7 I. INDAABIN INDAABIN is a decentralized institute of the Department of Public Administration which is responsible for exercising the powers set out in the General Law of National Assets. We determine the national real estate policy, appraisals, registry and cadaster updates; in addition, we control the federal properties used as offices and for religious worship, and we manage directly the surplus portfolio, shared offices, including Land Port of Entries.

9 I. INDAABIN National Development Plan For the first time, the real estate policy is incorporated on the National Plan , specifically the Transversal Program for a Closest and Modern Government. Objective 3: Optimize the use of resources in the Federal Public Administration Strategy 3.4. To promote a modern and transparent administration of federal real estate.

INDAABIN delegates to the occupants institutions control the rest of the property through Property Responsible.

Energy Reform Issuance of Average Land Values Tables The values of the Tables are the minimum amount to be paid to the land owners and they are based on market values, for facilitating negotiation. Also, we have received requests to issue the Tables for projects resulting of the Round One bidding process.

15 II. Energy Reform Most specialized appraisers in Mexico We created a Specific Section in the List of National Appraisers, everyone of them with vast experience and specialization. Right now the Specific Section is formed by 21 appraisers in Real Property, with additional knowledge on master appraisals, energy projects, negotiation and right of way expertise.

Energy Reform Determination of compensation The amount the land granted to the operator might be expected to realized if sold in the open market, the value can be based on the highest approved use of the land. The existence of characteristics of the real estate, goods, or rights that, without being reflected in their commercial value, make them technically suited for the development of the project. The loss of use by the owner or occupant. The adverse effect of the area granted on the remaining land and nuisance, inconvenience and noise that might be causes by or arise from or in connection with the operations. The damages to the land in the area granted.

17 II. Energy Reform Determination of compensation The value will never be lower than the fair market value. Appraisals can consider any other factors that the Institute considers proper under the circumstances.

Telecommunications Reform 22k federal properties will be used for the deployment of telecommunications infrastructure Operators can lease, total o partially, federal properties, through a one-stop shop (INDAABIN) to deploy telecommunications infrastructure. Leases can be allocated in regions where there isn t any telecommunications infrastructure or the existing one is insufficient. The purpose of this project is to reduce costs and time, especially because the complexity for acquiring the right of way in Mexico. In a second phase, we are including poles, ducts and rights of way of highways and railways.

20 III. Determination of Compensation Master Appraisals Its used as a tool for facilitating the negotiation process, by defining a range of mínimum and maximimum values for land aquisition. Opportunity Value When negotiations with the Master Appraisal faliled, the oportunity value is used as a last resource for paying above the market value before a condemnation process. Condemnation (Last Resource) Its the process in wich there is a declaration of public utility and the indemnization is made at market value of the land.

21 III. Determination of Compensation INDAABIN s leadership on valuation standards in Mexico and Latin America Advising Council evaluates the regulations issued and its implementation once a year. Using the Technology. Appraisals are moving to an electronic paperwork from end to end. Realignment of the procedures accepted within INDAABIN, including Appraisals Reports under international standards.

22 III. Cadaster of National Real Estate The right of way land acquired is registered in the Federal Cadaster System, for all types of infrastructure developed nation wide thus keeping the control of the federal real estate patrimony.

Conclusions INDAABIN is contributing to transparency and fairness by using the international best practices in the determination of compensation, that give confidence and trust for all investments and land owners or occupants. With the Energy Reform, the process for right of way acquisition has evolved, incorporated best practices. IRWA has been a great partner in this adventure. This practices will reduce the incidence of social conflicts having to be solved in courts.
