1 TOWN OF SWANSBORO Planning Board Regular Meeting December 5, 2016 Members Present Members Absent Wayne Mixon Christina Ramsey Sandi Eubanks Joel Wiltgen Brent Hatlestad Laurent Meilleur The meeting was called to order at 6:04 pm, and quorum verified. Public Comment Wayne Mixon, Chairman suggested that they would hear Public Comment after each agenda item. The council and audience agreed. Business PAEJ Properties, LLC with the Perry s permission seek a Special Use Permit pursuant to Article 12 of the Unified Development Ordinance to allow the Cottages of Swansboro-An Assisted Living and Retirement Community on the 7.06-acre tract of land fronting Old Hammocks Road (further identified as tax parcel ). Andrea Correll presented: The proposed area for development is located in the B-1 zoning district. The CAMA Land Use Plan depicts the parcel as commercial. Phase I of the Cottages of Swansboro will consist of six (6) single-story assisted-living homes and a single-story community/administration building. Each of the six assisted-living homes will contain six (6) licensed beds, for a total of 36 licensed beds. One home will likely be designated for memory care and will meet the state requirements for memory care facility. The homes will contain 3,200 square feet with an interior floor plan to include six private bedroom/bathroom units, a common dining area, common living area, and a common kitchen. Each home will have 24/7 staff and care. The interior courtyard will be shared by each home and will be landscaped similar to a private park with a paved walkway encompassing flower beds, shade trees, and benches/swings. A new street named Pelican Circle is proposed to align with Tarry More Avenue in the Ward Farm development. Andrew Wilson, Co-owner of the Cottages of Swansboro was available to answer questions. There was no public comment at this time.
2 Items discussed included security for the facility, particularly the proposed cognitive care unit, and an inter connective sidewalk or walking access to the Piggly Wiggly; Wayne Mixon, Planning Board Chairman read each statement and called for a vote. A) The special use is allowed per Article 10, Section 10-10, Table of Permitted/Special Use. The requirements of Section 12-2 appear to have been met. There was unanimous agreement that the requirements of Section 12-2 had been met. B) There is no evidence that the special use will endanger the public health or safety if located where proposed. There was unanimous agreement that it would not endanger the public health or safety. C) There was unanimous agreement that the proposed assisted living cottages are consistent with adjacent businesses but also an excellent transition with the adjacent neighborhood. D) The property is located in the B-1 zoning district. The CAMA Land Use Plan depicts these parcels as Commercial. There was unanimous agreement that the use will be in harmony with area in which it is located. Christina Ramsey made a motion to recommend approval of the Special Use Permit for the proposed Cottages of Swansboro. Stating that as a Special Use in the B-1 zoning district it is generally consistent with the current Comprehensive Plan as well as its Future Land Use Classification (Commercial) and other applicable adopted plans and policies, including but not limited to the Gateway Vision Plan; with the following conditions: that the developer will provide pedestrian access by installing a sidewalk along the total frontage of the property; and that they will have representation at the Board of Commissioners Meeting to answer questions regarding security. Brent Hatlestad seconded the motion. The motion to recommend approval passed unanimously. Preliminary Plat request for the Shipwright Point Subdivision. Parker and Associates, on behalf of A. Sydes Construction, Inc., is requesting preliminary plat approval for the Shipwright Pointe subdivision, located off of Pine Bluff Road (a Hall s Creek and Pine Bluff Shores Subdivision Street) and will connect to existing Whistling Heron Way in the Park Place subdivision. No driveway access is proposed to Pine Bluff Road from lot 1 or lot 64. The property is within Town s ETJ but is planned to be voluntarily annexed by the developer. Shipwright Pointe is contiguous to the town limits. Upon review, the Planning Board had some additional recommendations to forward to the Board of Commissioners for their consideration. Installation of a 4 chain link fence around storm water facilities Provide stub streets Payment in Lieu of park land Paved & signed pedestrian access to the school Maintain 10 vegetation between Halls Creek and Ship Wright Point Public Comment: Tom Cariker expressed concerned regarding the new homes looking right into the homes on Nellie Lane, many of which are for sale. He requested that a study of the status of the homes be done. How many won t sell, how many are short sales, and how many are repossessions?
3 He feels like the housing market in Swansboro is lagging behind the rest of the nation; and that too many homes are currently being built here. He also stated that traffic is a big issue. Chuck Quinlin also suggested that the Town sit back and evaluate. Scott Chase, Town Manager stated that the Town cannot dictate value, size, or market of a Development. Brent Hatlestad made a motion to recommend approval of the Preliminary Plat for the Shipwright Point Subdivision with the with the fore mentioned conditions. Christina Ramsey seconded the motion. All were in favor. The motion to recommend approval passed unanimously. Approve Regular Meeting minutes: November 7, 2016 Brent Hatlestad made a motion to adopt the November 7 th meeting minutes. Joel Wiltgen seconded the motion. The Planning Board voted unanimously to adopt the meeting minutes. Wayne Mixon made a motion to amend the Agenda to include a discussion on the type of gate for Hammocks at the Port of Swansborough, Phase II development. Brent Hatlestad seconded the motion. All members were in favor. A siren activated gate and duplicity (a Knox Box) was discussed. Joel Wiltgen made a motion to include a siren activated gate and duplicity to the conditions to recommend approval of the Hammocks at the Port of Swansborough, Phase 2 to the Board of Commissioners. Brent Hatlestad seconded the vote. All were in favor of recommending approval Amendment to Section 17-3: Minimum Parking Requirements revising the standard for Eating and Drinking Facilities and Fast Food Eating and Drinking Facilities. Also adding a provision to add Bicycle Racks. Section 17-3: Minimum Parking Requirements The following off-street parking space(s) shall be required and maintained: Eating and Drinking Facilities One (1) space for each (3) seats plus one Space for each two (2) employees. Six (6) spaces per 1,000 square feet including any outdoor seating area. Eating and Drinking Facilities, Fast Food Thirteen (13) spaces per 1,000 square feet of gross floor area. Ten (10) spaces per1,000 square feet of floor area including any outdoor area used for dining. To promote alternative modes of transportation within the town, one parking space for the development, as required, may be exchanges for bicycle facilities (i.e., bike racks).
4 Special situations which are not covered by the above shall be handled by the Board of Adjustment. The Board of Adjustment Commissioners shall make the final determination as to the number of spaces to be required, but shall in all cases give due consideration to the needs therefore. Sandi Eubanks made a motion to recommend the above Amendments to Section 17-3 Minimum Parking Requirements and to add a provision to add Bicycle Racks. Christina Ramsey seconded the motion. All were in favor of recommending approval. The motion passed unanimously. Amendment to Section 2.2 to add a definition of concealed wireless. (65a) Concealed Wireless Telecommunication Facility. A structure that is fabricated in a manner that aesthetically masks its appearance as a communication facility that is installed with or on an existing structure. Examples include church steeples, bell towers, light standards, signs, utility poles, flag poles, building facades, water tanks, silos, and other structures which conceal telecommunication antennas and equipment from visibility. A communications tower shall not be considered a concealed wireless telecommunication facility. (65ab) Conditional Zoning District (CD). Amendment to Section Table of Permitted/Special Uses to add Concealed Wireless Telecommunication Facility as a special use. Brent Hatlestad made a motion to recommend approval of amending Section Table of Permitted/Special Uses to add Concealed Wireless Telecommunication Facility as a special use. Sandi Eubanks seconded the motion. The motion passed unanimously. Amendment to Section 12-2: Specific Criteria for Certain Special Uses adding standards for a Concealed Wireless Telecommunication Facility. Use: Concealed Wireless Telecommunications Facility Special Use District: RA, O/I, G/E, B1, B2, B3, B2HDO and M1 Minimum Lot Area: Based on zoning classification lot standards. Plans are required and must show: To follow the standards of Appendix IV.
5 Structures: Location and approximate size of all existing and proposed buildings and structures within the site and on the lots adjacent thereto. Circulation: Proposed points of access and egress and pattern of internal circulation. Other Details: (1) Concealed Wireless Telecommunications Facilities shall be permitted in the RA, O/I, G/E, B1, B2, B3, B2HDO and M1districts as an accessory use provided the following conditions are met: a. In order to be considered an accessory use, a Concealed Wireless Telecommunications Facility must be clearly incidental and subordinate to the main use of a structure. b. Antennas associated with a Concealed Wireless Telecommunications Facility shall be concealed from exterior view. c. The addition of antenna, support or other equipment shall not add more than ten (10) feet in height to the attached structure unless a variance is obtained from the Zoning Board of Adjustment. Notwithstanding the foregoing, any increase in the height of an existing structure must comply with other provisions of this Ordinance unless appropriate approvals are obtained. d. Electronic equipment associated with Concealed Wireless Telecommunication Facilities may be placed inside a building or, if placed on a rooftop, all equipment enclosures shall be mounted behind a parapet wall or façade which is camouflaged to match or complement the color and architectural treatment of the building. If placed on the ground on a concrete pad, equipment enclosures shall be screened so as to make them unobtrusive. e. All cabling and wiring connecting antennas, equipment enclosures, and other components of concealed wireless telecommunications facilities shall be colored or concealed in a manner as to render them unobtrusive. f. Antennas associated with a Concealed Wireless Telecommunications Facility may not be co-located on a tower or other support structure used by an amateur radio operator. g. Antennas associated with a Concealed Wireless Telecommunications Facility shall not be located upon a Single Family Dwelling or Multi-Family Dwelling. h. Should the existing support structure require to be replaced and/or rebuilt it shall comply with all applicable codes including but not limited to these provisions. i. Any modifications to an existing structure associated with the installation of a Concealed Wireless Telecommunications Facility shall comply with all limitations, requirements, and standards contained in other provisions of this Ordinance including, but, not limited to the receipt of approvals that may be required by Section of this Ordinance should the Concealed Wireless Telecommunications Facility be located
6 within a Historic Preservation District. All other applicable local, state, and federal approvals and permits shall also be obtained. j. A structural analysis shall be performed by a licensed professional engineer in the State of North Carolina in accordance with the current revision to ANSI EIA/TIA-222 certifying that the structure is capable of supporting the proposed loading. k. Prior to installation of a Concealed Wireless Telecommunications Facility, a copy of the operators FCC license shall be submitted to the Planner. If the party installing the Concealed Wireless Telecommunications Facility is not an FCC licensee, the party must demonstrate that it has binding commitments from one or more FCC licenses to utilize the Concealed Wireless Telecommunications Facility and must submit a copy of each wireless service provider s FCC license. Sandi Eubanks made a motion to recommend approval of an amendment to Section 12-2: Specific Criteria for Certain Special Uses adding standards for a Concealed Wireless Telecommunication Facility.
