3 Auctioneers Foreword Halls are pleased to have received instructions from Mr Robert J Eyres on behalf of Messrs R J Eyres & Sons to disperse the Dairy Herd. The Decision to disperse the milking portion of the herd has been made to facilitate the development of a new dairy unit. The herd has been developed since 1946 by 4 generations of the Eyres family with the current herd under the management of Robert, his wife Rena with the support of sons Stuart, Ryan and Ian. The family have bred an upstanding Holstein Dairy Cow with strong chests they are capacious capable of giving very high yields on a simple system of Semi TMR supplemented by Corn in the parlour, NMR milk recording was common practice until September 2018 with their latest annual average as follows:- 7450kg 4.05%bf 3.37%ptn 288cc (sale animals ave 97cc) In 2016 before the milk price crash the herd performance on NWF costings shows annual milk sale of 9167 litres per cow at similar fat and protein which demonstrates the potential of these animals. Top Service Sires have been used with cows sired by Cold Springs Ponder, Go - Farm Zeber, Ter Beek Altaghost, De Su History, Gran J Oman McCormick, Levi, De Vlottenbury Fantasy Red Fantasy Orageux current service sire include Delta Webmail Red, Peak Altamento and Prossli (Brown Swiss) In all 15 Cows in the herd are currently dry. Herd Health Status The Herd has been closed since 2004 following the purchase of 40 French Heifers. No History of Johnes, Lepto or BVD. The herd passed its TB test date on the 29 th October 2018, There have been no significant issues, with only 1 reactor in the farm in Service Guarantee: All animals served over 10 weeks on the day of the sale will be guaranteed in calf. This is a day warranty under the LAA conditions of sale The key service date for this sale is 18 th October 2018, or due dates after 26 th July New Purchasers & Conditions of Payment: All accounts must be settled on the day of sale, no credit will be available. Any prospective purchaser s unknown to the auctioneers wishing to pay by cheque must make the following arrangements at least 7 days prior to the sale. 1. 15 General Conditions of sale 1.1 Every Vendor, Bidder and Purchaser shall be deemed to have full knowledge of the Composite Conditions and to agree to be bound by them All livestock is sold subject to these conditions, ("the Conditions"), the Livestock Auctioneers Association Conditions of Sale (2017 edition, as amended) ("the LAA Conditions") 2. All lots are accepted for sale on the terms the Vendor warrants his right to sell the same and undertakes to indemnify the Auctioneers against all actions, proceedings, claims, costs, charges and expenses to which they may be exposed or which they may incur by reason of any defect in the Vendor's title. 3. The Auctioneers act in all respects only as agents for the Vendor and it shall be deemed that no condition or warranty expressed or implied has in any circumstances been given by the Auctioneers or any servant of the Auctioneers, whether as to title, description, the quality of any lot sold or otherwise. 4. The Auctioneers reserve the right to refuse to accept bids from a Purchaser and they reserve on behalf of themselves and of the Vendor(s) the following rights: (a) to fix a reserve price; (b) to bid on behalf of a Vendor; (c) to re-arrange, consolidate or withdraw any lots or vary the order of sale; and (d) without giving any reason 5. The person making the highest accepted bid shall be the Purchaser. 6. No bid shall be retracted. 7. If a dispute arises as to any bidding, then at the discretion of the Auctioneers, and their decision shall be final and binding on all parties. 8. The Purchaser shall, when requested, give his name and address to the Auctioneers and unless otherwise agreed by the Auctioneers and the Purchasers shall pay for the lot(s) he has purchased ON THE DAY OF SALE. All lots are sold on condition that the ownership of the same shall remain with the Vendor and no property in the lots whether legal or equitable shall pass to the Purchaser and no lot(s) shall be removed from the premises unless or until: (a) payment in full has been made in cash, or by bankers draft, or by cheque not exceeding the amount stated on an accompanying valid cheque guarantee card; 9. Notwithstanding Conditions 8 and 10 each lot shall be at the absolute risk and at the expense of its respective Purchaser at the fall of the hammer and subject to Conditions 8 and 10 shall be removed from the sale premises at the Purchaser's expense within the time stated by the Auctioneers at the commencement of the sale. 10. If, notwithstanding Condition 8 above, the Auctioneer permits the Purchaser to remove his lot from the sale premises prior to payment in full having been received then: (a) Ownership of the same shall remain with the Vendor and no property in the lot whether legal or equitable shall pass from the Vendor to the Purchaser until payment of the full price has been received in cleared funds by the Auctioneer or the Vendor (as the case may be). Payment shall, unless otherwise agreed, be made to the Auctioneers. (b) the Purchaser's right to possession of the lot shall automatically cease immediately prior to his doing anything or failing to do anything which would entitle a Receiver to take possession of the lot(s) or which would entitle any person to present a petition for the winding up of the Purchaser; (c) the Vendor or the Auctioneers may for the purpose of examination or recovery of any lot remaining unpaid enter upon any premises, where it is housed or where it is reasonably thought to be housed; 11. Without prejudice to any other right or remedy of the Vendor or the Auctioneers, if the Purchaser shall be in breach of any other Composite Conditions, the Vendor or the Auctioneers shall have power to resell the lot(s) purchased by the Purchaser retaining any surplus and charging any deficiency or expense to the Purchaser. 12. Neither the Vendor nor the Auctioneers will be responsible for any accidents or injury, not arising out of their negligence, which happens to any person or property while on the sale premises. Vehicles are parked at their owner's risk. 1. Payment Terms, STRICTLY PAYMENT ON THE DAY by Cash, Card or Cheque. Cheques will only be accepted from persons known to the Auctioneers. Buyers not known to the Auctioneers and wishing to pay by cheque must contact the Auctioneers BEFORE the day of the sale to make arrangements. No lots may be moved until payment has been received and no credit will be given. The auctioneers reserve the right to retain deadstock item(s) until cleared funds have been received or in respect of livestock to retain the passports. Purchased items withheld will remain the responsibility of the purchaser from the fall of the hammer. 2. Agents: Customers are reminded that if they are bidding as agents on behalf of a third party they must produce to the Auctioneers before the sale commences a written authority from the person(s) on whose behalf they are bidding. If they do not, the Auctioneers will treat them as bidding on their own account and will invoice them personally for any purchase made. WARRANTIES Note: The Breeding and Udder Warranties DO NOT apply to cattle sold for less than Breeding: All the cows and heifers that are stated in the catalogue to have been served not less than ten weeks before the date of the sale or to have been running with a bull 2. Udders: Unless otherwise stated or announced, all cows in-milk or in-calf and heifers in-milk at the time of sale carry a guarantee that she is sound in the udder and teats at the time of sale. Any claim under this guarantee may be made by 12 noon of the day following the sale, they may be made orally but must be received by the Auctioneers within that period. 3. Maiden Heifers: The vendor warrants a maiden heifer stated in the catalogue or at the time of sale to be sold for breeding purposes. The warranty from the date of the sale is a 5 DAY warranty if the malformation is patent, or a 6 MONTH + 5 DAY warranty if the malformation is latent. 4. Warranty claims will not be considered on unpaid accounts or stopped cheques.
