2 COMMUNITY POLICIES These guidelines have been set forth to expand and detail the information found in the Condominium Declaration, Master Deed, and Bylaws under which the Villas of Stonehenge Condominium Association, (VOSCA), operates. All residents are asked to support these policies in order that the community be a more attractive and harmonious place to live. I. Personal property a. Owners may maintain the interior of their patio area as desired. All personal property, such as lawn chairs, bicycles, tables, etc. must be kept inside the patio or porch area or the garage, and must not be visible above the patio fence, with the exception of patio table umbrellas, one (1) double shepherd s hook, outdoor grills and chairs. b. Satellite dishes are NOT to be affixed to buildings, fences, roofs, and MUST stay below the fence line within the patio area. Satellite dishes and their location must be approved by the VOSCA Board of Directors prior to installation. The VOSCA Satellite Dish Request Form (C-1) is located in Section XXIII Supporting Documents and Forms, of this document, online at and also at the management website. c. No signs, awnings, canopies, shutters, antennae or any other device or ornament may be affixed to or placed upon the exterior walls, doors, EXTERIOR fences, or roof without prior written approval of the VOSCA Board of Directors. II. Decorative Items a. A wreath may be hung on the outside door or storm door year around. b. Any decorative items such as birdbaths, wreaths, lighting, signs, etc. are allowed within the patio areas only, and should not be visible above the fence. c. The display of real pumpkins in mulched areas around units, and patio fences, are allowed from October 15 th until November 30 th. d. Christmas decorations must not be displayed before Thanksgiving Day. Yard or patio ornaments must not be displayed outside of the patio fence (blow-up, animated lighting, lit animals, etc.). Any decorations within the patio areas should not be visible above the fence. White or colored lights may be used. No running lights, blinking lights, or icicle lights may be used. No lights on bushes, shrubs, doors or windows. Evergreen roping, (artificial or natural) with or without lights must be draped on patio fences. Red bows, and fence wreaths are permitted. All holiday decorations must be taken down on or before January 15 th of the New Year. III. Flags The American Flag may be flown or displayed at any time following normal flag protocol and the Michigan Condominium Act, Effective December 27,

3 IV. Flowers/Landscape Plants a. Planting of annuals and perennials around buildings is permitted. This would include areas inside the sidewalks, (between building and sidewalk), in front of fences, but not around the air conditioning units or trees. The exterior area of the patio fences can be planted with annuals and perennials. Owners are expected to remove annual flowers by October 31 st of each year. All units, outside the patio area, will be weeded twice a year and pruned once a year by the Association. b. The Association mulches as needed. If new mulch is needed in between only double shredded hardwood bark mulch must be used. c. A potted plant up to twenty (20) inches in diameter may be placed on the outside of the corner of the walkway. A potted plant up to twenty (20) inches in diameter may be placed at the corner of the garage that meets the condominium. These pots must be removed on or before November 30 th. d. All patio interior areas must be maintained by the owner. If the area, which includes hanging baskets or pots, becomes neglected with weeds and/or debris, a ten (10) day notice will be sent. Failure to comply will result in the Association taking care of it at the owner s expense. e. Unit Owners who choose to expand the planting area adjacent to their unit must submit a plan to get Board approval. Plans that are submitted must complement the existing landscape. The planting area shall not exceed thirty six (36) inches from the building, and plants shall not exceed 36 in height. The VOSCA Landscape Variance Request Form (D-1) and the VOSCA Tree Planting Request Form (B-1) are located in Section XXIII Supporting Documents and Forms, of this document, online at and also at the management website. When the VOSCA Board approves an appropriate expansion of a planting area, the unit owner assumes complete responsibility for the preparation of the area. 1. If you plan to dig, you must contact Miss Dig ( ) to ensure location of utilities. 2. If you are digging up sod, it must be removed and disposed of properly. 3. Vegetables are not permitted. 4. After planting, mulch that matches the rest of the complex must be laid. 5. The Villas of Stonehenge Condominium Association retains the right to restore the area to its original condition at the owner s expense if the area is not properly maintained. V. Prohibited Items The following items will be strictly prohibited in any common area of the community unless being used by the Association: any type of yard sign, statue, yard or lawn ornament, artificial flowers, ornamental rocks or stones, cypress mulch, swing sets, mounted hose reels, laundry poles or clotheslines, or other such items. The exception to this is the area between the building and sidewalk 3

4 of your unit, where you may have a small yard or lawn ornament (such as a statue), not to exceed 36. Laundry may not be hung over any patio fence (swim suits, towels, rugs, etc., included). VI. Grills Only gas and electric grills may be used on patios. Charcoal grills are not permitted to be used in the patio area, but can be used in the driveway away from the building. Outdoor fireplaces are not to be used anywhere in the community. VII. Exterior Alterations No alteration, additions, fences, walls, decks, etc. are allowed. Any tree, shrub, or ornamental grass in the area between garages requires Board approval prior to removal. a. Patio Gates b. Storm Doors c. Solar Tubes Patio gates may be installed at the owner s expense using only materials that match the existing gates in the community. All gates will be considered as Limited Common Element and will be the responsibility of the owners for maintenance, repair, and/or replacement as necessary or required. The Association will continue to paint gates when the Association fences are painted so as to provide for a continuity of color. Contact the Management Company for further information. Storm doors may be added at the owner s expense USING ONLY THE APPROVED DESIGN AND COLOR. Specific information about approved storm doors, found in F-1, Section XXIII, Supporting Documents and Forms of this document, also at and at the management company website. One (1) solar tube may be installed at the owner s expense USING ONLY THE APPROVED DESIGN found in E-1, Section XXIII, Supporting Documents and Forms of this document. Copy of the necessary waiver may be obtained from or the management company website. Any solar tube installed by the developer before purchase of a unit must have a signed waiver and be maintained by the unit owner as stated above. d. Sidewalk Solar Lights Solar lights are optional, and may be added along the inside of the sidewalk (between the building and the sidewalk) at the owner s expense. The lights should be the normal/conventional type, no flood/spot lighting. They should be neutral in color so as to blend in; no more than 18 (eighteen) inches in height from the ground; not more than 12 (twelve) lights per unit. No colored lights. The contracted snow removal company and/or VOSCA would not be responsible for any damage caused by snow removal. 4

5 e. Security Systems Security Systems, including exterior mounted cameras, installed and maintained at the owner s expense, may be allowed with prior Board Approval. Location for mounting equipment and method of doing so, must be clearly identified on Form I-1 PRIOR to installation, found in Section XXIII, Supporting Documents and Forms of this document also at and at the management company website. VIII. Windows and Window Coverings All window coverings, including draperies, blinds (vertical or horizontal) or valences must be white, off-white, light beige or light grey viewed from the exterior side. IX. Signs Nothing may be hung or displayed from inside the windows except professionally prepared For Sale or For Rent signs. Security system decals may also be displayed in windows only. Signs will be limited in size to no more than nine (9) square feet. The developer may place Sold signs in unit windows prior to occupancy. No real estate signs are permitted in the community except in the windows as specified above. Signs must be placed on the inside of the unit. X. Offensive Conduct (Added ) The following will not be tolerated and will be subject to fines found in Section XXI, and/or notification of proper authorities. a. Speed adhere to the posted 15 mph speed limit. b. No excessive noise, such as music, revving engines. c. Profanity and/or threatening behavior. XI. Animals Pet owners must complete a Pet Registration form, found in G-1, in Section XXIII, Supporting Documents and Forms of this document, online at and also at the management website. 5

6 a. Leased units may NOT have any pets. Those tenants with pets at the time of implementation of this policy revision will be grandfathered in for the natural life of their pet(s). b. Pets shall be limited to two (2) domestic pets kept in any one owned unit. Pets are limited to dogs and cats. They cannot be bred or maintained for commercial purposes. c. All animals, when outdoors, shall be maintained on a leash not more than eight (8) feet in length. They shall be supervised by a responsible individual at all times. Such individuals shall be responsible for the IMMEDIATE cleanup of all pet waste. Failure to do so will result in a written warning on the first occurrence, followed by a $50 fine and $35 management fee on the second occurrence; $100 and $35 management fee on the third occurrence; $200 and $35 management fee on the fourth occurrence, and so on. Biting will result in notification of the proper authorities, and further action will be at the Board s discretion. d. No pet shall be tethered outside in the lawn or common area; nor shall any pet be tied to any patio fence. Pets shall not be a nuisance in any way. Invisible fences are prohibited. e. Unit owners will be fined for violation of these policies as defined Section XXI, Violations, of this document. If pets become a nuisance they may be ejected at the discretion of the VOSCA Board of Directors. XII. Parking/Vehicles a. No boats, trailers, motor homes, trucks (larger than a ¾ ton pickup), travel trailers or any vehicle with commercial advertising may be parked on any street. Other vehicles used for recreation (van conversion/rv s) not garage-able, will be permitted to park in limited common areas (in front of garage) for forty-eight (48) hours to allow for loading and unloading. Such vehicles must not exceed twenty (20) feet in length and must not block normal access of other residents. Commercial moving vans, when conducting contract business and commercial trucks when in the area to perform service or repair work are an authorized exception. b. No parking in the turnaround areas at the end of the driveway if it impedes the ingress/egress to any neighbor s garage. All residents must inform their guests of the VOSCA parking policies. All parking by residents or guests must be: (a) within the garage, (b) two (2) cars in the limited common area in front of the garage door, (c) designated additional parking spaces, and/or working with your neighbors to establish a mutually acceptable alternate solution, and/or (d) in the parking spaces at the Clubhouse area or on the street in such a manner so as not to block any other residents access to the garage or street. Violations of this policy should be reported to the management company. c. Parking in any Designated No Parking Area shall be subject to immediate towing at Owners Expense. d. No vehicle may be parked in the Clubhouse parking areas for more than forty-eight (48) consecutive hours. Vehicles parked there for more than forty-eight (48) consecutive hours are 6

7 subject to being towed by the authorized towing company. Towing and impound charges will be the vehicle owner s responsibility. e. No repair work is permitted on vehicles in limited common areas except for short term emergency work (flat tire, battery change, etc.). f. No vehicle shall be parked in any manner which blocks any street, driveway, mailboxes, fire hydrants, or the ingress/egress to any garage other than the owners. Reckless operations, excessive speed, and parking or driving on the lawn areas is prohibited, and subject to a fine as outlined in Section XXII, Violations, of this document. XIII. Swimming Pool The pool is a smoke free area, for the exclusive use of residents and their guests. Any person who cannot be identified as a resident, temporary resident, or who is not accompanied by a resident, will be asked to leave the pool area. The pool rules are: a. All persons using the pool and pool facilities do so at their own risk and sole responsibility. There is no lifeguard. b. All children under the age of 18 must be accompanied by an adult resident age 18 or older. c. Guests must be accompanied by a resident at all times. Guests may be asked to leave if the resident is not present. Organizational groups are not allowed. d. The owner may request permission for independent pool usage for their temporary residents from the VOSCA Board of Directors. e. The following are prohibited in the pool area: Pets Smoking Glass or other breakable items Running, diving, splashing, or disruptive behavior Excessive noise Private pool parties Plugged in electrical devices f. Swimming is permitted only in garments sold as swim wear. Infants must wear swim diapers when in the water. All diapers/swim diapers must be disposed of at your residence. g. Lounge chairs or tables may not be reserved and must be repositioned in the order intended, and umbrellas closed and secured after use. h. The pool will be open daily during swimming season until 10 p.m. 7

8 i. Wet swimwear is not permitted in the Clubhouse great room. j. Adults are responsible for children using the restrooms. k. If you are the last one in the pool area, please lock both restrooms, and secure pool gates and clubhouse doors. l. The gas grill is to be operated only for VOSCA organized activities. XIV. Community Clubhouse The Clubhouse and pool area are non-smoking areas. The Clubhouse is for the private use of the residents. It is available for rental to residents only. Rentals for business meetings hosted by residents will be limited to no more than two (2) in any one (1) month, Monday thru Thursday, only on a first come basis. The rate for this type of rental is $ dollars per day with a $ deposit. The Clubhouse rental rules and reservation forms, found in A-3, Section XXIII, Supporting Documents and Forms, of this document. They can also be found at the management company web site. The following policy applies: a. A $50.00 rental fee ($ for businesses) and a $ refundable deposit are required. Reservations are granted on a first request basis. b. The renting resident will have exclusive use of the great room only; the guests may not use the pool or exercise equipment, and the pool may not be reserved for any party. No party items will be furnished by the Association. c. Only non-flammable candles are permitted. Trivets/hot pads must be used with hot dishes on all table surfaces. Coasters must be used with all beverages as well. d. The renting resident is responsible for all cleaning and trash removal. Cleaning must be done (completely) the day of the party. Failure to do so will result in forfeiture of security deposit as well as all cleaning fees charged to the renting owner. e. Damages to the Clubhouse or equipment and any follow-up cleaning done by the Association will be deducted from the deposit. If the deposit is an insufficient amount, the renting resident will be billed for the difference. f. Non-compliance with the rules will result in a one (1) year suspension of rental privileges. g. All alcohol brought into the clubhouse, must not be left unattended, unless in a locked closet/cabinet. h. Per the Fire Marshall, no more than one hundred twenty five (125) persons may occupy the great room. 8

9 i. Cover charges may NOT be charged for admission to any event during rental of the clubhouse. j. Any violations of the Clubhouse rental rules will become the sole responsibility of the renting resident. k. No pets allowed inside the clubhouse except trained service animals. XV. Trash Collection a. Trash collection regulations require that trash containers and recycle bins are not to be set out prior to 3 p.m. the day preceding the collection. The containers must be picked up and put in the garage by midnight the day of collection. Only trash containers with lids, or securely tied plastic bags are permitted for trash disposal. b. All trash for collection must be set out at the main street, next to the curb at the end of the driveway. Trash containers, when not set out for collection, must be kept inside the garage. Residents will be responsible for clean-up of trash spillage from the containers. XVI. Solicitation and Garage Sales Solicitation by commercial enterprises is not authorized within the community. XVII. Utilities a. Residents are responsible for maintenance and payment of their own gas, electric, cable, telephone, and for calling to initiate service. b. Water and sewage utilities as well as trash collections are paid for by the Villas of Stonehenge Condominium Association. The water is to be turned off to the entire condo unit if an owner/tenant will be gone for a period of more than 48 hours. XVIII. Condominium Sales Open House signs are permitted at the front entrance along with two (2) directional signs to the unit, and may be placed twenty four (24) hours prior to the Open House. Signs must be removed upon completion of the Open House. Before any unit owner sells their condominium, it is their responsibility to do the following: a. Make certain the management company is aware of pending ownership changes at the time a closing date is established. b. Make a determination that all VOSCA condominium dues and/or assessments are paid. 9

10 c. Make certain the new owners receive the Condominium Master Deed, By-laws, Community Policies Document, and pool key. XIX. Leasing/Rental Policy This policy shall take effect at the effective date of this document. Any lease/rental agreement before this date is not affected by this document. The Villas of Stonehenge Condominium Association provides for the following: According to the Michigan Condo Act and staying within the limits of the Villas of Stonehenge Master Deed, Article III, Restrictions, Section 2(g), the leasing of units in the Villas of Stonehenge shall conform to the following provisions: a. No Co-owner shall lease less than an entire Unit in the Condominium. b. The initial term of a lease shall be at least one (1) year, unless specifically approved in writing by the Association. The terms of all leases, occupancy agreements and occupancy arrangements shall incorporate, or be deemed to incorporate, all the provisions of the Condominium Documents. c. A Co-owner, including the developer, desiring to rent, or occupy a Condominium Unit, shall supply the Association with a copy of the Lease Acknowledgement Form, H-1 prior to occupancy. Occupancy will not be allowed until this information is received. This form is located in Section XXIII, Supporting Documents and Forms, online at or the Management Company website. All leases shall document that tenants or non-owner occupants will comply with all of the conditions of the Community Policies of the Villas of Stonehenge. d. The tenant must be a full-time resident of the unit, and all occupants of the unit must be listed on Form H-1. e. If the Association determines that the tenant or non-owner has failed to comply with the conditions of the Community Policies online at and also at the management website, the Association shall take the following action: 1. The Association shall notify the owner by certified mail advising of the alleged violation by the tenant. 2. The owner shall have fifteen (15) days after receipt of such notice to investigate and correct the alleged violation by the tenant or advise the Association that a violation has not occurred. 3. If after fifteen (15) days the Association believes that the alleged violation is not corrected or may be repeated, an action for eviction, and simultaneously for monetary damages may be initiated. The Association will hold both the tenant and the owner liable for any damages. 10

11 4. When an owner is delinquent with monthly fees and/or assessments, the Association will give written notice to a tenant. After receiving this notice, the tenant will deduct from the rental payments due the owner, the delinquent amount as they become due and pay them to the Association. The deductions shall not be a breach of the rental agreement or lease by the tenant. XX. Annual Meeting Election Process All owners and proxy holders shall enter the clubhouse through the clubhouse main front door only. Registration tables shall be set up in the lobby, and will be manned by staff from our management company. They will have a list of all owners, and those owners who are ineligible to vote will be clearly identified. Owners shall present themselves to the registration table, and their eligibility to vote will be determined. Those carrying proxies for an owner shall present the proxy and that eligibility will also be determined. Owners and proxy holders whose eligibility has been established will then be given a ballot, for which they will sign for receipt of each ballot received. During the process of the meeting, when there are no more nominations and the nominations are declared closed, registration of owners/proxy holders shall immediately cease for the purpose of voting. Should there only be the number of candidates to satisfy the number of vacancies and there are no other nominees, then the chair should ask for a motion for the candidates to be elected by acclamation. Should there be more nominees than available seats, owners/proxy holders shall mark their ballot as they wish. Ballots will then be collected and presented to the management company for counting. Counting of the number of ballots should be no more than the number of owners/proxy holders registered and the number of ballots handed out. The count could be less if an owner/proxy holder simply declined in voting. Once counting is completed the results of the election will then be announced to the owners/proxy holders. Once the election results are announced, the chair will then ask for a motion and a second accepting the results of the election. XXI. Amendments These Policies may be subject to change from time to time at the discretion and by a majority vote of the VOSCA Board of Directors and will be subject to enforcement. XXII. Violations In the event of violation(s), the following measures will be enforced unless specifically outlined elsewhere in this document. First notice of violation warrants a letter of notice. 11

12 Second notice of violation for the same reason warrants a $50.00 fine plus a $35.00 management fee to be paid by the 10 th of the following month of the date of the notice. Third notice of violation for the same reason warrants a $ fine plus a $35.00 management fee to be paid by the 10 th of the following month of the date of the notice. If the same violation continues then the $ fine plus a $35.00 management fee will continue each month thereafter. XXIII. Supporting Documents and Forms 12

13 Form A-1 VILLAS OF STONEHENGE CLUBHOUSE RENTAL RULES & RESERVATIONS FORM These rules are established to ensure that any owner will be able to use and enjoy the use of the Clubhouse without infringement upon the privileges by other owners and their guests. Reserved dates and hours shall be posted to the online calendar by the Management Company. The ONLY space that can be rented is the great room. The pool area and exercise room CAN NOT be rented and will remain open and available to all owners. The Clubhouse is a NON SMOKING facility. ANY SCHEDULED ASSOCIATION ACTIVITY HAS PRIORITY When renting the Clubhouse you must: 1. Contact the management company at to check date availability, obtain reservation form, rules and cleaning checklist. Two checks made payable to VOSCA in the amount of $50 ($ per day for businesses) for rental fee and $175 for refundable deposit must accompany the reservation form. Your reservation is not placed on the calendar or confirmed until these checks are with the management company. 2. Identify whether alcohol is being served or not. Proof of liability coverage or an insurance event rider must also be presented at this time if alcohol is going to be served. 3. Complete the cleaning checklist while clean-up is being done. The checklist should be left on the counter. 4. The next day, a representative of the Board of Directors will go through the checklist and inspect the facility. If the facility is clean and back to normal, the deposit check will be returned to the resident. 5. If there is any question about the condition, the Board of Directors will determine what charges will be issued or what actions will be taken, and then instruct the management company to contact the resident. 6. The applicable charges are: Cleaning $50/hour; carpet cleaning and maintenance & repairs will be the current rate plus cost of materials. Rev. 1/

14 Form A-2 VILLAS OF STONEHENGE CLUBHOUSE CLEANING CHECKLIST ***Cleaning must be done completely the day of the party! KITCHEN Wipe off kitchen counters Sweep and mop kitchen floors (Swiffer stored in closet) Clean up any spills in refrigerator, microwave and oven Do not leave any food in refrigerator or on counters Clean out sink Remove all trash and place in outside containers (on east side of the building) If containers are full, disposal of the trash is the responsibility of the resident. Trash is NOT to be left outside the clubhouse. GREAT ROOM Wipe down all tables and put in their original set up Vacuum carpeting Turn off fireplace If pool table is used, return cue balls, sticks, chalk, etc. to original place DO NOT MOVE THE POOL TABLE BATHROOMS Wipe down sink counters in both baths Empty trash cans Make sure doors leading to the outside pool area are locked Turn off lights GENERAL CLOSING Check temperature setting on thermostat. Return to original setting before leaving. Turn off all lights. 15 Form A-3, Page 1 VILLAS OF STONEHENGE CLUBHOUSE RENTAL RULES The owner renting the Clubhouse shall: 1. Be completely responsible for their guests at all times. 2. NOT charge any cover charge for admission to any event during rental of the clubhouse. 3. Identify if alcohol is being served or not. 4. Assume full responsibility for damage to the Clubhouse, all articles in the Clubhouse, and for theft of any property 5. Not allow guest(s) to use the pool, pool area, or exercise room 6. Not permit guest(s) to park in other owner's parking areas. Street parking is permitted. 7. Not permit loud noise or music, profanity or other offensive behavior. 8. Not permit pets or animals of any kind in the Clubhouse area at any time except those that are service animals. 9. Provide their own supplies, such as paper products, table cloth, tableware, etc. 10. Not be used for unsupervised children or teenage parties. Any child under the age of 18 must be accompanied by an adult resident at all times 11. Not reserve the Clubhouse for use on the behalf of any outside organization. Owners who make the reservation MUST be present at the event. An overt violation of this will result in a TOTAL deposit forfeiture 12. Not have more than 125 guests per fire code 13. DO NOT MOVE THE POOL TABLE. DO NOT SET DRINKS ON POOL TABLE 14. Close and secure the premises by the following hours: 1:00 a.m. on Friday/Saturday and 11:00 p.m. on any other night. 15. NO FLAMMABLE CANDLES ADDITIONAL RULES: 1. A Board representative will inspect the facility as soon as possible after an event. 2. No owner may make reservations for use of the clubhouse more than three (3) weekends (Friday/Saturday/Sunday) during a calendar year. 20 Form D-1 VOSCA LANDSCAPE VARIANCE FORM Unit owners who choose to expand the planting area adjacent to their unit must submit a plan to get VOSCA Board of Directors approval. Plans that are submitted must complement the existing landscape. The planting area shall not exceed 36" from the building.
