1 FAIR WINDS' RULES AND REGULATIONS VlLLAS I. Each villa shall be used exclusively as a one-family residence. 2. Owners must contact a Board member teiling of arrival of renter or renters mllst call office at (941) and leave a message telling day of their arrival. 3. All units shali remain of like exterior, design, color, and appearance as other units of the same type. 4. Each owner shall maintain the roof and interior, including lanais, in good condition. This includes annual washing of the roof. 5. No business or trade may be conducted from any unit. 6. &0% of units shall be occupied by at least one person aged 55 or older. The Board of Directors have discretion regarding the remaining 20%. All owners must submit their driver's license to the office to be copied and filed at the time of their interview. 7. No person under the age of 45 shall reside in a unit except as a temporary houseguest Babysittingldaycare provisions are not permitted either on a part-time, fuli-time or daily basis for children of any age. 8. Loud noises, obnoxious odors or offensive pets are not permitted. 9. No antennae, air conditioners or structures of any sort shall be erected on any building. 10. A small sign may be displayed in one front window oniy with the word ''For Sale" or "For Rent". No pennants, flags or unusual outdoor decorations are perinitted with the exception of one portable, moveable American flag. 11. No clothes lines,hangers or any drying facilities shall be permitted on the exterior of any villa or any part of the common elements. 12. No electric machine or apparatus is allowed wruch causes interference with TV reception. 13, All units must have smoke alarms and fire extinguishers. 14. Mailboxes must be standard, upright, in good repair and meet postal codes. Page I

No villa shall be rented or leased for less than 60 consecutive days. In addition, no unit owner who purchases a unit after January 22, 2004 is permitted to lease the unit at any time during the first year of ownership. Current owners and their heirs who acquire a unit through inheritance m e exempt aild will be permitted to lease or rent the unit for a term of no less than 60 consecutive days. 2. At the owner's discretion renters may be permitted to have pets. 3. Owner is responsible for all keys (including clubhouse/laundry room) and also a copy of these rules being supplied to tenailts or renters. Owners should explain to renters all rules, especially those concerning prohibition of pets aild pick-up trucks. Page I of4 Revised
4 4. It is the duty of the owner to notify the board promptly of a contract of sale or lease. 5. All renters and new owners must register at the office before occupying a villa. 6. All occupants must abide by condo rules and regulations, which must be given to them by the office when they check in ifthe owner has not given them hisfher copy. VEHICLES I. No trucks are allowed in Fair Winds except commercial vehicles, which may park for the time necessary to perform services for the unit owners. 2. Only passenger cars and station wagons, passenger and handicapped vans may be parked overnight on the condominium property, except that overnight guests, with well-maintained pick-up trucks, which qualify will be determined at the discretion of the Board of Directors, may park iu the van parking lot for up to seven (7) days. The Unit Owner is required to obtain prior approval for guest pick-up truck parking from two (2) members of the Board of Directors and register the vehicle at the office. The guest is required to carry a guest pass on the dashboard of the vehicle at all times when parked on the condominium property. 3. No trucks, trailers, campers, motorbikes, motorcycles, minibuses, recreational vehicles, and boats not in the water can be kept overnight on the condominium property. 4. Vehicles parked in a driveway must be entirely clear of the roadway. 5. Parking on lawns, in cul-de-sac roadways or on the blacktop in general is not permitted. 6. The speed limit in Fair Winds is 15 miles per hour 7. Auto ID tags are issued by the office. 8. RV's are allowed for one night only when first arriving or when departing and must be parked in the van-designated area for that night. 9. PLEASE OBSERVE THE ONE-WA Y ENTRANCE AND EXIT. We have had several near-accidents. The signs entering and exiting onto Albee Road are Sarasota County road department signs. not Fair Winds signs. Traffic laws apply and violators can be ticketed by law enforcement authorities. CLUBHOUSE and SOCIAL 1. The c!ubhollsemay be used for private parties with Board approval. A unit owner must be a participant in the party. 2. Gifts or donations to the Association must be approved by the Board. Page 2 of4 Revised
5 3. There will be no solicitation in Fair Winds. 4. No company or individual can use the facilities for profit. 5. No soliciting allowed. However, the Board may approve celtain charitable donations, Le., the Salvation Army food collection at holiday time, but there can be no coercion such as publication of donor names. 6. The picnic area may be used according to the same terms as the clubhouse. 7. Certain equipment may be borrowed for private nse after Board approval. The recreational facilities and social events sponsored by the Association are for the benefit of owners and renters. Guests are welcome, but their pruticipation will be secondary to the owners and renters. Overnight house guests will be given preference. GROUNDS 1. All plantings in the area 2 Y, feet from the unit are the owner's possessions and ru'e the owners responsibility and should be maintained in keeping with the area. Other than plantings only cement, terra cotta, woods, rock, shell or any natural material will be acceptable as ornaments in this area as well. 2. Any chrulge to the grounds such as planting of trees or shrubs fiuther thall 2 Y, feet from the building (except as above) must be submitted to the Board for approval. 3. The planting of all citrus trees must be approved by the Board. 4. Remove all moveable articles (chairs, planters, etc.) from grounds alld lanais before your seasonal exodus. VIOLATORS WILL BE F'INED $ Watering: Car washing allowed only with water from the irrigation system. If there is no hook-up near you, you may use the hoses at the docks. Similarly, unless using the irrigation system, garden watering is limited to Me hour a week. SEWER and WATER I. These plants are owned jointly by all villa owners. ONLY toilet paper alld humall waste shall be disposed of through the sewers. Violators will be assessed ally maintenallce and repair fees involved. 2. Do not waste water - CONSERVE! We are billed by the county for our water use. Excessive use increases our condo fees. PETS and BIRDS 1. Dogs must be leashed at all times. 2. Pet owners must clean up after their allimals alld dispose of same in garbage. Page 3 of4 Revised
6 3. Large wild birds, ducks and geese are not to be fed. 4. Song birds may be fed from a feeder. SECURITY 1. Lanai/carport lights must be on from dusk to daylight. 2. Turn on the dome light in your car as you approach Fair Winds after dark. (It helps security patrol) 3. If you leave the area for a protracted period of time, a timed switch or photo cell is strongly recommended for the lanai light. POOL 1. Pool hours - 9:30 - dusk 2. Swim at own risk. No lifeguard.3. No ful1l1ing, rougw10using or playing on rope. 4. Shower each time before entering the pool. Lotion must be removed. 5. Absolutely no children under the age of 4 at any time. 6. Children 4 to 12 years of age must be accompanied by an adult. 7. Family hours 10a.m. - 2:00p.m. 8. NO inflatable toys, etc. permitted. 9. NO admission to clubhouse in wet suits. 10. NO animals, food or drink in pool or on pool deck. 11. Put rope back before you leave pool. 12. Emergency phone outside office door. 13. ABSOLUTELY NO DIVING! MISCELLANEOUS 1. A penalty fee of up to $100 per day, not to exceed $1,000, shall be levied by the Board of Directors against any individual who, after a formal warning and proposed amount of time to rectify the violation, fails to comply. 7 RENTALS AND SALES I. No villa shall be rented for less than 60 days. In addition, no unit owner who purchases a unit after January 22, 2004 is permitted to lease the unit at any time during the first year of ownership. Current owners and their heirs, who acquire a unit through inheritance, are exempt and will be permitted io lease or rent the unit for a term of no less than 60 consecutive days. 2. At the owner's discretion, renters may be permitted to have pets. 3. Owners are responsible to give all keys, including clubhouse, to tenants or renters. Owners should explain all rules especially those concerning pets, pick-up trucks and the pool. 4 It is the duty of the owner to notiry the Board promptly of a contract of sale or lease. 5. Pool hours - 8:30 A. M. to dusk. 2. Swim at your own risk. No lifeguard. 3. No running, roughhousing or playing on the rope. 4. Rinse off in shower each time before entering the pool. All lotions must be removed. No shampoos or soap allowed. 5. Absolutely no children under the age of 4 at any time. 6. An adult must accompany children 4 to 12 years of age.. 7.
