Mayor McDonald asked the Planner, Terry Korotki, "By what method, what date and what notice of this meeting was sent?" Notification: The notice of the Public Meeting was circulated on October 29th, 2013, to property owners within four hundred (400') feet of the subject property and all affected ministries and agencies. Purpose: THE PURPOSE of the proposed amendment is to rezone the subject lands from Rural Exception No. 209 (RU-209) to Rural Residential (RR) Zone. The Rural Residential (RR) Zone will allow for the construction of a single detached dwelling and garage on the severed parcel of land. The Rural Residential (RR) Zone is to recognize the retained parcel of land in relation to Consent application AH-01/2013 whereby there is an existing single detached dwelling with detached garage and one (1) storage shed erected thereon. Mayor McDonald asked the Planner, "Is there anyone present other than the applicant in support of this zoning by-law amendment?"

The affect of the amendment is to fulfill the condition of the consent and to recognize the reduced lot area in the Rural Exception No. 284 (RU-284) and Rural Exception No. 285 (RU-285) Zones. The Rural Exception No. 284 (RU-284) Zone will also recognize the severed parcel of land in relation to consent application AH-08/2013 which will merge to the parcel to the north owned by Bradley Martin and Bernadine Davis-Martin to create an enlarged Rural parcel of land which has a single detached dwelling and agricultural building (barn) erected thereon. The retained parcel of land in respect to Consent application AH-08/2013 is being rezoned Rural Exception No. 285 (RU-285) to recognize the reduced lot area. The retained parcel of land has an existing single detached dwelling and detached accessory building (garage) erected thereon. Mayor McDonald asked the Planner, "Is there anyone present other than the applicant in support of this zoning by-law amendment?" The Planner, advised that there was present objecting to or requesting clarification of this application. Mayor McDonald asked, "Are there any written comments received?" 5 Re: Janet Arlene Lovekin and Kelly Lynn Elliott NOTIFICATION OF PUBLIC MEETING CONCERNING A PROPOSED ZONING BY-LAW AMENDMENT TAKE NOTICE that the Council of the Corporation of the Township of Alnwick/ Haldimand will hold a public meeting to consider a proposed amendment to The Township of Alnwick/Haldimand Comprehensive Zoning By-Law No under Section 34 of The Planning Act, R.S.O AND TAKE NOTICE that the Council of the Township of Alnwick/Haldimand has received a complete application and is notifying the public in accordance with Section 34 of the Planning Act. DATE AND TIME: Thursday, November 28th, 2013 at 12:30 p.m. PLACE: Township of Alnwick/Haldimand Municipal Administration Office, (upstairs), County Rd. # 2, Grafton, Ontario K0K 2G0. LOCATION OF SUBJECT LANDS The subject lands are located in Part of Lot 9, Concession 1 and comprise a total area of approximately 2.75 hectares (6.79 acres) along the north side of Rutherford Road. (Refer to Key Map). PROPOSED ZONING BY-LAW AMENDMENT THE PURPOSE of the proposed amendment is to rezone the subject lands from Rural Exception No. 209 (RU-209) to Rural Residential (RR) Zone. 7 Re: Janet Arlene Lovekin and Kelly Lynn Elliott To Whom It May Concern: Re: Proposed Zoning By-Law Amendment Part of Lot 9, Concession 1, (former Township of Haldimand), now in the Township of Alnwick/Haldimand The Zoning By-Law Amendment will change the zoning on the subject property from Rural Exception No. 209 (RU-209) to Rural Residential (RR) to satisfy a condition of consent imposed by the Land Division Committee of the Township of Alnwick/Haldimand in granting consent to land severance application AH-01/2013. The severed parcel of land resulting from the Consent application is vacant land but will be approximately 0.92 hectares and will have a single detached dwelling and garage erected thereon in the future. The subject property in relation to the severed parcel and the retained parcel for Consent application AH-01/2013 is being rezoned Rural Residential (RR). The retained parcel concerning Consent application AH-01/2013 has an existing single detached dwelling with a detached garage and one (1) storage shed erected thereon and will have a lot area of 1.83 hectares. The Township of Alnwick/Haldimand is in receipt of an application to amend The Township of Alnwick/Haldimand Comprehensive Zoning By-Law No for a parcel of land located in Part of Lot 9, Concession 1, in the former Township of Haldimand, now in the Township of Alnwick/Haldimand. The subject property has a land area of approximately 2.75 hectares from which a 0.92 hectare parcel is to be created by consent to land severance AH-01/2013. The severed parcel is to be zoned Rural Residential (RR) and are to be used for residential purposes. The retained parcel of land resulting from the Consent application will also be zoned Rural Residential (RR) and has an existing single detached dwelling, detached garage and one (1) storage building (shed). 2. 9 THE CORPORATION OF THE TOWNSHIP OF ALNWICK/HALDIMAND BY-LAW NO BEING A BY-LAW TO AMEND BY-LAW NO AS AMENDED, WHICH MAY BE CITED AS THE TOWNSHIP OF ALNWICK/HALDIMAND COMPREHENSIVE ZONING BY-LAW NO , WHICH IS A BY-LAW TO PROHIBIT THE USE OF LAND AND THE ERECTION AND USE OF BUILDINGS OR STRUCTURES EXCEPT FOR CERTAIN PURPOSES: AND TO REGULATE THE HEIGHT, LOCATION, FLOOR AREA, SPACING AND USE OF CERTAIN BUILDINGS TO BE ERECTED WITHIN THE MUNICIPALITY AND THE MINIMUM FRONTAGE OF THE PARCEL OF LAND THAT ANY BUILDING OR STRUCTURE MAY OCCUPY. WHEREAS the Council of the Corporation of the Township of Alnwick/Haldimand deems it necessary in the public interest to pass a By-Law to amend By-Law No ; AND WHEREAS pursuant to the provisions of Section 34 of the Planning Act R.S.O as amended, By-Laws may be passed by Council of municipalities for prohibiting or regulating the use of land and erection or use of building or structures within the municipality for or except for such purposes as may be set out in the By-Law and for regulating in certain respects, buildings or structures to be erected within the municipality. AND WHEREAS this By-Law conforms to the Official Plan of the Township of Alnwick/Haldimand; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF ALNWICK/HALDIMAND ENACTS AS FOLLOWS: 1. That Map No. 33 of Schedule A of Comprehensive Zoning By-Law No , as amended, is hereby further amended by changing the zone classification of lands in part of Lot 9, Concession 1, former Township of Haldimand, now in the Township of Alnwick/Haldimand from Rural Exception No. 209 (RU-209) to Rural Residential (RR) as shown on Schedule A attached hereto and forming part of this By-Law. 2. THAT Comprehensive Area Zoning By-Law No , as amended, shall, except as set out in the foregoing, remain in full force and effect. 3. THAT this By-law shall come into force on the date it is passed by the Council of The Corporation of the Township of Alnwick/Haldimand, subject to applicable provisions of the Planning Act, R.S.O. 1990, as amended. 4. 10 NOTICE OF THE PASSING OF A ZONING BY-LAW THE TOWNSHIP OF ALNWICK/HALDIMAND TAKE NOTICE that the Council of the Township of Alnwick/Haldimand passed By-Law No on the 28 th day of November, 2013 under Section 34 of the PLANNING ACT, R.S.O., AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-Law by filing with the Clerk of the Township of Alnwick/Haldimand not later than the 19 th day of December, 2013 a Notice of Appeal. The Notice of Appeal must set out the reasons for the appeal and such appeal must be accompanied by the fee of $ in the form of a certified cheque or money order made payable to the Ministry of Finance as required by the Ontario Municipal Board. An explanation of the purpose and effect of the By-Law describing the lands to which the By-Law applies and key map showing the location of the lands to which the By-Law applies are attached. The complete By-Law is available for inspection in my office during regular office hours. Only individuals, corporations and public bodies may appeal a by-law to the Ontario Municipal Board. A Notice of Appeal may not be filed by an unincorporated association or group. However, a Notice of Appeal may be filed in the name of an individual who is a member of an association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party. The Township of Alnwick/Haldimand is in receipt of an application to amend The Township of Alnwick/Haldimand Comprehensive Zoning By-Law No for a parcel of land located in Part of Lot 7, Concession 1, in the former Township of Haldimand, now in the Township of Alnwick/Haldimand. The subject property has a land area of approximately hectares. The subject property consists of the land holdings of Bradley Martin and Bernadine Davis- Martin and Beatrix Davis. The severed parcel originally from the Beatrix Davis property is to merge to the Martin property to the north is the result of severance consent application AH-08/2013. The merging of the severed parcel to the Martin parcel of land will result in a total area of approximately hectares.
