4 MINUTES ZONING BOARD OF ADJUSTMENT CITY OF RICHARDSON, TEXAS AUGUST 19, 2015 The Zoning Board of Adjustment met in session at 6:30 p.m. on Wednesday, August 19, 2015, in the Council Chambers, at the City Hall, 411 West Arapaho Road, Richardson, Texas. MEMBERS PRESENT: MEMBERS ABSENT: Mike Walker, Chair Larry Menke, Vice Chair John Veatch, Member Chip Pratt, Member Shamsul Arefin, Alternate Jason Lemons, Alternate Brian Shuey, Member CITY STAFF PRESENT: Mohamed Bireima, Planning Technician Sam Chavez, Asst. Dir., Development Services Cindy Wilson, Administrative Secretary Mike Walker, Chair, introduced: Mohamed Bireima, Planning Technician, Sam Chavez, AICP, Asst. Dir., Development Services; and Cindy Wilson, Administrative Secretary; explaining that the City staff serves in an advisory capacity and does not influence any decisions the Board might make. Walker summarized the function, rules, and appeal procedure of the Zoning Board of Adjustment. Walker noted that one member is absent. Lemons will vote in the motion for Minutes and Arefin will vote in the case V Walker added at least 4 of 5 must vote in favor for a request to be approved. MINUTES: DRAFT The Zoning Board of Adjustment minutes of the July 15, 2015 meeting were approved as presented on a motion by Veatch; a second by Menke and a vote of 5-0. PUBLIC HEARING ON ZBA FILE V 15-04, (CONTINUED FROM JULY 15, 2015): a request by Lynn Livingston, LivingDesigns unlimited representing Fern Livingston, for approval of the following variance to the City of Richardson Comprehensive Zoning Ordinance: (1) Article IV, Sec. 4(f)(1)(a), for a two (2)-foot variance to the required 7-foot side setback for an existing home located at 3007 Wren Lane. Bireima indicated that this case was continued from the last meeting in order to obtain a confirmation that the Fairways of Sherrill Park HOA approved the design of the proposed addition. Bireima introduced the letter from the Fairways of Sherrill Park HOA Architectural Control Committee indicating their approval of Livingston s plans for the residence at 3007 Wren Lane. At that time, Bireima asked if there were any questions of staff.

5 ZBA MINUTES PAGE 2 JULY 15, 2015 There being no questions for staff, Chair Walker noted that in the last meeting the Public Hearing was closed. This evening, the HOA document has been produced. Based on this, Walker asked for comments from the Board. Menke commented that the issue one (1) neighbor had at the last meeting had been resolved. Pratt noted that the information provided is very clear. Veatch made a motion to grant item number V as presented, limited to those specifics the applicant presented in the case. The motion was seconded by Arefin and approved 5-0. EXISTING ZONING: R-1100-M Residential EXISTING LAND USE: Residential SURROUNDING LAND USES: Residential STAFF COMMENTS: The existing home was constructed in The current owner, who has lived in this home since 1994, desires to expand the existing foot wide attached covered porch on the south side of the home. The other existing covered porch along the east (front) side of the home will not be altered. The applicant is requesting a variance to allow the existing attached covered porch along the south side of the home to encroach 5.5 feet into the required 20-foot side yard setback for a corner lot adjacent to a side street as shown on the attached site plan. The applicant s desire is to construct an accessible covered porch, which will be screened from the adjacent streets by the existing wood fence.

12 Although a side yard setback is not required for an uncovered porch per the Comprehensive Zoning Ordinance, a covered porch is required to comply with the required 20-foot side yard setback for a corner lot adjacent to a side street. The applicant has indicated that the need for extra space within the covered patio for a wheelchair maneuvering clearance presents the hardship for requesting a variance. He also explains that the proposed porch expansion will add to the aesthetic value of the home, and will not affect the view of pedestrian or vehicular traffic since it is screened by the existing private fence located along the south property line. 31 Staff Report ZBA Meeting Date: September 16, 2015 TO: FROM: Zoning Board of Adjustment Mohamed Bireima, Planning Technician MB DATE: September 8, 2015 RE: SE APPLICANT: OWNERS: LOCATION: Jon Chilcote Jon Chilcote 406 Lowell Lane REQUESTED SPECIAL EXCEPTION: (1) Allow a 1.5-foot exception to the maximum 3-foot height for a fence located between the front property line and the front wall of the building (Chapter 6, Article IV, Sec (3)) EXISTING ZONING: R-1100-M Residential EXISTING LAND USE: Residential SURROUNDING LAND USE: Residential STAFF COMMENTS: The applicant is requesting a special exception to the City s Fence Ordinance (Chapter 6 of the Code of Ordinances) to allow a fence greater than three (3) feet in height to be built in the front yard. The home owner installed a 4.5 high wood fence with the intention for it to function as a handrail to the front door of the house. As such, the fencing material hides the handrail hardware from view.

32 The applicant indicated that the fence/handrail, which will be used by the residents of the home, was built a 1.5 higher than the maximum allowable height within the front yard to comply with ADA standards. The applicant states that his immediate neighbors have no issue with the fence/handrail, and are supportive of his request. TECHNICAL RECOMMENDATION: Although the proposed handrail is considered a fence per Chapter 6 of the Code of Ordinances thus requiring a special exception for its height, the construction of the subject fence in the front yard is to provide for a handrail that is fully compliant with ADA Standards.
