2 CONDITIONS OF SALE 1. All stock is sold subject to the Conditions of Sale, dated 1984, recommended for use at Markets by the Scottish Institute of Auctioneers Pay Office. Every vendor, bidder and purchaser shall be deemed to have full knowledge of these conditions and agree to be bound by them. These conditions shall apply to the sale of any pedigree stock save in so far as they conflict with any Special Conditions expressly applicable to the sale of such stock, when the latter Conditions shall prevail. 2. All lots are accepted for sale on the terms that the vendor warrants his right to sell the same and undertakes to indemnify the auctioneers against all actions, proceedings, claims, demands, costs, charges and expenses to which they may be exposed or which they may incur by reason of any deflect in the vendor s title. 3. The auctioneers act in all respects only as agents for the vendor and it shall be deemed than no condition or warranty expressed or implied has in any circumstances been given by the auctioneers or any servant of the auctioneers, whether as to title, description, the quality of any lot sold or otherwise. The auctioneers and their servants shall not incur any liability to the purchaser in respect of any defect of title, error of description or imperfection or in respect of any announcement or statement relating to or affecting any lot offered for sake whether made orally or in writing and whether given before, during or after the auction, nor shall they incur any liability in relation to any dispute between any purchaser and vendor. 4. All animals are at the risk of the vendor before sale and at the risk of the purchaser after the sale. 5. Neither the Vendor(s) nor the Auctioneers will be responsible for any accidents or injury to persons or property, through fire or any other cause whatsoever. 6. The auctioneers reserve the right to refuse to accept bids from a vendor and they reserve on behalf of themselves and of the vendor(s) the following rights: (a) to fix a reserve price (b) to bid on behalf of a vendor (c) to re-arrange, consolidate or withdraw any lots or vary the order of sale (d) without giving any reason therefore, to refuse to accept the bids of any person 7. The person making the highest accepted bid shall be the purchaser. 8. No bid shall be retracted. 9. If a dispute arises as to any bidding, then at the discretion of the auctioneers, either: (a) the lot to which the disputed bid relates shall immediately be put up again, or (b) the auctioneers shall determine the dispute and their decision shall be final and binding on all parties. 10. The purchaser shall, if and when required, give his name and address to the auctioneers, and shall if required, pay to the auctioneers the purchase money fo each lot on the fall of the hammer, or so soon thereafter as the auctioneers may require. 11. Purchasers paying by cheque must be prepared, if required, to produce a banker s reference 12. No lot shall be removed from the sale premises until a written delivery orde has been given by or on behalf of the auctioneers. 13. Each lot shall, at the purchaser s expense, be removed from the sale premises within a reasonable time after the close of the day s sale. 14. (a) If a purchaser fails to comply with any of the preceding Conditions, the auctioneers may cause the lot in respect of which the failure is made to be re-sold by public or private sale without warranty or reserve and without notice to the purchaser. (b) If upon re-sale as aforesaid a lower price is obtained for any lot than was obtained on the first sale, the difference in price togethe with all cost and charges attending the re-sale, shall be a debt due from the purchaser in default at the first sale. 15. All other rules as stipulated in the Conditions of Entry REGISTRATION FORMS MUST BE AVAILABLE FOR INSPECTION WITH THE ANIMAL PRIOR TO BEING HANDED TO MARKET. SHEEP WILL NOT BE ACCEPTED UNLESS ACCOMPANIED BY THEIR CERTIFICATE

GENERAL INFORMATION AND SALES NOTES Location The Show and Sale will be held under cover at John Swan Limited, Auction Mart Newtown St Boswells, Melrose. Dipping No documentation must accompany the sheep to the Show and Sale Maedi Visna The appropriate documentation must accompany the sheep to the Show and Sale. Numbering Plastic tags, tied around the necks of the sheep, will be used for numbering. These tag will be distributed by the stewards on arrival but must be returned after loading. Showing All sheep entered for sale are eligible for showing but will only be judged if brought ou when called. Commissions The Auctioneers will faithfully execute commissions to purchase, on behalf of buyers unable to attend the sale in person, upon receipt of written instructions. Order of Sale All sheep will be sold in guineas and in strict catalogue order. It is the responsibility o the vendor to ensure that sheep are moved to and from the sale ring. Prize Winners Prize winning stock must be subject of a bona fide sale to be eligible for prize money awarded. If the Champion is not sold the prize will be withdrawn Refreshments Refreshments will be available throughout the day.
