Box 867, Linden, TX fax NOTICE OF TIMBERLAND SALE Linden Property, LTD Stevens Tract total deed acres- Cass County, Texas Bid Date: October 16th, 10:30 a.m. Bid Location: Hammett Real Estate Office, 1201 Hwy 59 South, Linden, TX Hammett Real Estate has been authorized to sale the above mentioned tract of timberland by timberland bid process. The tract is located on County Road 1623, approximately 2.7 miles southwest of Linden, Texas. Location, tract, topographic, and soils maps are attached for your reference. TRACT DESCRIPTION This is a sale of four tracts of land, a, 5.7-acre tract, a acre tract, a 6.0-acre tract, and a acre tract for a total of deed acres. The timber on this tract is predominantly a planted loblolly pine stand that has been thinned once about It is ready for its second thinning. The tract map shows three different timber stands and the timber types on the map. The access to the tract is off of County Road There is a gate that has a combination lock on it. The combination is The tract has a good internal road with a large culvert at the creek crossing. The boundaries of the tract are as follows: the north line is the county road, the east and west lines of the small tracts are not marked on the ground (pink flagging has been hung in the approximate location of the corners at the road), the boundaries of the larger 119 acre tract is old fences on the east, west, and south boundaries. A survey of the acre tract was done in 1996 and will be presented to Buyer at Closing. It is available for inspection at our office in Linden. Legal descriptions of all tracts are in this bid packet. According to the Natural Resources Conservation Service soil survey, there are five main soil types on the tract. They are a Lilbert soil type (loblolly pine site index of 88), a Bowie soil type (loblolly pine site index of 86), a Tenaha soil type (loblolly pine site index of 87), a Cuthbert soil type (loblolly site index of 84, and a Iulus soil type (no listing for loblolly pine site index). A Cass and Marion County Soils Survey and other information can be downloaded from my website at A soils map is attached for your reference. 1

2 BID INFORMATION The land and timber will be sold by lump sum sealed bids. Bids for the tract must be made on the attached bid form. No conditional bids will be accepted. Please mark each bid envelope Stevens Timberland Bid to ensure its being opened only at the designated time. Faxes and ed bids will be accepted and acknowledged immediately upon receipt, provided you include a phone number where you can be reached prior to the bid opening deadline. No phone bids will be accepted. Any modification of sale conditions in bid reply will not be accepted and will render the bid null and void. Bids will be received no later than 10:30 A.M., Friday, October 16th, 2015 at which time they will be opened and read at the Hammett Real Estate office, 1201 Hwy 59 South, Linden, TX Bidders are encouraged to attend bid opening. All bidders will be provided with a summary of the bid results. SALE CONDITIONS 1. All offers will be presented to the Seller. The Seller reserves the right to accept, counter, or reject any and/or all offers. 2. Offers will remain valid through 5:00 P. M., October 22, 2015 for the Seller to consider all bids. The successful bidder will be contacted at or before that time by phone, fax, or . The tract is being sold in its entirety for a single sum and not on a per acre basis, as is. Only offers for a specific dollar amount will be accepted, not a per acre price. Advertised acreage is believed to be correct, but is not guaranteed. Seller will not provide a new survey. 3. Upon acceptance of an offer, a more formal Contract of Sale, with earnest money check in the amount of 10% of purchase price, will be executed between the successful bidder and sellers within seven business days. A sample Contract of Sale may be provided upon request in advance. Terms are cash or check at closing. The checks may be a cashier s check or money order. Personal or company checks will not be accepted. Closing is expected within forty-five days of acceptance of offer, except the Seller shall have reasonable time to perfect and cure defects in the title to the subject property. Earnest money deposits will be made to Jeff Mays Law Office and will be applied to the purchase price at closing. In the event the Buyer defaults in the payment of the balance of the bid price in accordance with the terms and conditions of this notice, the Buyer will forfeit the earnest money deposited and it shall become the property of the Sellers as liquidated damages. 4. The Sellers will convey title to the subject property by Warranty Deed, subject to all previous reservations and exceptions, to any valid rights of way, easements, leaseholds, and to any protective covenants or restrictions, which may have been recorded affecting the property. Seller will reserve any and all minerals he may own by using the clause in the deed as shown in Exhibit A, which is attached. 5. Sellers will pay pro-rated taxes (through the date of closing), tax certificate fee, seller s broker s fees, deed preparation, title policy costs, and 50% of any other fee associated with closing. Buyer will pay recording fees, pro-rated taxes, and 50% of any other fee associated with closing. 6. Seller will furnish a title policy issued by Lone Star Title Company of Linden, Texas. 2

3 7. Closing will be conducted by Jeff Mays Law Office at 103 W. Hiram Street in Atlanta, Texas. 8. Hammett Real Estate in Linden, Texas is the real estate firm acting as agent for the seller. Any and all information contained in this bid prospectus is provided in good faith and is believed to be true and accurate, but it is not guaranteed. Bidders are advised to verify information and bid accordingly. No volume estimates are available on merchantable timber. Property Inspection Bidders are encouraged to inspect the subject tract prior submitting a bid. The tract is available for inspection by all bidders. The bidder by accepting the inspection invitation agrees to and shall indemnify and protect the Sellers and Hammett Real Estate and hold the Sellers and Hammett Real Estate harmless from and against any liability or personal injury or property damage or any other loss, cost, expense, or claim caused or alleged to be caused by bidder, or any invitees, representatives, employees, or agents of the bidder while on or about the Sellers property. Bidder s obligation in this regard shall survive any consummation, termination, or closing of any Contract of Sale.
