Site Location Just west of Bridgeport to the north of Route 245 one mile up Cornet Creek Drainage. Site Conditions The site has remained unchanged since the aerial photo on file was taken on July 1, Vegetation including sage brush and other native bushes and grasses are now well established within all portions ofthe previously disturbed areas. Storm Water The site is well vegetated and the soil stabilized, storm water is not an issue at this time. f there is renewed activity at the site the permittee will need to take all necessary precautions to ensure that storm water does not leave the site or apply fo r a storm water permit. This site has been graded with slopes at 3:1 or flatter. The sediment pond was filled and revegetated. No equipment used as part of this operation remains on site. A vegetative cover of bunch grasses has been established. This site has been successfully reclaimed. Five acres of land, that had been disturbed before Mr. Gallagher started his project, have been returned to a stable condition. Even the presence of livestock along Pine Creek in this area has not created a revegetation problem at the Elliott Mine site. t is recommended that this file be closed. Any future mine operation at the Elliott Mine will require an Operating Permit, reclamation plan, and reclamation security. Pine Creek-Elliott Mine Nyssa OR Section 15,22,23,26,27, Twp 12S, Range 39E Baker County Date Of nspection: June 15, 1995, Updated September 19, 1995 nterim Reclaimed Acres 0 Concurrent Reclaimed Acres 0 was accompanied on this inspection by Fred Osborne, BLM - Baker City representing the landowner; Paul Gallagher and Frank Lamb, operators. This site is located 7 miles east of Hereford, at milepost 17.2 Highway 7, one mile up Pine Creek. This site was previously inspected on September 28, A small portable trammel has been set up, and material is being processed. A small pond, 20' 40', recycles water for this operation. A cat was pushing material from the pay zone to a loader, then- running it through the trammel. Less than 1,000 cubic yards of material have been processed through the trammel. The area disturbed exceeds one acre, and may be on the order of 2 acres total. However, copies of 1969 and 1979 aerial photos supplied by Mr. Gallagher indicate the Elliot Mine had been disturbed prior to The quality of the photocopy is not exceptional, but clearly at least 2.5 acres were disturbed in 1969, with an additional lower pond present in the 1979 photo. During an inspection in September 1994, it was noted that some areas were revegetated with sage and bunch grasses. Other areas along Pine Creek previously disturbed by mining are supporting Alder trees, and were designated as revegetated as per OAR The current area being mined consisted of a series of ponds that were sparsely vegetated and had been bonded by Butch Bullard. Based on 1992 file photos, this area was to be regraded by Gold-Water Mining nc., but had not been accomplished as of 9/94. During the 1994 inspection it was agreed that the area previously bonded by Bullard, approximately 3 to 4 acres, was not revegetated, and a 1972 aerial photo was needed to document this area had been disturbed prior to reclamation laws. 16 Paul Gallagher D No. June 16, 1996 Page 2 of 2 Allen Throop of DOGAM visited this site during the week of May 29, 1996 and issued a Closure Order based on the disturbance of more than one acre. However, Mr. Gallagher applied for a Limited Exemption in September 1994 by submitting an application, application fee, background information on past mining in this area, and a site plan map. Aerial photography was requested, and was obtained in early With the aerial photography now reviewed, 4 acres of the Elliot Mine appear eligible for a Grant of Limited Exemption (LEP). This LEP is for 4 acres located in NW 4, NEVi Sec. 22,T12S,R39E, Baker County. The site is depicted as the Elliot mine on the 7.5" Hereford USGS topographic map. During this inspection Mr. Gallagher also presented DOGAM with a completed Transfer of Surface Mining Permit form, transferring the Grant of Total Exemption previously held by Emery Cameron for a one acre site within the NEVi of Sec. 22,T12S,R39E, Baker County. Based on the documentation provided by Mr. Gallagher and the work performed in the field at this site, the Closure Order was lifted, verbally, during this inspection. A Rescinding of Closure Order is attached to this report. This site was again inspected in September Mr. Gallagher is now working alone. Final grading had been accomplished on two acres that had been mined the past summer. The grading work was accepted by DOGAM and BLM. This area will be seeded later in the Fall 1995, once the rains begin. An additional one acre of pay zone remains to be excavated by Mr. Gallagher, probably not until Spring Mr. Gallagher has performed very good reclamation at several exploration pits in the lower Pine Creek drainage and the areas mined at the Elliot site. Approval is recommended for a Grant of Limited Exemption for 4 acres at the Elliott Mine in NW 4 NEVi Sec. 22,T12S,R39E, Baker County. '

We were met on site by Glenn Gmlle, Paul Gallagher, Frank Lamb, and Emery Cameron. The claim holder for this site is Ken Casper. This site is located seven miles east of Hereford at milepost 17.2 along Highway 7. Exploration work continues, although Fred Osborne stated it was his opinion that work at this site had progressed beyond the exploration stage. Fred requested a revised Notice of Operations be submitted to BLM. The operators had disturbed several areas, but had regraded approximately 2-3 acres that are now ready for seeding this fall. We toured the site up Pine Creek, and discussed eligibility requirements for inclusion as a Limited Exemption. Due to natural revegetation of past disturbed areas, very little of the proposed permit area would be eligible for Limited Exemption status. A 1972 aerial photo of this site will be necessary to determine if there are any areas within the proposed permit boundary that are eligible for Limited Exemption status. A Division 35 application package will be included with this report. t was agreed the bulk of the mining proposed at this site will require an Operating Permit. f an area is determined eligible for Limited Exemption status, this area will not be affected by an Operating Permit boundary. The reclamation completed by Butch Bullard at the Borwig Claims has a good vegetative cover, but has been grazed by livestock to the point where survival of vegetation is questionable. Mr. Guille stated they would set up a pilot operation on the Elliot Claims, to test the productiveness of this area. This pilot operation will be under one acre disturbance and will not exceed 5,000 cubic yards of material processed this year.
