The proposal conforms to the policies of the Official Plan. Cultural Heritage staff has no objection to the above-noted application. The subject parcel of land lies in an area defined as being of high archaeological potential in the City s database of archaeological resources. No archaeological assessment is required at this time. As such, the Owner is advised that the following standard clauses apply: i. Should archaeological resources be found on the property during construction activities, all work must cease and both the Ontario Ministry of Tourism, Culture and Sport and the City of Vaughan s Planning Department shall be notified immediately. ii. In the event that human remains are encountered during construction activities, the proponent must immediately cease all construction activities. 26 Page 2 of 2 Ministry of Consumer and Business Services. Development Planning Division Comments: On March 12, 215, the Committee of Adjustment approved of the same variances for the proposed addition and cabana. The Owner has reapplied for the same variances as he intends to relocate the proposed cabana on the property, due to privacy concerns. The addition to the existing dwelling is located at the rear and will have minimum impact on adjacent properties. The proposed cabana will maintain all minimum setback and maximum height requirements, and the increase of floor area will have minimal impact. Accordingly, the Planning Department has no objection to Variances #1 and #2. The proposed circular driveway will have two points of access (5.48 m) from the street. The widest point of the driveway will be m and will provide the access to the existing garage. The Development Engineering and Infrastructure Planning Services Department has indicated no objection to the increase in driveway width. As the proposed width is slightly deficient from the By-law requirements, the Planning Department has no objection to Variance #3. The Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land. Condition(s): Recommendation: None. The Planning Department supports Minor Variance Application A156/15. 28 2141 Major Mackenzie Drive Vaughan, Ontario Canada L6A 1T1 Tel (95) To: Committee of Adjustment From: Pia Basilone, Building Standards Department Date: May 11, 215 Name of Owner: Kuldeep Gupta Location: 165 Richard Lovat Court Lot 4, Plan 65M-4129 File No.(s): A156/15 Zoning Classification: The subject lands are zoned RR, Rural Residential Zone, and subject to the provisions of Exception 9(133) under By-law 1-88 as amended. Proposal: 1. To permit a floor area of a maximum of 72.1 m2 for the accessory building. 2. To permit a maximum lot coverage of 12.85% (1.96% dwelling, 1.89% accessory building). By-Law Requirements: 1. A maximum floor area of 67.m2 is permitted. 2. A maximum lot coverage of 1% is permitted. Staff Comments: Stop Work Orders and Orders to Comply: There are no outstanding Orders on file. Building Permits Issued: Building permit nos and have been applied for, for the construction of an accessory building and an addition, respectively. Other Comments: On the site plan submitted with the building permit drawings for the retaining wall, the driveway width has been revised from the previous site plan and has not been approved by Public Works Dept. The revised driveway width does not comply with the 9. metre maximum driveway width. You may revise the site plan to indicate the 9. metre maximum or follow through with the request for a variance. The widest point of the driveway (about metres plus 5.84 metres = in total) would require a variance. Please advise. Also, the enlarged driveway would cause a deficiency in the front yard landscaping requirement of 5%. Of that 5%, 6% shall be soft landscaping. Please advise. Please be aware that Section 3.14(a) permits the encroachment of eaves and gutters up to a maximum of.5 metres into a required yard. Also, be advised that the maximum building height, as defined, to the nearest part of the roof shall not be more than 3. metres and a maximum of 4.5 metres to the highest point of the roof. The subject lands may be subject to Ontario Regulation 166/6 (TRCA Toronto Region Conservation Authority). Conditions of Approval: If the committee finds merit in the application, the following conditions of approval are recommended. None * Comments are based on the review of documentation supplied with this application.
