1 NOTICE OF INVITATION TO BID AT PUBLIC AUCTION FOR RIGHT TO ENTER INTO AN AIRPORT HANGAR LEASE WITH CITY Sealed bids addressed to the City of Port Aransas will be received at the City Secretary s office at 710 West Avenue A, Port Aransas, TX during normal office hours. They will also be accepted from 1:00 PM until 1:30 PM on Saturday March 1, 2014 in the Council Chambers. At 2:00 PM they will be submitted into a live public auction. Bidders may also appear in person to bid at the live public auction which will commence on Saturday March 1, 2:00 PM in the Council Chambers located at City Hall, 710 West Avenue A, Port Aransas, TX. Doors will open at 1:00 PM. All Bidders participating in the live auction shall have their Bid Submission Packets approved by City Staff no later than March 1, 1:30 PM in the Council Chambers. Up for bid at auction is the right to enter into a hangar lease for the empty hangar space designated as BB (see attached site map). Once a lease is negotiated with the winning bidder, the new lessee will have the right to build a hangar on the site in accordance with the lease. Terms and conditions of the auction are listed below: Section I - General Information A. All bids submitted become public information and may be reviewed by a Request for Open Records to the City Secretary. B. The City of Port Aransas (City) reserves the right to reject any or all bids. C. In the event it becomes necessary to revise any part of this Invitation to Bid, addenda shall be updated on the City s web page at it is up to each prospective bidder to monitor this site until the auction takes place. D. The City is not liable for any cost incurred by prospective bidders related to bidding this auction. E. No sealed bids will be received after the time and date specified on the Invitation to Bid. Live auction bidders failing to submit the Bid Submission
2 Packet (BSP) by the 1:30PM registration cut off time will not be permitted to participate in the auction. There shall be no exceptions to this requirement. F. The award will be to the highest bidder. Once awarded, the successful bidder is bound by the bid and obligated to enter into a hangar lease with the City. Winning bidder may not assign any rights prior to entering a lease with the City. G. Only proposals that comply with all provisions, requirements, terms and conditions will be considered for review by the City. H. The City reserves the right to withdrawal from accepting any bid at any time prior to City Council approval. I. In case of a tie between equal sealed bids, the award will be made to the earliest bid received by the City Secretary s Office. Section II Biddings Requirements/Bidding Procedures A. All bidders must submit a full Bid Submission Packet (BSP) that shall be approved by City Staff. For sealed bids, they shall be addressed to the City of Port Aransas in a sealed envelope marked with For Airport Hangar Bid clearly written on the outside of the envelope and will be received at the office of the City Secretary at 710 West Avenue A, Port Aransas, TX during normal City Hall office hours and on Saturday March 1, 2014 from 1:00PM until 1:30PM The BSP includes: a. Bidder Information Form b. Sealed Bid Form (for those not participating in live auction) c. Money order or cashier s check for $1, made out to the City. Losing bidders will be issued a refund within seven (7) business days. This will be non-refundable to the winning bid but will be subtracted from the winning bid amount. B. Staff will supply each bidder a numbered bidder s card. C. Staff will conceal the sealed bids and bid for them independently during the live auction in increments of $1, until their maximum bid is reached or until their bid may be declared the winning bidder. D. The City will notify the successful bidder, in writing, within seven (7) days after the close of the auction.
3 Section III Lease Information A. Upon winning the bid, the winning bidder will complete a proposed lease by filling out a copy of the Sublease Agreement Mustang Beach Airport (on the City s webpage) provided by the City. It is the responsibility of each bidder to carefully read the sublease document prior to the auction to understand the lease requirements. B. Once complete, the proposed lease will be forwarded to City Council at their next available council meeting for approval. It is the responsibility of the bidder to submit accompanying preliminary plans and specifications of his/her hangar to staff to be included in the City Council packet. Once approved by council, the City Manager will execute said lease within sixty (60) days. C. Bid payment will be due in full upon execution of the lease.
