BACKGROUND: The Homeowner Rehabilitation Loan Program is designed to repair or eliminate health and safety hazards in residential properties for qualifying low income households whose income is 80% or below the Area Median Income. Eligible improvements include roofing, weatherization, heating and cooling systems, plumbing, electrical, ramps, handrails and widening of doorways. Financial assistance is available in the form of low interest loans, secured by Deeds of Trust and recorded against equity qualifying owner-occupied properties. The Housing Rehabilitation Loan Committee (HRLC) is authorized to approve loans up to $49,999; loans in excess of $49,999 require City Council approval. The Homeowner Rehabilitation Grant Program is designed to address health and safety concerns in residential properties for qualifying low income households whose income is 80% or below the Area Median Income. Eligible Improvements include upgrading or replacement of heating, ventilating and air conditioning systems; replacement of windows, water heaters, doors, fans; insulation, and leaking roofs. Financial assistance is available in the form of a grant with a maximum award of $10,000 for owner occupied single-family residential units and $20,000 for Modular Homes. Technical assistance is provided for both programs and includes preparation of work specifications, preparation and review of cost estimates, bidding assistance and coordination

DISCUSSION: On November 12, 2018, staff met with Virginia Flores (Homeowner) to complete an intake interview, and eligibility was completed and approved by the Housing Financial Specialist on November 30, On December 11, 2018 staff met with Virginia Flores to conduct housing quality standards inspection of the property located at 1704 Ruby Lane, Modesto, CA The inspection found substantial health and safety related items in need of repair and/or replacement such as a prep & paint exterior paint, replace GFCI, demo outbuilding, replace flooring and re-wire to code. A more detailed breakdown of the project improvements and corresponding costs are provided in the Homeowner Rehabilitation Program Summary Sheet, provided as Attachment A. FISCAL IMPACTS: The Homeowner Rehabilitation Program is funded through the Community Development Block Grant Revolving Loan Fund. Sufficient funds are available to fund the requested project. CEQA/NEPA REQUIREMENTS: As per the National Environmental Policy Act (NEPA) and as required by the U.S. Department of Housing and Urban Development, an environmental review is being prepared and completed. Funds will be released to the lowest responsive contractor only after the NEPA Environmental Review has been completed by the Environmental Review Specialist. DISCUSSION: On September 6, 2018 Housing Rehabilitation Loan Committee (HRLC) approved a completed Emergency repair in the amount of $ Emergency repair was due to plumbing issue. Certificate of completion was signed by all parties on August 28, On November 27, 2018, staff met with Sandra Starn (homeowner) to conduct an assessment of her property located at 139 Lee Street, Modesto, CA, (property). The inspection found the extreme need to address this concern as an emergency; repair issue to waste line. On December 10, 2018, City staff completed an income re-certification. It was determined Sandra Starn (Homeowner) currently has a payment plan for previous property taxes. City staff has confirmed payment plan is current. On December 10, 2018 the contract was awarded to the lowest bidder, Borges Construction for project cost not to exceed $ On December 17, 2018 a Certificate of Completion was signed by all parties. Pursuant to Section (Homeowner Eligibility) the Housing Rehabilitation Loan Committee (HRLC) will consider applications on a case-by case-basis. The HRLC will have the discretion to consider any extenuating circumstances for a homeowner who may not meet the Homeowner Eligibility Guidelines and may decide to approve the application a based on such extenuating circumstances. Applicants with debt-to-income ratios outside the limits established within these policies may be considered for assistance, if the debt-to-income ratio is within 10% of the current Homeowner Rehabilitation Program Policies & Procedures guidelines. Applicants who have defaulted on payments, but a payment plan has been established, and the applicant is current on those payments. Staff deemed this project as an emergency, because the waste line was affecting the foundation of the property. In order to complete this project quickly, the repair moved forward in accordance with the Emergency Repairs Procedures. Per Section 5.1.5, emergency repairs of up to $5,000 may be authorized by the Director of Community and Economic Development if it poses an extreme health and safety related emergency in line with Modesto Municipal Code From time to time, City of Modesto residents will contact the city with repair requests that constitute an immediate threat to their health and safety. Such cases will be treated as Emergency repairs; e.g. broken sewer line, broken water line, leaking roof (during rainy season), broken HVAC system (during summer/winter), and unsafe electrical and or plumbing conditions.

11 These cases will be given priority over other non-emergency projects. A more detailed breakdown of the project improvements and corresponding bid results are provided in the Homeowner Rehabilitation Program Summary Sheet, provided as Attachment A. FISCAL IMPACTS: The Homeowner Rehabilitation Program is funded through the Community Development Block Grant Revolving Loan Fund. Sufficient funds are available to fund the requested increases. DISCUSSION: On August 12, 2018, staff met with Penny Allington (Homeowner) to complete an intake interview. On August 13, 2018 eligibility was completed and approved by the Housing Financial Specialist. On August 15, 2018 staff met with Penny Allington to conduct an assessment of her property located at 2621 Prescott Rd, Space #116, Modesto, CA The inspection found substantial health and safety items, including, the need for a wheel chair lift and a new water heater in need of replacement. On September 6, 2018 HRLC approved the proposed scope of work not to exceed $16,000. On October 9, 2018, Homeowner and Borges Construction signed the Contractor Agreement in the amount of $9,990 (inclusive of contingencies). During the project the presence of termites was suspected and a pest report confirmed termites and substantial termite damages. The termite inspection found additional damage to the structure. Due to this unforeseen change order staff has completed a second contract to cover the pest control services and additional repairs in the amount of $9, The second contractor agreement dated December 18, 2018 for $9, exceeds the Housing Rehabilitation Loan Committee (HRLC) approval in the amount of $3, which was covered in an Advance Payment Agreement. Staff deemed this project as an emergency, because the siding had been removed and it was exposed to potential weather. In order to complete this project quickly, the repair moved forward in accordance with the Emergency Repairs Procedures. Per Section 5.1.5, emergency repairs of up to $5,000 may be authorized by the Director of Community and Economic Development if it poses an extreme health and safety related emergency in line with Modesto Municipal Code From time to time, City of Modesto residents will contact the city with repair requests that constitute an immediate threat to their health and safety. Such cases will be treated as Emergency repairs; e.g. broken sewer line, broken water line, leaking roof (during rainy season), broken HVAC system (during summer/winter), and unsafe electrical and or plumbing conditions. These cases will be given priority over other non-emergency projects. Staff is seeking approval to approve the Emergency Repair and convert the agreement to a grant.
