Sooke Core Sewer Specified Area Bylaw,.. The Council will consider applications from individual property owners for inclusion in the specified area, now known as a local service area under the Community Charter, made in the form of a petition of which a copy is also attached to this Policy. The District of Sooke may require that petitions be submitted jointly by all of the owners within a particular area comprising a logical extension of the Local Service Area boundary.. In the case of applications from property owners who wish to connect to an existing sewer main fronting their property: a. The property owner is required to install a service connection complying with District of Sooke standards at their own cost, within months of being included in the local service area, and to pay a capital charge to be used by the District of Sooke for expansion of the sewage treatment facilities. b. A sewer parcel tax imposed to recover the capital cost of the existing sewage collection and treatment facilities, and sewage generation charges, are also payable annually under Bylaw No., Sooke Core Sewer Specified Area Cost Recovery Bylaw, for properties within the local service area.. In the case of applications from property owners who will be constructing sewer main extensions to connect their property to the sewer system: a. The Council will consider the adoption of a bylaw amending the local service area boundary once the Director of Engineering has advised the Council that the works have been satisfactorily constructed. b. A latecomer charges agreement may be negotiated if the property owner s works serve properties other than those of the owner. c. The property owner is required to pay a capital charge to be used by the District of Sooke for expansion of the sewage treatment facilities.

A sewer parcel tax imposed to recover the capital cost of the existing sewage collection and treatment facilities, and sewage generation charges, are also payable annually under Bylaw No., Sooke Core Sewer Specified Area Cost Recovery Bylaw, for properties within the local service area.. In the case of applications from developers who will be constructing sewer main extensions to connect their subdivision or development property to the sewer system: a. The Council will consider the adoption of a bylaw amending the local service area boundary once the Director of Engineering has advised the Council that the works have been satisfactorily constructed or the developer has entered into a works and services agreement with the District of Sooke; b. The developer will be required to enter into a works and services agreement with the District of Sooke unless the works are constructed prior to the issuance of a subdivision approval or building permit authorizing the development; c. A latecomer charges agreement may be negotiated if the developer s works serve properties other than those of the developer. d. Developers will be required to pay a Development Cost Charge in respect of sewer system construction and expansion, at the time of subdividing or developing their property. e. A sewer parcel tax and sewage generation charges are also payable annually under Bylaw No., Sooke Core Sewer Specified Area Cost Recovery Bylaw, for properties within the local service area.
