ORDINANCE OF THE COUNCIL OF THE CITY OF DIXON REZONING APPROXIMATELY ACRES FROM LIGHT INDUSTRIAL- PROFESSIONAL AND ADMINISTRATIVE OFFICE-PLANNED DEVELOPMENT (ML-PAO-PD) TO COMMUNITY COMMERCIAL-MULTIPLE FAMILY RESIDENTIAL-PLANNED DEVELOPMENT (CC-RM3-PD) (APN's ,460) AND DIRECTING THAT THE OFFICIAL ZONING MAP OF THE CITY BE AMENDED ACCORDINGLY THE COUNCIL OF THE CITY OF DIXON DOES ORDAIN AS FOLLOWS: SECTION 1. City of Dixon ("City") is proposing an amendment to change the Land Use Element (Map) of the Dixon General Plan by amending the land use designation from Planned Businessllndustrial (PI) to Community Commercial Medium Density High Residential (CC/MDH) and amend the official Zoning Map of the City by rezoning from Light Industrial-Professional & Administrative Office Planned Development (ML-PAO-PD) to Community Commercial-Multiple Family Residential-Planned Development (CC-RM3-PD) for the properties located on the southwest comer of North First Street and North Lincoln Street, Solano County Assessor's Parcel Number's , 460 ("Project Site"). The approvals are collectively known as "the Project." SECTION 2. By resolution no. the City Council has, prior to or concurrent with this approval, considered and approved a Mitigated Negative Declaration in compliance with the requirements of the California Environmental Quality Act (CEQA), Public Resources Code Section 2100 et seq., the CEQA Guidelines, Cal. Code Regs, Title 14, Section et seq., and the Dixon Environmental Guidelines, City Council Resolution ("City Guidelines"). SECTION 3. The City Council finds as follows: (1) In order to provide the required flexibility to develop the Project Site with commercial development and high density housing it is necessary to rezone the Project Site from Light Industrial-Professional & Administrative Office-Planned Development (ML-PAO-PD) to Community Commercial Multiple Family Residential-Planned Development (CC-RM3-PD). (2) This request for rezoning the Project Site is made pursuant to Section of the City's Zoning Ordinance. The proposed rezoning of the Project Site is depicted in Exhibit "A". (3) Pursuant to Section of the Zoning Ordinance, the Community Development Department made an investigation into the proposed rezoning and a report of the investigation was submitted to the Planning Commission. 2 (4) The Planning Commission held a properly noticed public hearing on the proposed rezoning on September 16, (5) The City Council held a properly noticed public hearing on the proposed rezoning on January 13, (6) After considering all of the evidence, the City Council found that the proposed rezoning is necessary to achieve the objectives of the Zoning Ordinance as prescribed in Section and that the proposed rezoning was consistent with the City's General Plan. (7) The Council's findings herein are based on its review and consideration of the recommendations of the Planning Commission, staff reports, all evidence and testimony submitted at the public hearing, and all related documentation in the record. (8) The proposed rezoning is consistent with the objectives, policies, general plan land uses and programs specified in the Dixon General Plan and more specifically the Housing Element. The policies, uses and programs are an integral part of the Dixon General Plan, which encourages multi-family housing. (9) Approval of the proposed rezoning will enable land uses that are appropriate and beneficial to the City, foster a harmonious and convenient relationship between land uses. The proposed rezoning approval is therefore necessary and convenient to achieve the objectives of the Zoning Ordinance as prescribed in Section (10) Approval of the proposed rezoning will promote the public health, safety, and general welfare. SECTION 5. Pursuant to the provisions of Section of the Zoning Ordinance and Government Code Section 65853, the Project Site is hereby rezoned as depicted on the attached Exhibit "A". SECTION 6. Pursuant to Section of the Zoning Ordinance, the City Clerk is hereby directed to amend the Official Zoning Map of the City of Dixon with the rezoning approved by this ordinance. SECTION 7. This Ordinance shall become effective thirty (30) days from and after its final passage and adoption, provided it is published within fifteen (15) days after its adoption in a newspaper of general circulation in the City of Dixon.

41 Ian Baird, consultant for Joe Duffel (applicant), discussed the proposed project stating it would fill a need for "market-rate" residential as well as other components of the project. Photographs distributed of similar completed projects illustrates a Spanish-style design that would blend well with the existing businesses. Chair Duncan asked for public comment from the speaker cards submitted. Rita Holder, resident for 16 years, stated when she and her husband brought their property they asked what could they expect to be built on the subject property in the future, and were informed it would be light industrial, business administrative, medical offices, etc. - businesses that would be closed at night and during the weekends. She spoke in opposition to commercial and/or apartments backing up to their property, and presented letters for the record from neighbors within the noticing area also opposed to this project. Shirley Humphrey commented on conflicting numbers of residential permit approvals between now and year 2022, and that "mixed-use" in smaller towns historically has not worked well. Michael Ceremello commented this is the third time this property has been viewed for apartments and asked if we [the City] are allowing developers to change the General Plan. Larry Simmons commented on a shortage of "normal" housing versus apartments. Ginger Emerson asked if these apartments were viewed as "catch-up" for affordable housing. A resident from Clipper Court, stated he bought his home specificially where he wanted to raise his family, not backing up to a 3-story apartment complex with 240 units; he discussed the impact on schools, law enforcement, and bonds for parks and roadways. He asked the Planning Commission not to let this happen. Chair Duncan commented he received a phone call from "Sarah" opposing the project. Chair Duncan closed public hearing. Commissioner Gil-Blanco expressed the same concerns as the residents that the project would potentially de-value their homes. Commissioner Johnson added that home buyers rely on what the existing zoning of undeveloped lots are when they purchase, felt the proposed project to be ill-timed with upcoming discussions of the General Plan, and does not support the project. 3
42 Commissioner Hendershot opposed the idea of apartments and did not want to see more vacant buildings downtown; he does not support the project. Commissioner Quinn commented that Dixon is in need of change, however felt this project lacks what Dixon needs right now and does not support the project. Commissioner Ritchey felt this was not an area for mixed-use, an apartment complex with commercial on both sides is not a good use in this area. Chair Duncan agreed with all the comments made by the Commission, adding it is the City's job to listen to the citizens and make decisions accordingly; he does not support the project. A motion was made by Chair Duncan, seconded by Commissioner Johnson, to deny the request to re-zone the subject property.
