1 TERMS OF SEALED BID SALE THE CITY OF CASEY by and through it council and also the Mayor, NIK GROOTHUIS, are receiving sealed bids for the purchase, under the successful bid, of the fee simple interest in the following parcels of land: PARCEL NO 1: THE WEST TWENTY-TWO (22) FEET OF THE EAST THIRTY-FOUR (34) FEET OF LOT EIGHT IN BLOCK SEVEN (7) OF LANG S ADDITION TO CASEY, CLARK COUNTY, ILLINOIS; ; 18 W Main St., Casey, IL PARCEL NO 2: THE EAST TWELVE (12) FEET OF LOT EIGHT (8) AND THE WEST THIRTY-TWO (32) FEET OF LOT NINE (9), ALL IN BLOCK SEVEN (7) IN LANG S ADDITION TO THE TOWN (NOW CITY) OF CASEY, CLARK COUNTY, ILLINOIS; ; W. Main St., Casey, IL See attached sheets for maps. The above parcels are commercial tracts of land that have buildings situated thereupon. The buildings have been deemed unsafe by the city, and the successful bidder will receive a deed subject to a reverter clause, which will provide that the tract will revert back to the city if the successful purchaser fails to put the property into a safe condition, as determined by the City of Casey Superintendent of Utilities and any structural engineer chosen in the sole discretion of the City within 60 days of the date of transfer. This may include (but not be limited to) either full or partial demolition of the existing structure. The purchaser must include with their bid a plan to place the property in safe condition (including timeline) as well as a narrative explaining future plans for use of the premises. 18 West Main and West Main are currently connected by way of an opening, which if two different purchasers acquire the parcels, the buyers will be responsible to repair in order to restrict access among the two buildings. The parcels are being sold as is/where is, without warranty, or without guarantee as for fitness for a specific purpose or otherwise. It is the responsibility of bidder to inspect the land and any improvements prior to bidding. Failure to inspect or be fully informed as to the condition of all or any portion of the property will not constitute grounds for any claim, demand for adjustment or withdrawal of a bid after the bid is opened or a contract signed. Bidders may bid the two parcels either as a group or individually or both in order to obtain the highest and best possible bids in the best interest of the municipality. Bidders are not required to bid it both ways. Any questions may be directed to Cara C. Shoaff at or to City Hall. Bids must be received by the city council at City Hall, returnable to Jeremy Mumford, City Clerk, whose mailing address is P.O. Box 425, Casey, IL and whose physical address is 108 East Main St., Casey, IL Said bids must be received in the office no later than 3:30 p.m. on October 1st, Bids submitted shall be sealed and bear the legend SEALED BID SALE OF WEST MAIN PROPERTY and the name and address of the bidder. All bids received will be publicly opened and read aloud at the regular meeting of the City Council of the City of Casey at 6:00 p.m. on October 1, A contract may be awarded to the highest bidder whose bid is found to be in the best interests of the City of Casey. The City of Casey reserves the right to reject any and all bids and to waive any informalities or irregularities in the bidding. The City of Casey further reserves the right to review and study any and all bids and to make a contract award within 30 days after the bids have been opened and publicly read. Upon acceptance of bid, ten percent (10.00%) earnest money shall be immediately due and payable in certified funds. Bidder shall also execute a Contract for purchase and sale of said parcels. Following the selection of a bid, non-selected bidders shall be notified by electronic mail to the address provided below. Seller reserves the right to sell lands as a whole or by parcels as divided herein. Any final contract entered into with the successful bidder will contain the following terms: (1) Conveyance will be by warranty deed, subject to the reverter clause described above, and further subject to generally accepted permitted exceptions, including but not limited to encroachments, overlaps, boundary line disputes, and any matters which would be disclosed by an accurate survey and inspection of the premises, easements of record taxes and special assessments which are not shown as existing liens by the public records, 2018 and all subsequent general taxes, existing leases, and prior conveyances of oil, gas and other minerals; (2) Ten percent (10.00%) earnest money due at signing and remainder due in immediately available funds at closing; (3) Possession delivered at closing; (4) Sale is AS IS; (5) If Buyer seeks title insurance and search, such expenses shall be paid by Buyer; (6) Closing to occur within 14 days of Contract. Sale is not contingent upon Buyer being able to obtain financing nor any appraisal. 1
