THE LAND The land is a compact block shown on the plan and extends to approximately 89.1 acres (36.1 hectares). All land included in the tenancy can be accessed without restriction. The soils on the farm are largely Grade 3 free draining silty and light loamy soils. The farm lies at approximately 110 m above sea level. The land offered as permanent pasture must be kept as such, and farmed in accordance with the terms of the tenancy. The land types and acreages on the farm are split as follows: Pasture acres (24.11 ha.) Woodland acres (10.08 ha.) Buildings, yard, misc 4.62 acres (1.87 ha.) acres (36.06 ha.) A further acres (6.82 hectares) of pasture in the locality of the Farm may be available to let from 1st October 2013 by separate negotiation with the landlord. SINGLE FARM PAYMENT Where available, any Single Farm Payment entitlements for the holding will be leased to the tenant for the term of the tenancy. ENVIRONMENTAL STEWARDSHIP SCHEMES The tenant must comply with the terms of any Entry Level or Higher Level Stewardship Scheme agreement, details of which will be provided tenant. to the successful DESIGNATIONS / RIGHTS OF WAY The holding falls within a Nitrate Vulnerable Zone (NVZ) and is within the Surrey Hills Area of Outstanding Natural Beauty. The woodland is largely ancient semi-natural in status. There is a public footpath which runs up part of the driveway to the farm, before turning off through fields. DIVERSIFICATION The landlord would welcome proposals for diversification opportunities to expand the tenant s farming business and add value to the tenancy. This is on the proviso that the usage of the holding remains primarily agricultural at all times. All proposals are subject to the landlord s prior written approval. GC/

5 THE FARM TENANCY AGREEMENT From the outset, the following key terms are anticipated. The landlord may be agreeable to negotiating some of the terms in order to accommodate the most suitable tenant. PROPOSED TENANCY The landlord is offering the Farm to let as a whole for an initial term of 3 years under the provisions of the Agricultural Tenancies Act 1995, and is anticipated to commence on 24th June The tenancy will roll on from year to year thereafter, unless terminated by Notice by either party. A copy of a sample tenancy agreement is available to view on viewing days. RENT AND RENT REVIEWS Offers to rent the farm should be tendered as a fixed sum and should be in excess of 3,500 per calendar month (or equivalent). There will be no rent review within the first 3 years of the tenancy. The successful tenant will have the choice of paying the rent monthly or quarterly in advance. USE OF THE HOLDING The permanent pasture on the holding must be grazed for agricultural purposes, and may be restricted to cattle or sheep grazing only. This is due to the high ecological value of the land. BOUNDARIES AND FENCING Subject to any requirements of the landlord or any Environmental Stewardship Scheme, the responsibility for maintaining the field boundaries lies with the tenant. The tenant will be expected to put and keep the boundaries, including any fencing or hedging, in good heart and condition. DEPOSIT A deposit equivalent to two months rent will be retained by the landlord s agent (Batcheller Monkhouse). RATES/OUTGOINGS All rates, taxes and outgoings, including Council Tax, electricity, and water charges will be payable by the tenant. REPAIRS AND INSURANCE These will be detailed in the Tenancy Agreement. In general the landlord will be responsible for all major repairs (unless caused by the tenant) and for insuring the buildings, and the tenant will be responsible for insuring their contents, equipment, livestock/animals and for any third party liability insurances. SPORTING AND TIMBER RIGHTS All sporting and timber rights are reserved to the landlord. METHOD OF LETTING In order for the letting process to run smoothly and fairly, the following is essential reading for any prospective tenant wishing to make an offer. a. Birketts Farm is offered to let by informal tender (unless let previously) whereby best and final offers, subject to contract, are to be received in writing or by no earlier than 1st June 2013 and no later than 12 noon on Friday 7th June A bid submission form is available from the agents. b. Offers are to be enclosed in a sealed envelope clearly marked Birketts Farm Offer and sent or delivered to Bartram House, Station Road, Pulborough, West Sussex RH20 1AH or professional@batchellermonkhouse.com c. Offers should be subject to contract only. d. Offers should be for an exact sum per calendar month, quarter, or annum, and any escalating bids above any other received will be disallowed. e. The letter should include the name(s) and address(es) of the prospective tenant(s) and any solicitor acting, together with information on any conditions under which the offer is made. f. Confirmation should be given that the Tenancy Agreement will be signed and the deposit, fees, and first period s rent will be paid within 5 working days of the tenant receiving the said Agreement and related documentation following the confirmation of acceptance of their offer. g. Any conditions that may affect the offer must be stated clearly in the letter. h. Our clients reserve the right to be present when the offer letters are opened. They do not undertake to accept the highest offer or indeed any of the other offers received. All offers will be treated in the strictest of confidence. i. Batcheller Monkhouse will only accept offers from applicants who have visited the farm on a pre-booked viewing day and submitted an offer prior to the specified closing date. TENANT FEES A single fee of 500 including VAT is payable by the tenant to Batcheller Monkhouse towards the cost of preparing all tenancy documentation, referencing, and independent inventory and record of condition.
