1 The "THIRTY SECOND MEETING" (SPECIAL) of the Port Colborne City Council was held for purposes of a Public Hearing under the Planning Act at the Municipal Offices, 66 Charlotte Street, Port Colborne on Monday, November 10, 2014 commencing at approximately 6:37 p.m. ATTENDANCE Mayor Vance Badawey presided with the following members in attendance: COUNCILLORS D. PRAYER Councillor Ron Bodner delivered the prayer. 2. NATIONAL ANTHEM Joel Longfellow sang 0 Canada. 3. OBSERVANCE OF REMEMBRANCE DAY In observance of Remembrance Day, a music video titled "A Pittance of Time" was displayed. James van Dillen, President, Port Colborne Historical and Marine Museum Board, and S. Powell Baswick, Director/Curator, were in attendance and provided an introduction regarding the Remembrance Day display from the Archives of Ontario and titled "From the Home Front to the Front Lines". Councillor Elliott read a poem titled "Remember Them" written by Hayley Ancaster. 4. CONFIRMATION OF THE AGENDA No. 241 Moved by Councillor D. Elliott Seconded by Councillor Y. Doucet

DISCLOSURES OF INTEREST Nil. 6. PUBLIC HEARING UNDER THE PLANNING ACT (a) APPLICATION FOR ZONING BY-LAW AMENDMENT Department of Planning and Development, Report No , Subject: Public Meeting Report for an Official Plan & Zoning By-law Amendment (File No. D & D ) 54 West Side Road (i) PURPOSE OF MEETING Shannon Larocque advised that the purpose of this meeting, pursuant to Sections 17, 22 and 34 of the Planning Act, is to consider applications submitted by Ontario Limited to amend the City of Port Colborne Zoning By-law and the Official Plan for property municipally known as 54 West Side Road. Mrs. Larocque also advised that the zoning of the property is proposed to be changed from the (P) Public and Park zone to a site-specific (P) Public and Park zone which would also allow the use of the property for mini storage, a warehouse with outdoor storage, trade shows, farmer's market, flea market, vehicle sales and an auditorium within the existing building. The zoning change will also allow a reduced parking requirement for the auditorium use. The applicant also proposes to add a special policy to the Parks and Open Space designation in the Official Plan to support the use of the property for all of the above uses listed. (ii) METHOD OF NOTICE Mrs. Larocque advised that Notice of the Public Meeting was administered in accordance with Section 17(15), 22(1) and 34(12) (13) and (14) of the Planning Act, as amended, Section 3 of Ontario Regulation and Section 3 of Ontario Regulation The Notice of Public Meeting was mailed to property owners within 120 metres of the property and two public notice signs were posted on the property on October 21, A public notice was also posted on the City's website on October 21, Mrs. Larocque also advised that at this time, no comments have been received from members of the public and the following comments have been received from agencies: Canadian Niagara Power: Engineering & Operations: "No issues." "No adverse comments at this time." Niagara Region Planning & Development Services: Owners of commercial and industrial buildings are required to comply with the Region's Sewer Use By-law. The owner or occupant of commercial or industrial premises are required to install and maintain a suitable access point (manhole) and interceptor.
3 Minutes, Thirty Second Meeting (Special) of Council, November 10, 2014 Page 3 of 5 Regional staff has no objection to the approval of these applications from a Provincial and Regional perspective subject to local planning requirements, as well as the above comments regarding Regional engineering interests. (iii) EXPLANATION OF PROCEDURE TO BE FOLLOWED Mrs. Larocque advised that the procedure to be followed this evening will be to present Department of Planning & Development Report , to hear any comments from the applicant, to receive questions of clarification from Council to the applicant or Planning Staff, to open the meeting to the public for comments and questions, to announce the requirements under the Planning Act for written notice of passage of the proposed official plan and zoning by-law amendments, and to provide a brief explanation of future meetings regarding the application. (iv) PRESENTATION OF APPLICATION FOR ZONING BY-LAW AMENDMENT At this time Mrs. Larocque presented Planning and Development Public Hearing Report Mrs. Larocque noted that the zoning will allow the property to be used for mini storage, a warehouse with outdoor storage, trade shows, farmer's market, flea market, vehicle sales and an auditorium within the existing building. The zoning change will also allow a reduced parking requirement for the auditorium use. The Official Plan Amendment will also add a policy to permit these uses on the property. Mrs. Larocque advised Council that the Draft Official Plan Amendment is attached to the report as Appendix A and the draft Zoning By-law Amendment is attached to the Report as Appendix B. Mrs. Larocque also noted that Council at the November 12, 2013 meeting, entered into an Agreement with Port Colborne Yacht Harbour & Marine Limited for the purchase of the subject property (former West Side Arena). The property owner has submitted the proposed Zoning By-law and Official Plan Amendment applications in order to allow for the uses that have been described on the property. City of Port Colborne Official Plan Schedule "A": City Wide Land Use to the City of Port Colborne Official Plan designates the property as Parks and Open Space. Land uses in the Parks and Open Space designation include public landscaped open space, playgrounds and sports fields not administered by a school board; cultural and recreational facilities such as arenas; museums, halls swimming pools, docks and publicly operated golf courses; linear parks and public open spaces such as multi-use trails and pathways and on-road bicycle routes. City of Port Colborne Zoning By-law 1150/97 /81 The City of Port Colborne Zoning By-law 1150/97/81, as amended, zones the property "P (Public and Park) zone. The "P (Public and Park)" zone permits an auditorium, a public day nursery, a public park, a school and any public use. Adjacent lands to the north, south, east and west are zoned P - Public and Park and contain the Tenn1s Club, Parks, School, Public Works building and Regional pumping station. Lands to the southeast and west are also zoned R2 - Second Density Residential and R1 - First Density Residential and contain residential dwellings.
4 Minutes, Thirty Second Meeting (Special) of Council, November 10, 2014 Page 4 of 5 Mrs. Larocque advised that this now concludes the presentation of Planning and Development Report The Zoning By-law Amendment is necessary to permit the described uses of the property. (v) COMMENTS OF APPLICANT Mr. Ross Templain, owner of 54 West Side Road addressed Council. Mr. Templain indicated that the immediate plans for the property is for storage. The long term plan is to have car and RV shows, possibly auctions. This will help to promote the property as well as Port Colborne. Mr. Templain indicated that this is a multi-phase plan and will be developed over time. (vi) QUESTIONS OF STAFF/APPLICANT CLARIFICATION TO PLANNING Councillor Kenny noted that she had expressed concern earlier to Mr. Templain regarding the lettering on the building and has been advised that this will be removed soon. She questioned how much space will be used for outside storage. Mr. Templain responded that it will be similar to their site on King Street. Councillor Butters asked Mrs. Larocque to address the need for reduction in parking spaces. Mrs. Larocque responded that the reduction will not be significant however a more detailed analysis will follow in the Planning recommendation report. Councillor Elliott questioned where the parking will be located in the event of a trade show. Mr. Templain advised that the shows are in the long term plans. Parking will be determined by professional event planners. At present their need is for storage. He suggested that by working with the City, the adjacent ball diamond might be a possibility for additional parking. Before opening the meeting up to the public, Mrs. Larocque then read the following cautionary statements into the record: "If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of Port Colborne before the proposed official plan and zoning by-law amendment are approved, the person or public body is not entitled to appeal the decision of the City of Port Colborne to the Ontario Municipal Board." And; "If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of Port Colborne before the proposed official plan and zoning by-law amendment are approved the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to add the person or public body as a party." Mrs. Larocque also advised that for any interested members of the public there is a sign-in sheet located at the rear of the room in order to request future notices regarding these applications. (vii) ORAL PRESENTATIONS AND/OR QUESTIONS BY PUBLIC At this time, Mrs. Larocque invited any members of the public who wish to speak to the applications to do so. Zarko Brauka Zlomislic of 614 Stanley Street addressed Council. Mrs.
5 Minutes, Thirty Second Meeting (Special) of Council, November 10, 2014 Page 5 of 5 Zlomislic advised that she is the owner of two lots near the rear of the former arena as well as a right-of-way along Helen Street. She expressed concern that the outside storage will become an eyesore. Shannon Larocque addressed Mrs. Zlomislic's concerns and advised that the property would be subject to site plan control. A full analysis of the impact of parking, fencing, landscaping, outside storage, etc. will be addressed in the Planning recommendation report. (viii) ANNOUNCEMENT RESPECTING WRITTEN NOTICE OF PASSAGE OF THE OFFICIAL PLAN AND ZONING BY-LAW AMENDMENT Mrs. Larocque advised that if anyone wishes to be notified of the approval of the official plan and zoning by-law amendments they must make a written request to the Clerk. Only those persons and public bodies that give the Clerk a written request for the notice of the adoption and passing of an official plan and zoning by-law amendment will be given notice." (ix) EXPLANATION OF FUTURE MEETINGS 7. ADJOURN Mrs. Larocque advised that this concludes the Public Hearing under the Planning Act.
