11 OUTSTANDING TASKS The Corridor Management Study Update At the August 16 th Transportation Planning Organization meeting, the City requested that a Corridor Management Study for all of Highway 85, from Airport Road to Antioch Road, with a phase split at Aplin Roadway, be placed on the priority list. This was approved by the TPO unanimously. The study will provide a means to study all the traffic issues affecting Highway 85 in its entirety, such as the volume of vehicles, timing of lights, and other issues. The result will be the ability to provide suggestions to improve the flow of traffic and reduce wait time at lights. The resulting solutions could vary from closing the dangerous wide-open medians in some areas and creating controlled turns, improved light timing, to improving and creating alternative routes through City streets for locals and emergency services to have a way of moving north and south without using Highway 85. This study is on the priority list along with three other studies and will need to be prioritized and then funded. Continuing efforts by the TPO will be to push for this Study to occur as quickly as possible as well as ensure funding is available. Usual timelines for this effort is at times 2 3 years before completion, sometimes longer as it is dependent on available funding. More information on the Corridor Management Study? Would a short presentation from the Planner provide a better understanding of the need, procedures and cost for the study? Title VI Non-Discrimination Policy and Plan The City of Crestview is successfully working towards becoming LAP Certified. This will allow the City to administer Transportation Alternative (TA) Grants on our own, without having to utilize the services of Okaloosa County. This will improve our ability to receive funding from that source for projects such as sidewalk design and construction, bicycle facilities, intersection improvements for pedestrian safety. One part of that LAP Certification effort is bringing the City of Crestview into compliance with numerous federal regulations that are compiled together into a program known as the Title VI program. This program protects people from discrimination based on race, color, or national origin in any program that receives federal funding. This program will also serve to open up other opportunities for funding various improvement projects. It will also improve the services the City provides to the citizens. More information on the Title VI? Would you like a copy of the draft Policy? Would a short presentation provide a better understanding of the Policy? The next round of TA applications are due in November 2018, this Policy will need to be in place. August 27, 2018 Page 11 of 16
12 OUTSTANDING TASKS ADA Compliance Study and Analysis Planning Dept. is in the process of compiling data concerning the compliance of developments of the City with the current ADA Standards. In the processing of Business Tax Receipts, which involves a site visit to the property, we have discovered that outdated signage was the main key element that was out of compliance. To aid this compliance issue, the Department shall stock the approved signage and provide it to the public at cost. We shall work with the property owners to correct the non-conformities. This will also include the City buildings. As per the City s Code of Ordinances: Parking for the handicapped. The number, design and location of handicapped spaces shall be consistent with the requirements of F.S and , or succeeding provisions. On publicly owned and maintained streets and parking lots, reserved parking space for the handicapped shall be posted with a fixed sign approved by the State Department of Transportation (DOT) bearing the internationally accepted wheelchair symbol with caption, "PARKING BY DISABLED PERMIT ONLY." The following minimum number of parking spaces shall be provided as follows: Total Parking in Lot Required Minimum Number of Handicapped Accessible Spaces 1 to to to to to to to to to to percent of total 1001 and over 20 plus 1 for each 100 over 100 Any business, firm or persons licensed to do business with the public are encouraged to provide parking for the handicapped consistent with the above minimums. Such spaces when marked by the DOT approved signage shall be subject to the same restrictions and punishments in the event of violation. Handicapped spaces shall be located as close as feasibly possible to the handicapped-accessible entrance or entrances of a business. Maintenance: Parking lots shall be properly maintained in all respects. Parking area surfaces shall be kept in good condition, free from potholes, and parking space lines or markings shall be kept clearly visible and distinct. 13 OUTSTANDING TASKS Revisions of Chapter 14 Building and Building Regulations Revisions of Chapter 14 are based on the Florida Building Code, Sixth Edition (2017) which was made effective December 31, The Building Officials Association of Florida has prepared a model document for use by its members as a tool to facilitate the uniform and consistent application of local amendments to the administrative provisions of the Florida Building Code. Every effort represented has been made to present the amendments in the mandatory language format. The Crestview Administrative Code contains substantial materials owned and copyrighted by the International Code Council. The ICC has granted a non-exclusive license to the Florida Department of Business and Professional Regulation to make the Florida Building Code available. This material is made available through the BOAF web site in order that members may have a tool for the integration of administrative provisions from the Florida Building Code and the 2015 International Building Code. This will be an intense study and may require a couple of workshops to work through the complete thirty-four page booklet. However, it is based on the ICC Document. The Property Maintenance was also an ICC Document and the formatting is very similar. Provide the draft document for study and review at least 2-4 weeks prior to any workshops being scheduled?? May require scheduling special workshops?? The new Building Code has been in effect since 12/31/17. It is advantageous to have the new revisions be adopted as soon as possible. Revision of Chapter 38 Health and Sanitation Revisions of Chapter 38 for the addition of the Crestview Property Maintenance Code into the Code of Ordinances. Chapter 38 was created by the adoption of Ord. No. 805, as adopted on Minor revisions are necessary to the remainder of Chapter 38 will allow for the updating of the verbiage. The verbiage of the Crestview Property Maintenance Code has already been approved. This needs to be adopted and in use as soon as possible. Chapter 74 Streets and Sidewalks Addressing Updating We are now receiving the calls from the first wave of the Census 2030 workers. The main Census Information collection from physical sites will take place next year. As part of being prepared for this, as well as meeting the Local Government Unit deadline for address verification, Staff has confirmed the existence of approximately 13, 000 addresses within the City. One of the request August 27, 2018 Page 13 of 16
14 OUTSTANDING TASKS from the Census Bureau is the physical verification of the visibility of the number placement on the structure. During the early field investigation, numerous structures were found without proper visibility posting, posting of a conflicting number and some with no posting at all. Notification to the property owners will need to be sent out via postal delivery, which would incur a cost. Advertisement, also a cost. Mailings, a cost. Physically delivering, cost. Secondary, the absolute need for the updating of the internal system within the City itself, which is noted in an item below. More information on the complexity of correcting the Addressing System? The Census data collection is extremely important and holds tremendous value in the future development of the City. It happens every 10 years. The ease of location of the citizens being interviews shall aid to the accuracy factor of the data. Land Use and Zoning Incompatibility We have discussed this item before without uncovering a complete solution. The City made great strides in correcting a large portion of the problem with the EAR process beginning in 2008, with the passages of the 2010 Amendments. This portion was completed the summer of 2014, with the adoption of numerous rezoning ordinances. This was a good start, however, there is much more that is needing to be completed. This is a self-induced problem and is causing hardship on the citizens involved. We have analyzed the approaches of solving the situation. Unfortunately, it is costly, but not as costly as citizens processing the changes one property at a time. More information on the complexity of correcting the Incompatibilities? New Zoning Categories Mixed Use District and R-2S and R-2M Districts The new Zoning District classifications are needed to implement the existing Future Land Use Categories in clear and concise way. This will be necessary prior to the passage of the proposed Code and Land Use Regulations. Land Development Code Land Use Regulations The updating of the Land Development Code, Chapter 102 Land Use Regulations is currently undergoing intense analysis and revision in order to incorporate the new laws and regulations from Federal, State, and Local entities, along with the new regulations of the numerous agencies involved in the development avenues and operational activities of the City. Since this August 27, 2018 Page 14 of 16
15 OUTSTANDING TASKS is a major overhaul and modernization of the existing Code, it will require a period of time in which to work through the details. If a suggestion is not out of line, I would like to see this scheduled during the period after the holidays and before the budget cycle starts again. Alcoholic Beverage Regulations Alcoholic Beverages consumption on premises has been studied and analyzed. documentation ready to be presented. We have Downtown Parking District The Downtown Parking District need to be analyzed and the regulations revised and clarified. Itinerate Vendors, Mobile Vendors and Specialty Vendors We have analysis and data that show alternate solutions to the vending sales within the City. Workshops for discussion and direction will be necessary, in order to proceed in a way that will be acceptable to Council. Complex issue with numerous regulatory agencies involved and rights of property owners to be considered. Rights of way Parking and Enforcement Procedures FLS. STAT provides Municipalities jurisdiction over any roadway within its jurisdiction except state roads. Private roads are included if agreed by the HOA. The roadway is defined as everything from right of way to right of way, or property line to property line. FLS. STAT specifically states Police powers include regulating parking. FLS. STAT (2) specifically states that "The municipality, through its duly authorized officers, shall have nonexclusive jurisdiction over the prosecution, trial, adjudication, and punishment of violations of this chapter when a violation occurs within the municipality and the person so charged is charged by a municipal police officer. The disposition of such matters in the municipality shall be in accordance with the charter of that municipality." Per the above FLS. STAT., parking on the right of way, if deemed not allowable by City code, is enforceable by a Police Officer. FLS. STAT states it is unlawful to impede, in any way the roadway. This means no parking on the roadway / travel way. August 27, 2018 Page 15 of 16
16 OUTSTANDING TASKS City Ordinance, 86 Traffic and Vehicles, Sec states, no parking in roadway unless marked for parking. City Ordinance, 86 Traffic and Vehicles, Sec 86-28, covers no parking in roadway, in a fire lane, etc. Does not specifically call out shoulders or right of way. City Ordinance, 86 Traffic and Vehicles, Sec 86-29, also covers no parking in the roadway. City Ordinance, 86 Traffic and Vehicles, Sec 86-36, DOES specifically cover no parking within the right of way. No parking is allowed within the right of way of any street (Sec 86-36) except as marked for parking. FLS. STAT gives Municipalities jurisdiction over roadways within its limits FLS. STAT specifically states Police or Law Enforcement is to enforce parking regulations. The only caveat would be 'Parking Enforcement Officials". City Ordinance, 86 Traffic and Vehicles, Sec (4), provides for 12 hours for the vehicle to be moved before it can be towed. At one time, CPD placed a 72-hour sticker on vehicles, stating if not removed in 72 hours, the vehicle will be towed. Of note... City Ordinance, 86 Traffic and Vehicles, Sec 86-42, does also place parking within a fire lane as a fineable offense. Law Enforcement has the responsibility, even on private property, to ticket those parked within the fire lane. Complex issue that will need discussion in order to provide a workable solution. Systematic updating of computer records The property data within the systems are not updated in a regular cycle. The requires a form of sit-down communication between the parties and formulate an avenue for updating the data without harming the archival records. It must be doable, as Okaloosa County property data is updated and presented once a week. It seems the only board spectrum update that the City has is when we update the program system itself. Complex issue with several departments. Need discussion time authorized among parties and well as Council time. Out of City Utility Services and Annexation Discussion of pros and cons of small annexations verses wide area approach. This is most needed in only one area adjacent to the City. We are continuing to process the Out of City Requests in order to keep current agreements, the matter is not urgent. Just keeping it out in the open as a reminder, in case the Council would want to hear of other options. August 27, 2018 Page 16 of 16
