1 MINUTES JACKSON COUNTY ZONING & LAND INFORMATION COMMITTEE : Site Visit, Committee Meeting and Public Hearing Meeting Called To Order by Chairman Gary Olson at 8:00 a.m. Amy Peterson, MSA, was present to discuss the public hearing procedures with the Committee. She will have a brief presentation of the comprehensive plan, Terry will state the public hearing procedures for the public and Gary will comment on why the County has prepared a comprehensive plan. Following the public hearing, the Zoning and Land Information Committee will hold the resolution meeting. Terry updated the committee on the status of the municipalities that have not completed their plans. Bear Bluff will be acting on the resolution and ordinance at their November meeting, Manchester and Albion are continuing to work on their plans and will act on the resolution and ordinance in the near future. Adams, Alma and Irving have elected not to do anything and not adopt the comprehensive plan. A Motion by Stoker, to approve the September 9 and September 16, 2010 minutes, seconded by Gaylord Olson. Motion carried. A Motion by Gaylord Olson, to approve the vouchers for payment, seconded by Jim Olson. Motion carried. CSM REVIEW Dallas Wilhite is doing a survey for Rick Johnson, there is an existing 33 foot easement to the serve the forty. Johnson s intend on splitting off two acres as an agriculture use lot for tax assessment purposes. They are proposing a 66 foot easement to serve the proposed lot. A Motion by Evenson, to approve a 66 foot easement for the Rick Johnson, seconded by Stoker. Motion carried. SURVEYOR S REPORT Tim Jeatran, see report. Working in Bear Bluff. They have been using the otter from the Forestry and Parks Dept. Jack was driving the unit last week with Tim and Ralph riding on it, when they hit a stump unexpectedly causing the guard to bounce back hitting Tim in the ribs. He ended up going in to have x rays completed to ensure that he hadn t broken any. They found that he had bruised the sternum and it will take time for it to heal. 1
2 Busy drawing tie sheets for the corners being set. Working in Merrillan on the Felske survey issue. This a re location of subdivision survey corners due to a Forestry and Parks Department blue line survey and property owner dispute. Preliminary work supports the initial work that Jack has done. Tim and Lauree have been reviewing the aerial photos and there are a couple of minor issues that Ayres & Associates will try to correct. The final photos are scheduled to arrive in November. Discussion of replacing Lauree s Xerox printer. It is continuing to act up with errors and the memory issues. Repairs to the existing unit would be approximately 1/3 of the cost of a new unit with no guarantee that the repairs will correct the problems. IT has received quotes and the unit that they recommend for replacement is a Xerox Phaser for $3,950.00, which includes a three year warranty. There is the potential of a rebate for the existing unit of $450.00, once the new unit is purchased. The resolution was read into the minutes. A Motion by Evenson, to approve the purchase of a Xerox Phaser printer for the GIS Technician, seconded Stoker. Motion carried. GIS TECHNICIAN REPORT Lauree Kratcha, see report. All assessment rolls are in and submitted to the state. Skolos replied with suggestions for the text amendment to the E911 Ordinance. We plan on taking the changes to public hearing in November. He suggested that proof of access is provided prior to the issuance of the fire number, which would eliminate the conflicts between ordinances. Lauree will work with the Forestry and Parks Department on the trail naming issues. Forestry and Parks will be responsible to enforce the driveway permit and compliance of properties that have not obtained one. Tax bill backers have been printed and arrived from Badger State Industries. We will begin printing bills in late November to early December. Melrose Mill Pond update. The Tax Deed Committee plans on quit claim deeding the two tax deed parcels that are located in the mill pond area to the Village of Melrose. The ADC mapping website is undergoing a make over. They have moved to the evaluation stage for users to review and get familiar with the changes. If there are any changes that need to be completed, now is the time to address them so we are looking for input from all users. Lauree attended the training for ArcGIS Server in Minneapolis. She needs to set up the software, but has not had the time to do so as it will take the better part of a week to 2
3 get everything handled. She hopes to do so in the very near future as the software would be extremely helpful and time saving. In the recent flood event, Lauree was called in to assist with mapping issues. She ended up working about 40 hours on the flood event with creating maps of road closures and evacuation areas. The event showed the need for roof print layers and lidar elevation data, as these would have helped identify prone areas for damage and assessment. PUBLIC HEARINGS CONDITIONAL USE REQUEST # as requested by Spencer Emerich on property known as Lot 2 of CSM 1943 located in the SE1/4 NW1/4, Section 19, T21N, R5W, Town of Springfield, Jackson County, WI. The request is to allow for a home based business within the R 2 (Residential) District. No township position has been received. Petitioner plans on selling computers and obtaining a license as a gun dealer. A Motion by Jim Olson, to approve conditional use request # for Spencer Emerich, seconded by Evenson. Motion carried. CONDITIONAL USE REQUEST # as requested by Michael and Valery Fay on property known as Lot 1 of CSM 848 located in the NE1/4 SW1/4, Section 34, T20N, R1W, Town of Knapp, Jackson County, WI. The request is to allow for undomesticated animals to be located on property located within the R 2 (Residential) District. Township supports the request with the stipulation that the number of animal units coincides with the Land Conservation Department recommendations. Terry added that the parcel meets the minimum three acre lot size requirement. Gaylord Olson added that he has met with Michael and the proposed five animal units are acceptable. He would not recommend exceeding this amount. A Motion by Stoker, to approve conditional use request # for Michael and Valery Fay with the stipulation that the maximum number of animal units is five, seconded by Jim Olson. Motion carried. ZONING REPORT Terry Schmidt. WCCA Fall Conference is the end of the month in Neenah. Terry and Dustin plan on attending. Floodplain Ordinance and recent flood event. We recently learned that our office is responsible for flood damage assessment for all properties with improvements within 3
4 the floodplain. Since Jackson County participates in the National Flood Insurance Program, we had to do text amendments to the Floodplain Ordinance to bring it into compliance with FEMA standards since Katrina. This was done a few years ago, and since then we have been the designated enforcing agency. With this participation, we are required to perform an inspection of every parcel with improvements within the floodplain to assess damage. We have determined that approximately 825 properties are located within the floodplain that the tax roll has identified. Beth has begun creating the Damage Inventory Worksheets for all the parcels and obtained the FEMA software for the creation of the database to maintain the property damage assessment totals. Terry has begun the inspection process with the assistance of General Engineering. During this time, Dustin is completing all the permit issuance for sanitary permits as well as land use permits. This assessment process between form creation, field inspection and data entry has monopolized the office staff and has been very time demanding. Results of the inspections completed thus far have shown one permanent residence that will not be re occupied due to substantial damage. Substantial damage is 50% of the assessed value. Of all the inspections completed so far, none of the property owners have carried flood insurance. We are finding the majority of properties will have some type of damage; we are required to document the cost of repairs and maintain a record of the total damage over the lifetime of the structure. We are sending letters to all affected property owners placing them on notice of what may happen in the future, as repairs accumulate over the lifetime of the structure. Once they reach the 50% threshold, if located in the floodway they will not be allowed to reoccupy the structure. If located in the floodfringe, they will need to meet the ordinance standards for floodproofing prior to re occupying the structure. The ordinance does not allow for human habitation of a structure within the floodway. Additionally, well and septic systems are not allowed within the floodway. Discussed the database conversion. We have researched and surveyed other counties to determine the type of system they are utilizing. By completing this survey, we have determined that this is a customized and unique situation as most counties do not have their survey records in a database system. The vast majority of counties have internal programmers on staff, which has created their data management systems. We have received quotes from a number of vendors. After review of their products, the IT, Zoning and Land Information Department staff feels that Pro West and Associates best meets the needs of Jackson County. A resolution was read into the minutes. A Motion by Jim Olson, to approve the resolution for the database conversion and approving Pro West and Associates as contractor, seconded by Evenson. Motion carried. The Town of Manchester Chairman, Ed Chamberlain, wanted to place a question on the November ballot regarding the Comprehensive Land Use Plan. They cannot meet the minimum number of days for publication prior to the election so they will wait until 4
5 the spring election. Albion is meeting with MSA and continuing to work on revisions to their plan. Randy Anderson, Highway Commissioner, ed Terry with a couple of recommendations for the countywide plan. There are a couple of inconsistencies regarding the Phaser recommendations in the plan. Terry will bring them forward at the public hearing for review. A Motion by Jim Olson, to adjourn the meeting, seconded by Gaylord Olson. Motion carried. Meeting adjourned at 11:45 a.m. 5
