EXECUTIVE SUMMARY (General Business): This application proposes to rezone approximately 1.14 acres from LMD (Limited Mixed Use District) to CG (General Commercial). PRESENTATION INFORMATION: Staff may provide a presentation. STAFF RECOMMENDATION: The Planning and Zoning Department staff finds the request to be consistent with the direction and intent of the future land use map and policies of the City's Comprehensive Plan and recommends approval. Move that the Council approve the ordinance as recommended by the Planning and Zoning Board. ALTERNATE RECOMMENDATIONS: 1. Move that the Council not approve the ordinance. BACKGROUND: On November 7, 2017, the Planning and Zoning Board unanimously recommended approval of this rezoning application. ISSUES/ANALYSIS: See attached staff report. LUCIE BOULEVARD AND SW CARY STREET FROM LMD (LIMITED MIXED USE DISTRICT) TO CG (GENERAL COMMERCIAL) FOR A PROJECT KNOWN AS SEVEN REAL ESTATE HOLDINGS, LLC (P17-192); PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Seven Real Estate Holdings, LLC, seeks to rezone 1.14 acres of property located on the southwest corner of SW Port St. Lucie Boulevard and SW Cary Street, and described as Port St. Lucie Section 18, Block 766, Lots 17-20, and within the City of Port St. Lucie, from the zoning designation of LMD (Limited Mixed Use District) to CG (General Commercial); WHEREAS, the City of Port St. Lucie Planning and Zoning Board held a public hearing on November 7, 2017 to consider the rezoning application (P17-192), notice of said hearing to adjoining property owners for a radius of seven-hundred and fifty (750) feet havin g been g iven and advertisin g of oublic hearin g havin g been made; and WHEREAS, the City Council held a public hearing on November 27, 2017 to consider the rezoning application (P17-192), advertising of the public hearing having been made; and WHEREAS, the proposed zoning is consistent with all applicable elements of the City's adopted Comprehensive Plan and complies with the City's Code of Ordinances. NOW, THEREFORE, THE CITY OF PORT ST. LUCIE HEREBY ORDAINS: Section 1. Ratification of Recitals. The City Council of the City of Port St. Lucie, Florida, hereby adopts and ratifies those matters as set forth in the foregoing recitals. 4 ORDINANCE Section 2. That the property described as Port St. Lucie Section 18, Block 766, Lots 17-20, be rezoned from the Zoning Classification of LMD (Limited Mixed Use District) to CG (General Commercial). Section 3. Conflict. If any ordinances, or parts of ordinances, or if any sections, or parts of sections, of the ordinances of the City of Port St. Lucie, Florida, are in conflict herewith, this Ordinance shall control to the extent of the conflicting provisions. Section 4. Severability. The provisions of this Ordinance are intended to be severable. If any provision of this Ordinance is determined to be void or is declared illegal, invalid, or unconstitutional by a Court of competent jurisdiction, the remainder of this Ordinance shall remain in full force and effect. The drive-through requires the special exception use. IMPACTS AND FINDINGS: Land Use Consistency: The rezoning of this property is consistent with the direction and policies of the City's Comprehensive Plan. In particular, Policy identifies the CG Zoning category as compatible with the CG Future Land Use Classification.
