1 Condominium Units Marina Villas Condominium Rules and Regulations Please refer to the Declaration of Condominium of Marina Villas for the complete definition of a Unit. Owners, their guests and tenants, have full exclusive use of their individual unit within the legal rights of the laws granted in the Official Documents. Note, a Unit does not include Limited Common Elements (Areas) or Common Elements (Areas). Balconies and screen porches, are Limited Common Areas, and are not included in the Unit. 1. Maintenance - Owners are responsible for maintaining, repairing and replacing, at the Owner s expense all portions of their Unit. In addition, owners are responsible for: repairing and replacing any damages to other units or common areas caused by themselves, their tenants, guests, pets or due to deferred maintenance of their unit; Please refer to the Preventive Maintenance Guide and Checklist 2. Pets - No more than a total of two (2) household pets, 40 lb. limit, may be kept in units, provided that such pets are not kept, bred, or maintained for any commercial purpose. Pets creating disturbances or annoyances to the reasonable displeasure of other residents may require removal from the condominium. Residents MUST clean up after their dogs. 3. Noise - The owners, tenants and guests must have due regard for the comfort and enjoyment of all residents in the complex. Televisions, stereos, radios and musical instruments are not allowed to be played at such volume at any time that will annoy persons in other units. Appliances, such as washing machines, dryers, dishwashers, vacuum cleaners or any other similar machines or equipment, will not be operated between the hours of 10 p.m. - 8 a.m. 4. Alterations - See Condominium Declarations Window Air Conditioners - No window air conditioners are allowed to be installed in any unit. 6. Antennas, Dishes, Signs and Flags - Radios, television and CB aerials are not allowed to be placed or erected on the roof or exterior of any building, or from the windows of any building. Flags may be displayed only from rear of units. 7. Attachments - No attachments are allowed to be made to exterior of any unit or the buildings. This includes clothes lines. 8. For Sale/For Rent Signs For Sale/For Rent Signs are not allowed to be posted in windows, on doors or placed in common areas. The only authorized posting is on the ladder sign located at the rear of the building, facing the parking area near Unit 1. 2 Marina Villas Condominium Rules and Regulations Continued Limited Common Areas Please refer to the Declaration of Condominium of Marina Villas for the complete definition of Limited Common Elements (Areas). The balconies and screen porches attached to an owner s unit is a Limited Common Area. Owners have exclusive use of the balconies and screen porches attached to their unit. Balconies and screened porches are not enclosed living area and can be readily viewed from the outside. As such, their exclusive use is limited to uses that do not detract from the overall aesthetic appeal and property values of Marina Villas as a whole. 1. Maintenance by the Association The Association is responsible for maintaining, repairing, replacing and painting balcony and/or screen porch components (wood/screens) due to age related wear and tear or weather conditions. 2. Maintenance by the Owner - Owners are responsible for maintaining repairing and replacing, at the Owner s expense, damage to any portion of the balcony and/or screened porch (wood, screen, paint) caused by themselves, their tenants, guests, or pets; or caused by deferred maintenance/age-related/weather damage not reported to the Association in a timely manner so as to prevent further damage. 3. Aesthetic Appeal Residents are responsible for maintaining the cleanliness and aesthetic appearance of their balcony and/or screened porch. Common sense and respect for the overall appearance of Marina Villas much be observed regarding these areas. Overcrowding and/or inappropriate objects shall be considered an infraction. Acceptable items include tables, chairs, storage container/cabinet that will conceal items, and plants. Bicycles and small water craft may also be stored neatly on the balconies and screened porches. 4. Unpermitted Uses Grilling/Firepits No charcoal, gas or electric grills are allowed on patios or balconies. (Amendment to Florida Fire Prevention Code (FFPC) --- Electric Grill Prohibition). This will also include the use of fire pits. 5. Unpermitted Uses Household Storage The Board recognizes that storage space inside individual units is limited. In order to maintain safety of all residents and property, and the aesthetic appeal of Marina Villas, the use of balconies and screened porches as storage area of general household items will not be permitted. Stored items must be completely concealed from exterior view in a storage container. Refer to #3. 6. Unpermitted Uses Other The hanging of clothes, towels, rugs or other such items outside of any unit is not permitted. Balcony railings should not be used as drying devises. Page 2

3 Marina Villas Condominium Rules and Regulations Continued Common Areas Owners do not have exclusive use of Common Areas. Please refer to the Declaration of Condominium of Marina Villas for the complete definition of Common Elements (Areas). Essentially, any area not defined as a Unit or Limited Common Element (Area), is Common Area. Other than vehicles parked in designated parking spaces, or bicycles and small outdoor recreational items that fit neatly under the outside stairwells, absolutely no personal items are permitted in common areas. Common areas shall not be obstructed in any manner. 1. Prohibited Uses- No vehicles or items of personal, household or furniture use are allowed to be parked, stored, maintained, kept or displayed on the walkways, stairs or landings. For Sale/For Rent Signs are not allowed to be placed in common areas. Please use the aforementioned ladder sign. 2. Maintenance - The Association has arranged for routine maintenance of Marina Villas. This consists of the following contracted services: Weekly: blowing off common area walkways, stairs, landings, and parking areas; inspecting steps, rails, wiring, concrete/tile walkways; checking lights; faucets/signs. Monthly: Inspect fences As Needed: maintain/secure as needed: steps, rails, wiring, concrete/tile walkways, replace/repair lights/faucets/signs; realign parking stop, secure fence slats and gates. This includes replacing common area light fixture light bulbs. As maintenance is not performed daily, residents are asked to pick litter from their area. Absolutely no littering of the grounds or parking areas is permitted. Residents and owners are asked to immediately report any deferred maintenance items to the Association or Management. 3. Dumpsters All trash is to be placed in plastic or paper bags and sealed before placing in dumpster. No trash, garbage, rubbish, debris, waste material or other refuse shall be deposited or allowed. All trash containers shall be kept inside the units until placed in the dumpsters. New residents must discard boxes promptly upon moving into Marina Villas. No discarded boxes may be left outside of the unit. Break/fold down and place boxes in dumpster. ABSOLUTELY NO DUMPING OF FURNITURE! Page 3

4 4. Pets Pets are to be kept on a leash at all times while outdoors and are not allowed to roam unattended. Pets are not allowed to relieve themselves on the grassy areas in front of units. Residents will clean up after their pets and dispose of waste in plastic or paper bags in the dumpster. 5. No Offensive Activities - No illegal, noxious or offensive activities are allowed in or around any unit, nor shall anything be allowed which is or may become a source of embarrassment, discomfort or annoyance to the neighborhood. 6. Clothes Lines - The hanging of clothes, towels, rugs or other such items outside of any unit is not permitted. Landing or stairway railings should not be used as drying devises. 7. No Parking of Vehicles, Boats, etc. - Wheeled vehicles such as or similar to mobile homes, motor homes, self-contained or otherwise, travel trailers, utility trailers, commercial vehicles and campers; boats or any offensive objects may not be parked or kept on the common areas of the Marina Villas. The parking areas are in front of the building. Passenger vehicles may only be parked in the paved, marked parking areas serving the units. Disabled vehicles, or vehicles under repair, may not be kept in the parking lot and are subject to being towed away at the owners' expense. No boats or vehicles of any kind are allowed on any grassy areas. 8. Speed Limit - The maximum speed limit throughout the Marina Villas Complex is 10 MPH including roadways and parking lots. Please drive carefully. 9. Parking and Repairs of Vehicles - No repairing, lubricating or maintenance of any type or kind is permitted in the parking or grassy areas within the Marina Villas Complex. All motorized vehicles on the property shall be in operable condition, properly tagged and licensed and operated by licensed drivers while in the Marina Villas Complex. Vehicles that are not properly tagged may be towed away at the Owners' expense. A maximum of two vehicles per unit are allowed to park in the Complex parking area. 10. Motorcycles, Moped and Mini-bikes - All state regulations applicable to motorcycles, motor bikes, mopeds and mini-bikes that apply on public streets and highways will apply within the Complex area. All must be licensed. Page 4

Bicycles, Skateboards, Small Personal Recreation Items and Play Areas - All bicycles and small water craft must be stored neatly under stairwells, back porches or inside units. Please use the stairwell nearest your unit. All other riding toys must be stored inside your unit. No swimming pools or other toys are allowed to be stored under stairwells. Skateboarding is not allowed at Marina Villas. Please consult the local recreation facility for designated areas. Children are not allowed to play on stairs or walkways. Children may not play around the irrigation sprinkler system when it is engaged. Children and pets should be kept away from areas where pesticide spraying is taking place. Warning signs are posted after each application. 1. Fence Enclosed AC Unit Area The fence enclosed areas for the AC units are for the AC units only. Absolutely no storage of any item within these fence enclosures will be tolerated. Any item found within the AC Enclosures will be disposed of without warning. 2. Golf Equipment - Golf carts and other golf equipment are not permitted under steps or in stairwells. Golf carts must not be parked on patios, walkways, grass or other common areas. Golf carts may be parked, on a temporary basis only, in a marked parking area in the parking lot. No spiked shoes, such as golf shoes, shall be worn on the wood stairways. Please follow these guidelines for reporting violations: Attempt to resolve noise complaints by speaking to the offending person.
