1 INDIAN HILLS- PALM DESERT HOMEOWNERS ASSOCIATION RULES AND REGULATIONS Revised In a planned community development, living is somewhat different from that in one s own individual home. Here we live close together. We share certain facilities in common with our neighbors and have the opportunity to live in close harmony with them or of running the risk of impinging on their rights. These Rules and Regulations were adopted having in mind the greatest good for the greatest number, even though they may at times appear to be contrary to our individual desires. I. SWIMMING POOLS AND SPAS 1. Pool hours at 8:00 a.m. to 10:00 p.m. 2. Posted notices are to be observed at all times. 3. Lotions and oils are PROHIBITED in all pools and spas. 4. Parties and outside barbecues are not permitted in the pool areas without prior written approval of the Association. 5. All litter and personal effects are to be removed from the pool area by the persons responsible on departure from the pool area. 6. No glass, glassware, etc. is permitted in the pool area. All drinks must be in plastic or paper containers. 7. Hairpins must be removed before entering the pools or spas. 8. Excessive noise, including but not limited to yelling and loud radios, and roughhousing are prohibited in the pool area. All persons using the pool must refrain from activities which interfere with the quiet use and enjoyment of the pool by other users, or which reasonably interferes with the quiet use and enjoyment of neighboring occupants in their homes. Floatation devices are not permitted in the pool if the use of the same precludes other from using the pool. 9. Children under the age of fourteen (14) years must be accompanied by an adult over the age of eighteen (18) years. The accompanying adult is responsible for the conduct of the children while in the pool area. 10. Under no circumstances is anyone other than authorized personnel permitted to adjust or correct the heating elements or controls of either the pools or spas. 11. Persons using the pool or spa must wear appropriate pool attire. No cut-offs or clothing other than normal swimming attire is permitted. 12. Animals are prohibited in the pool areas at all times. This rule does not apply to registered guide, service or companion animals. 13. Association pool furniture is not to be removed from the pool area. This furniture, if vacated for 30 minutes, will be considered to be available. 1
2 14. For safety s sake, common sense demands no running, pushing or horseplay in or around the pool. No water polo is allowed. 15. The life preserver and the wand used for rescue purposes are not to be used for any other purpose at any time. 16. The gates are to remain closed at all times. II. PETS 1. Only Indian Hills HOA owners may bring pets onto the property. 2. The Riverside County Leash Law requires that all pets are to be kept on a leash at all times when outside their dwelling. Pets must be controlled by a person capable of restraining the animal at all times when in the common areas. 3. No household pet shall be left chained or otherwise tethered in a Lot or in the Common Area. 4. No pet deemed to be a nuisance, as determined in the sole discretion of the Board of Directors, shall be allowed to remain anywhere in the project. 5. Owners must clean up after their pets immediately and to dispose of their pet s waste in a sanitary manner. III. RENTALS 1. When a unit is to be leased or occupied by anyone other than an owner, the owner must notify the Association Management in writing, giving the lessee s/guest s name, number of occupants, and period of occupancy. 2. No unit can be leased less than 30 days. 3. Owners shall be responsible for any and all conduct and actions of their guests, tenants, lessees, invitees or agents and shall be responsible to ensure that the foregoing comply with any and all of the Association s governing documents. Notwithstanding that responsibility, Owners must furnish any lessee or renter a copy of the Association s governing documents including but not limited to these Rules and Regulations. It is suggested that you obtain additional copies of these Rules and Regulations and that they be placed conspicuously in your guest quarters and be discussed with your guests. 4. Owners are prohibited from leasing or renting less than the entire separate interest Unit. Sub-leasing is prohibited. Units shall not be occupied such as to violate any Municipal, State or Federal Health and Safety ordinance, code, statue or regulation. 5. Owners are responsible to provide gate access for their renters or invitees. 2
3 IV. TRAFFIC AND PARKING RULES Traffic and parking rule violations are subject to disciplinary action (see Section VII. VIOLATIONS); and, certain parking rules shall not apply when there are circumstances such as repairs, renovations, service provider installations, landscaping, and/or other operations that are non-typical and/or temporary in nature (as determined solely by the Board of Directors). 1. SPEED LIMIT The speed limit in Indian Hills is 15 MPH and shall be adhered to at all times. 2. RESIDENT PARKING Owner/tenant vehicles shall be parked in the lot-specific parking areas provided for each lot (a single carport plus a single garage for all two bedroom residences, and a double garage for all three bedroom residences). 3. TEMPORARY GUEST PARKING - Common Area parking spaces and onstreet parking are for temporary guests only. Owner/ tenant vehicles shall not park in any Common Area parking spaces, or on the street. For the purposes of this rule, temporary guests are defined as those guests who do not park in Common Area parking spaces or on-street parking for more than 72 consecutive hours in a twoweek period. Anyone parking in Common Area parking spaces or on-street parking in excess of 72 consecutive hours in a two-week period shall be considered a Resident and will be required to park in a carport and/or garage. 4. PARKING AREA STORAGE Carports shall not be used for any storage; and, garages shall not be used for storage that prevents unit owners/tenants from being compliant with parking rules; however, garages that are used for storage where the owner/tenant is otherwise in compliance with parking rules does not constitute any violation. 5. NON-OPERATIONAL VEHICLES Any vehicle that is not operational, not licensed, not registered, and/or not insured (as determined solely by the Board of Directors), shall not be parked anywhere in Indian Hills at any time. 6. RECREATIONAL/ COMMERCIAL VEHICLES Recreational campers, trailers, motor homes, boats, or other recreational vehicles or vessels and commercial vehicles shall not park in Common Area parking spaces and on-street parking, except for loading and unloading purposes only, not to exceed two hours. 7. SAFETY AND ACCESSIBILITY Vehicles may not be parked so as to impede or obstruct access to fire hydrants, mailboxes, walkways, walkway steps, handicap ramps, handicap cutaways, extend beyond the curb line of site; or as otherwise determined solely by the Board of Directors. *Be advised that vehicles not in conformance with the parking restrictions set forth in the Rules and Regulations or CC&R s are subject to tow by the Association without warning. 3
4 V. ARCHITECTURAL CONTROL COMMITTEE 1. Owners area prohibited from making any physical modifications, alterations and or/improvements to the exterior of his or her separate interest Unit, including landscaping, without first seeking and obtaining the prior written approval of the Architectural Control Committee or the Landscape Committee. Failure to seek and obtain such approval may subject any nonconforming owner to an enforcement action, including legal action in the form of a lawsuit. Pursuant to the California Civil Code, the prevailing party in any such legal action shall be entitled to recover their reasonable attorney s fees and costs. VI. GENERAL RULES 1. Cycling, roller-skating, roller-blading and other similar self propelled devices are not permitted on the common area walkways or lawns. Skateboards are prohibited in the common areas. 2. Patios, porch and carport areas may not be used for storage. Only items intended for use in such areas may be kept there e.g. patio furniture and barbeques. Swimsuits, towels, laundry, and clothing may not be hung in patio or porch areas. 3. Owners shall be responsible for any for any and all damage caused to the common areas, including the common area landscaping, as the result of their willful or negligent misuse of those areas. 4. Dangerous activities including but not limited to the use of firearms or other dangerous weapons are prohibited. 5. All trash and trashcans shall be stored in the garage at each unit. Trash or trash cans or trash bags shall never be left outside except on trash pickup day, and then only in closed and sealed containers. Trash receptacles shall not be placed in the street prior to 6:00 p.m. on the prior day of pick-up and shall be returned for storage in the garage by 11:00 p.m. on the day of pick-up. 6. Light timers, pool and spa regulators, and sprinkler timers may not be tampered with or adjusted by anyone other than a person authorized by the Board of Directors. 7. NO PERSON SHALL GIVE DIRECTION OR WORK ORDERS TO INDIVIDUAL WORKMEN OR CONTRACTORS WORKING ON THE PROPERTY (GARDENERS, POOL MEN, ETC.). These workmen work for the association, not for the individual homeowners. If a problem arises, the Management Company should be notified, and they will deal with the situation. 8. A valid driver s license must be held in order to drive a golf cart. 4
5 9. Suggestions, requests or complaints relative to the common areas must be conveyed in writing to any member of your Board of Directors or to the Association s managing agent. 10. Members shall be held fully responsible for the actions of their tenants, guests, or other invitees to the premises, and as such, may accordingly be assessed for any damages or fines imposed for any infraction of these rules by such tenants, guests, or other invitees. 11. Owners are responsible for the actions of their familial minors and for the actions of minors affiliated with the Owner s guests, tenants, lessees, invitees or agents. VII. SIGNS 1. No commercial signs, billboards, real estate flags, or advertising of any kind shall be permitted, except for one sale or lease sign per residence. To provide continuity throughout the community, each sign must conform to the Indian Hills standards as follows: a. The sign must be no larger than 18 inches by 24 inches and displayed on the garage door only. b. The sign must be aluminum with a baked enamel finish, with a beige or white background and dark brown lettering. c. The sign may include the real estate company s logo and only the following 4 lines of print: Name of the real estate company or owner; Name of the agent; One telephone numbers; and One additional line which may either be an address or website. d. The only real estate sign riders that are acceptable are Sale Pending, In Escrow, or Sold which must be attached to the sign. 2. In addition to the single sign permitted under paragraph 1 above, an open house sign may be displayed only at the time of the scheduled open house. The sign must be aluminum with a baked enamel finish, with a beige background and dark brown lettering, with the words Open House. To further identify the location of an open house, not more than two (2) standard sized balloons may be attached to the open house sign which may be placed between the house and the curb during the time of the open house. No directional signs are allowed anywhere with the Indian Hills gates. One standardized directional sign may be placed in the median strip on Vista Viejo near the main gate during the open house. The sign must be removed at the end of the day. 5
6 VIII. VIOLATIONS 1. The Board of Directors has the authority to impose discipline against any members whose Unit is found to be in violation of the Association s governing documents. Such discipline includes levying a Reimbursement Assessment against the Owner for the cost incurred to bring an Owner s Unit into compliance with the governing documents, suspension of an Owner s privilege to use the common area facilities, cable interruption, and suspension of an Owner s privilege to vote in Association elections, and the imposition of fines. The Association will not impose discipline unless and until the Owner has been provided with written notice and an opportunity to be heard on the violation. 2. Any person alleged to be in violation of the Association s governing documents including the CC&R s, and the Rules and Regulations shall be advised in writing in accordance with the Association s Enforcement Procedure. 6
