THAT application /D for a development permit with variances, as detailed in Report No. EDP , be approved in principle, and that a permit be prepared for an upcoming Council Hearing; and 3. THAT the Mayor and Corporate Officer be authorized to execute all documents relating to this matter. BACKGROUND Proposal: Applicant/Owner: Legal Description: The applicant wishes to construct a set of stairs from an existing sundeck to allow direct access to the rear yard. The proposed siting along the north side of the sundeck requires the minimum interior side lot line setback be reduced from 1.8 m to 0.9 m. Gene & Kathleen Defries and Michael & Erin Knott Lot 25 Section 25 Township 16 New Westminster District Plan BCP10496 OCP Designation: Urban Residential Zoning: Site Area: Description: One Unit Urban Residential Zone (RS3) 559 m 2 The subject property is a moderately sized interior lot that contains a single residence with sundeck, and a registered secondary suite. The lot decreases in elevation from east to west, with the most heavily sloped portion located an approximate 5 m from the west property line. This area is fenced off and lined with cedar hedging. Surrounding Uses: N: Single family (RS3); S: Single family (RS3); E: Applewood Drive, with single family (RS3) beyond; and W: Single family (RS3). -89-
2 Report No. EDP Page 2 of 3 ANALYSS 1. The subject property is currently zoned One Unit Urban Residential Zone (RS3). Abbotsford Zoning Bylaw, 1996 specifies that principal buildings in the RS3 zone are to have a minimum interior side lot line setback of 1.8 m. 2. The applicant wishes to attach a set of stairs to an existing sundeck to allow direct access to the rear yard. The applicant would prefer to locate these stairs along the north side of the sundeck and requests that the 1.8 m minimum interior side lot line setback be reduced to 0.9 m, to allow this desired siting. No additional supporting posts would be required as the design would have the stairs cantilevered. See attached letter and Figure The Abbotsford Zoning Bylaw, 1996 allows for slight relaxation of setbacks for a variety of circumstances under Section Supplementary Regulations. For instance, where cantilevered balconies and steps project beyond the building face, the minimum setback from an abutting interior side lot line may be reduced by not more than 0.6 m. However, the applicant requires an additional 0.3 m to the 0.6 m afforded by the general siting exception, to accommodate the 0.9 m wide set of stairs. This variance is minor in nature and presents little impact to adjacent property owners. 4. The applicant has obtained written support from the neighbour most impacted by this variance, shown in Figure 1. Staff support this application proceeding to a Council Hearing. FNANCAL PLAN MPLCATON No financial plan implications are anticipated. STRATEGC DRECTONS No Strategic Directions plan implications are anticipated. COMMUNCATON PLAN f supported by Council, a permit will be prepared for an upcoming Council Hearing. The City will notify in writing the adjacent property owners and occupiers of the date and time of the Council Hearing. SUMMARY The proposed set of stairs will provide direct and convenient access to the rear yard from the existing sundeck. The neighbour most impacted by this variance has reviewea the proposal with the applicant and has offered written support for the project. Considering this and the minor nature of the variance requested, Staff recommends this application proceed to a Council Hearing. L: EOP doc -90-

6 April 5, 2011 City of Abbotsford Planning Department Re: Development Variance Permit Application, 3417 Applewood Drive, Abbotsford This note is being sent in support of our application for the above noted Development Variance Permit. We currently have an enclosed, raised deck that is only accessible from the second story of our home. Our desire is to put in a flight of stairs from the north side of the deck down to 'the ground level. Of the 3 possible sides of the deck, this is most obviously the best choice - the other two sides would involve interrupted sight lines and would take away available space in the back yard, and the only other alternative would be to cut away a large portion of the deck to provide space for the stairs. Unfortunately, runni ng the stairs down from the north side encroaches into the set back space. Thus, we are submitting our request for the va riance approval. (Please note that we have not yet started work on this development.) Our builder has designed a cantilevered approach to these stairs, so that there is no need for supporting posts. Deta ils of the plans have already been submitted (earlie r today) to the Planning Department. Finally, we have already talked with the only neighbours that would be impacted by this deve lopment (the Campbells, who live in the house to the north of us), and they are fully supportive of this application. hope to send along a note from them to that effect in the next few days. thank you for yo ur attention to this request, and look forward to your reply!
