26 DATE: April 15, 2013 RECEIVED APRIL 16, 2013 VAUGHAN COMMITTEE OF ADJUSTMENT Page 1 of 2 TO: Todd Coles, Committee of Adjustment FROM: Grant Uyeyama, Director of Development Planning Development Planning Department MEETING DATE: April 25, 2013 OWNER: Luciano Fiorini FILE(S): A106/13 Location: Proposal: 59 Flatbush Avenue, Woodbridge Ward 3, Vicinity of Rutherford Road and Pine Valley Drive The Owner is requesting permission to construct a singlestorey addition to an existing two-storey dwelling, and install a pool, with the following variances: Variance Proposed Required 1 Maximum lot coverage 24.73% (21.70% for the dwelling and garage, and 3.03% for the covered, 20% 2 Location of pool unenclosed porches) pool to be located in the interior side yard pool to be located in the rear yard only Official Plan: Comments: The subject lands are designated Low Density Residential by in-effect OPA #240 (Woodbridge Community Plan). The subject lands are also designated Low Rise Residential by the new City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board. The proposal conforms to the policies of the Official Plan. On June 5, 2008, the Committee of Adjustment approved Minor Variance application A099/08, to permit, among other items, the location of a pool to be within the interior side yard, and a dwelling and accessory structures/covered porches with a maximum lot coverage of 22.63%. To date, the pool has not been constructed. The Owner is currently requesting permission to construct a single-storey addition to the existing two-storey single detached dwelling, in the rear of the subject lands, which results in a further increase to the previously permitted maximum lot coverage of 22.63%. The Development Planning Department can support the increased lot coverage (Variance #1), as the dwelling, with the single-storey addition, is only 1.7% above the permitted maximum lot coverage in Zoning By-law Further, the dwelling maintains all other development standard requirements (including setbacks and height) of Zoning By-law Regarding Variance #2, the location of the pool was previously approved by the Committee of Adjustment. Accordingly, the Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land. Note construction of the proposed addition and pool has not yet taken place. The proposed addition and pool can be properly accommodated on the lot without impacting the existing grading and drainage conditions of the subject lot and does not appear it will have any adverse impact of the existing drainage pattern of the adjacent properties. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established.
