1 PART A - BULK AND LOCATION REQUIREMENTS FOR BUILDINGS 401 GENERAL Requirements for Predominant Uses: This ordinance specifies, for predominant uses, the various requirements which relate to the size of buildings and their position relative to the boundaries of their sites. The various terms including 'yards', 'coverage' and 'height' are more particularly described in ordinance 'Definitions' Requirements for Conditional Uses; Without limiting Council's powers to grant exemptions from, or modifications and waivers of, bulk and location requirements in respect of any particular conditional use application, the requirements listed below for predominant uses shall be used as a guide to the bulk and location controls likely to be imposed in respect of conditional uses in the same zone Boundary Determination: Where in respect of any yard any doubt arises as to whet:her any boundary of a site is a front, rear or side boundary, the Council shall, on the application of the owner of that site, designate that boundary as a front boundary or a rear boundary or a side boundary as shall appear to the Council to be appropriate having regard to the street frontage, shape, topography and outlook of the site General Requirements relating to all Industrially Zoned Land: a) All industrial sites shall be maintained in as tidy a condition as is reasonably possible having regard to the particular use or uses of that site. b) No raw materials or products of the use of any such commercial or industrial site and no by-products, refuse or containers of any kind shall be stored or deposited on

3 - 79 any part of the site, unless the Borough Engineer is satisfied that an open storage area has been properly constructed to adequately contain the material and to screen it from public view. c) All yards required to be provided under the bulk and location requirements of ordinances 409, 410, 411, 412, 413 shall be landscaped to the satisfaction of the Borough Engineer and thereafter maintained to a standard that meets with his approval. d) The front street boundaries of industrial properties are to be demarcated by low nib walls, broken only to provide vehicle access to approved street crossings. e) All boundaries which adjoin residential zones shall be screened from adjoining properties by a solid wall or walls not less than 6 feet in height, constructed of concrete, brick, stone or such other materials as are approved by t±ie Borough Engineer Verandahs in Commercial Zones: Where a building situated on land in a commercial zone and having frontage onto a pedestrian oriented retail area as defined by the map on page No. 78 is constructed, substantially reconstructed, altered or added to in a way that substantially changes the appearance of its face, it shall be provided with a verandah designed in compliance with the by-laws and placed within such minimum or maximum heights as the Council may prescribe. Each verandah shall be so related to its neighbours as to provide continuity of cover and each having a fascia within such limits of depth as the Council may prescribe. 402 BULK AND LOCATION REQUIREMENTS FOR RURAL ZONES The following shall be the bulk and location requirements for all the buildings in Rural zones: Front Yards a) Dwelling houses only - least dimension...25 feet b) All other buildings - least dimension feet.

4 Side Yards Least dimension...10 feet Rear Yards Least dimension...20 feet Height Limitations (See also Ord ) No part of any building shall exceed a height equal to the shortest distance from that part of the building to the nearest site boundary Special Height Limitation All applications for planning approval relating to buildings shall be accompanied by a certificate from the Civil Aviation Division of the Ministry of Transport that the height of all structures is within the limits defined by approach path requirements. (Refer Aerodrome Height Limitation map) Housing and Keeping of Animals The housing or keeping of animals in any building or enclosure within 50 feet of any residential building or less than 40 feet from any boundary of the site or within 200 feet of any urban or residential zone boundary is expressly prohibited under tjiis Scheme. 403 BULK AND LOCATION REQUIREMENTS FOR RESIDENTIAL A ZONES The following shall be the bulk and location requirements for dwelling houses and buildings accessory thereto, (including dwelling houses incorporating an office permitted as a predominant use) Number of Buildings on Site Not more than one residential building shall be erected on any site in this Residential A Zone Maximum Height (See also Ord ) a) Accessory buildings...12 feet. b) Other buildings...24 feet.

5 Height Relative to Site Boundaries No part of any building shall exceed a height equal to 12 feet plus the shortest horizontal distance from that part of the building, to the nearest site boundary with a minimum of 8 feet Front Yard a) Least dimension 15 feet b) In the case of rear sites and special rear sites the 15 feet front yard shall not be allocated within the access strip, and the adjacent boundary shall be at least 40 feet in length Side Yard a) One yard of least dimension 8 feet, other yard of least dimension 5 feet. b) In the case of rear sites and special rear sites least dimension 10 feet Rear Yard a) Least dimension 25 feet b) In the case of special rear sites the 25 feet rear yard shall be adjacent to the boundary of the major reserve and provided that in all other cases the 25 feet yard is not allocated within the access strip and the boundary adjacent to this yard is at least 40 feet in length Accessory Buildings Accessory buildings may be erected in any rear yard but not closer than 5 feet to any rear boundary, provided that not more than one fifth of the area of such yard is covered by buildings. A 'carport' as defined in ordinance 101 may be erected in a sideyard if the adjoining owners consent is first obtained or if advertised as a conditional \.ise but enclosure of such a building is expressly prohibited Maximum Building Coverage Accessory buildings only sq.ft. 6 The following shall be the bulk and location requirements for apartment houses and travellers' accommodation in Residential A zones (including apartment houses incorporating an office permitted as a predominant use in these zones): Density Control a) Maximum density...50 habitable rooms per acre. b) Minimum habitable room count. For the purposes of calculating the density of any apartment house - each household unit shall be deemed to have at least three habitable rooms irrespective of its design Number of Residential Buildings on Site Not more than one residential building shall be erected on any site in a Residential A zone Maximum Height (See also Ord ) a) Accessory buildings...12 feet b) Other buildings feet Height Relative to Site Boundaries No part of any building shall exceed a height equal to 10 feet plus the shortest horizontal distance from that part of the building to tlie nearest site boundary Front Yard a) Least dimension 15 feet. b) In the case of rear sites and special rear sites the 15 feet front yard shall not be allocated within the access strip, and the adjacent boundary shall be at least 40 feet in length Side Yard Rear Yard Least dimension feet. a) Least dimension 25 feet b) In the case of special rear sites the 25feet rear yard shall be adjacent to the boundary

In all cases accessory buildings must be at least 5 feet from the rear boundary. Accessory buildings may not be erected in a side yard Maximum Coverage Accessory buildings... 10%. All buildings including accessory buildings but excluding swimming pools...35% Outlook Court Where there are three or more household units on a site the main glazing to the living room of each household unit shall face on to and immediately adjoin, either a front yard or an outlook court which shall have at least dimensions of 35 feet in width and 20 feet in depth and a satisfactory and permanent screen fence on the adjacent boundary to provide privacy. 404 BULK AND LOCATION REQUIREMENTS FOR RESIDENTIAL B ZONES The following shall be the bulk and location requirements for Residential B Zones: Number of Buildings on Site Not more than one residential building shall be erected on any site in this Residential B Zone.

8 Maximum Height (see also Ordinance 205.1) a) Accessory buildings...12 feet b) Other buildings...30 feet Height Relative to Site Boundaries No part of any building shall exceed a height equal to 12 feet plus the shortest horizontal distance from that part of the building to the nearest site boundary with a minimum overall space under any circumstances of 10 feet Front Yard Least dimension...15 feet Side Yard Least dimension...10 feet except as varied by Ordinance Rear Yard Least dimension...25 feet Accessory Buildings Accessory buildings may be erected in a rear yard but if erected within or immediately below an outlook court required by Ordinance they must be located at least 20 feet from t±ie main glazing referred to therein and all access drives and sealed areas associated with the accessory buildings must also be at least 20 feet from that main glazing. In all cases accessory buildings must be at least 5 feet from the rear boundary. Accessory buildings may not be erected in a side yard Maximum Building Coverage Accessory buildings only...10%. All buildings including accessory buildings...40%, Density Control a) Maximum density habitable rooms per acre. b) Minimum room count. For the purpose of calculating the density of any apartment house each household unit shall be deemed to have at least three habitable rooms irrespective of its design.

9 Outlook Court Where there are three or more household units on a site the main glazing to the living room of each household unit shall face on to and immediately adjoin, either a front yard, rear yard or an outlook court which shall have least dimensions of 35 feet in width and 20 feet in depth and a satisfactory and permanent screen fence on the adjacent boundary to provide privacy. 405 BULK AND LOCATION REQUIREMENTS FOR COMMERCIAL A ZONES The following shall be the bulk and location requirements for all predominant uses in Commercial A Zones: Height Requirements (See also Ord ) a) Maximum Height...24 feet. b) Height Relative to Site Boundaries. Except on any boundary which adjoins another Commercial A site, no part of any building shall exceed a height equal to 10 feet plus the shortest horizontal distance from that part of the building to the nearest site boundary Front Yard Least dimension...15 feet. Provided that no front yard shall be required in respect of a frontage that has been set back by a dedication of at least 15 feet in order to provide for parking Side Yard Least dimension...15 feet on each side which adjoins a residential zone or 5 feet if rear access to the site is provided Rear Yard Least dimension...25 feet Maximum Building Coverage a) For buildings with residential accommodation...50%. b) For all other buildings... 60%.

10 Outdoor Living Space for Residential Accommodation Each household unit located in this zone shall have an outdoor area of not less than 1200 sq.ft with a least dimension of 15 feet. The area shall be contained in no more than two parts, reserved exclusively for and readily accessible to the household unit to which it relates Special Provisions: Screening of Yards, Storage and Service Areas Where any yard, outdoor storage area or service area to any shop or office is located in this zone and adjoins or is visible from any residential site or any public place, the Council may require such yard or storage or service area to be screened by the erection of walls or fences to the satisfaction of the Engineer Burning of Rubbish No rubbish shall be burned in this zone except in an appliance which, in the opinion of the Borough Engineer, will prevent the objectionable emission of smoke, smell, or other products of combustion, and which complies with the provisions of any relevant Act, Regulation or By-law Verandah Provision - refer Ordinance BULK AND LOCATION REQUIREMENTS FOR COMMERCIAL B ZONES The following shall be the bulk and location requirements for all predominant uses in Commercial B zones: Maximum Height feet (See also Ord ) Height Control Line Buildings shall conform to the 65 height control line requirement detailed in Appendix C-3.

11 Rear Yard Least dimension...25 feet required only where rear boundary adjoins a residentially zoned site Side Yard Least dimension...15 feet on each side which adjoins a residential zone, or 5 feet if rear access to the site is provided Maximum Building Coverage a) For buildings with no residential accommodation other than caretakers accommodation «/ aj ^ «b) For buildings containing residential accommodation other than caretakers accommodation % Verandah Provision (See Ordinance 401.5). 407 BULK AND LOCATION REQUIREMENTS FOR COMMERCIAL Bl ZONES The following shall be t±ie bulk and location requirements for all predominant uses in each of the specified Development Sites in Commercial Bl zones: Development Site No.l (Lot 1 DPS 14753) a) Maximum Height (see also Ord ) - 40 feet except that a maximum height of not more than 100 feet shall be permitted for a part of the building comprising not more than ten per cent of the total site coverage. b) Height Control Line - Buildings shall conform to the 65" height control line requirement detailed in Appendix C-3. c) Yard Requirements - No part of a building shall be erected closer than 25 feet to any boundary. d) Screening Requirements - where any bar, garden bar, dining room, lounge, bottle store or wholesale store has glazing facing onto a boundary other than a street boundairy and such glazing is within 50 feet of such

12 boundary the glazing shall be screened by a solid wall not less than six feet in height and constructed of concrete, brick, stone, or such other materials as are approved by the Borough Engineer. Every such wall so required shall be erected in a workmanlike manner to the satisfaction of the Borough Engineer. In addition a solid wall of the type described above shall be provided on the North Eastern boundary of the site adjoining Lot 3 DPS Where any outdoor storage area or service area adjoins or is visible from any residential site or any public place the Council may require such yard or storage or service area to be screened by the erection of walls or fences to the satisfaction of the Engineer. e) Landscaping - All parts of the site not occupied by buildings, vehicle manoeuvring areas, parking and loading areas shall be planted in grass, trees and shrubs to the satisfaction of the Borough Engineer and thereafter maintained in a manner that meets with his approval Development Site No. 2 (Lot 3 DPS 14753) a) Maximum Height 40 feet provided that a maximum height of 60 feet may be permitted for not more than 10 per cent of the total site coverage. Refer also to Clause Height Limitations For Airport Protection. b) Height Control Line Buildings shall conform to the 65 height control line reqiiireraent detailed in Appendix C-3. c) Yard Requirements No part of any building shall be located closer than 35 feet to any boundary of the site. d) Screening of Yards;, Storage and Service Areas Where any yard, outdoor storage area or service area located in this development site adjoins or is visible from any residential site or public place the Council may require such yard storage area or service area to be screened by the erection of walls or fences to the satisfaction of the Engineer.

13 e) Burning of Rubbish Rubbish shall not be burnt on this development site except in an appliance which, in the opinion of the Borough Engineer will prevent the objectionable emission of smoke, smell or other products of combustion and which complies with the provisions of any relevant act, regulation or bylaw. f) Comprehensive Development Plan All development on this site must be carried out in accordance with a comprehensive plan of development for the whole area of the site. Such a plan shall be designed to provide a high standard of customer comfort and convenience and shall provide for the segregation of vehicular traffic from the principal pedestrian areas. Provision for off-street parking of vehicles shall be in accordance with Part 6 of the Code of Ordinances. g) Paving and Weatherproofing of Pedestrian Areas Pedestrian areas within a distance of 12 feet from the frontage of all main display windows and main entrances to retail premises shall be paved to provide an obstruction free, nonskid permanent surface; shall be provided with weatherproof roofing designed in such a way as will in normal weather conditions exclude rain from the pavements; and shall be sloped sufficiently to provide adequate surface drainage of stormwater to suitable outlets to the satisfaction of the Borough Engineer. h) Other Public Amenities A sum equal to not less than one percent of the tender sum for the construction of buildings in each stage of the development shall be allocated to the provision of public amenities such as children's play areas, rest rooms, fountains, pools, art and statuary, seating, or such other items as the developer may consider appropriate and as approved by the Council.

14 BULK AND LOCATION REQUIREMENTS FOR COMMERCIAL H ZONES The following shall be the bulk and location requirements for all predominant uses in the Commercial H Zones: Maximum Height 24 feet (see Ord ) Height Control Line Buildings shall conform to 65 Height Control line requirement detailed in Appendix C Height relative to site boundaries No part of any building shall exceed a height equal to 10 feet plus the shortest horizontal distance from that part of the building to the nearest site boundary, which adjoins residentially zoned land Front Yard Least dimension 15 feet. Provided that no front yard shall be required in respect of a frontage which has been set back by a dedication of at least 15 feet in order to provide for parking Side Yard Least dimension 15 feet on each side which adjoins a residentially zoned site but otherwise 12 feet on one side if no other rear access is provided Accessory Buildings Accessory buildings may be erected in any rear yard (but not closer than 5 feet to a rear boundary) provided that not more than one fifth of such yard is covered by buildings Minimum of Open Space Where residential accommodation is provided within a building also used for a predominant use, an outdoor area of not less than 900 sq.ft. with a least dimension of 15ft is required for each household unit. This area shall be directly accessible only to the household unit to which it relates. Such area shall be bounded by fences or walls to maintain privacy; the design, materials and methods of construction employed shall be to the satisfaction of the Borough Engineer and shall ensure reasonable permanence of the structure.

15 Underground Wiring Requirements Where a building is constructed substantially reconstructed, altered or added to or where there is a change in the use of any building that requires the consent of the Council, then provision shall be made for the connection of the buildings electrical wiring system to the electrical power supply street main, and the connection of the buildings telephone wiring system to the street telephone reticulation system, to be made underground Verandah Provision See Ordinance BULK AND LOCATION REQUIREMENTS FOR INDUSTRIAL A ZONES The following shall be the bulk and location requirements for predominant uses in Industrial A zones: Maximum Height feet (see Ordinance 205.1) Height Control Line Buildings shall conform to the 650 height control line requirements detailed in Appendix C Front Yard Least dimension feet Side Yard Least dimension feet along each side boundary which adjoins a residentially zoned site but otherwise at least one side yard with a minimum width of 12 feet Rear Yard Least dimension feet Maximum Building Coverage... 75% Special Conditions Refer to ordinance for speciai "conditions relating to maintenance of yards, boundaries, and similar matters. 410 BULK AND LOCATION REQUIREMENTS FOR INDUSTRIAL B ZONES The following shall be the bulk and location requirements for predominant uses in Industrial B zones: Maximum Height feet. Refer to ordinance for special conditions relating to maintenance of yards, boundaries, and similar matters. 411 BULK AND LOCATION REQUIREMENTS FOR INDUSTRIAL Bl ZONES The following shall be the bulk and location requirements for predominant uses in Industrial Bl zones: Maximum Height feet. (See also Ord ) Height Control Line Buildings shall conform to the 65 height control line requirements detailed in Appendix C Maximum Building Coverage % coverage is permitted withm the areas defined by building lines on the plan in Appendix S-2 to the Scheme Statement Other Requirements Refer to Section 7 of the Scheme Statement. 412 BULK AND LOCATION REQUIREMENTS FOR INDUSTRIAL C ZONES ' The following shall be the bulk and location requirements for predominant uses in Industrial C zones Maxim.um Height feet. (See also Ord ) Height Control Line Buildings shall conform to the 65 height control line requirements detailed in Appendix C-3.

Maximum Building Coverage feet on one. 25 feet. 75% Special Conditions Refer to ordinance for special conditions relating to maintenance of yards, boundaries, and similar matters. 413 BULK AND LOCATION REQUIREMENTS FOR INDUSTRIAL D ZONES The following shall be the bulk and location requirements for predominant uses in the Industrial D zones. Maximum Height 110 feet. (See Ord also) Height Control Line Buildings shall conform to the 65 height control line requirements detailed in Appendix C Front Yard Side Yard Rear Yard Least dimension feet. Least dimension feet on one side. Least dimension feet Maximum Building Coverage... 75% Special Conditions Refer to ordinance for speciai conditions relating to maintenance of yards, boundaries, and similar matters.

18 PART 5 - SUBDIVISION REQUIREMENTS, 501 GENERAL This ordinance specifies the requirements which are imposed by the scheme on the subdivision of land within each zone Existing Buildings Where any building is situated on the land proposed to be subdivided the Cotmcil may refuse its consent to such subdivision if t:he open spaces around such buildings and within the new site will, in the opinion of the Council, be inadequate having regard to the use of the building and of the new site and of standards of open space most appropriate to such use Design of Subdivision Subject to other provisions of this ordinance every subdivision of land shall be so designed as to: (a) (b) (c) (d) Provide sites that will permit the erection of buildings for a predominauit use in accordance with the bulk and location requirements of this zone. To provide an orderly and simple arrangement of boundaries to facilitate fencing, and the location of boimdary marks. To provide space in appropriate locations for outdoor activities which are normally association with the particular predominantuse. (e.g. gardening and recreation space on residential sites, uncovered parking areas and so on). Subject to a right of appeal to the Town & Country Planning Appeal Board by the owner of any land affected the subdividing owner shall make financial contribution for tmderground reticulation of all electric power lines and telephone services except in any particular subdivision or part thereof where, to request underground reticulation would be unreasonable.

19 SUBDIVISIONS IN RURAL ZONES The following shall be the subdivision requirements in Rural zones: Minimum area of site acres Minimum frontage of site feet. 503 SUBDIVISIONS IN RESIDENTIAL A AND B ZONES The following shall be the subdivision requirements in Residential A and B zones: Front Sites (a) Minimum frontage feet (b) Minimum depth 70 feet (c) Minimum area 30 perehes Provided that where sewerage reticulation is installed the minimum site area may be reduced to not less than 24 perches for any site, # subject however to the limitations set out in ordinance Front sites of irregular shape In a residential zone for a front site for a dwelling, being a site with side botmdaries diverging from the street, the frontage may be reduced to 30 feet if the width of the site at a distance of 30 feet from the street boundary is not less than prescribed for a frontage in Ordinance (a) Shape factor and measurement of area Each front site shall be capable of containing a rectangle measuring 45 feet by 40 feet and located to be: (i) (ii) (iii) (iv) at least 15 feet and not more than 30 feet from the street frontage at least 10 feet from, one side boundary and at least 5 feet from the opposite side boundary at least 25 feet from the rear boundary for the purposes of this ordinance in calculating the area of the site no account shall be taken of any part of the site which has a width of less than 40 feet as described and located above

20 The minimtam area of a front site shall be reducible in the case of any particular lot by not more than six perches provided that the average of all front sites in that stibdivision is not less than 30 perches or 27 perches where sewerage reticulation is installed Corner Sites (a) (b) (c) td) Minimum total frontage feet Minimtam depth feet Minimum area perches or 27 perches if sewerage reticulation is installed Shape factor and measurement of area: Each corner site shall be capable of containing a rectangle measuring 45 feet by 40 feet and located to be: (i) (ii) at least 15 feet from both street frontages. at least 5 feet from one side boimdary and at least 10 feet from the adjoining side boundary Rear Sites (iii) for the purpose of this ordinance, in calculating the area of the site no account shall be taken of any part of the site which has a width of less than 40 feet as described and located above. (a) (b) Minimum frontage feet Minimum net area 40 perches Special Rear Sites Provided that: where sewerage reticulation is installed the minimum site area may be reduced to not less than 32 perches for any site. (a) (b) Minimum frontage feet Minimum net area 32 perches Rear Sites Includinq Special Rear Sites (a) Other requirements. The minimum width of the entrance strips shall be 10 feet. The maximum length shall be 198 feet. Provided that the width of an entrance strip may be reduced to 5 ft subject to the following conditions - (i) An easement or easements shall be granted or reserved over land adjoining the entrance, such easement or easements being a condition of the Council' s consent to t:he subdivision.

21 (ii) The frontage of the entrance strip of the rear site, together with the frontage of the land over which appurtenant easement or easements are required pursuant to subclause (i) above shall in aggregate be not less than 10 feet. (iii)the width of the entrance strip of the rear site together with the width of the land over which appurtenant easement or easements are required, pursuant to subclause (i) above; shall in aggregate be not less than 10 feet. (b) Shape factor and measurement of area; each rear site shall be capable of containing a rectangle measuring 45 feet by 40 feet located at least 25 feet from one rear boundary and at least 15 feet from any other rear boundary and at least 10 feet from all boundaries. Provided that the boundaries from which the rectangle is located 25 feet and 15 feet distant shall each be no less than 40 feet in length and Provided further that in the case of special rear sites the rectangle shall be located 2 5 feet from the boundary adjoining the major reserve. For the purpose of this ordinance in calculating the area of the site no account shall be taken of any part of the site which is less than 40 feet in width measured in a direction parallel to the largest side of the rectangle as described and located above. 504 SUBDIVISIONS IN COMMERCIAL A & B ZONES The following shall be the subdivision requirements in Corronercial A & B zones: Every subdivision of land in Commercial A & B zones shall comply with the following requirements. Minimum area... 9 perches Minimum frontage feet Minimum depth feet Provided that where the street frontage has been set back by dedication in order to provide for parking the Council may permit a reduction in the depth of that site. Such a reduction miay not exceed 20 feet or the depth of the street widening whichever is the lesser.

22 SUBDIVISIONS IN COMMERCIAL Bl ZONES The following shall be the subdivision requirements on each of the specified Development Sites in the Commercial Bl zone Development Site No. 1 (Lot 1 DPS 14753) Subdivision of this site will not be permitted Development Site No. 2 (Lot 3 DPS 14753). Subdivision of this site will be a conditional use. 506 SUBDIVISIONS IN INDUSTRIAL A AND B ZONES The following shall be the subdivision requirements in Industrial A and B zones: Minimum site area perches Minimum frontage feet Minimum depth feet 507 SUBDIVISIONS IN INDUSTRIAL C&D ZONES The following shall be the subdivision requirements for Industrial C and D zones: Average and minimum frontage and area. The average of the area of all lots in the subdivision for which approval is sought shall not be less than 80 perches and the minim.um area of any individual lot shall not be less than 40 perches. The average of the frontage of all lots in the subdivision for which approval is sought shall not be less than 100 feet and the minimum frontage of any individual lot shall not be less than 60 feet. 508 SUBDIVISIONS IN INDUSTRIAL Bl ZONES The following shall be the subdivision requirements in Industrial Bl zones Minimum> frontage feet. Minimum site area...40 perches.

23 PART 6 - PARKING AND LOADING REQUIREMENTS 6 01 PROVISION AND FORMATION OF PARKING AND LOADING SPACES Where a building is constructed, substantially reconstructed altered or added to, or where there is a change in t±ie use of any land or building that requires the consent of the Council: Provision shall be made for vehicles used in conjunction with that site (whether by occupiers, their employees or invitees or other persons) to stand on that site but not on a street or service lane, (a) while such vehicles are awaiting use, and (b) where the site is used or intended to be used for the manufacture, servicing, storage or sale of any goods, materials or substance, while such vehicles are in the course of being loaded or unloaded Availability of motor vehicle facilities: All parking and loading spaces, manoeuvring areas, access drives and aisles must be kept clear at all times for the use of motor vehicles and must not be used for the storage of goods, articles, materials or substance or for any other purposes Formation of parking and loading spaces: Except m the case of parking spaces required for detached dwelling houses, the whole of the parking and loading space or spaces, access drives and aisles shall, before the commencement of the use to which those loading and parking spaces relate, and thereafter for as long as that same use is continued, be formed, surfaced and maintained so as to be available for use in all weathers Design of Parking Layout Size of parking spaces; Every parking space shall be of usable shape and shall have a width of not less than 8 ft. and an area of not less than 144 sq.ft, exclusive of access drives, manoeuvring areas and aisles.

24 Parking in Yards: No part of a parking space shall be located within a front yard provided that - (a) Parking may be permitted in front yards in Commercial or Industrial zones where such yards are landscaped to the satisfaction of the Borough Engineer. (b) Where parking space is located within or immediately below an outlook court required by Ordinance it must be located at least 20 ft. from the main glazing referred to therein and all access drives and sealed areas associated with the parking space or spaces must also be at least 20ft. from that main glazing. (c) Nothing in this Ordinance shall apply to a residential property containing not more than two household units Reverse manoeuvring: Where three or more parking spaces are required, sufficient space shall be provided on the site so that no reverse manoeuvre onto or off the street is needed. Provided that an alternative arrangement may be approved by Council, where vehicular access to any such parking spaces is obtained from a service lane or from a minor street if, in its opinion, t±ie safety and flow of vehicular and pedestrian traffic would not be adversely affected by the backing of vehicles to or from that street or service lane Vehicular crossings over footpaths; Where suitable and adequate vehicular access to a site from a street is possible by means of the use of a service lane, or land over which rights-of-way are held in respect of that site, such means of access shall be used for any parking spaces in preference to any new vehicular crossing over any footpath. In all other cases vehicular crossings over footpaths which may provide access to any parking space to or from a street shall comply with the following conditions: a) Not more than two crossings will be permitted in respect of any front or corner site which has a total street frontage of 200 ft. or less. Where a site has a separate street frontage to two or more streets, the crossings shall be placed as directed by the Borough Engineer.

25 b) Not more than three crossings will be permitted in respect of any front or corner site which has a total street frontage greater than 200 ft. Where a site has separate street frontage to two or more streets, the crossings shall be placed as directed by the Borough Engineer. c) In respect of each rear site one crossing will be permitted for each separate street frontage of 20ft. or more (including frontage of land subject to registered appurtenant easements by way of rights-of-way.) d) The maximum width of any crossing at the street frontage boundary shall be 20 ft. e) Notwithstanding anything to the contrary in the foregoing clauses the total crossing width for any front or corner site shall not exceed 50% of the frontage to the street on which it is placed. f) In the case of any property having street frontage or access onto Maunganui Road, Girven Road, The Mall, or Marine Parade, crossings shall be located as directed by the Borough Engineer Access to parking spaces: Parking spaces and associated access areas must be so designed as to ensure that vehicles using them have free access to a street at all times without the necessity for moving any motor vehicle occupying any other parking or loading space provided that this requirement shall not apply to a site containing not more than two household units. All access drives and aisles necessary for the manoeuvring of vehicles within the site shall be designed in accordance with the recommendations contained in the Ministry of Transport publication, "Ministry of Transport Traffic Engineering Data Book" Section 11/1. No access drive shall be constructed in any outlook court required by ordinance Screening of spaces: Where five or more parking spaces are provided on a site which adjoins or faces any residentially or recreationally zoned site, the Council m.ay require such space or spaces to be screened from the adjoining properties by a solid wall not less than 6 ft. in height which is constructed of concrete, brick, stone or such other materials as are approved by the Borough Engineer. Every wall so required shall be erected in a workmanlike manner and to the satisfaction of the Borough Engineer.

26 Landscaping of Parking Areas: On every site where more than 40 off-street parking spaces are required to be provided a landscaping plan of the parking area shall be provided by the applicant. The purpose of landscaping shall be the reduction of the visual dominance of the large area of parked vehicles and of large sealed areas, and this shall be accomplished wherever possible by depressing the finished levels of the parking areas up to three feet below the finished level of adjoining pedestrian areas, and by dividing the areas of parking into groups of not more than 20 spaces each such group being surrounded on three sides by a raised planting bed at least 3 feet in width and planted with trees and shrubs to the satisfaction of the Borough Engineer Assessment of Parking Spaces Required Assessment of floor area: The area of any parking space or spaces and of access drives and aisles provided within a building shall be excluded from the assessment of gross floor area of that building for the purpose of ascertaining the total number of spaces required Number of parking spaces required: (a) Subject to sub-clause (b) hereof the number of parking spaces to be provided in respect of any particular site shall be as follows, provided that where the front yard of any site has been dedicated as street to provide parking, in accordance with the requirements of ordinances and the number of required parking spaces shall be decreased by an amount equal to the parking provided by the dedication of the front yard. Dwelling houses Apartment houses Two parking spaces for each dwelling. One parking space for each dwelling unit plus one parking space for each two dwelling units. Boarding houses. One parking space for every Lodging houses and five persons whom the building similar residential is designed to accommodate, institutions

(b) Nothing in this ordinance shall limit the power of the Council to impose conditions as to the provision of parking spaces in respect of conditional uses.

28 Fractional spaces: When the assessment of the number of parking spaces required in respect of the use of any building results in a fractional space being involved, any fraction under one half shall be disregarded and fractions of one half or more shall be counted as one parking space Design of Loading Layout Size of loading spaces: Every loading space shall be of usable shape and shall be not less than 25 ft. in depth. No loading space shall be less than 10 ft. in width Access to loading spaces: Every loading space shall have adequate physical access to the street and the building or land which it is intended to serve. Every loading space shall be provided with such access drives and aisles as are necessary, in the opinion of the council, for the ingress and egress of motor vehicles using such spaces from and to the street and for the manoeuvring of motor vehicles within the site Assessment of Loading Spaces Required Nuinber of loading spaces required: The number of loading spaces required shall be such as the Borough Engineer considers to be reasonable and practicable in all the circumstances of the case. Provided that the owner or occupier of any property claiming to be injuriously affected by any requirement under the foregoing clause may within 21 days of the receipt of such requirement give notice in writing that he requires the decision to be reviewed by the Council. The Council shall thereupon hear the complainant and it shall hear such other evidence as it considers may be necessary to determine the matter at issue. The Council may delegate its powers under this clause to a committee and the decision of the Council or its Committee as the case may be, shall be final Service Lanes: Except where the Council, by resolution determines th.at this provision need not apply, every owner or occupier of a building in a commercial or industrial zone shall provide adequate vehicular access to the rear of the premises, either over his own land, or by the dedication of a service lane or otherwise. Where land for a dedicated service or accessway is provided at the rear or at the side of the site, the rear yard requirements or the side yard requirements as the case may be shall be diminished accordingly.

29 PART 7 - THE CONTROL OF SIGNS AND ADVERTISING. 701 RESTRICTIONS AS TO SIGNS No sign shall be erected or displayed in any rural or residential zone except: (a) (b) (c) (d) (e) (f) Traffic signs erected by or with the permission of the Council, including signs directing travellers to accommodation facilities, signs denoting the name of the street, number of the premises or the location or time-table or other details of any public utility or facility. A sign not exceeding 12 sq.ft. in area erected for any public purposes or in connection with any of the following uses: (i) recreation grounds (ii) Churches and buildings used for religious purposes (iii) community buildings (iv) educational institutions (v) private hospitals A sign not exceeding 6 sq.ft. in area bearing the name of the residential building. A temporary sign for electioneering or other purposes, provided that such sign shall not be erected without consent of the Council and shall be subject to such conditions as the Council shall impose, A sign not exceeding 2 sq.ft. in area bearing the name, qualifications and hours of attendance of a Chartered Accountant, Registered Architect, Barrister and Solicitor, Registered Engineer, Registered Medical Practitioner, Dentist, Registered Valuer or Vetinary Surgeon. A sign not exceeding 12 sq.ft, in area advertising travellers accommodation.

30 (g) A sign not exceeding 12 sq.ft. in area advertising the intention to sell the land or premises on which it is placed provided that the sign shall not be displayed for more than 12 mont^hs in all without the prior consent of the Council. (h) A sign not exceeding 12 sq.ft. in area may be erected for and during the period 20th December to 31st January of the following year provided that the Cotmcil is satisfied that such sign is primarily intended to inform visitors of holiday entertainment fixtures and provided the Council is satisfied that the sign will be removed at the expiration of this period. 702 POWER TO PROHIBIT SIGNS AFFECTING TRAFFIC SAFETY Notwithstanding that a sign may comply with the above requirements, if at any time the Council, having regard to considerations of traffic safety or the requirements of traffic control, is of the opinion that the erection, construction or display of the sign ought not be permitted, the Coimcil may by resolution, prohitib the erection, construction or display of any such sign and may, in a like manner, require the removal of any existing sign. 703 POWER TO PROHIBIT SIGNS AFFECTING AMENITIES Notwithstanding that a sign may comply with the above requiremtents, if at any time the Council is of the opinion that the erection, construction or display of the sign will detrimentally affect the amenities of any land or will tend to depreciate the value of the adjoining property or will be visually inappropriate to the neighbourhood, the council miay, by resolution, prohibit the erection, construction or display of the sign and may, in a like manner, require the removal of any existing sign.

31 ORDINANCE SUPPLEMENTARY TO BY-IAW 704,1 Without limiting the generality of the application of any by-law, it is expressly declared that this ordinance is supplementcury to, and not in substitution for, the by-laws relating to the control and licensing of signs and advertising.

32 PART 8- APPLICATIONS FOR PLANNING APPROVAL. 801 APPLICATION FOR A PREDOMINANT USE 801,1 All applications for approval to a predominant use shall be accompanied by the following plans and information, Where the work concemed is a proposed use of land, a) a legal description of the property concemed, including its street number; b) a site plan of the property (accurately drawn to a scale of not les than one-sixteenth inch to a foot showing the boundaries of the site, the site area, the location of the proposed use and the location-rgnd use o all buildings on the site, including accessory buildings; c) a plan (accurately drawn to a scale of not less than one-sixteenth inch to a foot) showing the position and dimensions of every required parking and loading space and the proposed access and manoeuvring areas, including the location of footpath crossings necessary to serve such spaces. Provided that, where it is possible to do so without unduly reducing the clarity of the plans, -the parking plan may form part of the site plan, Where the work concemed includes the construction of a proposed building, or a reconstruction, alteration or addition to an existing building, or a proposed use of an existing building; a) a legal description of the property concemed, including its street number; b) a site plan of the property (accurately drawn to a scale of not less than one-sixteenth inch to a foot) showing boimdaries, site area, the location (or proposed location) of the building or proposed building for which Town Planning approval is requested and the location and use of all other existing buildings and accessory buildings, or proposed buildings and accessory buildings for which Town Planning approval has been granted, c) a plan of each floor of the building or proposed building for which Town Planning approval has been granted, accurately drawn to a scale of not less than one-eighth inch to a foot, with the use to which each part is to be put, clearly noted thereon;

33 d) sufficient elevations of the building or proposed building, accurately drawn to a scale of not less than one-eighth inch to a foot, so as to show clearly the external appearance of the building, its fenestration, number of floors and height relative to ground level; e) a plan (accurately drawn to a scale of not less than one-sixteenth inch to a foot) showing the position of every required parking and loading space and the proposed access and manoeuvring areas, including the location of footpath crossings necessary to serve such spaces. Provided that, where it is possible to do so without unduly reducing the clarity of the plans, the parking plan may form part of the site plan. 802 SPECIAL PROCEDURE FOR APPLICATIONS FOR SIGNS AND FOR REQUIREMENTS FOR THE REMOVAL OF EXISTING SIGNS The procedure referred to in this ordinance shall be followed in cases where the Council; a) refuses permission for the erection, construction of display of a sign, or b) gives its consent to the erection, construction or display of a sign on terms unacceptable to the applicants, or c) prohibits the display or requires the removal of an existing sign upon the grounds that the sign would or (in the case of an existing sign) does, in its opinion, conflict with the requirements of the ordinances relating to traffic safety and amenities In any of such cases the applicant or the owner of an existing sign shall, on having been informed in writing of such decision and of the reasons therefor, have the right to refer the decision to the Council or to a committee thereof constituted for tihe purpose and to state a case seeking a reversal or alteration of that decision.

34 APPLICATION FOR A CONDITIONAL USE Plans required: All applications for approval to a conditional use shall be accompanied by such plans and information as are required for applications for a predominant use under ordinance Procedure for applications; The procedure for dealing witji applications shall be as laid down by the Act and Regulations. (Refer particularly to Section 28c and Regulation 32 of the Act and Regulations). 804 APPLICATION FOR A USE NOT EXPRESSLY PROVIDED FOR All applications for the Council's determination of any use that is not expressly provided for by this Code in any of the zones herein, shall be accompanied by a full and accurate description of the proposed use. 805 APPLICATION WITH RESPECT TO DESIGNATED LAND Note This ordinance should be read in conjunction with ordinance 201 hereof and Section 33A of the Act Application in respect of land designated for an existing public work Where it is proposed to erect a building or reconstruct, alter or add to any existing building or to change the use of any land or building where such land or the site of such building is designated for an existing Public Work and where such work or use is for a purpose other than that for which the land is designated, the following shall apply; a) Where the erection, reconstruction, alteration or addition or change of use is a predominant use in the zone in which the land is situated, the provisions of ordinance 801 shall apply, b) Where the erection, reconstruction, alteration or addition or change of use is a conditional use in the zone in which the land is situated, the provisions of ordinance 803 shall apply. c) Where the erection, reconstruction, alteration or addition or change of use is not expressly provided for by tjiis Code in any zone herein, the provisions of ordinance 804 shall apply.

35 - Ill Application in respect of land designated for a proposed public work. Where it is proposed to erect a building or reconstruct, alter or add to any existing building, or to change the use of any land or building, or to subdivide any land, where such land is designated for a proposed Public Work and where the Council is satisfied that such erection, reconstruction, alteration or addition or change of use or subdivision has been consented to by the Minister, local authority or Council having financial responsibility for the proposed Public Work, the following shall apply: a) Where the erection, reconstruction, alteration or addition or change of use is a predominant use in the zone in which the land is situated, the provisions of ordinance 801 shall apply. b) Where the erection, reconstruction, alteration or addition or change of use is a conditional use in the zone in which the land is situated, the provisions or ordinance 803 shall apply. c) Where the erection, reconstruction, alteration or addition or change of use is not expressly provided for by this Code in any zone herein, the provisions of ordinance 804 shall apply. d) Where it is proposed to subdivide the land the provisions of ordinance 806 shall apply Application in respect of land designated for any purpose other than a public work Where it is proposed to erect a building or reconstruct, alter or add to any existing building on any land designated for any purpose other than a Public Work, and where such erection, reconstruction, alteration or addition is consistent with the designated purpose, the Council shall determine whether such erection, reconstruction, alteration or addition shall be deemed to be a predominant or a conditional use and if predominant what bulk and location requiremients shall apply. Where such work is deemed to be a conditional use the provisions of ordinance 803 shall apply Where it is proposed to erect a building or reconstruct, alter or add to an existing building or change the use of any land or building or subdivide any land, where such land or the site of any such building is designated for a purpose other than a Public Work and where such erection, reconstruction, alteration or addition, or use, or subdivision is inconsistent with the designated purpose, the following shall apply:

36 112 - (a) (b) (c) Where the erection, reconstruction, alteration or addition or use or subdivision is permitted as a predominant use within the zone in which the land is situated, the Council shall determine whether such work or use or subdivision shall be a predominant use and if predominant what bulk and location requirements shall apply. Where such work or use or subdivision is deemed to be a conditional use, the provisions of ordinance 803 shall apply. Where the work or use is a conditional use in the zone in which the land is situated, the provisions of ordinance 803 shall apply. Where the work or use is not expressly provided for by this Code in any zone herein, the provisions of ordinance 804 shall apply. 806 APPLICATION FOR A SUBDIVISION Plans and information All applications for a subdivision shall be in terms of Section 351 of the Municipal Corporations Act 1954 and its amendments and Section 33 (4) of the Town & Country Planning Act 1953.

37 PART 9 - MODIFICATION AND WAIVER PROCEDURES 901 MODIFICATIONS AND WAIVERS Modification or waiver of subdivision requirements Notwithstanding anything to the contrary contained in the subdivision ordinances of this Code, the Council may consent to a subdivision which does not comply with those ordinances if: (a) (b) (c) such subdivision is an adjustment of boundaries and the consent to the subdivision is made subject to the provisions of Sub-section 351A(1)(e) of the Municipal Corporations Act 1954 (requiring the issue of one Certificate of Title) or Section 351D(2) of the Municipal Corporations Act 1954 (requiring the execution of an agreement where one Certificate of Title cannot be issued). such subdivision is a disposal of land for t:he purposes of a public work within the meaning of the Public Works Act where the Council is satisfied that; (i) (ii) (iii) it is not reasonable or practicable to enforce those requirements in respect of that site; and the modification or dispensation will not detract in any substantial way from the amenities of adjoining properties or the neighbourhood generally, and in the case of a front site in a residential zone the modification will not result in a reduction exceeding that allowed under Ordinance or of more than 10 percent in the case of any other site in the requirements for minimum area (with a minimum of 24 perches in respect of any residential site), or depth or in either length or width (but not both) of the shape factor rectangle or a reduction of more than 10 feet in the frontage of any front site.

38 (d) Such subdivision is a re-subdivision of a residential lot existing at September 21, 1971 and the Council is satisfied the modification or dispensation will not result in a reduction of the area of any front site to less than 24 perches and the net area of any rear site to less than 32 perches and the reduction of more than 10 feet in the frontage of any front site. 901,2 Modification or waiver of bulk and location requirements The Council may, in the case of any particular site, either absolutely or conditionally modify or dispense with any one or more of the bulk and location requirements prescribed in these ordinances if it is satisfied that: (a) (b) (c) it is not reasonable or practicable to enforce those requirements in respect of that site; and the modification or dispensation will not detract in any substantial way from the amenities of adjoining properties or the neighbourhood generally; and the modification or dispensation will be within the limits listed hereunder. (i) Rural Zones Reduction in depth of front,side or rear yard of not more than 10 ft. Increase in height of not more than 5 ft. (ii) Residential A and B zones Increase in maxim.um height of not more than 5 feet. Increase in height relative to site boundaries of not more than 5 feet. Reduction in depth of front or side yard of nil. Reduction in depth of rear yard of not more than 5 feet. Increase in maximum coverage of nil.

39 Increase in maximum density of not more than 4 habitable rooms per acre. Increase in number of buildings per site of nil. (iii)commercial A Zones and Commercial H Zones Increase in maximum height of not more than 5 feet. Increase in angle of height control line of nil. Increase in height relative to site boundaries of not more than 5 feet. Reduction in depth of side yard of nil. Reduction in depth of rear yard of not more than 5 feet. Increase in maximum coverage of not more than 5 percent. Decrease in Outdoor living space of not more than 200 sq.ft. (iv) Commercial B Zones Increase in maximum height of not more than 2 0 feet. Increase in angle of height control lines of nil. (v) Decrease in depth of rear or side yard of nil. Increase in maximum coverage of not more than 5 percent. Industrial Zones Increase in maximum height of not more than 5 feet. Increase in angle of height control line of nil. Decrease in depth of front, side or rear yard of nil. Increase in maximum coverage of not more than 5 percent.

40 Without in any way limiting its powers as aforesaid, the Council may, in its discretion, treat any application to proceed under this ordinance as an application for a conditional use and in such circumstances the provisions of ordinance 803 shall be applied accordingly Modification or waiver of parking and loading requirements The Council may either unconditionally or subject to such terms and conditions as it thinks fit, reduce by not more than 10%, the number of offstreet parking spaces required by the provisions of the parking and loading requirements contained in this Code, where it is satisfied that; (a) (b) it is not reasonable or practicable to enforce those requirements in respect of that site; and the modification or dispensation will not detract in any substantial way from the amenities of adjoining properties or the neighbourhood generally Modifications or waiver of sign requirements The Council may either unconditionally or subject to such terms and conditions as it thinks fit, modify the provisions of any of the requirements relating to the size of signs contained in ordinances of the Code, by allowing an increase in total area of the sign of not more than 10 percent where it is satisfied that (a) (b) it is not reasonable or practicable to enforce those requirements in respect of that site; and the modification or dispensation will not detract in any substantial way from the amenities of adjoining properties or the neighbourhood generally. 902 SPECIFIED DEPARTURES Information concerning Specifier Departures from the District Scheme, inducing the procedure to be followed, is contained in the Act and Regulations. 903 SCHEME CHANGES Information concerning changes to The District Scheme is contained in the Act and Regulations.

46 APPENDIX C-3 CONTROL OF HEIGHT IN COMMERCIAL AND INDUSTRIAL ZONES. Height Control Line. In any commercial or industrial zone (other than a commercial A zone) the height of every building (including its parapet, cornice, roof ridge or other solid element, or other, structure or part thereof), shall be restricted so that every part thereof shall be contained within the height control line as herein defined. "Height-control line", in relation to a site, means a line directed over the site from the originating points herein-after prescribed at an angle of 65 from the horizontal. The direction of each heightcontrol line shall be at right angles to the boundary of the site. Points of Origin of Height-Control Line. (a) (b) (c) Street - In relation to any street boundary of a site the originating points shall be on the middle line of the street at street level, except that in the case of a corner site where the streets are of different widths, the middle line of the narrower street for a distance of 100ft from the corner or its whole length whichever is the less, shall be deemed to lie at the same distance from the site as the middle line of the wider street. Rear - In relation to the rear of any site the originating points shall be on the rear boundary at ground level, except that if a service lane adjoins the rear boundary of the site originating points shall be on the middle line of the service lane at ground level. Extra wide streets - For the purpose of this ordinance any street wider than 100ft shall be deemed to be 100ft wide.

47 Exclusions from Measurements In determining whether any building or structure or part thereof is contained within the height-control line the following shall not be taken into account: (a) (b) (c) (d) Lift wells, elevator and stair bulkheads, roof water-tanks and cooling towers (together with their enclosures). Provided that the maximum dimension thereof parallel to the middle line of the street shall not exceed 30ft. Chimneys and flues. Provided that the maximum dimension thereof parallel to the street shall not exceed an aggregate of 15ft for any 100ft of frontage. Spires, flagpoles, aerials and wire, chain, link or other open or transparent fences and such finials and similar parts as constitute only decorative features. A one-storey structure located in a rear yard when permitted by the ordinance for the zone, including any of the following: (i) A basement or first floor used for accessory off-street parking spaces. (ii) A ground floor used for retail or commercial purposes. (iii)a one-storey detached accessory building. (e) A wall of reasonable dimensions along a boundary of a site.
