1 \Tri,1 City Council Agenda Report Meeting Date: April 7, 2015 TO: City Council FROM: Jake Morley, Associate Planner ( ; RE: Public Hearing and Final Reading Regarding Rezone 1-03 (SC Student Housing) REPORT IN BRIEF: This is a final reading and adoption of an ordinance adding the -COS (Corridor Opportunity Site) overlay zoning district to two parcels currently zoned CC-FS (Community Commercial with Fraternity/Sorority Overlay) located along Walnut Street (Highway 32) between West 5th and 6th Street On 12/18/1, the Planning Commission conducted a public hearing and on a vote (Juht-Darlington absent), adopted a resolution recommending that the City Council approve the proposal. On 3/17/15. the Council conducted a public hearing and voted (Schwab and Morgan absent) to adopt a related resolution and to schedule the ordinance for a final reading and adoption. Recommendation: The Planning Commission and Community Development Director recommend that the City Council adopt the Ordinance (Attachment A) by reading its title only: ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHICO AMENDING THE ZONING OF PROPERTY IDENTIFIED AS ASSESSOR'S PARCEL NO AND FROM CC-FS (COMMUNITY COMMERCIAL WITH FRATERNITY/SORORITY OVERLAY) TO CC-FS-COS (COMMUNITY COMMERCIAL WITH FRATERNITY/SORORITY AND CORRIDOR OPPORTUNITY SITE OVERLAY) (SC STUDENT HOUSING) FISCAL IMPACT: N/A ENVIRONMENTAL REVIEW: The application of the -COS overlay zone to the project site would directly implement a number of goals of the General Plan, and is therefore within the scope of analysis of the General Plan Update Final EIR (SCH ). The conservative and cumulative nature of the programmatic environmental review prepared for the General Plan update reasonably covers the minor increased development potential attributableto the proposed change in zoning for the project site. The technical analysis of the environmental effects of the General Plan Update (e.g., traffic operation analysis, noise and air quality modeling and analyses) assumed complete build-out of the Land Use Diagram by the year 2030 even though trends indicate that build-out will occur well after In short, there wijl be no additional impacts associated with the proposed rezone beyond those contemplated in the comprehensive and programmatic EIR analysis prepared for the General Plan update. (Uncodified) ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHICO AMENDING THE ZONING OF PROPERTY IDENTIFIED AS ASSESSOR'S PARCEL NO AND FROM CC-FS (COMMUNITY COMMERCIAL WITH FRATERNITY/SORORITY OVERLAY) TO CC-FS- COS (COMMUNITY COMMERCIAL WITH FRATERNITY/SORORITY AND CORRIDOR OPPORTUNITY SITE OVERLAY) (SC STUDENT HOUSING) BE IT ORDAINED by the Council of the City of Chico that: Section 1. The zoning of all that real property situated within the City of Chico, County of Butte, State of California, identified as Assessor's Parcel Numbers and I is amended to CC-FS-COS Community Commercial with Fraternity/Sorority and Corridor Opportunity Site Overlay, as depicted on Exhibit 1. Section 2. The City Council finds that: A. The proposed rezone, adding the-cos overlay zoning district to the site, is consistent with the site's designation of Commercial Mixed Use, its location along a major arterial roadway. and being located within the South Campus Opportunity Site as established 17 in the General Plan. The -COS overlay would allow additional residential development in a location and manner which encourages alternative modes of transportation and more efficient use of land, and is consistent with numerous General Plan policies (LU-1.3, LU-2, LU-2.3, LU-2.3.3, LU-3, LU-3.1, LU-.2, LU-5. LU-5.1, LU-5.1.2, H.3 and H.3.5). No specific plan, neighborhood plan, or area plan applies to the project site.: and B. There are no physical or environmental constraints on the property which would prohibit use of the land consistent with the CC-FS-COS zoning regulations. All utilities are available, and additional multi-family residential development will be compatible with existing multi-family residential in the same block. The project site is physically suitable for denser multi-family residential development, and such development will be consistent with other anticipated land uses along the Walnut Street Page 1 of2
