1 The Silver Spring Township Board of Supervisors met in a regular session on Wednesday, August 10, 2016 at the Township Building, 8 Flowers Drive, Mechanicsburg, Pennsylvania. Chairman Konhaus Griffie called the Board of Supervisors meeting to order at 6:30 pm and the Pledge of Allegiance to the Flag was given. Supervisors present: Nancy Konhaus Griffie, David Lenker, Harold Kertes, Carl Machamer and Robert Seader. Staff members present: Corrina Chandler, Administrative Assistant; Theresa Eberly, Township Manager; Florence Ford, Assistant Township Manager; Jason Foster, Building & Codes Manager; Ann Hursh, Zoning Officer; Alexis Isenberg, Township Engineer; Tom Kilko, Public Works Director; Cheryl Neidig, Finance Manager; Kristy Owens, Parks & Recreation Manager; Christopher Raubenstine, Chief of Police; John Feichtel, Township Solicitor. Executive Sessions Chairman Konhaus Griffie announced that Executive Sessions were held on July 21, 2016 and immediately prior to tonight's meeting to discuss a personnel matter and on July 27, 2016 to discuss a real estate matter. 2. Presentation by the Bell Tavern Association (BTA) Cooper Wingert spoke on behalf of the Bell Tavern Association, (BTA). Mr. Wingert noted that the BTA had recently incorporated and been designated as a 501 c(3) non-profit. He noted that the BTA was also in the process of applying for a grant to be used toward the printing of an informational flyer as a means to help solicit for additional donations. Wingert thanked Ithaca College for their work in preparing a Page 1of11

2 3-D scan of the building, which the association would be using in its restoration efforts. Supervisor Seader asked for clarification as to when the BTA would consider its work complete. Wingert said that they intend to restore the building to its circa 1780 appearance, minus rear the L shaped addition. 3. Volunteer Appreciation Chairman Konhaus Griffie noted that plans were in process to acknowledge the efforts of the Township's volunteer emergency service providers at the September 14, 2016 Board of Supervisors meeting and invited everyone to attend. TREASURER REPORT - June 2016 NEW BUSINESS 1. Resolutions through : Committee Membership Requirements 2. Resolution : Green Light Go

Resolution : PennDOT Traffic Signal Application the adoption of Resolution , giving Township Manager Theresa Eberly the authority to sign the PennDOT Traffic Signal Application for Hogestown Road (114) & Woods Drive (585). 4. Potteiger Park & Vincent DiFilippo Nature Preserve the advertisement of bid documents on August 23 and 28, 2016 with a bid opening date of September 7, 2016 for Potteiger Park and the Vincent DiFilippo Nature Preserve subject to review and approval of the advertisement and associated bid documents by the Township Solicitor Rich Valley Road: Settlement Stipulation having the Township Solicitor execute the proposed settlement stipulation for the assessment appeal of 227 Rich Valley Road. 6. CCVFA Convention Parade: September 10, 2016 the use of Fire Police personnel for the Cumberland County Volunteer Firefighters Association (CCVFA) Convention Parade to be held on September 10, 2016, from 1 :00 pm to 4:00 pm in South Middletown Township. 7. Restore the Church 5K: October 8, 2016 a temporary road closure for Dewalt Drive and Willow Mill Park Road on October 8, 2016 from 11 :00 am to 12:00 pm and authorized the use of Fire Police personnel for a 5K Race hosted by the Hogestown Heritage Committee. Mulberry Drive Bridge: Engineering Services/Scope of Work the Scope of Work presented by HRG for engineering services related to the replacement of the Mulberry Drive Bridge, to include preconstruction engineering services ($97,800.00), construction consultation ($12,600.00), and bidding, administration and inspection services, if required ($22,200.00) at a total coast not to exceed $132, Committee Appointment: Land Preservation Review Board On a Seader/Kertes motion, the Board of Supervisors approved the appointment of Harry Kotzmoyer to the Land Preservation Review Board for a term to expire January 2, Expense Approvals a. Police Security Fence Supervisors Lenker and Machamer asked for additional detail in regard to the proposed fencing. Chief Raubenstine advised that the fencing would include the north side of the building only and that everyone would continue to use the same entrance and exit. He also advised that a button to open the gate would be installed inside the building to help prevent any delay in response times. an expense toward the installation of a security fence at the north end of the police station by Security Fence at a cost not to exceed $14, the purchase of a Ferris model S5100Z/C33D/72 zero turn mower from Messick's Farm Equipment at a cost not to exceed $13, b. Public Works i. Ferris Mower Page4of11

5 ii. Roadway Repairs Supervisor Lenker requested clarification in regard to what kind of work was being done. Public Works Director Tom Kilko advised that the roads crew would be repairing some small patch areas on various Township roads caused by tire rutting, etc. Lenker asked if this added expense would impact the ability to repair Beechcliff Bridge and Mulberry Bridge. Township Manager Theresa Eberly noted that we were expecting to receive $500, in liquid fuels funding for 2017 that would offset the cost. an expense toward the repair of several existing Township owned roads at a cost not to exceed $90, to be paid via the Liquid Fuels Fund. the advertisement for a Planning & Zoning Manager. Board of Supervisors members considered an ordinance in regard to automobile sales, automotive services, repair facilities and storage lots, which would modify the Township's existing Zoning Ordinance. the establishment of a Public Hearing to be held on September 28, 2016 at 6:30 pm for testimony in regard to the possible adoption of Ordinance for a modification of Township Zoning Ordinance, Section Personnel Matters a. Planning & Zoning Manager SUBDIVISION AND LAND DEVELOPMENT 1. Ordinance : Request for Public Hearing 2. Resolution : Eagles Crossing ( F) On a Kertes/Lenker motion, the Board of Supervisors approved Resolution for Eagles Crossing ( F) in regard to the renaming of streets as approved at the July 13, 2016 meeting. 6 North Locust Point Road ( ): the Planning Exemption for 564 North Locust Point Road ( ). a. Planning Exemption 4. Escambia Properties, LLC ( F): a. Planning Exemption Supervisor Lenker asked if the issues with the septic system had been addressed. Assistant Township Manager Flo Ford advised that DEP had denied the outfall request and that the development would be using sand mounds instead. Lenker asked if the lot sizes would change; Ford advised that they would not. the Planning Exemption for Escambia Properties, LLC ( F) West Main Street (LD F) 08/31/16 a. Final Land Development Plan Supervisor Seader asked Engineer Isenberg if HRG was in support of the Preliminary Plan, Carbonate Assessment, and Minimum Vertical Curve waivers. Isenberg noted that the waivers would be supported, provided additional revisions were made to the plan. Isenberg providing copies of the plan revisions to the Board of Supervisors members for their review. On a Kartes/Machamer motion, the Board of Supervisors approved the Amended Final Land Development Plan for 90 West Main Street (LD F) with associated waivers, subject to staff and engineering comments. b. Planning Exemption the Planning Exemption for 90 West Main Street (LD F). Page 6of11

Exeter Property Group ( ) 1 0/05/16 On a Kertes/Lenker motion, the Board of Supervisors approved the Final Subdivision Plan for Exeter Property Group ( ) with associated waivers, subject to staff and engineering comments. a. Final Subdivision Plan 7. The Willard Tract ( P) 06/27/16 a. Plan Review Extension On a Kertes/Lenker motion, the Board of Supervisors approved a Plan Review Extension for The Willard Tract ( P) from August 26, 2016 to September 26, Improvement Guarantees a. Key Development Group (LD2015-1F) reduction of the Improvement Guarantee in the amount of $1,343,079.73, leaving a balance of $10, b. Peninsula Phase 4 (2015-4F) reduction of the Improvement Guarantee in the amount of $337, , leaving a balance of $1,555, c. Traditions of America Phase 3A (LD2015-5F) reduction of the Improvement Guarantee in the amount of $882,747.44, leaving a balance of $287, Page 7of11

8 d. Carmella Phase 3 (LD F) reduction of the Improvement Guarantee in the amount of $154,393.92, leaving a balance of $76, e. Eagle's Crossing ( ) reduction of the Improvement Guarantee in the amount of $117,519.86, leaving a balance of $947, f. Eagle's Crossing ( ) reduction of the Improvement Guarantee in the amount of $443,964.45, leaving a balance of $503, g. 90 West Main Street (LD F) establishment of an Improvement Guarantee in the amount of $88, h. Bobby Rahal Sales Lot Land Development Plan (LD2015-6PF) establishment of an Improvement Guarantee in the amount of $800, Page 8of11

9 SUPERVISOR AND STAFF COMMENTS 1. Police Department Chief of Police Chris Raubenstine announced that the National Night Out event on August 2nd was a success. He thanked Sam's Club for providing food and operating the grill and noted his appreciation for those that helped organize the event as well as those that were able to attend. Chief also thanked Miller & Sam's Towing and Walmart for their donation of five bicycles that were given away to children who had participated in a bike rodeo as part of the festivities. 2. Parks & Recreation Parks & Recreation Manager Kristy Owens advised that over $2, was raised for the Veterans Memorial Committee at the BBQ & Bluegrass Festival. She noted that she felt the festival was well worth the time put into organizing it. Resident JL Bruner asked how many chickens were sold at the event; Owens advised that the fire company quickly sold a total of 350. Resident Kathi Pifer thanked the Parks & Recreation Department for a job well done. 3. Supervisor Seader Supervisor Seader asked Building & Codes Manager/EMC Jason Foster for clarification in regard to the recent 52% increase in inspections versus the 6% increase in issued permits. Foster advised that inspections were previously being outsourced, but that Township staff was now performing the inspections and outsourcing plan reviews. Foster noted that this had been proven to be a more economical way for the Township to complete the permitting, review and inspection process. 4. Township Manager Township Manager Theresa Eberly advised that she had spoken with Dr. Withum of Cumberland Valley School District in regard to the costs incurred by the Township due to the recent political rally held at the high school. Supervisor Seader noted that he would be happy to present CVSD with an invoice at their next meeting. Chair Konhaus Griffie and Supervisor Seader would also like to get in touch with Mr. Rothman of the Republican Committee. Manger Eberly noted with sadness that Flo Ford had announced her resignation as Assistant Township Manager and thanked her for her service to the Township. Page 9of11

10 Supervisor Lenker thanked Ford for having done a great job with the EIP. He noted that he had been resting well knowing that Ford was on the job and that she had truly impressed him. 5. Supervisor Lenker Supervisor Lenker asked for information in regard to who it was that had been directing traffic during the recent removal of trees along Woods Drive; Manager Eberly agreed to follow up. 6. Supervisor Kertes Supervisor Kertes thanked Chief Raubenstine, Jason Foster and associated staff for a wonderful job at the recent political rally. Supervisor Kertes asked Chief Raubenstine if the department had considered purchasing long riffles for its officers. Chief noted that they were looking at including the purchase of riffles for each officer as part of the 2017 budget. Kertes asked that Chief obtain quotes for their purchase; Chief agreed to follow up. 7. Supervisor Machamer Supervisor Machamer noted that he had been made aware of a feud developing in his neighborhood in regard to the keeping of chickens and asked what measures were available for enforcing the Township ordinance. Manager Eberly noted that the Township had the authority to site a resident if he/she was found to be in violation of the existing ordinance and that a fine could be imposed. 8. Supervisor Lenker Supervisor Lenker requested that staff look into drafting a Township Ordinance specific to the keeping of chickens in residential areas. Chairman Konhaus Griffie suggested that the ordinance include the temporary keeping of sheep as well. Manager Eberly agreed to follow up. Chairman Konhaus Griffie noted that she had attended the recent ribbon cutting ceremony at Hidden Creek Park located behind Millfording Highlands. She suggested the park was well worth visiting. Resident Kathi Pifer noted that the New Kingstown Vision Committee was seeking volunteers for improvements to Potteiger Park as part of National Lands Day on September 25th from 11 :00 am to 1 :30 pm. She suggested anyone interested in volunteering contact Parks & Recreation Manager Kristy Owens. 9. Chairman Konhaus Griffie 10. Township Residents Page 10of11
