6 Department of the Comptroller Stafftime December 3, 2013 Release of FY 13 Audit and Comprehensive Annual Financial Report (CAFR) and overview of the County s Financial Position Today the Board will release the County s FY 2013 audited financial statements and Comprehensive Annual Financial Report (CAFR). I will present a brief review of the results of operations and financial position of the County as reported. We have received an unmodified audit opinion from the independent CPA firm of CliftonLarsonAllen, LLP. The Single Audit of Federal Grants is included in the CAFR. The CAFR will be distributed to the State and Federal governments, credit rating agencies, bond markets, governmental partners, media and made available on the County s website ( Additional copies may be obtained by contacting the Department of the Comptroller. Following the release of the County s FY 13 financial statements, I will provide the Board and the public with an overview of the County s current financial position. 7 DATE: November 22, 2013 TO: RE: The Carroll County Board of Commissioners Carroll County Detention Center On-Site Dental Services - REBID 27-F-4-13/14 EXECUTIVE SUMMARY: The Carroll County Bureau of Purchasing is requested bids from licensed firms to conduct an independent practice of dentistry at the Carroll County Detention Center (CCDC), located at 100 North Court Street, Westminster Maryland, with an average population of 275 inmates. Carroll County, in turn, shall provide the required space and sufficient time to conduct its dental practice. The successful bidder shall provide services one day every other week and any other time when services are required as scheduled. Major Steve Reynolds, Detention Center in cooperation with the Bureau of Purchasing recommends award for the above project to be awarded to Dentrust Dental This is within the project budget and no additional funds will be needed. 8 DATE: November 20, 2013 TO: RE: The Carroll County Board of Commissioners Westminster Community Pond Stormwater Management Facility 75-F-1-13/14 EXECUTIVE SUMMARY: The Bureau of Purchasing solicited bids from qualified contractors for the work at the site which shall include, but is not limited to, the retrofit of an existing pond, and installation of new diversion structures at the ends of existing culverts beneath Maryland routes 140 and 97, along with all associated conveyances. Sediment and erosion control is also included in the work effort. This project is located on the North side of Maryland Route 140, on east side of the junction with Maryland Route 97 North. 9 December 3, 2013 Briefing and Request for Public Hearing on Proposed Amendments to Chapter 103 Cluster Subdivision Requirements Chapter 103 specifies the requirements for cluster subdivisions in the Residential zoning districts. Development Review staff has received comments from both developers and other County review agencies to modify the specific requirements that allow for cluster subdivisions. Staff met with the Planning and Zoning Commission on November 19 to discuss this matter and the Commission unanimously endorsed the code changes. To implement the recommended code change, the Board must host a public hearing following appropriate notice and advertisement. Following the hearing and a period where the record remains open, the Board may consider formal adoption. Authorize staff to host a public hearing to accept testimony in support or opposition. 10 December 3, 2013 Briefing Proposed Zoning Text Amendments Solar Energy Conversion Facilities Solar Energy Conversion Facilities as a principle permitted land use activity is not currently recognized in Chapter 223. Recent advances in technology and changes in power generation and transmitting have made this activity a more feasible activity and it is likely that Carroll County will experience some level of development pressure related to this use. To prepare for this, the Environmental Advisory Council (EAC) and staff were tasked with investigating this land use activity and developing recommendations. The EAC and staff produced a report which was later reviewed with the Planning Commission. The Commission continues to evaluate this issue. The purpose of this briefing is an interim status update to the Board of County Commissioners. No action is required. Briefing. Philip R. 12 Public Hearing 2013 Carroll County Water & Sewer Master Plan The purpose of this hearing is to accept public comment regarding the triennial update of the County Master Water and Sewer Plan. In compliance with Environment Article of the Annotated Code of Maryland, the hearing was duly advertised in the Carroll County Time on November 21 st and November 28 th. Hearing Philip R. 13 Public Hearing - Rezoning Case No Property located at Old Gamber and Gamber Road Rezoning Case No property located at Old Gamber and Gamber Road is to reclassify 4.45 acres from Business Neighborhood Retail (B-NR) to Business General (B-G). The property is located at the intersection of Old Gamber Road (MD 879) and Gamber Road (MD 91), in election district 4. The property has a land use designation of Neighborhood Business in the 1981 Finksburg Area and Environs Comprehensive Plan. The case was introduced to the Planning and Zoning Commission on September 17, 2013 and a full staff report was given on October 15, Following the review, the Planning and Zoning Commission voted to forward the petition to the Board of County Commissioners with an unfavorable recommendation based upon a finding of no mistake in the current zoning. A briefing was held by the Board of County Commissioners on November 21 st regarding this case. On in accordance with Section of the Land Use Article of the Annotated Code of Maryland, a Public Hearing is scheduled before the Board. This hearing was duly advertised in the Carroll County Times on November 21st and November 28 th as well as signs posted on the petition property two weeks in advanced. Landowners of property that either adjoins, or is in close proximity to the property involved in the above-referenced rezoning case and landowners in the petition neighborhood were notified by mail of the request and hearing date and time. 14 Consideration/Adoption Comprehensive rezoning of land adjoining Baltimore Boulevard corridor in accordance with the Finksburg Corridor Plan On October 15 th the Planning and Zoning Commission approved the map and forwarded it to the Board of County Commissioners for a Public Hearing. A public forum was held on October 30 th for landowners to come and discuss their proposed zoning change. On October 31 st the Board of County Commissioners was briefed on this matter and request for a Public Hearing was granted. This hearing was duly advertised in the Carroll County Times on November 7 th and November 14 th as well as signs posted on the petition properties two weeks in advance. Landowners of properties that either adjoin, or are in close proximity to the properties involved in the abovereferenced rezoning case and landowners in the petition neighborhood were notified by mail of the hearing date and time. A public hearing was hosted by the Board of County Commissioners on November 21. This rezoning will affect 21 properties along Baltimore Boulevard corridor, from the 3400 block to the 2900 block, at the intersection of Emory Road. Landowners of affected properties have received notice of this potential change in their zoning. One property owner requested to be exempted from this action and another requested that the rezoning proposal be modified to conform with an existing approved site plan. Consideration of Adoption. 15 Deliberate/Consideration of Adoption Rezoning Case No. 219 Long Reach Farms, Inc. (Robert R. Clarke) Rezoning Case No. 219 Long Reach Farms, Inc. (Robert R. Clarke) is a petition to reclassify a 6.59-acre portion of a acre area on Lot 19 of the Long Reach Farms subdivision from C Conservation to B-NR Business Neighborhood Retail. The property is located on the south side of MD 26 and north side of Rhonda Road, in election district 14. The case was introduced to the Planning and Zoning Commission on August 7, 2013 and a full staff report was given on September 17, Following review, the Planning and Zoning Commission voted to approve the requested rezoning petition and unanimously approved a motion to forward the request to the Board of County Commissioners with a favorable recommendation. The Board of County Commissioners was briefed by staff on October 10 th regarding this case. In accordance with Section of the Land Use Article of the Annotated Code of Maryland, a Public Hearing was scheduled before the Board. This hearing was duly advertised in the Carroll County Times on November 7 th and November 14 th as well as a sign posted on the petition property two weeks in advance. Landowners of property that either adjoins, or is in close proximity to the property involved in the above-referenced rezoning case and landowners in the petition neighborhood were notified by mail of the request and hearing date and time. 16 Chapter 71 Finding of Exceptional Circumstances Walnut Ridge, Section 8 Chapter 71, Adequate Public Facilities and Concurrency Management, establishes minimum adequacy standards or thresholds for public facilities (schools, roads, water and sewer facilities, police, fire, and emergency medical services). The Code states No project may be approved by the Commission if a public facility or service is inadequate or projected to be inadequate during the current CIP, unless a relief facility is planned to address the inadequacy or the developer provides mitigation acceptable to the County or the Board of County Commissioners has determined that exceptional circumstances exist to allow the approval despite the inadequacy or approaching inadequacy. On September 17, 2013 the Planning and Zoning Commission denied the residential subdivision Walnut Ridge, Section 8 based on the results of testing the subdivision as measured by the criteria detailed in Chapter 71. The specific denial of the subdivision was based on the fire service being rated inadequate. The criteria that resulted in the rating: [1] Total number of late and no responses equals or exceeds 15%, and the total number of no responses equals or exceeds 4% measured on a 24-month basis, updated monthly The first-due Fire Department that was rated inadequate according to the standards in Chapter 71 is the Reese fire station. When the plan was presented to the Commission, 6.0% of the calls were categorized as no responses, and 16.0% as late and no responses. As required by the Code, the Commission denied the plan. The Code does authorize the Board of County Commissioners to allow the Chapter 71 approval with a finding that is based on exceptional circumstances in instances where the Planning Commission has denied approval of a subdivision plan due to the inadequacy of a facility/service,. The owner/developer will be presenting information intended for the Board of Commissioners to determine exceptional circumstances exist that will allow for the subdivision to continue. 18 Agricultural Land Preservation Using Installment Purchase Agreement (IPA) on the Boerner Property, 1686 Garrett Road, Manchester, District 1 A acre farm property owned by Joseph E. Boerner, Barbara A. Boerner, Angela J. Roop, Amy J. Boerner, and Joseph E. Boerner, Jr. and located at 1686 Garrett Road was approved for the purchase of an agricultural conservation easement by the Carroll County Agricultural Land Preservation Advisory Board. Notice of Intent to purchase a Conservation Easement on the property has been duly advertised. The Option signed by the owners provides 120 days for the Commissioners to exercise the Option thereby converting it to a Contract of Sale. The property owners requested to be compensated through an Installment Purchase Agreement (IPA) and agreed to the purchase price of $190,560.00, which represents 40% of Fair Market Value. Twice-annual interest payments will be committed at 5.25% for 20 years. Each agreement requires a Resolution by the County Commissioners. Staff is recommending exercising this option. In preparation for settlement, it is now requested that the Board of Commissioners sign the Resolution. To exercise an Option to Purchase and to sign a Resolution for an Agricultural Conservation Easement on the Boerner property. Philip R. Fleming and Carolyn E. Ringley, Trustees under the Will of Stanley S. Fleming and located at the East Side Woodbine Road, Woodbine was approved for the purchase of an agricultural conservation easement by the Carroll County Agricultural Land Preservation Advisory Board. Notice of Intent to purchase a Conservation Easement on the property has been duly advertised. The Option signed by the owners provides 120 days for the Commissioners to exercise the Option thereby converting it to a Contract of Sale. The property owners requested to be compensated through an Installment Purchase Agreement (IPA) and agreed to the purchase price of $307,880.00, which represents 40% of Fair Market Value. Twice-annual interest payments will be committed at 5.25% for 20 years. Each agreement requires a Resolution by the County Commissioners. Staff is recommending exercising this option. Hoff and located at 1835 Wilt Road was approved for the purchase of an agricultural conservation easement by the Carroll County Agricultural Land Preservation Advisory Board. Notice of Intent to purchase a Conservation Easement on the property has been duly advertised. The Option signed by the owners provides 120 days for the Commissioners to exercise the Option thereby converting it to a Contract of Sale. The property owners requested to be compensated through an Installment Purchase Agreement (IPA) and agreed to the purchase price of $662,400.00, which represents 40% of Fair Market Value. Twice-annual interest payments will be committed at 5.25% for 20 years. Each agreement requires a Resolution by the County Commissioners. Staff is recommending exercising this option. In preparation for settlement, it is now requested that the Board of Commissioners sign the Resolution. 26 Review of Carroll County Master Plan Chapters 1 2 The Carroll County Master Plan is currently under revision. This is an update and revision to the 2011 Planning Commission Approved version. On November 6 th the Bureau of Comprehensive Planning presented the Planning Commission with Chapters 1-4 of the current draft document. Comments regarding these chapters have been received by the Comprehensive Planning Bureau and have been incorporated into the document. Staff has also presented the Planning Commission with Chapters 5-8 and the table of contents. The Planning Commission is scheduled to provide feedback at the December Planning Commission meeting. 27 OFFICE OF HUMAN RESOURCES Conduct deliberations and consider Adoption of Proposed Changes to County Retirement Plans (County Pension Plan, County Certified Law Officers Pension Plan, 401(k) Plan and Section 457 Deferred Compensation Plan. Minor changes to the Plans are proposed for the following purposes: 1. Update the plan documents in compliance with changes made to federal laws; 2. Eliminate the current provision in the Carroll County Certified Law Officers Pension Plan that would prevent future transfers of service from other Maryland pension plans; 3. Provide increased clarity and simplification of the wording used in sections of the current documents. On November 14, 2013, the Board held a public hearing. No comments were offered during the public hearing. At the conclusion, the Commissioners indicated that they wished to keep the record open for a period of time not less than ten (10) days.
